    What you need to know for the Jodi Arias hearing tomorrow

    The judge in the Jodi Arias murder case will determine Tuesday when the trial will begin.

    Jury selection for the Arias murder trial had been set to begin February 21, but now the trial will be delayed after an attorney for Arias withdrew from the case. On December 23, Arias’ death penalty qualified public defender, Victoria Washington, withdrew from the case. A death penalty qualified defense attorney helps with jury selection, and will play a major role during the sentencing phase if Arias is convicted of first-degree murder.

    Judge Sherry Stephens will decide Tuesday just how much time a new attorney will need to get up to speed. There's been a lot speculation about the delay, with some guessing it will only be a couple months and others predicting Arias' trial may not start until 2013. But the judge is the one who gets to decide and Stephens has said the delay will be brief.

    The hearing Tuesday is expected to cover these three issues:

    Appoint a new public defender
    Address motion to dismiss, dealing with the death penalty
    Set a new trial date

    There is also a hearing scheduled for Wednesday, January 4, but that hearing may not take place if court wraps all of its issues on Tuesday.

    Jodi Arias is accused of brutally murdering her ex-boyfriend, Travis Alexander in 2008. Arizona police said Alexander had 27 stab wounds, a gun-shot wound in the face and his throat had been slit from ear when his roommates found his body in the shower at his home in Mesa, Ariz.

    Arias’ trial, which was initially set to begin in February, was delayed until October because Arias' death penalty-qualified public defender withdrew from the case in December. A death penalty-qualified defense attorney is essential to Arias’ case during jury selection, especially if she is convicted of first-degree murder in Arizona, a death penalty state.

    Arias, a 32-year-old photographer from California, has given police various explanations for her boyfriend’s death. Arias initially said she wasn’t with Alexander when he was killed, but later said Alexander was killed by two intruders.Arias is now claiming that she killed Alexander in self-defense after he became violent with her.

    “There was something very off about her. She was extremely obsessed with him,” Sky Hughes, a close friend of Alexander told The Huffington Post. “She liked him an abundance more than he liked her.”

    “She would break into his email - multiple times - and when he started dating another girl, she snuck into the house and watched them sleeping - they had fallen asleep on an oversized bean bag watching a movie,” Hughes added. "To affirm Jodi was creepy and obsessed with Travis would be a huge understatement.”

    Photo tiff postpones trial over 2008 killing

    Jodi Arias, 32, was supposed to go on trial Monday involving the 2008 murder of her boyfriend Travis Alexander.

    In early June 2008, Alexander, 30, was found in the shower of his Mesa home with his throat slit, 27 stab wounds and a gunshot wound to the face. Police found a camera in the home’s washing machine, and the memory card revealed naked photos of Alexander and Arias taken the day of the murder as well as photos of Alexander’s dead body.

    More than a month later, Arias was arrested at her parents’ home in Northern California and charged with murder. If convicted, she could be sentenced to die.

    In part because of the salacious photos, the brutality of the murder and Arias’ willingness to talk to reporters until her lawyers asked her to stop, the case has been covered nationally.

    But the trial has been delayed because defense and prosecuting attorneys are fighting over tens of thousands of photographs on the hard drive of Arias’ computer.

    On Monday, over the objections of the prosecutor, Maricopa County Superior Court Judge Sherry Stephens pushed jury selection in the trial to Dec. 10 to allow the defense time to analyze the photos. With the upcoming holidays, Stephens said, testimony in the case likely won’t begin before the new year.

    Police and prosecutors have been in possession of the computer since Arias’ arrest, but there were questions about whether it could be accessed because it was supposedly broken.

    In April, Arias’ defense attorneys, Kirk Nurmi and Jennifer Willmott, asked prosecutor Juan Martinez to let them find their own experts to try to access the computer. The computer was turned over to them May 31. The prosecution was able to retrieve three-fourths of the computer’s content, but it was provided to the defense only on Nov. 5.

