Jury deliberating Brandon Bradley's sentence for killing Brevard Deputy Pill

The jury that convicted Brandon Bradley of murder has begun deliberating whether to recommend a life sentence or the death penalty for the man who killed Brevard County Deputy Barbara Pill in 2012.

Bradley again declined to take the stand in his own defense Tuesday morning before attorneys on both sides gave their closing arguments in the penalty phase of the trial.

Jury recommends death penalty for Brandon Bradley

The jury has recommended the death penalty for Brandon Bradley, who was found guilty of murder in the slaying of Brevard County sheriff's Deputy Barbara Pill.

The jury said with a vote of 10 to 2, Bradley, 24, should be put to death. The judge still must rule on Bradley's sentencing, but will take the jury's recommendation into account.

The jury was deliberating since around 2:30 p.m. Tuesday. They asked to watch the dash camera video from Pill's cruiser.

The jury also asked if one of the defense's expert witnesses has permission to publish Bradley's brain scan findings.

The state made their closing arguments on Tuesday, going through six aggravated circumstances on why the state thinks Bradley deserves the death penalty.

"He decided to shoot Deputy Barbara Pill to death for no other reason than that he did not want to go back to prison," said Assistant State Attorney Jim McMaster.

On Friday, Bradley's two half-brothers took the stand, discussing how they were beaten by their stepfather growing up and how Bradley took the brunt of those beatings.

The testimony got so emotional Friday, jurors were wiping away tears.

"We wasn't bad children, man, because of that," said Bradley's half-brother Anthony Nelson.

Nelson talked about the abuse he and his brothers took from their stepfather at an early age. He said for Bradley, it started when he was just 5 years old.

"Brandon wasn't bad. Brandon wasn't bad at all," Nelson said. "Like my brother said, he was happy, always had a smile on his face, but when you got somebody in the house that's constantly beating you, you're trying to get away from that."

The bad memories could be seen coming back to the 24-year-old. It was the first time since the start of his first-degree murder trial that Bradley showed emotion as tears rolled down his face.

For a month and a half, Bradley had sat stone-faced, something the judge warned jurors about ahead of time because of his psychotropic medication.

"Where would he hit him?" asked defense attorney Randy Moore.

"Face, legs, if he had a belt, whatever he could get his hands on he would use, just because we weren't his kids," replied Bradley's other half-brother, Keith Nelson.

Bradley's brothers described him as someone who always had a smile on his face; someone who would do anything to help someone out and not the person who opened fire on Pill during a traffic stop in March 2012.

Carrie Ellison, Bradley's ex-girlfriend, was also called to the stand.

She said Bradley started acting differently after his cousin was killed and when she had a miscarriage with Bradley's child.

"He started using drugs more heavily, more prevalently, wasn't eating much. I guess (he) was just trying to numb himself from feeling any of the pains," said Ellison.

A psychologist also took the stand Friday. She testified that when Bradley was pulled over by Pill, he wasn't thinking normally and was acting with fear.

She said Bradley didn't know Pill just wanted to arrest him and not kill him.

Bradley did not testify during the trial and said on Tuesday that he would not take the stand in the sentencing phase.

Juror describes scene during Bradley deliberations

At first, eight out of 12 jurors voted Brandon Bradley should die. According to Juror 107 — who spoke with FLORIDA TODAY but wasn't identified by name — an initial vote Tuesday afternoon showed one juror was unsure and three jurors were in favor of life without parole.

So they went over the circumstances of the crime — the "aggravating circumstances" that would justify a death penalty and the "mitigating circumstances" that would suggest life in prison is more appropriate. They went outside for a few minutes of fresh air, went back inside and made their final decisions.

Juror 107 said they then took a secret vote. Each juror selected the penalty they supported by writing either "life" or "death" on a sheet of paper before passing it to the foreperson. They delivered a 10-2 vote in favor of the death penalty.

Bradley was convicted last week of killing Deputy Barbara Pill during a traffic story following a hotel robbery in 2012. It took jurors about three hours to deliver a recommendation for the death penalty, which was about twice as long as it took them to find Bradley guilty of four crimes including first-degree premeditated murder.

