    Pakistans Top Court Accepts Appeal by Daniel Pearls Family

    Pakistans Supreme Court on Monday accepted an appeal by the family of slain American journalist Daniel Pearl seeking to keep a British-born Pakistani man on death row over the beheading of the Wall Street Journal reporter.

    The court delayed until next week hearing the appeal over the lower-court acquittal of Ahmed Omar Saeed Sheikh, who had been on death row since his conviction in 2002 over Pearls killing.

    Sheikh had been convicted of helping lure Pearl to a meeting in the southern Pakistani port city of Karachi in which he was kidnapped. Pearl had been investigating the link between Pakistani militants and Richard C. Reid, dubbed the Shoe Bomber after trying to blow up a flight from Paris to Miami with explosives hidden in his shoes.

    The lower courts April ruling acquitted Sheikh and three other accomplices, who had been sentenced to life in jail for their role in the plot. The lower court found Sheikh guilty on a single lesser charge of abduction, which he is also appealing.

    The acquittal stunned the U.S. government, Pearls family and journalism advocacy groups.

    We felt like (it was) a thunderstorm that is about to reopen our pains of 2002, Pearls father Judea Pearl told The Associated Press in an email Monday. Pakistans judicial system caved to either inside or outside pressure to send a message of impunity to extremist elements worldwide.

    The Pearl familys lawyer, Faisal Siddiqi, said after Mondays court hearing that there was ample evidence to overturn Sheikhs appeal and return him to death row.

    There is eyewitness evidence, there is forensic evidence, there are confessional statements, Siddiqi said.

    Among the confessional statements is a handwritten, July 19, 2019 letter by Sheikh that acknowledged his involvement in Pearls killing, Siddiqi said. In the letter, Sheikh said his involvement in Pearls death was a relatively minor one. However, Siddiqi said Sheikh implicates himself in Pearls killing with that admission.

    Sheikhs lawyer, Mahmood Shaikh, told the AP he suffered a heart attack while arguing the case in the lower court, but remained confident the acquittal would stand.

    I have no doubt in my mind, Shaikh said. He said his doctors ordered him to remain on bed rest for the next two weeks, throwing into question whether the Supreme Court hearing will happen next week.

    The Sindh provincial government also is appealing Shiekhs acquittal.

    Pearl, 38, of Encino, California, was abducted Jan. 23, 2002. In Sheikhs original trial, emails between Sheikh and Pearl presented in court showed Sheikh gained Pearls confidence sharing their experiences as both waited for the birth of their first child. Pearls wife Marianne Pearl gave birth to a son, Adam, in May 2002.

    Evidence entered into court accused Sheikh of luring Pearl to his death, giving the American journalist a false sense of security as he promised to introduce him to a cleric with militant links.

    Pakistani police sought to locate Pearl for weeks until a video received by U.S. diplomats showed his beheading.

    The 2019 letter by Sheikh was not among the evidence heard by the lower court that in April acquitted Sheikh on a number of charges, including the most serious of the kidnapping for ransom that lead to Pearls slaying.

    The 2019 letter is only one (piece of) evidence to something that we knew all along, without any doubt, that Sheikh lured Danny into the abduction trap which led to his murder, Pearls father Judea said. We had copies of a long email exchange he had with Danny, using a pseudonym Bashir, was which was downloaded from Dannys computer.

    An investigation by students of Georgetown University in Washington implicated Khalid Sheikh Mohammed, the alleged mastermind of the 9/11 terrorist attacks in the United States, in Pearls death. Mohammed has been in U.S. custody on Guantanamo Bay since his arrest in Pakistan in March 2003.

    Pearls father said he has received assurances from the U.S. State Department that it was closely following Sheikhs acquittal and subsequent appeals. The trials outcome could impact relations between the two countries and again paint Pakistan as a haven for militants and extremists, he said.

    The U.S. Embassy in Islamabad did not immediately respond to a request for comment.