    The two sides have debated postponing the trial for weeks because of the computer findings. Martinez has repeatedly said that the computer has been available for four years and that it has nothing new on it. He has been pushing to start the trial.

    Nurmi and Willmott say that additional images from the hard drive illuminate the relationship between Alexander and Arias.

    Arias has changed her story, first saying that she was not guilty and that other people killed Alexander. According to current court arguments, Nurmi and Willmott say that Arias killed Alexander in self-defense after their relationship became abusive. Some national media outlets have painted Arias as a stalker and “a temptress” who lured Alexander to his death, Nurmi said in court Monday.

    Among the digital evidence found by the defense attorneys are a video of Alexander baptizing Arias into the Mormon faith and nude photos of Alexander and Arias. Martinez said the images found on the hard drive are nothing new.

    Willmott disagreed, saying that the newly discovered photos show Alexander initiating abusive behavior much earlier in the relationship.

    Stephens pushed the trial back three weeks instead of the two months requested by the defense attorneys.

    Recap: Week 5 of Jodi Arias trial

    After the State of Arizona rested their case, Jodi Arias’ defense team took center stage this week as they presented their case to the jury for the first time. Arias claims she stabbed her ex-boyfriend, Travis Alexander, 29 times, shot him in the face, and slit his throat from ear to ear in self-defense. If convicted, she faces a possible death sentence.

    Former lover defends Arias

    Gus Searcy, a Prepaid Legal Executive Director, was the first defense witness called to testify Tuesday.

    Searcy testified that he served as a mentor to Arias while she was looking to become more successful in the business of selling legal insurance.

    During an overnight stay at his house, Searcy said Arias was crying and shaking after she talked to Alexander on the phone.

    Darryl Brewer, Arias’ 52-year-old ex-boyfriend, testified Arias was never jealous or violent during their relationship, and the two remained friends when they split after four years.

    In the summer of 2006, a few months after Arias joined Prepaid Legal, she “had become a different person that I’d known previously,” Brewer said.

    “We stopped being intimate” after Arias adopted the Mormon faith and became more religious, Brewer testified. “She said she was saving herself for her husband.”

    Brewer’s testimony also revealed that Arias stopped by his house the day before Alexander was killed and she asked if she could borrow two 5-gallon gas cans for a long road trip. Brewer said Arias never returned the cans.

    During cross-examination, prosecutor Juan Martinez suggested Arias was sexually aggressive when he asked Brewer if he and Arias ever had anal sex. Brewer responded by saying they were equally aggressive and had anal sex on one occasion.

    On re-direct, defense attorney Kirk Nurmi asked Brewer if he ever called Arias sexually explicit names like “whore” and “slut.” Brewer denied ever calling Arias those names.

    Ex-girlfriend calls victim a cheater

    Testimony from the victim’s ex-girlfriend Wednesday painted an unflattering picture of Alexander as a cheater, liar and hypocrite who pursued marriage with one woman while having sex with another.

    Lisa Daidone, formerly known as Lisa Andrews, said she had an on-again-off-again relationship with Alexander for almost eight months from July 2007 to February 2008.

    Daidone said Alexander was interested in marriage soon after they started dating, but they broke up when she learned Alexander cheated on her with Arias.

    The witness said that while she was with Alexander, they never had sex, and she was shocked to find out after his death that Alexander wasn't a virgin.

    In a dramatic moment, prosecutor Martinez, without any warning, flashed a photo of Alexander’s dead body on the court’s projector.

    The witness was taken aback and Alexander’s sisters began to cry. One of them stormed out of the courtroom while Arias broke down and wept.

    Martinez asked Daidone if any of Alexander’s behaviors warranted him having his throat slit. The defense objected and Daidone never answered the question.

    Siblings Desiree and Daniel Freeman testified Wednesday that Alexander and Arias had accompanied them on two overnight trips, one to Sedona and the Grand Canyon and another to Havasupai in September 2007.

    The witnesses said Alexander appeared to be different with Arias, acting more affectionate with her when they were alone and distant when they were in large groups.

