    Yes, maybe even less since Virginia sets execution dates directly after Fourth Circuit denials rather than waiting for the US Supreme Court to make a decision on certiorari. However, the Fourth Circuit has grown increasingly liberal and far more disposed to overturning death sentences than it used to be. So, we'll see.

    Potentially, though, Virginia could whittle their death row down to two guys by the end of next year. Porter, Teleguz, Prieto, Juniper, Gray and Morva could get dates next year. That would leave just Lawlor (who's just about to file in Federal District Court) and Burns (whose appeals have long been on hold because he's loopy).

    On September 16, 2015, oral argument will be heard in Porter's appeal before the US Court of Appeals for the Fourth Circuit.

    The Fourth Circuit panel deciding Porter's appeal is made up of Judges Harris (Obama), Shedd (G.W. Bush) and Thacker (Obama).

    In today's Fourth Circuit Court of Appeals opinions, the court dismissed Porter's appeal and remanded for adjudication of Porter's actual juror bias claim.
    An uninformed opponent is a dangerous opponent.

    Court hears appeal from man on death row in Norfolk police slaying

    RICHMOND, Va. (AP) — A federal appeals court has heard arguments in the case of a Virginia man sentenced to death for killing a police officer in 2005.

    Thomas Porter was convicted of shooting Norfolk police Officer Stanley Reaves three times in the head.

    Porter testified he shot Reaves in self-defense because he feared for his life during an encounter with the officer. Prosecutors said Porter shot Reaves to avoid arrest.

    Porter's lawyers say he was convicted and sentenced to death by a biased jury, citing a juror who failed to disclose that his brother was a deputy sheriff.

    In arguments before the 4th U.S. Circuit Court of Appeals on Tuesday, Porter's lawyer said he is entitled to a hearing on his claim.

    The state says there is no evidence the juror was biased.

    On August 3, 2018, the Fourth Circuit REMANDED Porter's case to Federal District Court. Judges Thacker (Obama) and Harris (Obama) made up the majority. Senior Judge Shedd (G.W. Bush) dissented and would have dismissed Porter's habeas petition.