    LHC acquits Christian man on death row for blasphemy

    The Lahore High Court (LHC) has acquitted a Christian man who spent about 7 years in jail on the accusation of blasphemy, a charge that led to communal rioting that saw more than 120 houses in a Christian-majority area in Lahore city burned down by an enraged mob in 2013.

    Sawan Masih, 40, was arrested in 2013 on blasphemy charge following an argument with a Muslim man in Lahore.

    A 2-member bench of the high court the other day acquitted Masih of all charges, with a full verdict detailing the reasons for the acquittal to be issued at a later date.

    Masih was convicted and sentenced to death under blasphemy laws by a lower court in 2014. The court had convicted him for insulting Holy Prophet (Peace Be Upon Him), a charge that carries the death penalty under law.

    In 2013, a day after the accusations against Masih surfaced, a mob attacked his Christian-majority neighbourhood of Joseph Colony, in Lahores Badami Bagh area, in what was then one of the worst incidents of violence around the blasphemy laws.

    More than 120 homes were burned down, in addition to a church and several shops, as hundreds of protesters armed with sticks, pipes, and stones ransacked the colony before setting it on fire.

    Rawalpindi - A court on Thursday awarded death penalty to a man for the rape of a five-year-old girl.

    The Additional District and Sessions judge Jahangir Ali Gondal sentenced Munir Ahmed to death for the crime committed in January 2020 in Ratta Amral, the limits of Police Station Ratta Amral.

    The court also imposed fine of Rs500,000 besides ordering him to pay Rs500,000 as compensation to the victim family. The accused had lured the girl away from her house on the pretext of giving her chocolates and had raped her, according to police. The father of girl got registered a rape case against the accused while police held him.

    “This court held Munir guilty of the charges of rape and sentenced him to death,” said a prosecution lawyer.

    Meanwhile, City Police Officer Muhammad Ahsan Younas has lauded the court verdict saying Rawalpindi police have been adopting a zero tolerance policy against accused involved in child abuse cases. He said the legal wing of police under supervision of SSP Investigation Muhammad Faisal Kamran had produced ample proofs against accused before court.

    Separately, an anti-terrorism court special judge had rejected pre-arrest bail of an accused involved in demanding extortion while impersonating official of anti-graft body and OGRA from owner of a petrol agency at Girja Road.

    Anti-Terrorism Court Number 1 Special Judge Shaukat Kamal Dar has dismissed bail application of Imran Mani and ordered police to arrest him.

    Saddar Bairooni police had booked Imran Mani along with three of his accomplices on offences of torturing and demanding extortion from Raja Ikram Ul Haq the owner of Petrol Agency while impersonating officers of Anti-Corruption Department and OGRA.

    Chaudhry Asad Umer Advocate appeared before the court on behalf of applicant and argued that Imran Mani along with his gang is involved in collecting extortion from traders under garb of media men and officers of OGRA and anti-corruption department.

    He added the gang is notorious and was involved in a series of crimes of similar nature. He pleaded the court to cancel his pre-arrest bail application.

    The defence lawyer opposed the arguments of prosecution saying his client was innocent and the court should drop the provision of extortion offences from the case. He pleaded the court to grant his client bail.

    After conclusion of arguments of both parties, ATC No 1 Special Judge Shaukat Kamal Dar rejected the pre-arrest bail of Imran Mani and ordered police to arrest the accused.

    ISLAMABAD: The Supreme Court (SC) on Thursday ordered to release a person convicted of death sentence due to insufficient evidence and faulty investigation.

    A three-member bench of the apex court, headed by Justice Manzoor Malik and comprising Justice Mazhar Alam Khan Miankhel and Justice Amin-Ud-Din Khan, conducted hearing of an appeal against the high court judgment in a murder case.

    Accused Muhammad Ishaq was accused of killing his wife. The trial court awarded capital punishment to Muhammad Ishaq over alleged murder of his wife in 2008 in Layyah, while the high court commuted the death sentence into life imprisonment.

