    Child rapist must die: Abu Dhabi appeals court confirms

    An appeals court in Abu Dhabi upheld a previous verdict and sentenced an Asian man to death after he was convicted of raping an Asian school girl.

    Witnesses had testified in court that the defendant had raped the child inside the school kitchen despite his denial of the charges.

    Defence lawyer had demanded acquittal of the defendant on the grounds there was no concrete evidence of the crime.

    But a medical report showed the girl had been raped, prompting the prosecutor to demand the maximum penalty for the defendant, according to the Arabic language daily Al Khaleej, which did not specify the girl’s age.

    New death penalty hearing for Abu Dhabi motorist who ran over boy

    ABU DHABI - The death sentence on a man who deliberately ran over and killed a 12-year-old boy has been overturned.

    The Court of Cassation sent the case back to the Court of Appeal to reconsider the sentence.

    The driver, a Pakistani expatriate, had been sitting in his car in Musaffah in October 2012 when three boys opened the door and threw in a pile of rubbish.

    The children ran away and were joined by a fourth boy, Hazaa Khaled from Sudan. The driver believed Hazaa had thrown the rubbish, drove after the boy and knocked him down.

    He denied denied intending to kill the boy, and said he meant only to scare him and was driving at only 40kph. However, scientific evidence showed the car’s impact was so powerful that it crushed the boy’s skull.

    Abu Dhabi Criminal Court found the man guilty of manslaughter and sentenced him to 15 years in prison. He was also ordered to pay blood money of Dh200,000 and compensation of Dh21,000 to the boy’s parents.

    The case then went to the appeals court, which sentenced him to death.

    Asian gets death for adultery in Abu Dhabi

    An Abu Dhabi criminal court sentenced an Asian housemaid to stoning to death after she was found guilty of committing adultery while married.

    The maid had been rushed to hospital following abdominal pains and tests showed she was pregnant after sleeping with another man.

    Newspapers said the maid confessed in court that she committed adultery and the judge handed down the sentence on the basis of her confession in line with Islamic law.

    It was the first time in many years that a person was sentenced to stoning to death in such a case in the UAE. Judicial sources said the maid can appeal the sentence.

    Well, arguably under Islamic law if the maid's husband was in another country and she had the affair with her employer then it isn't adultery, since she would be what his right hand possesses and therefore the sexual relations would be halal, that and her marriage doesn't legally exist by virtue of her being in the Islamic zone and her husband being outside the Islamic zone, which would prevent the marriage existing for all practical purposes.

    Just throwing that out there, if they're going to sentence someone to death under "Islamic law" then they should at least apply all of Islamic law to the case.

    Maid sentenced to death for murder of infant

    Abu Dhabi: An Indonesian maid charged with the murder of her employer’s four-month-old child will receive the death penalty, a second court of appeals has ruled.

    Although the defendant, S.T., had initially been found guilty at the Criminal Court of First Instance, the death penalty verdict was looked into by the court of appeals and a lawyer was assigned for the suspect.

    The decision was rendered on Wednesday.

    She is accused of killing the child, Malak, out of jealousy for her Filipina nanny earlier this year. Court documents state that the cause of death was head trauma and home security cameras caught the defendant taking the child out of her crib and returning her there four minutes later. The defendant reportedly bashed the child’s head against a wooden table at the victim’s home.

    However, the court-assigned lawyer reportedly did not take his task of defending S.T. seriously and so the case was looked into again by a second court of appeals that upheld the verdict.

    The victim’s parents insisted on carrying out the maximum punishment in the case, and declined to accept any proposals for leniency.

    Malak’s caretakers will be present at the execution.

    Worker who stabbed wealthy man to death gets death sentence at Dubai court

    The death penalty for a man who stabbed a wealthy father of 3 to death was upheld by Dubai Court of Appeal on Wednesday morning.

    Afghan tourist BS, 21, was handed the death sentence, while his countrymen TR, 21, and 22-year-old AA were given life sentences for plotting to rob their Iraqi victim, HK Their life terms were also upheld.

    BS had worked for the Iraqi for a short time and realised that he carried large sums of money.

    Records state that, on the night of November 6, 2012, the victim was attacked by the 3 men, who stabbed him with 2 knives, mainly in the back.

    In the scuffle, the Iraqi managed to take one of the knives and stab BS in the chest but he was soon overpowered and the trio continued to stab their victim until the blades of the knifes broke under the skin of his back.

    Shortly after midnight, a police patrol found a car driving around the Russian area of International City and stopped the vehicle.

    Speaking in court in June last year, YQ, a 45-year-old policeman, said: "We stopped the driver, BS, and noticed bloodstains on his shirt but he said he had bled from his nose while playing tennis."

