    Replacing Ginsburg with a conservative is one thing, replacing her with a man is probably a no-go, even for Trump.

    If Barrett is going to be the replacement, I don't think that's necessarily good news for the site.

    Her 1998 article seems to suggest that Catholics should recuse themselves from capital cases.

    Assuming that it's true that she would recuse herself from capital cases, it would still be a win to get Ginsburg off the Court. At the very worst, the most divisive capital cases would then be 4-4 decisions. So the Court couldn't create new bad precedent.

    I'm not convinced that she would recuse herself though, because at her confirmation hearing, she said that she didn't intend to recuse herself from capital cases and that she participated in capital cases when she clerked for Justice Scalia.

    Barrett said that, but that was more theological than legal. She participated in capital cases while clerking for Scalia.
