    Facts of the Crime:

    On April 22, 1995, a former Mexican Mafia member and his family were murdered for his decision 12 years earlier to leave the group in violation of a gang code. The victims were Anthony Morena, 42, Morena's sister, Maria, 38; her son, Ambrose Padilla Jr., 6 months; her daughter, Laura, 5; and a friend Gus "Tito" Aguirre, 36. One child survived by hiding under a pile of debris.

    The gunmen, Richard Anthony Valdez, of West Covina and Jimmy Palma, of Arcadia, were sentenced to death in Los Angeles County on June 11, 1997, and another accomplice, Anthony Torres, of Alhambra, is serving life without opportunity for parole. Two others involved in the killings, Daniel Logan, of Pasadena and Jose Ortiz, of San Gabriel, are serving 129 years to life.

    Luis Maciel, the man who had ordered the killings, was sentenced to death in Los Angeles County on May 8, 1998.

    Oral arguments on direct appeal are scheduled for the 3rd of June. A decision will be issued within 90 days of the argument.

    Court: California Supreme Court

    After a jury trial, Defendant, an alleged member of the Mexican Mafia, was convicted of the first degree murders of three adults and two children. The jury also found true multiple-murder special-circumstance and weapon use sentence enhancement allegations. Defendant was sentenced to death. The Supreme Court affirmed, holding (1) the trial court did not err in its rulings and decisions prior to trial; (2) the evidence was sufficient to support Defendant's convictions and the multiple-murder special-circumstance true finding; (3) the trial court did not err in the remainder of its rulings during the guilt phase of Defendant's trial; (4) the trial court did not engage in judicial misconduct during either the guilt phase or the penalty phase; (5) the prosecutor did not commit prejudicial misconduct during closing argument; (6) the trial court did not err in the remainder of its rulings during the penalty phase; and (7) California's death penalty statute is not constitutionally invalid.

    In today's orders, the United States Supreme Court declined to review Maciel's petition for certiorari.

    On February 7, 2014, Maciel filed a habeas petition before the California Supreme Court.
