    Joshua Young Found Not Guilty in 2011 KY Slaying of Trey Zwicker

    15-Year-Charged With Murder To Be Arraigned Monday

    LOUISVILLE, Ky. -- A 15-year-old boy accused of killing his stepbrother will be arraigned in court as an adult Monday.

    Joshua Young will before a judge in connection with the death of 14-year-old Trey Zwicker.

    Developments come after a grand jury decision last Thursday, that Young should be tried as an adult despite his age.

    He is accused of killing Zwicker, who was found beaten in a ditch outside Liberty High School in May.

    Soon after, Trey's father suggested to police that they investigate Young.

    He was later charged in connection with the crime, but he was charged as a juvenile, which has kept most of the case sealed.

    An arrest citation simply states that Young beat Zwicker to death, and then disposed of the murder weapon and clothing.

    Little else is known, but that will likely change with the grand jury indictment that he be prosecuted as an adult

    For the victim's father, Terry Zwicker, it's welcome news, but the grieving continues.

    "A lot of sad days, a lot of bad days. I'm sure there are more still coming, but now, it's anger. I have a lot of anger," said Terry Zwicker.

    Zwicker is calling for the harshest punishment in his son's death.

    It's possible Young could be eligible for the death penalty, if the Commonwealth decides to pursue that option.

    In addition to murder, Young has also been charged with tampering with physical evidence.

    Why is eligible for the DP?
    State law has a minimum age of 16. Either way he can not get the DP under 18, can he?

    He's not eligible, but they can charge him with capital murder. Maybe that is what they meant.

    Teen admitted killing his stepbrother with baseball bat, according to newly released documents

    WHAS11 is finding out more about the case against Joshua Young.

    He's the 15-year-old accused of murdering his stepbrother, Trey Zwicker and leaving his body behind Liberty High School earlier this year.

    On Thursday, 255 pages of evidence, along with witness interviews, photographs and videos were released.

    In the discovery, it indicates that Young admitted to killing Zwicker by hitting him with a baseball bat 15-30 times.

    He also allegedly disposed of the bat and the clothes he was wearing by putting them in a dumpster.

    The evidence indicated he made incriminating statements to at least six people, including his father, Josh Gouker.

    Josh Young is charged as an adult with murder, along with other charges.

    A 16-year-old boy accused of killing his stepbrother will appear in court Tuesday.

    A pretrial conference is scheduled for Joshua Young.

    According to police, Young beat 14-year-old Trey Zwicker to death in May 2011.

    Young's father told police his son beat Trey to death with a baseball bat because he "hated him so much."

    Zwicker's father , Terry, said he will be at Young's court appearance Tuesday.

    The penalty for Young's murder charge could range from 20 years in prison to death.

    Teen charged with step-brother's murder getting ready to go to trial

    LOUISVILLE, KY. (WDRB) -- The teen charged with his step-brother's murder is getting ready to go to trial. 16-year-old Joshua Young is accused of murdering his step-brother Trey Zwicker behind Liberty High School last May.

    According to court documents and family members, Young beat him to death.

    Young is staying in a Jefferson County Juvenile Detention Center, but his attorneys want to move him to a group home for troubled teens.

    Young's trial is set for October.

    More than a year after his son's death, the father of a murdered Louisville teen is tired of waiting for justice.

    Terry Zwicker sat in a courtroom Friday morning as lawyers discussed 16-year-old Joshua Young's upcoming murder trial.

    Young is accused of beating his step-brother, 14-year-old Trey Zwicker, to death behind Liberty High School last May.

    Young will be tried as an adult.

    Trey's father says he is confident it was Young who killed his son, but says he is frustrated with how long the legal process is taking.

    Inmates tell police Joshua Gouker had son kill Trey Zwicker to get revenge against Trey's mother

    Joshua Gouker told two fellow prison inmates that he put his teenage son up to killing his stepson in May 2011 as revenge for the stepson’s mother having an abortion, according to court records released Friday.

    Gouker and his son, Joshua Young, were indicted Thursday in the murder of Trey Zwicker. Gouker told Roederer Correctional Complex inmate Robby Krystynak “it was payback time, when you kill my child, I’ll kill yours,” according to a summary of Krystynak’s interview with police last month.