    Daniel Freeman also recalled a heated argument between Alexander and Arias before one of their trips during which Arias became very upset and cried.

    Phone sex evidence emerges

    When Daniel Freeman was called back to finish his testimony Thursday, jurors asked him a series of questions, including if he’d ever seen Alexander be abusive to Arias and whether he ever heard him call Arias names. Freeman answered no to all the questions, and said their fights were much like arguments all couples have.

    Freeman said when he called Arias to inform her of Alexander’s death she was initially silent but later began to cry.

    As a member of the Mormon Church, Freeman said Alexander risked being ex-communicated if it was ever revealed that he engaged in pre-martial sex with another church member.

    After a two-hour wait while the judge reviewed a defense exhibit for admissibility, testimony resumed with forensic computer examiner Lonnie Dworkin.

    Dworkin testified that an examination of the victim’s laptop revealed there had been internet access between 4:08 a.m. and 4:45 a.m. on June 4, 2008.

    The witness also testified he was able to retrieve photos from a mirror imaged of Alexander’s damaged hard-drive.

    Jodi Ann Arias, the California woman accused of brutally killing her ex-boyfriend, will face the death penalty when her case goes to trial later this year, an Arizona judge has decided.

    Judge Sherry Stephens denied a defense motion Thursday in which defense lawyers requested the death penalty be removed as a punishment option for Arias. The 31-year-old photographer is accused of shooting her lover, Travis Alexander, in the face, stabbing him multiple times, and slitting his throat.

    The defense had argued that Arias should not face death because she had not planned to kill Alexander. His death was an act of self-defense, her attorneys argued.

    While Stephens denied the motion regarding the death penalty, she did grant a separate motion, prohibiting witnesses from hearing the testimony of other witnesses when the case goes to trial.

    Alexander, a 30-year-old motivational speaker and insurance salesman from Mesa., Ariz., was found dead on June 9, 2008. Friends found Alexander's naked body inside his standup shower, and advanced decomposition suggested he had been dead for several days.

    Authorities ultimately determined Alexander had been shot in the right brow with a .25-caliber gun and stabbed 27 times before his throat was cut from ear to ear.

    Arias initially denied any involvement in the slaying. When police used DNA and other physical evidence to place her at the crime scene she admitted she was present when Alexander was murdered, but said his death occurred during a home invasion. Arias now claims she was a victim of domestic violence who killed him in self-defense.

    Originally slated to begin on Feb. 21, Arias trial was delayed because Arias' lawyer, Victoria Washington, asked to withdraw from the case. Jennifer Willmott, a death penalty-qualified defense attorney, has since been assigned to represent Arias.

    Stephens has set Oct. 17 as the date jury selection will begin.

    Not a bad looking lady, wonder how this one will play out. I for one am very sceptical that she was the victim of abuse, but then again I dont know the whole story.

    Potential jurors questioned in Jodi Arias trial

    The process of selecting potential jurors continued Monday in the Jodi Arias murder trial.

    Dozens of people were questioned individually by both the prosecution and defense on their stance on the death penalty, religion and their attitudes towards law enforcement.

    One lady, who was questioned by prosecutor Juan Martinez, said voting for the death penalty “would be difficult for me to do.” Another said “she thinks she can vote for death once she has all the facts.”

    Defense attorney Kirk Nurmi was allowed to ask if the jurors could consider other sentences besides death. All but one person said they could give life in prison some thought.

    However, a few people, when questioned by defense attorney Jennifer Willmott, said there are some crimes that deserve the death penalty, such as the killing of a police officer, the rape and killing of a woman and murder-for-hire cases.

    One lady, who said she once had an abusive boyfriend, assured the prosecution her views would not affect how she would view any evidence that would be presented during trial.

    Arias is accused of shooting her ex-boyfriend Travis Alexander in the face, stabbing him 27 times and slitting his throat from ear to ear. At trial, Arias’ attorneys will argue she killed Alexander in self-defense.
