    Death Penalty Sought in Ame Deal Murder Case

    The Maricopa County Attorney will seek the death penalty for the two suspects, charged with murdering 10-year-old Ame Deal.

    Prosecutors say John "Bud" Allen and Samanthea Allen locked Deal inside a storage box last July. Both of them have pleaded not guilty to the charges of first degree murder, conspiracy to commit child abuse and multiple counts of child abuse.

    5th arrest made in girl's storage box death

    A fifth person has been arrested in the death of 10-year-old Ame Deal, who died in July after being locked in a storage box.

    One of Ame's cousins, Ammandea Stoltzmann, was taken into custody Wednesday in Glendale and booked into jail on three counts of child abuse.

    Ame's two other cousins John Allen, 23, and Samantha Allen, 23, are charged with first-degree murder, conspiracy to commit child abuse and multiple counts of child abuse.

    Ame's grandmother, Judith Deal, 72, and Ame's aunt Cynthia Stoltzmannn, 44, are charged with multiple counts of child abuse.

    A police investigation revealed that Ame had been abused by multiple family members from 2005 to July 2011. The abuse occurred in Midland, TX; Ogden, UT, and Phoenix and included being forced to walk barefoot down the hot street, forced to eat hot sauce, and forced to sleep in a shower stall.

    According to court paperwork released Thursday, Ammandea Stoltzmann is accused of restraining Ame with a dog collar and chain outdoors overnight and confining her in a dog kennel or crate, scrubbing her face with a wire brush, kicking her in the face and putting hot sauce into her mouth.

    According to court records, Allen locked Ame in a storage box on July 11, as his wife Samantha stood by and watched.

    Ame was being punished because she wanted a Popsicle, investigators said.

    Ame's death was originally reported as a tragic accident from playing hide-and-seek.

    The Maricopa County Attorney announced last month his office will seek the death penalty for two of the suspects, John and Samantha Allen.

    6th arrest made in death of Ame Deal

    A sixth suspect in the harrowing abuse and death last year of 10-year-old Ame Deal was arrested Friday night, Phoenix police say.

    David Deal, the girl’s father, was taken into custody in connection with abusing Ame, who was found dead last July, locked in a footlocker that measured 311/2 inches long, 14 inches wide and 121/4 inches deep in a south Phoenix home, said Sgt. Trent Crump, a Phoenix police spokesman.

    Deal, 52, was arrested on suspicion of four counts of child abuse, three counts of kidnapping and dangerous crimes against children, Crump said.

    A court ordered Deal’s release from jail Saturday at 3:45 p.m., according to the Maricopa County Sheriff’s Office.

    Officials believe Deal to be the final suspect in the case, and that he was the first to use confinement as punishment for Ame. The girl’s cousins, aunts and grandmother have also been charged in the case.

    Officials allege that, on several occasions between December 2010 and July 2011, David locked Ame in a trunk as punishment.

    “On one occasion, (he) was said to have thrown the trunk, containing Ame, into the backyard swimming pool because she kept crying and yelling that she couldn’t breathe during the confinement,” Crump said. “The trunk was removed before it could sink.”

    After his arrest, Deal denied that Ame was his daughter and that he abused her.

    Despite the development in the case, family members accused of tormenting and killing Ame last summer are months, if not years, from standing trial because of the complexity of the case and the severity of the charges.

    Authorities allege that John Allen, 23, and Sammantha Allen, 24, her cousins, had stuffed Ame in the footlocker at her home in the 3700 block of West Romley Road in Phoenix the night of July 11 as punishment for taking a Popsicle from the freezer.

    Police allege she had been forced into the footlocker several times before. She also faced other abuse that spanned much of her short life.

    John Allen and Sammantha Allen are charged with first-degree murder, child abuse and conspiracy to commit child abuse. Police allege that John padlocked Ame inside the footlocker while Sammantha made sure she didn’t escape.

    The state is seeking the death penalty against John Allen and Sammantha Allen, who were arrested last summer along with Ame’s grandmother Judith Deal, 73, and aunt Cynthia Stoltzmann, 45. Judith Deal and Stoltzmann are charged with multiple child-abuse counts.