    Krystynak also told police Gouker acted giddy and excited while talking about the murder and bragged that he made a “demon seed and created a killer” out of his son, Joshua.

    An inmate who was a childhood friend of Trey’s father, Terry Zwicker, first came forward with the allegations in a letter to Zwicker last month, and then met with police on June 19.

    Gouker allegedly told that inmate, Jason Bierman, that he was getting an “eye for an eye.” He also allegedly outlined his alibi, saying he and Trey’s mother, Amanda Campbell, were “making a porno” the night Joshua is accused of bludgeoning Trey at least 15 times before leaving him to die in a creek bed behind Liberty High School on East Indian Trail.

    Gouker also allegedly told Krystynak that when he was released, he would kill Campbell and his own mother, Ruby Jessie. Neither Campbell or Jessie could be reached for comment.

    Both inmates told police they were not looking for any deals from the Jefferson County commonwealth’s attorney’s office in exchange for their testimony. According to the Kentucky Department of Corrections offender online system, Bierman is incarcerated on charges of robbery, burglary and receiving stolen property. Krystynak is serving time on convictions for robbery, burglary, escape and theft.

    In a letter to Terry Zwicker, Bierman said Gouker was incarcerated with him and “told me everything” and “I acted like I didn’t know you or what was going on,” according to a copy of one of the letters.

    Bierman asked Zwicker what he wanted him to do.

    “Do you want me to beat his ass?” Bierman asked in the letter. “I could go home in six months and if I whoop him I’ll end up serving out. ... But, I will if you want me to. ... I don’t want him to get away with it.”

    Bierman also agreed to testify and later identified Krystynak as also talking with Gouker.

    “Now, I’m no rat, but this is unacceptable,” Bierman said in his letter, referring to Gouker blaming his son for the murder. “He made his son do that and now he’s leaving him out to dry like a coward.”

    Gouker was indicted Thursday on charges of murder, unlawful transaction with a minor, possession of a handgun by a felon, being a persistent felony offender and torturing animals. The last charge involves allegations that he beat a dog to death with a bat and threw a cat out of second-story window.

    Bierman also told police that Gouker sent a letter to Jessie, telling her he was going to confess to the murder so the charges would be dropped against Joshua, and then recant the admission.

    In an interview, Terry Zwicker said he was best friends with Bierman in middle school but hadn’t spoken with him since 1995. He said his letter was a “prayer answered.”

    Assistant Commonwealth’s Attorney Elizabeth Jones Brown said the inmates’ statements to police were similar to those that a neighbor made early in the investigation regarding Gouker. Jones Brown said the neighbor’s recollection wasn’t enough for an indictment at the time.

    Zwicker added that Bierman had gleaned facts from Gouker about the case that only a few people knew, and “I know for a fact that what he is saying is true.”

    Jones Brown said Thursday that Gouker is in jail in Floyd County, Ind., on a theft charge. Gouker could not be reached for comment and does not yet have an attorney in the murder case. Both Gouker and Joshua are scheduled to be arraigned Monday in Jefferson Circuit Court.

    Gouker has told police that his son admitted sneaking out with Trey on May 11, 2011, and, without warning, striking the boy on the head with a baseball bat.

    Joshua, who is being tried as an adult, has blamed his father for the murder, as has Gouker’s mother. Joshua was re-indicted by the grand jury along with his father Thursday, charged with murder and tampering with physical evidence, for allegedly getting rid of the bat and his bloody clothing.

    Bierman said Gouker told him that another relative left the bloody bat in a dumpster, but it was never found by police.

    Pete Schuler, Joshua’s public defender, said he couldn’t comment on the evidence but said his client denies having anything to do with the murder and had no motive to kill Trey.

    “Trey was his best friend, and Josh believes that a lot of people know that,” Schuler said.

    Gouker allegedly told Krystynak that both he and Joshua never liked Trey.

    “It’s absolutely not true,” Schuler said.

    the father shouldnt be on trial as ordering a killing is speech hence protected by the 1st amendment