Juror 107 said all 12 jurors were in agreement about Bradley's guilt during the initial vote. They spent time going around the table, having each juror explain how they came to their conclusion.

He said the video of Pill's death was overwhelming for all of them.

"He shot her in a way that was indescribable," Juror 107 said. "He gunned her down; she didn't have a chance."

The decision to recommend a death penalty was more difficult for them than deciding on guilt.

"I think it would be for anybody," Juror 107 said.

After the recommendation, Juror 107 and two others went to World of Beer to finally talk openly about the case. Previously, they weren't allowed to.

Juror 107 said the group was not impressed with the testimony of Jacquelyn Olander, a neuropsychologist who said Bradley had a low IQ score and is easily manipulated. Juror 107 said she seemed to fight with the prosecutor.

"It seemed like she was going around the question," he said.

One detail from the video stood out to Juror 107 — he said Bradley used his turn signal as Pill followed him before pulling him over. For Juror 107, that stood out as an indicator that Bradley wasn't so intoxicated.

The video of Pill's shooting hasn't been made public, but Juror 107 said Pill approached the car and was shot as she reached inside.

"I saw this innocent police officer gunned down like she was nothing," Juror 107 said. "I saw the calculated way he did it — it seemed like he drew her in."

Juror 107 said during jury selection he retired after working more than 40 years as a general foreman for Con Edison in New York. FLORIDA TODAY previously reported that he agreed with the Casey Anthony verdict, but he said Wednesday that he didn't. He raised four children in New York and has five grandchildren. He told the court he considers himself a trustworthy and honest person. He sees two sides to every story.

"Never thought in a million years I would ever be chosen to go on trial and not only find them guilty but, as far as I know, put them to death."

He said he voted for the death penalty.

"I hope it sends a message out to everybody out there that you can't go around killing the police."

Son of slain Brevard deputy accused of sex with girl

VIERA, Fla. - The son of slain Brevard County sheriff's Deputy Barbara Pill was arrested on allegations of having sex with a teenage girl who was in the agency's explorer program.

Ryan Scott Pill, who was twice employed by the Brevard County Sheriff's Office, along with the Melbourne Village Police Department, was arrested Thursday, accused of having sex with a minor.

Officials allege that Pill had sex with a girl who was 16 or 17 years old at least 10 times. The document says Pill was at least 24 years old at the time.

Pill was a corrections deputy at the jail, according to Sheriff Wayne Ivey. He was fired on Oct. 26, as a result of the allegations.

According to the Brevard County Sheriff's Office website, Law Enforcement Career Exploring is open to young men and women ages 14 and not yet 21 years old who have completed at least the 8th grade with an interest in learning more about careers in the field of law enforcement.

?Pill also served as an officer with Melbourne Village Police Department between May 2009 and September 2012, according to Chief Jack King. Pill was investigated once for a sexual assault accusation, but it was found to be unsubstantiated. He left the agency in good standing, King said.

Pill's mother was killed in the line of duty in 2012.

Brandon Bradley was convicted of Barbara Pill's murder in April, and the jury recommended the death penalty. A hearing on the final sentencing for that case is scheduled for later this month.

Judge weighs sentence for Brandon Bradley in Brevard deputy's murder

VIERA -- The man convicted of killing Brevard County Deputy Barbara Pill more than two years ago will be back in court today for a Spencer Hearing.

It will allow lawyers from both sides to sway Judge Morgan Reinman’s decision whether to sentence Brandon Bradley to life in prison or death for Deputy Pill’s murder.

A jury found Bradley guilty April 1 and recommended a death sentence.

Judge Reinman will announce her decision at Bradley's sentencing hearing June 27.

Bradley to be sentenced Friday, likely to death

Brandon Bradley, the man convicted of killing Brevard County Sheriff's Deputy Barbara Pill, will probably be sentenced to death Friday.

A jury recommended the death penalty by a 10-2 vote and though Judge Morgan Reinman has the authority to choose life in prison, she must give the jury's recommendation great weight.

