    Death Penalty Sought in Girl's Murder

    PHOENIX - The Maricopa County Attorney is seeking the death penalty against a Mesa couple in the murder of a 4-year-old girl.

    Jose Gonzalez-Dominguez and Crystal Carimbocas each face counts of first-degree murder and child abuse.

    Police say the woman called 9-1-1 three months ago to report her daughter having trouble breathing.

    Officers and paramedics found Anays "Annie" Carimbocas unresponsive, lying on a bathroom sink in her apartment.

    She died at the hospital.

    The medical examiner determined her death was caused by blunt force trauma.

    "The decision to seek the death penalty is the most serious decision any County Attorney can make," Bill Montgomery said in a statement.

    "In any given case, I weigh the appropriateness of the death penalty and then determine whether the death penalty is a just punishment for the crime committed. In this case, if the State successfully proves beyond a reasonable doubt that the defendant is guilty as charged, the jury will then have the duty to consider imposition of the death penalty.”

    The couple is awaiting trial.

    Mesa man accused in deadly child beating stands trial

    A 4-year-old girl was taken to a Mesa hospital more than three years ago with fatal injuries that her mother's boyfriend said she suffered when she fell in the pool at an apartment complex.

    But doctors found other injuries on Anays Chenal Carimbocas — including a fractured skull and pelvis — that were not recent.

    Her mother and her mother's boyfriend are facing murder charges in Anays' death in a trial that opened Monday in downtown Phoenix.

    Prosecutors say Crystal Carimbocas and Jose Gonzalez-Dominguez, who are being tried in separate courtrooms with separate juries, will struggle to explain away the pre-existing injuries and history of abuse calls.

    Jeff Kirchler, an attorney representing Dominguez, asked jurors to weigh all the evidence presented during the trial, which is expected to last weeks.

    "Please be patient and please keep an open mind," Kirchler said. "The evidence will show this man is not guilty at the end of the trial."

    Anays had been living with Dominguez, 24, Carimbocas, 30, and three siblings at the La Mesa Village apartments near Mesa Drive and Franklin Avenue in the months leading up to her death.

    Dominguez told police on the day Anays died in May 2011 that he had taken the children to the apartment complex's pool and Anays fell while trying to get in, police records show.

    Prosecutor Jeanette Gallagher told jurors that surveillance footage from the complex did not show Dominguez or the children at the pool, which was closed for renovation on the day of the incident.

    Dominguez had told police the blunt-force trauma Anays suffered was due, in part, to the pool incident and rough play with her siblings. Prosecutors say an autopsy revealed injuries that occurred long before the day of her death, including skull fractures, a lacerated liver, broken ribs and numerous bruises.

    "She didn't fall at the pool. She didn't get those catastrophic injuries playing with her sister," Gallagher said before Judge Warren Granville. "What happened to her was no accident: It was child abuse."

    Carimbocas arrived home from work around midnight and called 911 nearly an hour and a half after finding Anays short of breath, according to police reports.

    Dominguez told police he noticed she was struggling to breathe earlier in the evening and administered "rescue breaths" but did not call 911, reports show. She was taken to a nearby hospital and pronounced dead, police said.

    "For all intents and purposes, Anays was already dead by the time the 911 call was made," Gallagher said.

    Kirchler began his opening statement by outlining Dominguez's history and his family's move to Mesa from Mexico in 2005.

    Dominguez met Carimbocas at the apartment complex and began a courtship that would later result in the birth of their son in 2010. Carimbocas' three children from prior relationships would later move in with Dominguez.

    Kirchler said Carimbocas and Dominguez always provided food and formula for the children, paid rent on time and kept their living area clean.

    However, Kirchler did not address Dominguez's statement about the pool, which Gallagher highlighted numerous times throughout her opening statement on Monday.

    Gallagher said Anays' sister, now living in a foster home, witnessed Dominguez repeatedly hit Anays' head against a wall and step on her while the family was living together.

    Gallagher said the motive was that Anays reminded him of Crystal Carimbocas' mother, with whom he did not get along.

    Allegations of child abuse go back to 2010, when Carimbocas' mother told police Dominguez had punched another of Carimbocas' children in the face, though Dominguez and Carimbocas said the child's facial bruise was caused by a toy.

    A separate incident that year involved Child Protective Services investigating Anays' black eye.

    The couple attributed it to her hitting her head on the edge of a table, police records show.

    "These girls were active," Kirchler said of Anays and two of her siblings, ages 6 and 8 in 2011. "Jose didn't fracture Anays' ribs.

    "He didn't know she had a fractured pelvis. While with Anays on May 13, he didn't know to seek medical attention."

    The trial is expected to last through August.

    A Mesa woman has been convicted of first-degree murder in the 2011 death of her 4-year-old daughter.

    Maricopa County prosecutors say jurors also found 30-year-old Crystal Carimbocas guilty Wednesday on two counts of child abuse.

    She's scheduled to be sentenced Sept. 18.

    Authorities say Anays Chenal Carimbocas was taken to a Mesa hospital in May 2011 with fatal injuries that her mother's boyfriend said incurred when the girl fell into an apartment complex's pool.

    Prosecutors say the pool was closed for renovation on the day of the incident.

    They also say an autopsy revealed injuries that occurred long before the day of the girl's death including skull fractures, a lacerated liver, broken ribs and numerous bruises.

    Crystal Carimbocas and her 24-year-old boyfriend, Jose Gonzalez-Dominguez, were tried separately in the case.

    Mesa woman gets life sentence in 4-year-old son's death

    A Mesa woman was sentenced to life in prison on Friday for her role in the 2011 murder of her 4-year-old child.

    Crystal Carimbocas, 30, was convicted of first-degree murder as well as domestic violence offenses for committing a dangerous crime against a child.

    Maricopa County Superior Court Judge Warren Granville gave Carimbocas a life sentence in the murder with the possibility of release after 35 years. In addition, Granville gave Carimbocas consecutive terms of 28 years for child abuse and 13 years for a second child-abuse charge.

    Investigators said Jose Gonzalez-Dominguez, the boyfriend of Carimbocas, had a history of physical abuse with Carimbocas' children and is currently on trial in the beating death of the 4-year-old.

    Dominguez was found guilty of first-degree murder and is awaiting sentencing.

    Prosecutors pointed out that Carimbocas allowed the abuse to continue and did not immediately report the child's death, thus seeing her as an accomplice to the murder.

    Deputy County Attorney Jeannette Gallagher read a letter during Friday's hearing from the foster parents who adopted Carimbocas' two other children. The foster parents wrote that Carimbocas and Dominguez also caused mental harm to her other girls.

    "It's hard for them to make friends because they can't get close to people," Gallagherread. "The trial has brought up past memories and they've had problems academically because of it."

    A minister with the "Rescued Not Arrested" organization testified that Carimbocas was a loving and forgiving person and was never in trouble while in jail.

    Granville agreed that she was loving and forgiving, just not to her child.

    "You had a choice between your boyfriend or your flesh and blood," Granville said. "You chose your boyfriend."

    Carimbocas' defense attorney, Rebecca Felmly, said she was disappointed with the outcome of the case because Carimbocas never personally inflicted physical harm upon the children.

    Felmly said she planned to file an appeal.
