    N.C. Supreme Court delays hearing appeals until February

    The winter weather that left icy roads is leading North Carolina's Supreme Court to scrap hearing new cases until next month.

    The state's highest court decided hearings scheduled Tuesday are postponed until mid-February. The justices had planned a longer work day after postponing oral arguments Monday.

    The delay includes the death penalty case of Mario McNeill. He was convicted of killing 5-year-old Shaniya Davis in Cumberland County in 2009. McNeill wants justices to overturn his convictions because his attorneys should not have told police where to find his victim's body.

    The Supreme Court next month also plans to hear an appeal from tea-party congressional candidate Greg Brannon. The Cary obstetrician was found to have made false or misleading statements while asking people to invest in a now-closed technology company.

    Mario McNeill’s Attorney Seeks to Throw Out Death Sentence

    RALEIGH - The North Carolina Supreme Court heard an appeal Tuesday from an attorney for Mario McNeill, who was sentenced to death for the 2009 murder of five-year-old Shaniya Davis.

    McNeill’s attorney said his client should receive a new trial because his previous lawyers disclosed privileged information during his trial.

    However, the state said the evidence proved without a doubt that McNeill was guilty.

    “Mr. McNeil would have been better off without any lawyers because if his condition of anonymity was not going to be honored, if he was not going to get any promise of a benefit protection for this evidence used against him, he could have done this himself,” said Andrew Desimone of the Defense.

    “There was such overwhelming evidence in this case that a slight misstatement that the defendant didn’t even want to recall the jury’s attention to and was addressed by a curative instruction didn’t change the outcome of this trial, said Ann Middleton of the NC Dept. Justice.

    The court did not announce a decision Tuesday.

    McNeill is one of 150 killers on North Carolina’s death row.

    Death penalty upheld for man convicted of killing Shaniya Davis

    FAYETTEVILLE -- The man convicted of killing 5-year-old Shaniya Davis will receive the death penalty after his appeal to have his conviction overturned was denied.

    Mario McNeill was convicted and sentenced to death for killing the 5-year-old in 2009.

    McNeill wanted the court to overturn his conviction because he says his attorneys should not have told police where to find the little girl's body.

    While his attorney Andrew DeSimone said McNeill would have been better off without a lawyer.

    "Mr. McNeill would have been better off without any lawyers because if this condition of anonymity was not going to be honored if he was not going to get any promise of a benefit or protection from use of this evidence against him, he could have done this himself," said DeSimone.

    The jury decided McNeill received a fair trial.

    I still cannot work out how other than Danny Hembree and now McNeil not one other death sentence handed out since 2008 has been reviewed by the North Carolina Supreme Court as far as I can tell.

    In today's United States Supreme Court orders, McNeill's petition for a writ of certiorari was DENIED.
