Tentative date set for accused Brevard deputy shooter

The cases against two people accused of killing Brevard County Sheriff’s Deputy Barbara Pill are moving forward, though one suspect still remains without a tentative trial date.

Brandon Bradley and Andria Kerchner are each accused of murder in the deputy’s death and will go to trial separately.

Earlier this week Circuit Judge Morgan Reinman heard final arguments in Kerchner’s case related to a motion to suppress evidence that could be used at trial.

Kerchner’s attorney has previously argued that statements Kerchner made to police after her arrest should not be used in court because Kerchner was on drugs at the time. The judge said she would rule on that motion by early November and has set another hearing in Kerchner’s case for Jan. 15.

A tentative trial date in Bradley’s case is set for Jan. 27. No date has been set for Kerchner’s trial, and prosecutors have not said if they will seek the death penalty in her case.

Pill, 52, was fatally shot March 6, 2012 when she pulled over a vehicle connected to a Melbourne robbery.

Trial for Brevard Deputy Barbara Pill's murder pushed back to February

The first of two trials for the murder of Brevard County Deputy Barbara Pill, which was supposed to begin two weeks from today, has now been delayed until the end of February at the earliest.

Prosecutors Monday asked for a continuance in the trial against Brandon Bradley, which was scheduled to start Jan. 27. They said they needed more time to gove over a long list the defense has come up with of additional expert witnesses.

A judge granted the continuance, moving Bradley's trial for the deadly 2012 shooting until at least late February -- possibly Thursday, Feb. 27, if that date is clear.

A hearing has also been scheduled for this Thursday, Jan. 16, at which Bradley's defense will argue against the death penalty.

Bradley faces death for charges of shooting Deputy Pill in the head during a traffic stop on March 6, 2012.

Andria Kerchner, who was in the car with Bradley when the shooting happened, will stand trial once Bradley's is finished. The judge granted separate trials last year for the two suspects.

Judge: Police can't wear uniforms at cop killer's trial

The suspect’s attorney argued a ‘sea of blue’ would sway the jury’s decision

BREVARD COUNTY, Fla. — A judge has enacted a policy barring police officers from wearing their uniforms or other insignia while in attendance of the trial for a man accused of killing a Brevard County sheriff’s deputy.

Judge Morgan Reinman enacted the policy after Brandon Bradley’s attorney argued that a "sea of blue" in the courtroom would influence the jury and prevent Bradley from a fair trial. He is accused of fatally shooting deputy Barbara Pill at a traffic stop in 2012, according to Florida Today.

The police barring the wearing of uniforms does not apply to witnesses and court deputies.

Bradley is charged with first-degree murder for the death of Pill, who pulled Bradley over for allegedly stealing from a motel, according to WFTV. Prosecutors are seeking the death penalty.

Andria Kerchner, who was in the suspect's vehicle at the time of the shooting, pleaded guilty to being an accessory after the fact to first-degree murder. She was sentenced to 12 years in prison. As part of her plea deal with the state, Kerchner has agreed to testify truthfully in Bradley's trial.

Trial of man accused of killing Brevard County deputy begins Monday

If convicted, Brandon Bradley could be sentenced to death

BREVARD COUNTY, Fla. —The trial of a man accused of killing a Brevard County sheriff's deputy begins Monday.

Barbara Pill, 53, pulled over Brandon Bradley and his passenger, Andria Kerchner, on suspicion of theft on March 6, 2012.

During the traffic stop Bradley opened fire, hitting Pill multiple times in the face and killing her, according to investigators.

When Bradley and Kerchner were arrested, both pleaded not guilty. But Kerchner changed her plea last month. She is now spending 12 years in prison after admitting her role in the crime.

On Friday, Bradley was given another chance to plead guilty and avoid a trial but he declined.

If he's convicted of first-degree murder, he could face the death penalty.

Kerchner is expected to testify against Bradley.

Jury selection under way in Brandon Bradley trial

Juror 106 -- the last of the second group of potential jurors for the trial of accused deputy killer Brandon Bradley -- was questioned Friday morning.

The court has 25 candidates for jury. Judge Morgan Reinman said they're looking for 41. There will be a second phase in which candidates from that group will be questioned further and ultimately 15 will be selected to watch the trial.

Jury selection continues in deputy murder trial

After almost seven days of jury selection, attorneys are still questioning potential jurors in the Brandon Bradley murder trial.

Bradley is accused of killing Brevard County Deputy Barbara Pill in February 2012.

By Friday afternoon, attorneys had 30 potential jurors for the case. But they're hoping to have closer to 50 before they begin the process of narrowing down the jury pool to 12 people plus three alternates.

Bradley has been charged first-degree murder and the state is seeking the death penalty. Judge Morgan Reinman admitted Friday that the jury selection process has been going slow.