The hearing will take place at 1:30 p.m. on Friday in Viera.

Bradley's mother knows the death penalty is likely. His lawyers have already talked about the appeals process.

"There are days when I would have complete meltdowns and I would just cry about it," Tiffany Taylor said. Sometimes she feels nauseous.

She avoids online comments about her son on media websites. She quit watching the news after the March 2012 incident.

"Brandon is not the monster that he's portrayed to be," she said.

A jury found Bradley guilty on April 1 after hearing from witnesses who saw Bradley and co-defendant Andria Kerchner leaving from the Econo Lodge on U.S. 192 with stolen furniture. They also saw video of Pill's death that was recorded on her patrol car's dash camera after she pulled Bradley over, and evidence of Bradley's DNA on the gun.

Bradley's attorneys presented evidence that he took psychedelic mushrooms and cocaine the night before the killing and was on Xanax and marijuana at the time.

"This is not Brandon, this is something he would never do," his mother said of the shooting. "Had he been in his right mind, he would never have done that."

The jury recommended death on April 8 after the state told them Pill ordered Bradley to "get out of the car" 23 times during the traffic stop. Among six factors they said supported a death sentence, the state reminded jurors Pill was a deputy on duty.

"That alone justifies the death penalty," Assistant State Attorney Jim McMaster said.

While Florida only requires a majority vote to recommend a death penalty, every other state except Alabama requires a unanimous vote, according to attorney Kepler Funk, who analyzed the case for FLORIDA TODAY. In 2011, State Sen. Thad Altman (R-Melbourne) sponsored a bill that would have changed the law to require a unanimous vote for a death penalty recommendation, but that bill stalled.

In a final hearing before the judge delivers her sentence, Bradley said nothing. Pill's widow, Steve, said in court the family was looking for justice.

"This family doesn't want revenge but justice and the justified punishment to be given per the laws of the state of Florida," he said.

Brandon Bradley gets death sentence for Brevard deputy's murder

Brandon Bradley, the man convicted of murdering Brevard County Deputy Barbara Pill, has been sentenced to death for the 2012 shooting in Melbourne.

Brevard County Judge Morgan Reinman handed down the capital sentence to Bradley shortly after 1:30 p.m. Friday.

According to Florida Today, Bradley briefly addressed the court before his sentence was announced.

Bradley: "I just want to say I'm sorry to the family and friends of Deputy Pill." pic.twitter.com/8KvWROL3ix
    — Andrew Ford (@AndrewFordNews) June 27, 2014

Judge: "Mr. Bradley, may God have mercy upon your soul." pic.twitter.com/knwWfAsGwK
    — Andrew Ford (@AndrewFordNews) June 27, 2014

The courtroom was packed with spectators, Brevard County deputies, and members of both Bradley's family and Pill's as the judge handed down the sentence.

"We are pleased with today's sentence," Sheriff Wayne Ivey said in a statement released Friday afternoon. "Barbara was an incredible deputy, mother, wife and friend, and we will never forget her. Justice was rendered today, and we hope that it is carried out swiftly. We pray that today actions will finally bring peace and closure to Barbara's family."

Bradley, 24, was convicted in April in shooting and killing Deputy Pill on March 6, 2012. The same 12-member jury that found Bradley guilty of first-degree murder recommended that he receive the death penalty by a vote of 10–2.

Pill had pulled over Bradley and his then-girlfriend, Andria Kerchner, after the pair robbed the Econo Lodge in Melbourne following a two-week-long drug binge at the motel.

Kerchner had testified against Bradley on the stand as part of a plea deal she took in January, reducing her first-degree murder charge to accessory after the fact of first-degree murder, and dropping what could have been a life sentence to just 12 years in prison.

On the stand during Bradley's trial, Kerchner said she and Bradley were confronted by Econo Lodge staff for trying to steal furniture from their room. Despite being told to wait for police to arrive, the pair took off in Bradley's SUV, brushing an employee as they fled the scene.