    The officer then asked BS to hand over his driver's licence and vehicle registration but he replied that he did not have either to hand. BS was taken to a police station, where the stab wound in his chest was found.

    "He then confessed that he killed the car's owner because he tried to rape him," said the policeman. BS went on to say that he had worked for the victim for more than 20 days and had complied with the man's demands for massages.

    "On the day of the incident he asked me to have sex with him, so I punched him in the face and then he stabbed me in the chest and I grabbed another knife and stabbed him until he died," BS said in records. He said that he then called his 2 friends to help him escape.

    AK, a supervisor who had known the victim since 1998, said BS was given a job but, 5 days after he was hired, the Iraqi sacked him.

    "He told me that BS had often sought financial help from him and he repeatedly helped him and that, when he returned to the UAE from Afghanistan, he kept calling HK asking for his job back," said AK.

    "The defendant's claims that HK tried to rape him are baseless because HK was in my house until 5pm and, during his stay, BS called him to ask for a job but HK did not take his call and told me and another friend how BS was repeatedly calling, asking for a job."

    Other witnesses testified that the victim was a decent man and a good husband.

    The 3 Afghans were convicted of premeditated murder associated with robbery.

    TR and AA will be deported after completing their jail terms.

    Family of murdered maid accept blood money over death sentence

    The family of an Ethiopian maid tortured to death by her employers has spared her killers the death sentence.

    An official letter stating the relatives’ decision to accept blood money instead of a death sentence reached Abu Dhabi Criminal Court on Monday.

    M A and his wife R Y, both from Palestine, tricked the maid into working for them for nothing, locked her in the house, and beat her several times, prosecutors said. The couple also barred the windows to prevent her escaping. Neighbours said they constantly heard horrific screams from the couple’s apartment.

    Prosecution lawyers previously said that on the day of the death, a fight broke out between the wife and the maid. She assaulted the maid so severely with a cane that she died.

    Then the husband poured a chemical on her body in an attempt to hide her identity. He wrapped the body in white fabric, placed it in a suitcase and put it in the boot of their car.

    That night they drove to the Al Ajban desert in Abu Dhabi to dispose of the body. It was not clear from records why the fight broke out or when this happened.

    Despite the body being badly burnt by the chemicals, officers were able to identify the victim, which led them to the couple.

    Previously, at the Criminal Court, M A and R Y had blamed each other for the maid’s death.

    R Y said on the day of the death the maid slipped on the soapy bathroom floor and could not get up. When her husband arrived he thought she was faking it so he started beating the maid’s legs with a gas pipe.

    No one was on good terms with the couple because they caused many problems, a female neighbour said. A verdict will be announced on June 30.

    UAE's Al Reem Island killer gets death penalty

    Ala’a also convicted of planting a crude, bomb in front of a doctor’s house in Abu Dhabi

    Abu Dhabi: The death sentence has been given to Ala’a Al Hashemi, who was found guilty of killing kindergarten teacher, Ibolya Ryan, last year, the Federal Supreme Court ruled on Monday.

    The 37-year-old American teacher is survived by her ex-husband and three children. The crime took place in the women’s rest room of the Boutik Mall on Al Reem Island on December 1, 2014.

    The murder weapon, a large kitchen knife, was left behind along with trails of blood on the site. Two women, who were in the bathroom during the time of the murder, later told the court that they heard the victim’s screams and saw the suspect, who had concealed her identity using a niqab (face covering), a shayla (headscarf) and an abaya (national clothing).

    Authorities condemned her use of the Emirati national dress to commit the murder. However, her attire meant that witnesses were unable to positively identify Ala’a as the killer in court.

    Hours after the crime, the niqab-clad woman was seen entering the Khalidiya area’s Ali and Sons building carrying a suitcase. Shortly after, the son of an Egyptian-American doctor was leaving his home to perform Maghrib prayer when he noticed a foreign-looking object placed near the entrance of his apartment.

    Upon informing his mother, who called her husband, a bomb squad was sent to dismantle what appeared to be a primitive bomb that failed to explode due to a technical glitch.

    Later in court, the Egyptian-American doctor said that he immediately went home after receiving the phone call from his wife who had sent him pictures of the object [outside their apartment].

    The wife had also informed her husband that two weeks before this incident, a woman wearing an abaya and niqab had visited their home and inquired whether an American woman was living in the building. She was later escorted outside by security who had failed to reveal her identity.

