Samuel Lee Jordan Sentenced in 2010 LA Slaying of 2-Month-Old Daughter Lyrica Kennedy

A man accused of brutally shaking his 2-month-old baby daughter so hard that she was left brain dead will face trial in November.

Samuel Lee Jordan, 23, is charged with first-degree murder in the December 2008 death of his daughter, Lyrica Kennedy.

If convicted, Jordan could face the death penalty.

Caddo Parish Court Judge Mike Pitman set Jordan's trial for November 28 during a routine hearing this morning.

Jordan's attorney, public defender Kurt Goins, also argued that statements Jordan made during questioning by police should not be used as evidence in his trial.

Goins said the statements, which included Jordan saying he always knew he would go to prison for killing someone, would unfairly influence the jury.

But Caddo assistant district attorney Dale Cox said the jury had a right to hear the statements because they revealed Jordan's state of mind.

In ruling against Goins' motion, Pitman said the statements could be used as evidence because they did not refer to past crimes or those that Jordan intended to commit.

Sentencing under way in infant murder trial

Mere hours after being found guilty by jurors, Samuel Jordan’s life hung in the balance as the same panel started weighing evidence for a decision whether he should die or spend the rest of his life in prison.

The 24-year-old was found guilty Saturday of first-degree murder for the death of his nine-week old daughter, Lyrica Kennedy, in a trial that took far less time than it did to select jurors.

Sunday, witnesses paraded in Judge Michael Pitman’s courtroom, with the defense trying to depict Jordan as mentally incompetent, a problem child who suffered from brain damage due to substance abuse by his mother, and prosecutors trying to paint him as a violent man bent on murder.

Defense attorney Kurt Goins said Jordan grew up in a foster home where he wasn’t able to get treatment as a child and grew into a troubled adult.

“His impairment has played a role in his life,” Goins said. “Samuel is responsible for his crime, that’s not disputed… He’s responsible for what he did, but not who he is.”

Jordan brought his daughter to WK Pierremont Health Center in December 2008, where the infant was described as being in crit*ical condition with breath*ing troubles. Doctors said Kennedy suffered from se*vere head trauma, which caused internal hemor*rhaging. She was declared brain-dead and died six days later.

Prosecutor Dale Cox called four deputies from Caddo Correctional Center to testify. Each had either been threatened by Jordan or had helped restrain him after violent outbursts there. Deputy Tony Dickey testified Jordan was the “most violent” inmate he had ever seen while working at CCC. Dickey also said Jordan “claimed he was suicidal,” which prompted a move to the center’s mental watch unit.

Cox countered, asking Dickey if he believed Jordan was incompetent. Dickey said he didn’t, that “we’ve had intelligent conversations before, he knew more than I did sometimes.”

Deputy Davis Romero, also apart of an emergency response team that responded to incidents involving Jordan, elaborated in his testimony.

“He frequently spitted on deputies,” Romero said, adding that Jordan’s behavior even led to policy changes. “Every eight hours we had to shake down (his) cell.”

Deputy Jacob Bergren also said he was threatened and spat on, necessitating a trip to the hospital, and was taunted by the accused on his way into court.

He testified that on the way into the courtroom minutes earlier, Jordan said “Oh, you’re going to court today, I’ll see you there...” finishing with a curse word. A curse word also accompanied a taunt aimed at Deputy Christene Stephenson, who said Jordan had told her “I hope you die,” accompanied threats to her and her family.

The penalty phase of the trial resumes today at 9:30 a.m. in Pitman’s courtroom, where character witnesses are expected to speak on Jordan’s behalf.

“It’s not a crime of gain,” Goins said. “He gained nothing from killing his little girl.”

Convicted Baby killer leaves court during penalty phase

Convicted baby killer Samuel Jordan was not in court Monday morning for the second day of sentencing deliberations. In court his attorney explained a request was made out of concern that Jordan might become agitated and "act out" in court as the defense calls witnesses to the stand.

A mental health specialist that helped Jordan in his teenaged years called him a "very defiant teen who disobeyed orders on several occasions both at school and at home." Jordan was reportedly taking medication, and became "a very different person" when he didn't take it.

Jordan was convicted Saturday of first degree murder for the death of his 8 week old son. The jury continues to decide between life in prison or the death penalty. Defense attorneys are focusing on ruling out the death penalty, rather than contesting Jordan's conviction.

The defense team is trying to prove Jordan suffers from a disorder known as fetal alcohol syndrome. Testimony given Monday addressed how Jordan's biological mother allegedly used drugs and alcohol while Jordan was still in the womb.

The woman who adopted Jordan at only one month old, Ella Lowe, said from a very early age she noticed something wasn't right. In a tearful plea to the jury Lowe said "I know he has to pay for what he did, but I ask y'all (the jury), the Lord and the Judge not to take his life."

Testimony is expected to continue on Tuesday morning at 9:30am at the Caddo Parish Courthouse.

The Caddo Parish jury charged with deciding the fate of a local man found guilty of killing his eight-week-old daughter, was unable to find consensus for the death penalty. The default sentence will instead be life in prison.

Deliberations began just before 5:50 p.m. and ended just after 9:30 p.m. to determine whether or not Samuel Lee Jordan would face the death penalty in the slaying.

The jury was unable to reach a unanimous decision, according to District Attorney Charles Scott, meaning Jordan will serve the default sentence of life in prison without the possibility of parole.

"We certainly respect the decision of the jury, and we will continue from here," said Scott.

He said a formal sentencing hearing has been set for Aug. 7.

    SHREVEPORT, LA (KSLA) -
Samuel Lee Jordan was sentenced Tuesday to life in prison without the possibility of probation or parole for the 2008 murder of his 8 week old daughter, Lyrica.

A jury convicted Jordan with first degree murder in late July, but the penalty phase of the trial resulted in a hung jury. The Caddo Parish District Attorney's office sought the death penalty for Jordan, but jurors were unable to reach a unanimous verdict on Jordan's punishment.

First Assistant Caddo District Attorney, Dale Cox considers this trial a failure on his part despite having convinced the jury to convict Jordan. "I think I'll always be haunted by this case because I really do believe I failed the baby. The only true and just verdict in this case would have been the death penalty, based on the agony that this 8 week old baby suffered at his hands. I take it as a failure that I was unable to convince the jury to kill him. So it will haunt me," said Cox.

Before Caddo Judge Pittman read the sentence on Tuesday, Samuel Jordan was called out for showing the middle finger to the District Attorney's office. The judge said that gesture was just another instance of what the jury had already seen during the trial.