"We were anticipating that we would be through this case by March 28. I don't think that's going to happen, this process has taken longer than we anticipated," Reinman said.

Attorneys plan to dismiss Monday's jury pool so they can continue to question the jurors already called.

Jury selection continues in Brandon Bradley murder trial

Opening statements in the trial of a man accused of murdering Brevard County Sheriff's Deputy Barbara Pill are still days away from beginning as jury selection continues.

Brandon Bradley is accused of shooting and killing Deputy Pill in March 2012 and faces a potential death sentence if convicted of first-degree murder.

So far, 41 potential jurors have been selected for the pool.

In court Tuesday, two dismissed jurors told the court they had already formed opinions about the guilt of Bradley.

One juror who was questioned said they do not believe in the death penalty and the court had no choice but to dismiss that person.

A new jury pool of 53 was brought in Tuesday afternoon as the court is tries to get 50 total and then whittle that down to the 15, 12 jurors and 3 alternates, need for the trial. Of the new pool, 21 were sent home.

Prosecutors said Bradley shot Deputy Barbara Pill during a traffic stop on March 6, 2012. Investigators said he and girlfriend Andria Kerchner had just stolen items from the Econo Lodge in West Melbourne, and deputies were called to track down the suspects.

Minutes later, Pill made the stop. That's when investigators said Bradley pulled out a gun and shot the deputy outside a neighborhood on John Rodes Boulevard, in Melbourne.

Investigators said Bradley then sped away, later crashing into a water-filled drainage ditch, where he and Kerchner were arrested.

Kerchner accepted a plea deal last month and was sentenced to 12 years in prison. As part of the agreement, she will testify against Bradley in this trial, which is expected to last five weeks.

Bradley trial moving forward after jury candidates found

After scrutinizing 212 people over the course of nearly three weeks, a group of 49 potential jurors have been chosen for the trial of the man accused of shooting Brevard County Sheriff's Deputy Barbara Pill.

State prosecutors and Brandon Bradley's defense team will question that group of 49 people further to narrow down to 15, including 12 jurors and three alternates.

Bradley, 24, is accused of shooting deputy Pill in March 2012.

"We are pleased that we can be moving forward in the selection process and getting closer to the presentation of evidence," said Assistant State Attorney Tom Brown. He said there was a distinct possibility they would have needed to question a fifth group of jurors, which is a time consuming process.

Brown and the others who worked on jury selection have good reason to be pleased. While group questioning swiftly removed those who couldn't serve as jurors, the individual questioning process was grueling. Over and over, Brown explained for lay people the process of how a juror would watch the case, determine whether the defendant is guilty, then weigh good and bad circumstances about that person to determine if they should be sentenced to death.

They questioned potential jurors about their feelings on the death penalty and their knowledge of the case.

Very few people knew nothing about the high-profile 2012 case. Many had heard about it through the news, but were ready to acknowledge the media can be inaccurate. If they said they could set aside their prior knowledge when acting as a juror, they could stay. If someone was against the death penalty, they were dismissed.

Before the trial begins, Judge Morgan Reinman will readdress an issue she had previously reserved ruling on. The defense had tried to suppress testimony from people including: a woman who said she saw Bradley with a gun, a man who was on the phone with co-defendant Andria Kerchner around the time of the shooting, a man who stole the gun used in the shooting and traded it to Bradley for crack, and Kerchner herself, who has said she told Bradley "you don't need to do this."

The state will question potential jurors tomorrow. That could take a full day. The defense would then question them on Monday.

Then Reinman would readdress the reserved ruling, which will take maybe an hour and a half.

And then opening arguments can begin.

Brandon Bradley trial: Opening statements may start Tuesday

We expect opening statements Tuesday in the Brandon Bradley murder trial.

Bradley is accused of gunning down Brevard County Sheriff's Deputy Barbara Pill during a traffic stop two years ago.

But first a jury has to be seated, and that’s already taken four weeks. We've also learned a key person in the case will be testifying before a jury is even seated.

Andria Kerchner -- Bradley's former girlfriend -- is part of a handful of witnesses who the prosecution and defense will question ahead of time, with no jurors present, to make sure their statements made later won't potentially damage what the jury will hear in court.

Deputy Pill's widower said he is now here for the duration. Steve Pill sat in court on the back row, listening to the final moments of jury selection.

Just feet away sat Brandon Bradley, accused of killing Pill’s wife of three decades.

The 32-year law enforcement veteran was shot and killed after she pulled over Bradley and Kerchner. The pair was accused of stealing items from a West Melbourne motel room.

After the deadly shooting, investigators said Bradley and Kirchner sped away before crashing into a water-filled ditch. Both were arrested. Kerchner made a plea deal and will serve 12 years.