    Within four days of the crime, Lt Gen Shaikh Saif Bin Zayed Al Nahyan, UAE Deputy Prime Minister and Minister of Interior, held an unprecedented press conference in the Abu Dhabi Police General Headquarters where he announced that a suspect had been arrested.

    A video portraying the ambush and eventual arrest of Ala’a in her Shakhbout City (formerly known as Khalifa City B) home also showcased an array of nails, chemicals and other items reportedly used in manufacturing the home-made bomb.

    The video also revealed a set of what appeared to be bloodied fingerprints on her vehicle’s steering wheel.

    Further investigation into Ala’a’s background unearthed a history of accessing online forums that promote extremist and terrorist ideologies which she is believed to have participated in.

    Medical report

    According to a statement released by the Emirates News Agency (WAM), Ala’a had been listening to lectures by Al Qaida leaders Osama Bin Laden and Abu Musab Al Zarqawi before committing the crime.

    In court Ala’a claimed that she had been suffering from hallucinations since childhood and the Federal Supreme Court decided to appoint a medical committee to examine her mental state of mind.

    Although the report concluded that Ala’a was, in fact, responsible for her actions during the time of the murder, her lawyer argued that his client had been suffering from schizophrenia and other mental illnesses as detailed in the assessment.

    Her lawyer’s request for a second examination to be performed by another medical committee was denied by presiding judge Falah Al Hajeri.

    RAK Court upholds man's death sentence in murder case

    The RAK Court of Cassation has upheld an earlier death sentence passed against a Bengali man found guilty of murdering two compatriots, who were brothers.

    As per court records, the case unfolded early in 2013 when the convict had a heated argument with the victims over a loan of Dh300 they owed him, and refused to pay back.

    The RAK Court of First Instance convicted the defendant of premeditated murder - based on the irrefutable evidence collected by the CID teams of RAK Police, and the killer’s confession.

    The culprit has admitted to his crime during police investigations and prosecution's interrogation. He later affirmed the same before the RAK Court of First Instance which sentenced him to death.

    The murderer told the court that he had killed the brothers because they refused to pay him back a debt of Dh300.

    “I stormed their room at the cattle market, slaughtered the first while he was talking on the phone, slayed the second when he was sleeping in bed, and fled the scene,” he had said.

    Law enforcement bodies, after being alerted of the massacre, launched an intensive investigation and tracked the killer down. He was apprehended red-handed with the sharp knife used in the crime.

    The assailant had stabbed the first victim again, though he was fatally injured, when he tried to defend his sleeping brother from the killer.

    The RAK Public Prosecution charged the suspect with premeditated murder, and referred him to the RAK Criminal Court concerned which ordered adjournment of the case seven times due to the absence of the prosecution witness, a fellow worker who was sleeping in the same room where the murder took place.

    “I woke up scared at the loud screaming of my two fellow mates, who were shouting out of pain and excessively bleeding from their throats while the killer was rushing out of the room with a blood-stained knife in his hand.”

    The case was moved to the RAK Criminal Court of Appeal, which confirmed the death sentence, and finally the RAK Court of Cassation, where the accused was unanimously found guilty and upheld the death ruling.

    DUBAI, United Arab Emirates (AP) – The United Arab Emirates on Monday put to death a woman with links to Islamic extremists who was convicted of murdering an American teacher with a butcher knife in an upscale Abu Dhabi mall.

    The execution, carried out just two weeks after the country's top court delivered a guilty verdict, marked a swift end to a case that has rattled this Western-allied Gulf country, where violent crime is rare.

    The Federal Supreme Court convicted Alaa Bader Abdullah al-Hashemi, a 30-year-old Emirati mother of six, of deliberately murdering 47-year-old schoolteacher Ibolya Ryan in a mall restroom stall on the capital's upscale Reem Island.

    Authorities say the killer, shrouded in a traditional black garment and veil, later planted a homemade bomb outside the home of another American. It failed to explode.

    Al-Hashemi also was found guilty of sending money to al-Qaida in Yemen and of publishing information aimed at harming the reputation of the Emirates, a seven-state federation that also includes the commercial hub of Dubai.

    The verdict was not eligible for appeal.

    Ahmed al-Dhanhani, attorney general for the state security prosecution, told state news agency WAM that al-Hashemi was executed Monday morning following the approval of the president, Sheikh Khalifa bin Zayed Al Nahyan.

    Ryan had three children and had been living in Abu Dhabi with her 11 year-old twins. She previously worked at Palmer Elementary School in Denver.

    Executions are rare in the Emirates, and are typically carried out using firing squads.

    The most recently reported execution, of a Sri Lankan migrant worker convicted of intentional murder for running over a man, was in January 2014 in the emirate of Sharjah.