    The death-penalty case won’t come to trial until Dec. 16, 2013, court records indicate. That’s not unusual for that kind of case, said John Curry, Sammantha Allen’s lawyer from Maricopa County’s Office of the Legal Defender.

    “These are the time limits and the rules. The rules reflect an understanding by all concerned that these cases take a long time,” Curry said.

    The four original defendants are named in a 15-part indictment that recounts repeated instances of abuse before Ame’s death.

    Those four original defendants remain in jail, said Jerry Cobb, spokesman for the Maricopa County Attorney’s Office.

    In February, a new defendant was added to the case: 25-year-old Ammandea Stoltzmann, another of Ame’s aunts who’s accused of abusing her. Ammandea was released from custody the day after her arrest on the condition she show proof that she lives at her current address, Cobb said.

    Ammandea’s arrest came as new details emerged during the case investigation, which has crossed state lines, Cobb said.

    Witnesses alleged to investigators that while living with Ame in Texas, Ammandea beat the child, restrained her outdoors overnight with a dog collar and chain, and confined her in a dog kennel. They also alleged that in Arizona, in the months before Ame’s death, Ammandea scrubbed her face with a wire brush, kicked her in the face, and put extremely potent hot sauce in her mouth as punishment for lying, police records show.

    In a police statement, Ammandea said Ame was never schooled, allowed to play or taken anywhere with the rest of the family.

    The trial of Cynthia Stoltzmann,Ammandea Stoltzmann and Judith Deal was separated from that of John Allen and Sammantha Allen because their charges are related to abuse before her death, records show. The three facing lesser charges are scheduled to meet for a case-management conference on Aug. 10, but their trial date has not been set.

    While neither prosecutors nor defense attorneys would comment publicly on details of the cases, court records show there is a complex discovery process in place to lay out evidence showing how Ame was abused and how she died. A long list of witnesses is expected to be called.

    There already has been controversy between Sammantha Allen’s defense team and the prosecution over what may be admitted into evidence.

    Records show that the defense moved to have a private jailhouse conversation between John and Sammantha stricken from available evidence, arguing that the recording violated state law. The defense became aware of the conversation in discovery.

    The judge has not yet ruled on a motion to suppress that evidence.

    Police, meanwhile, said the investigation continues.

    An April 16 trial date has been set for a woman charged with abusing her 10-year-old niece who authorities say died after other relatives padlocked her in a footlocker.

    Arizona child abuse case dismissed

    Child abuse charges were dismissed against the cousin of a 10-year-old Arizona girl who authorities say died after another relative padlocked her in a footlocker.

    A judge threw out the charges against 26-year-old Ammandea Stoltzmann after prosecutors said there's not enough evidence for the case to move forward and asked that the charges be dismissed. Her trial would have been the first trial over the severe abuse that authorities say 10-year-old Ame Deal suffered at the hands of family members before her July 2011 death.

    Jerry Cobb, a spokesman for the Maricopa County Attorney's Office, which is still prosecuting other Deal relatives, declined to comment on Thursday on how the dismissal bodes for the other cases, other than saying prosecutors can't comment due to the other cases. The case was dismissed Tuesday.

    Stoltzmann had been charged with abusing Deal, but wasn't charged in the child's death. Five other Deal relatives, including two who are charged with first-degree murder, face various charges in the case. All have pleaded not guilty to the charges.

    Authorities say Deal died after a man who's married to the girl's cousin padlocked her in the footlocker as discipline for having stolen popsicles. She was left in the plastic box all night and was found dead the next morning at the Phoenix home where her relatives lived. Investigators say the abuse heaped on the 10-year-old by some relatives included putting her in the footlocker on other occasions, being forced to eat dog feces and crush aluminum cans barefoot, and having her head forcibly dunked after she was thrown into a cold swimming pool.

    Lawyers for the Deal relatives charged in the case, including Stoltzmann attorney Lisa Caryle Posada, didn't return a call seeking comment. An attorney for another accused relative declined to comment.

