    Judge restricts live camera coverage of second penalty phase of Jodi Arias murder case

    PHOENIX – The second penalty phase in the Jodi Arias murder case will not be televised live, a judge ruled in an order made public Tuesday, marking a change from her first trial that attracted worldwide attention and created a media spectacle when the proceedings were broadcast in real time.

    Arias, 33, a former waitress, was convicted of first-degree murder last May for the 2008 killing of her one-time boyfriend in Arizona, but jurors couldn't reach a decision on a sentence.

    Under Arizona law, while her murder conviction stands, prosecutors have the option of putting on a second penalty phase with a new jury in an effort to secure a death sentence.

    If the second panel fails to end in a unanimous decision, the death penalty would be removed from consideration. The judge would then sentence Arias to spend her life behind bars or to be eligible for release after 25 years. The penalty phase retrial is set for Sept. 8.

    Video and audio coverage of the proceedings will be allowed but may not be broadcast publicly until after the verdict, Judge Sherry Stephens wrote in her ruling.

    "Any violation of this court order will result in immediate expulsion from the courtroom," Stephens wrote.

    Stephens appeared to give herself some leeway with the ruling, noting that if any footage was allowed to be broadcast, there would have to be a 15-minute delay.

    Media lawyers had argued for the same live TV coverage that occurred during Arias' first trial.

    Messages left for attorneys in the case were not immediately returned.

    Jodi Arias could still face death penalty, judge says

    PHOENIX – A judge denied a motion from Jodi Arias' defense team this week to have the death penalty removed as a sentencing option for the woman whose murder trial became an international sensation.

    Arias' attorneys argued that banning a defense aide from making jail visits last March affected the aide's relationship with the entire defense team and her ability to prepare for Arias' new punishment trial in September.

    Maricopa County sheriff's officials say mitigation specialist Maria De La Rosa was banned for a week after she took a drawing by Arias out of the jail.

    In court documents filed Friday, Judge Sherry Stephens says Arias' attorneys showed no evidence that banning De La Rosa prejudiced the case. There is no proof the incident would impact the ability to present evidence in Arias' penalty phase retrial on Sept. 8, Stephens ruled.

    Defense attorney Kirk Nurmi declined to comment Saturday.

    Arias, 33, was convicted of first-degree murder last year in the 2008 killing of her lover, but jurors couldn't reach a decision on sentencing. The case captured headlines worldwide and became a cable television staple with its tales of sex, lies and a brutal killing.

    She admitted killing Travis Alexander at his suburban Phoenix home but claimed it was self-defense. He was stabbed nearly 30 times, had his throat slit and was shot in the forehead. Prosecutors argued it was premeditated murder carried out in a jealous rage when Alexander wanted to end their affair.

    Stephens previously denied a defense motion in February that the Arizona law allowing a retrial of the penalty phase was unconstitutional.

    Sentencing retrial in Jodi Arias case still on schedule

    PHOENIX -- The sentencing retrial in the Jodi Arias murder case is still on schedule to begin Sept. 8.

    A status conference was held in Maricopa County Superior Court on Wednesday.

    Arias was found guilty of first-degree murder in the 2008 killing of her former boyfriend, Travis Alexander, but jurors couldn't reach a decision a sentence.

    A new jury will be selected at the start of the retrial.

    At Wednesday's hearing, Arias' defense team claimed prosecutor Juan Martinez has not been forthcoming about potential witnesses for the sentencing retrial.

    Prosecutors are seeking the death penalty.

    Arias wants to act as her own attorney during retrial

    In court Monday, convicted killer Jodi Arias stated that she wants to act as her own attorney in the sentencing retrial.

    Acting as her own attorney would put Arias head to head with prosecutor Juan Martinez.

    Judge Stephens cautioned Arias that representing herself would not be in her best interest and that she may face the death penalty.

    Arias will have the assistance of her current attorneys who will act in an advisory capacity.

    PHOENIX -- A judge ruled Monday that Jodi Arias can represent herself in the upcoming penalty phase of her murder trial, where jurors will decide whether she is put to death for killing her ex-boyfriend.

    Arias, 34, was convicted of first-degree murder last year in the 2008 killing of Travis Alexander, but jurors couldn't reach a decision on sentencing. Under Arizona law, while Arias' murder conviction stands, prosecutors have the option of putting on a second penalty phase with a new jury in an effort to secure the death penalty.

    Arias, who has long clashed with her defense lawyers and tried to fire them previously, asked Judge Sherry Stephens to let her serve as her own lawyer during the second penalty phase set for Sept. 8. Stephens granted the request but said there would be no delays.

    "I do not believe it is in your best interest ... I strongly urge you to reconsider," Stephens told Arias before granting the motion.

    Arias will now have the task of arguing a death penalty case just four weeks from now despite having no legal experience and no college degree or high school diploma. Arias got her GED in jail.

    Her defense lawyers will remain on as advisory council. They declined to comment on the latest developments. Prosecutors also declined comment.

    Experts say the move might not be such a bad idea given the gruesome nature of the crime. Arias admitted killing Alexander at his suburban Phoenix home but said it was self-defense. He was stabbed nearly 30 times, had his throat slit and was shot in the forehead. Prosecutors argued it was premeditated murder carried out in a jealous rage when Alexander wanted to end their affair.

    "It's actually probably a good idea to represent herself," said San Francisco-area defense attorney Daniel Horowitz. "She looks like a vicious psychopath with a ridiculous defense."

    However, Horowitz noted, the jury "may find her pathetic."

    "If she can get just one juror to bond with her on some level, even if they hate her, they're getting to know her, and it's harder to kill someone you know," he said.

    Helen, cameras are allowed but not live. After the trial ends the media is allowed to show it.

    Obviously, she's the poster girl for narcissism. And having just a GED is little training for a death-penalty defense. But representing herself may be her only chance to beat the gurney. All it'll take is one juror to bond with her somehow and vote for life.
