    Replacing Ginsburg with a conservative is one thing, replacing her with a man is probably a no-go, even for Trump.

    If Barrett is going to be the replacement, I don't think that's necessarily good news for the site.

    Her 1998 article seems to suggest that Catholics should recuse themselves from capital cases.

    Assuming that it's true that she would recuse herself from capital cases, it would still be a win to get Ginsburg off the Court. At the very worst, the most divisive capital cases would then be 4-4 decisions. So the Court couldn't create new bad precedent.

    I'm not convinced that she would recuse herself though, because at her confirmation hearing, she said that she didn't intend to recuse herself from capital cases and that she participated in capital cases when she clerked for Justice Scalia.

    Barrett said that, but that was more theological than legal. She participated in capital cases while clerking for Scalia.

    Senate Republicans Press Ahead With Plan to Speed Up Confirmations

    Senate Republicans are pushing ahead with a plan to dramatically speed confirmation of most of President Donald Trump’s nominations, blaming Democratic obstruction for lengthy delays that sap floor time.

    Rules Chairman Roy Blunt and Republican James Lankford have proposed a measure that would limit debate on most nominees to just two hours of floor time, with Blunt planning to push the rules change through his committee Wednesday.

    Major nominations such as cabinet officials, circuit court judges and Supreme Court picks would still have up to 30 hours of debate before a final vote.

    Blunt said Tuesday the Democratic minority has abused their right to demand 30 hours of debate and it’s time to change the rules as a result.

    "With President Trump, it’s been 55 days from the time we get a nominee out of committee until the Democrats finally will allow that nominee to come to the floor," Blunt said. Blunt also said Democrats have forced 128 votes to cut off debate on nominees in the last Congress despite many of those nominees getting 70 votes or more.

    Blunt also complained that rarely did the hours of debate forced by Democrats result in actual floor debate on the nominees themselves.

    "It is clearly an attempt just to use up time to not let the president have the team he needs in place to run the government and not to let us have the legislative time we need," Blunt said.

    Senate Minority Leader Chuck Schumer said he would oppose the rules change without concessions to Democrats.

    "Unless they go back to 60 votes or restore the blue slips, either one, then there’s a reason to move along," said Schumer of New York. "Not if they have monopoly power."

    Senate Republicans have angered Democrats by repeatedly violating a "blue slip" tradition of only moving forward with judicial nominations when home-state senators sign off on their selection.

    Democrats also complained when McConnell and Republicans eliminated the 60-vote threshold for ending filibusters on Supreme Court nominees -- years after Democrats did the same for other nominations.

    If Democrats don’t agree to the changes, many Republicans said they are prepared to change the rules by a majority vote. Republicans and Democrats have previously used a simple majority, known as the "nuclear option," to change the rules for confirming nominations.

    The move would free up time to fulfill Senate Majority Leader Mitch McConnell’s top priority: confirming as many conservative judges as possible.

    Ginsburg back at Supreme Court

    Justice Ruth Bader Ginsburg was back at the court on Friday [February 15] for the justices’ private conference.

    The Supreme Court’s Public Information Office told The Hill that Ginsburg was attending the regular closed-door meeting in which the justices consider requests to review cases. Ginsburg has been absent from the court since undergoing surgery in late December to remove two cancerous nodules from her lower left lung.

    The 85-year-old justice missed oral arguments last month while recovering at home from the surgery. Her absence marked the first time in more than 25 years on the bench she was forced to miss arguments due to her health.

    The court said last month that Ginsburg’s recovery was on track and that post-surgery evaluation indicated no evidence of remaining disease, and no further treatment was required.

    The health scare raised concerns among liberals about how long Ginsburg will be able to remain on the bench. Supporters are hoping she will be able to remain on the court until a Democrat wins the White House and is able to name her successor.

    President Trump has had two successful appointments to the court with the confirmations of Justices Neil Gorsuch and Brett Kavanaugh. After Ginsburg missed arguments, Politico reported that the White House urged conservative activist groups to start preparing for her possible death or departure.

    But Ginsburg, who’s affectionately known by her fan following as the “Notorious RBG,” has survived bouts of cancer before, colon cancer in 1999 and pancreatic cancer in 2009, both of which were caught in the early stages.

    The Supreme Court said the nodules in her lung were discovered incidentally during tests performed at George Washington University Hospital after she fell and fractured three ribs in November.

    The justices have been on winter recess for the last month but are due back on the bench for oral arguments on Tuesday. The court’s press office did not say whether Ginsburg will be on the bench for arguments Tuesday.

    Among the petitions the justices considered Friday is a request from the Trump administration to bypass a regional appeals court and review a lower court’s decision to block administration officials from adding questions about citizenship to the 2020 census.

    I'm starting to buy into some of the conspiracy's surrounding RBG's health. Where is she? 2 months and she hasn't been seen in public. The one time she was suppose to be in public nobody even knew she was at an event that was honoring her.