Now it's Bradley's turn, facing a possible death sentence. His former girlfriend will testify against him.

It's been a tedious process to pick a jury. More than 200 candidates were brought through, narrowing that down to 40, then soon, 15.

Kerchner and the other witnesses will be questioned on the stand in the morning. Again, once a jury is agreed upon, then opening statements could begin.

    That could be Tuesday afternoon.

Andria Kerchner takes stand at Brandon Bradley murder trial

Prosecutors in Brandon Bradley's murder trial in Brevard County called their star witness to the stand Thursday: Bradley's ex-girlfriend.

Andria Kerchner, who was with Bradley in his SUV when prosecutors say he shot and killed Brevard County Deputy Barbara Pill in 2012, testified against Bradley as part of a plea deal she took in January.

Andria Kerchner went into great detail on the stand Thursday about what happened during the deadly traffic stop on March 6, 2012.

Kerchner was on the stand for more than an hour as prosecutors asked her to tell the jury she accepted a plea deal in the case, and is serving 12 years in prison in exchange for her testimony.

The 21-year-old told jurors she and Brandon Bradley had only been dating for about three weeks before the day of the shooting, and during that time, Bradley always carried a gun.

Under cross-examination by the defense, Kerchner admitted she didn't remember much of their two-week drug binge at the Econo Lodge in Melbourne. Both were high on Xanax, Codine and marijuana, and she even took ecstasy when they were confronted by motel staff for trying to steal furniture from their room.

Kerchner said despite being told to wait for the police to show up, she and Bradley took off in his SUV, brushing an employee and hitting part of a staircase.

She testified she did remember female deputy getting behind them with blue lights flashing.

The SUV stopped, and Deputy Barbara Pill ordered them out of the car, but Kerchner said Bradley refused to get out, and instead pulled out his gun.

After a police chase and crashing into a ditch, Kerchner said she took even more drugs, afraid officers would find them in her pocket.

The defense hammered away at Kerchner after she admitted under oath that she lied to Brevard County sheriff's investigators about a third person being in the car, even giving them another person's name and date of birth.

Bradley's public defenders also grilled her about how she was not cooperative with officers during their initial interview after the shooting, saying, "I'm going to shoot all three of you, because I hate cops."

Kerchner also admitted on the stand that she faked a seizure right after her arrest.

Jury sees Deputy Pill's death on dash cam video

On Day 3 of testimony Thursday, jurors saw perhaps the most important piece of evidence in the state's case: Dash cam video from Deputy Barbara Pill's patrol car showing her death.

The jury watched the video twice -- once at normal speed, and again at a slower speed -- on a video monitor positioned away from the courtroom gallery, so only jurors could see it. Deputy Pill's family left the courtroom before the video was played.

A string of gunshots rang out, heard on the dash cam mounted on the rearview mirror of the deputy's patrol car.

Moments before, Pill's voice could be heard during the traffic stop on March 6, 2012, as she demanded the occupants of the car several times to get out of the vehicle.

One witness, Trista Lowman, said she had just gotten home and saw what was going on in the street outside her house. She testified she saw a white SUV with two people inside. Prosecutors said it was Bradley and Kerchner.

On the stand Thursday, Lowman said she crouched down behind her car when she heard gunshots.

"I saw smoke in the air and just heard shot after shot," Lowman recalled.

She added she saw the officer was hurt, and she called 911 after the SUV speed away from the scene.

Prosecutors say Deputy Pill was able to activate her uniform's microphone during the shooting, and some shots were broadcast over the radio.

"I could tell from the gunshot wound to the head that there was not much that I would be able to do, so I immediately tried to locate witnesses," said Brevard County Deputy Victor Velez, who was second to the shooting scene.

One of those witnesses was Trista Lowman.

Testifying before the video was played and on the stand during it, the original deputy who responded to the burglary call at the motel where Bradley and Andria Kerchner were suspected of stealing items from their room.

Another deputy, James Troup, briefly broke down on the stand when asked about what he saw as he showed up first on scene where his colleague Barbara Pill had been shot several times.

Prosecutor: Did you request medical assistance for Deputy Pill?

Deputy James Troup: Yes, I did.

Prosecutor: Was there anything you could do?

    Deputy Troup: No, there wasn't.
A Brevard County Sheriff's Office supervisor also testified Thursday morning. Cpl. Brad Cervi was in charge of installing 200 dash cam video systems in the agency's cruisers, including Deputy Pill's, which recorded the shooting on an SD card.

The systems were installed in late 2011, just months before the incident took place. Cervi explained the cameras are activated when an officer turns on his or her blue lights, or manually presses a record button on the rear view mirror or a microphone on their own uniform.

Prosecutors also questioned two other sheriff's investigators who took the SD card into evidence, to show jurors that the card was never altered in any way.