Kerchner said a female deputy ordered them out of the car, but Bradley refused to go back to jail, and instead pulled out his gun and shot Deputy Barbara Pill multiple times, killing her.

The entire trail against Bradley lasted nine days following a long jury selection process that took four weeks.

Jurors took just over an hour to come to its guilty verdict, and about three hours to recommend that Bradley be put to death. But as our legal analyst, Mark NeJame of NeJame Law, explained before the sentencing, the decision was ultimately up to Judge Reinman.

"In Florida, [there are] a tremendous number of cases going to the death penalty," NeJame said. "We have more in Florida and Texas than anywhere else, and I think you'll see, in this particular case, the judge following the jury's recommendation and will be imposing a sentence of death."

Despite arguments from the defense that Bradley's troubled childhood, brain injuries and two-week drug binge were cause to spare his life, the judge sided with the jury's recommendation for a death sentence.

But while this may be the end of the case, it's not the end of the story if Bradley is sent to death row.

"It's an automatic appeal to the Florida Supreme Court," NeJame explained. "It's one reason these cases do go on. They can last 20, almost 30 years."

See, this is where the abolitionists lose me. How does binging on drugs vindicate a just punishment?

But here it is, I guess. The one that started it all. Part of the reason I unearthed this forum in the first place was to dig up what happened to the guy that shot Officer Pill, whose death I heard about on my car radio in real time two years ago. See you in Hell, Bradley.
I am vehemently against Murder. That's why I support the Death Penalty.

Death Row Inmate Who Killed Florida Deputy to Be Resentenced

TALLAHASSEE, Fla. (AP) — The Florida Supreme Court is ordering a new sentencing hearing for a death row inmate convicted of fatally shooting a Brevard County deputy during a traffic stop.

The ruling Thursday is because the jury that recommended death for Brandon Lee Bradley was not unanimous.

Deputy Barbara Pill pulled over Bradley in March 2012 shortly after a Melbourne motel owner reported he stole pillows, sheets and an air conditioner from a room.

A dashboard camera showed Pill told Bradley to get out of the car more than 20 times and he refused. She then reached into his car to try to turn off the ignition when Bradley fired eight shots, striking Pill five times.

Jurors voted 10-2 for the death penalty. Bradley will receive life without parole if a new jury doesn't unanimously recommend death.

Juror outraged over Brandon Bradley resentencing

ORLANDO, Fla. —It was last week that the state's highest court dropped a bombshell on Central Florida.

The court ruled that Brandon Bradley, convicted of killing a local sheriff's deputy, would not face the death penalty and would instead be resentenced.

WESH 2's Michelle Meredith sat down with the case’s original jurors, who aren’t happy about the decision.

“I think it's wrong because he's going to get a second chance. Barbara Pill didn't get a second chance,” said Mike Carlo, who is outraged.

Carlo was one of 10 jurors who voted to sentence Bradley to die. Bradley was accused of shooting and killing Deputy Barbara Pill in 2012.

Last week, the Florida Supreme Court threw the death sentence out, for now.

“That's what's driving me crazy,” he said. “We went by the law, and how the law was read to us. We were told we only needed 10 out of 12 and we got 10 out of 12. So it shouldn't be changed.”

The sentence changed because of a Supreme Court ruling that says 10 to 2 is not good enough; they ruled that a death sentence vote must be unanimous.

“You just can't come up with laws three years later and change them like that. Not when you have a jury of its peers ruling on it,” Carlo said. “Then you take the whole system of the jury and throw it out the window. What good are we?”

The shooting death of Pill outraged the people of Brevard County and Central Florida.

Bradley was accused of stealing items from Melbourne Hotel, then shooting Pill five times when she confronted him.

Carlo said the dash-cam video and autopsy pictures are seared into his mind.

“Anybody who saw that would have made the same decision we made. Anybody. It was a cold-blooded, calculated murder,” Carlo said.

The Florida Supreme Court has not completely ruled out the death penalty for Bradley.

A new jury can hear the evidence and sentence Bradley to death, but all jurors must agree.
