    Clyde Gibson to be sentenced in third murder case

    NEW ALBANY, Ind. — The sentencing phase began Monday for William Clyde Gibson in the murder of Stephanie Kirk.

    Opening statement in the sentencing phase began Monday morning with Chief Deputy Prosecutor Steve Owen's opening.

    At the start of his trial in early June, Gibson pleaded guilty.

    That means Judge Susan Orth will decide his fate in the case, which could be a death sentence, life without parole or a sentence of years in prison.

    Police found Kirk's body buried in Gibson's backyard in New Albany after he was arrested in the death of Christine Whitis.

    The sentencing phase will consist of opening statements, then the state will present evidence about aggravating factors. Next, the defense will present its case and mitigators. Closing arguments will follow.

    Then, each side has 7-10 days to file briefs.

    Once received, Orth will set a hearing 7-10 days later and decide the sentence.

    Orth said on Monday that she expected to determine Gibson's fate at a hearing somewhere around Aug. 18-20.

    Gibson received the death penalty in the Whitis case and a 65-year sentence for killing Karen Hodella.

    Defense portrays serial killer as remorseful addict with rough childhood

    NEW ALBANY, Ind. — Defense attorneys used the second day of William Clyde Gibson's penalty hearing to paint the serial killer as a remorseful addict with a rough childhood.

    Gibson's oldest sister and his ex-wife both took the stand and testified he was an alcoholic.

    Sister Brenda Ray said Gibson was devastated by their mother's death in January 2012 and his drinking only got worse after that.

    She also said they grew up in a strict household with a father who could be verbally abusive.

    Gibson confessed to strangling Stephanie Kirk in March 2012 and burying her in his backyard.

    The defense reminded the court if he hadn't admitted this to police, Kirk would still be missing, but the prosecution argued that nothing could mitigate what Gibson did.

    “There's certain actions in our society that demand certain punishment and that's why we're seeking the death penalty,” said Floyd County prosecutor Keith Henderson.

    A psychologist will be the final witness to take the stand Wednesday.

    Gibson has already been convicted of two other murders and received the death penalty for one and 65 years in prison for the other.

    Image of Clyde Gibson's death row tattoo released as sentencing hearing continues


    An image of a serial killer's controversial tattoo he got while on death row has been released for the public to view.

    A corrections officer testified about the image at Clyde Gibson's penalty hearing.

    Over the past three days more information about Stephanie Kirk's murder has been released; since there was no trial, just Gibson's guilty plea.

    Prosecutors have argued for death in Gibson’s third and final murder case, but Judge Susan Orth can also sentence him to life without parole or a number of years in prison.

    Kirk's father sat through every minute of the often graphic details and disturbing pictures.

    "It's been horrible. How else could you describe it?" Tony Kirk said.

    Tony Kirk said he didn't have a choice, he needed to know what happened to his daughter.

    Stephanie Kirk was strangled, sexually assaulted and buried in a hole in Gibson's New Albany backyard.

    "It's something I needed to do for Stephanie," Tony Kirk.

    In court Wednesday, he listened as Gibson's defense team called its final witness, a psychologist who deemed Gibson competent to stand trial two years ago.

    Dr. Heather Henderson-Galligan also diagnosed him with bipolar disorder, alcohol-dependence, polysubstance dependence and personality disorder. She also found he had some impairment in reality testing and communication.

    A defendant can't be sentenced to death if mentally incompetent.

    "Clearly no one says that's the case here. In fact, I'd argue this defendant is very smart. There's nothing at all that shows he's mentally incompetent. The issue the defense puts forth is whether or not there's any mental defect and that's not the standard as far as levying capital punishment," said Floyd County Prosecutor Keith Henderson.

    Gibson had been silent through the hearing until Wednesday.

    During the prosecution's cross-examination, he blurted out, "What are you going to do? Kill me again?"

    The psychologist attributed the outburst to his mental health.

    "I guess that's impulsivity at its best," Henderson said.

    Prosecutors said it's right in line with the tattoo Gibson got after his first murder conviction, which Death Row Times 3.

    They believe it's Gibson's way of flaunting his crimes.

    Last fall, a jury sentenced him to death for killing Christine Whitis.

    In March, Gibson got 65 years in prison for the murder of Karen Hodella.

    "That's an evil person. You want to see what evil looks like, look at the news because that's the face of evil right there," Tony Kirk said.

    Tony Kirk said it's been a long and stressful two years, but he's beginning to see some light as the conclusion of the case nears.

    The prosecution will have one final rebuttal witness Thursday before going into closing arguments.

    The judge will hand down her sentence in mid-August.

    Since he is so proud of his tattoo the state should oblige him with a second death sentence and then force him to amend his tattoo to Death Row X 2. Another poster boy for the DP.

    Slain woman's father wants 2nd death sentence for Indiana man convicted in 2 other killings

    A slain southern Indiana woman's father wants a death sentence for the man who admitted killing her and burying her body.

    Four days of testimony ended Thursday on whether a judge should give William Clyde Gibson III the death penalty for the strangulation death of 35-year-old Stephanie Kirk of Charlestown. Her remains were found buried behind his New Albany home in 2012.

    Gibson's already been given the death penalty for killing a 75-year-old family friend and a 65-year sentence for the stabbing death of a 44-year-old woman.

    Tony Kirk told reporters he believed Gibson should die for killing his daughter.

    Defense attorney Patrick Biggs argued a second death sentence for Gibson is unnecessary and cited his history of alcoholism and bipolar disorder.

    The judge set Gibson's sentencing for Aug. 15.

    NEW ALBANY, Ind. — A Floyd County judge sentenced serial killer William Clyde Gibson to death in a second case.

    Last month, prosecutor Keith Henderson urged the ultimate punishment for the murder of Stephanie Kirk, calling Gibson "the worst of the worst."

    Gibson pleaded guilty in Kirk’s death, giving Judge Susan Orth the task of deciding his fate.

    Kirk's body was found in Gibson's backyard.

    She'd been strangled and sexually assaulted.

    Gibson was already on death row for the 2012 murder of his mother's best friend, Christine Whitis.

    He also received a 65-year prison sentence after pleading guilty to the cold-case murder of Karen Hodella.

    Any idea on whether this execution has been stayed yet? It's set for November 26th 2014, and I don't see anything in the news about this case...

    Gibson just received his second death sentence. He still has all of his appeals. Some states set execution dates the day of sentencing.