    Stolzmann was accused of scrubbing the 10-year-old's face with a wire brush as punishment for lying, kicking her in the face while she was on the ground and putting a potent hot sauce in her mouth. Authorities say she denied kicking the girl or using the wire brush on her face, but admitted to putting hot sauce in her mouth and spanking her with a belt.

    Two of Deal's cousins, 24-year-old John Michael Allen and 24-year-old Sammantha Lucille Rebecca Allen, are charged with first-degree murder in the girl's death. Prosecutors are seeking the death penalty against the Allens, who are married.

    Investigators say John Allen padlocked her in the footlocker as a form of punishment for the popsicle theft on the night before her death.

    Sammantha Allen is accused of telling her husband that the child would be able to force the footlocker's latches open and standing watch over the girl as her husband went in the backyard to get the padlock. The couple went to sleep while the girl remained in the plastic box, and Deal's death was discovered the next morning.

    Sammantha Allen also is accused of coaching a 12-year-old girl who also lived at the house to say that Ame Deal was playing hide and seek with other children the night before her death and that she wasn't found before everyone went to bed.

    Cynthia Stoltzman, Deal's aunt and legal guardian, is accused of throwing the child into a cold swimming pool several months before the girl's death and forcing her head underwater. Police say Ame Deal, who was afraid of water, flailed her arms as she went under and came up choking and crying.

    Stoltzman and Deal's father, 53-year-old David Martin Deal, are charged with child abuse for allegedly causing or allowing Deal to be throwing into the pool.

    Stoltzman, 45, also is accused of once sitting on the footlocker while the child was inside the box for stealing food. Police say a man who lived at the house urged Stoltzman to let the child go, and Stoltzmann - who was playing with a laptop while sitting on the box- responded by threatening to complain to child welfare workers about the man's children having lice.

    She was sweating profusely as she emerged from the footlocker, police said.

    The child's paternal grandmother, Judith Cora Deal, also faces child abuse charges.

    Nicole Moon, a spokeswoman for the Arizona Department of Economic Security, which oversees the state's child welfare agency, said the agency didn't receive any reports of abuse about Ame Deal before her death.

    Police said they had child welfare agency reports from Utah that listed Deal as an abused child.

    Father of Phoenix girl in footlocker death pleads guilty to abuse

    The father of Ame Deal, a 10-year-old Phoenix girl who died in July 2011 after she was locked in a footlocker, has pleaded guilty to an attempted child abuse charge and possession of marijuana, according to court officials.

    David Deal, 53, was taken into custody on July 8, almost a year after Ame’s death. He was one of several suspects taken into custody after Ame’s body was found in a footlocker that measured about 32 inches long, 14 inches wide and 12 inches deep, police said.

    Officials also had accused Deal of locking his daughter in the trunk as punishment on several occasions between December 2010 and July 2011. After his arrest, Deal denied that Ame was his daughter and that he abused her, officials told The Republic in 2012.

    Ame’s aunt, Cynthia Stoltzmann, 45, also pleaded guilty to two counts of child abuse and one count of attempted child abuse, according to Maricopa County prosecutors. The sentencing for both Stoltzmann and Deal is scheduled for June 6.

    Ame’s cousins, 24-year-old John Allen and 24-year-old Sammantha Allen, have been charged with first-degree murder in connection to Ame’s death, according to court records.     Maricopa County prosecutors say 45-year-old Cynthia Stoltzmann also was sentenced Friday to lifetime probation.

    She pleaded guilty in April to two counts of child abuse and one count of attempted child abuse.

    A Phoenix couple accused in the 2011 death of a 10-year-old relative is scheduled to stand trial in January.

    Trial for both John Michael Allen and his wife, Sammantha Lucille Rebecca Allen, had been set to begin next month.

    But attorneys on both sides told a Maricopa County Superior Court judge Wednesday that they needed more time to find mitigating circumstances and interview witnesses.

    The trial has been postponed until Jan. 6.

    The couple, both 25, have pleaded not guilty to first-degree murder charges in the death of Ame Deal.

    Authorities say the girl died after being locked in a footlocker as punishment for taking a popsicle from the freezer.

    Prosecutors say they plan to seek the death penalty. The Allens were among six relatives originally arrested in the case.