    During the course of proceedings, the counsel for the victim said that accused Ishaq stabbed his wife to death. Accused Ishaq and Razia Bibi were married for only two months, he added.

    The counsel for the accused said that false murder case was registered against the accused as Razia Bibi fell and got injured.

    There was no witness to this incident, he added.

    Justice Manzoor Malik said that it seemed that the victim's brother and father were made witnesses. False witnesses were made in such cases, he added.

    Sialkot lynching: Police books key suspect, 800 others under ATA

    The police have arrested a prime suspect and booked at least 800 people under the Anti-Terrorism Act (ATA) a day after a mob tortured a Sri Lankan man, employed as a manager in a factory on Wazirabad Road, Sialkot, to death and set his body on fire.

    The police said Farhan Idrees, the key suspect, has been detained. They said hundreds of people armed with sticks and batons were present inside the factory at the time of the murder of the foreign national, Priyantha Kumara.

    After the murder, the mob dragged his body on the streets, the police said, adding that it failed to stop the crowd due to a lack of strength.

    As per the initial investigation, the police said that the Sri Lanka citizen was killed over allegations of blasphemy. They added that they were investigating the matter from all angles.

    Meanwhile, an initial report of the incident has been submitted to Prime Minister Imran Khan by the Punjab Police. As per the report, at least 112 suspects have been detained who were identified with the help of the factory managers. The provocateurs have been arrested as well.

    The detained suspects have been moved to unknown locations, they said, adding that investigation was still underway.

    Separately, the body of the deceased has been handed over to the police after post-mortem for legal formalities.

    In a statement, cleric Mufti Taqi Usmani condemned the killing of the foreign national over blasphemy allegations. He said blasphemy was a “grave crime” but the evidence to prove the blasphemy charges must be beyond doubt.

    The Sialkot incident has tarnished the image of Pakistan and Muslims across the world, he added.

    Court Awards Death Penalty In Murder Case

    Additional District and Session Judge, Anjum Raza Syed on Friday awarded death sentence to a man in a murder case of Jhal Chakiyan police limits.

    According to prosecution ,on December 2,2020 accused Asad along with his two accomplices Shehriyar and Muhammad Iqbal had gunned down Ramzan over a minor dispute.

    Local police registered a case against the accused and presented challans in the court for trial.

    After completing arguments, the learned judge awarded death sentence to Asad along with fine Rs 200,000 as compensation money while acquitted Shahriyar and Iqbal on the benefit of doubt.

    The culprit was shifted to Sargodha Jail.

    Pakistani judge sentences Christian to death

    A Pakistani Christian has been sentenced to death for blasphemy against the Prophet Muhammad. Authorities plan to execute him by hanging in the coming weeks. Zafar Bhatti has languished in prison since his arrest in 2012. His legal defense will appeal the ruling.

    In 2017, courts sentenced Bhatti to life in prison. But earlier this month, a judge appealed to a 1991 law prescribing the death penalty for those who blaspheme Muhammad.

    A flimsy case

    However, Nehemiah with FMI says the case against him doesnt hold up. In July 2012, a local Islamic leader filed a complaint in Rawalpindi, saying he had sent messages from an unregistered phone number insulting the Prophet Muhammads mother. They tortured him to extract a confession but he insisted on his innocence. No forensic evidence exists for any blasphemy by Bhatti. In fact, every piece of physical and electronic evidence suggests he is innocent.

    Before his arrest, Bhatti led a small ministry, serving those in deep poverty and praying with people in their homes. But these actions caught the attention of local Muslim leaders.

    Bhatti has suffered terrible mistreatment while in prison. Nehemiah says, Zafar experienced pressure from other Muslim prisoners to convert to Islam and has been beaten several times. On March 31st, 2013, his food was poisoned, which caused bleeding from the nose and mouth. It left him in a critical condition for days.

    Pray for Bhatti, his wife, and his extended community. Nehemiah says, Pray he would experience a deep peace and joy that comes from knowing Jesus as well as the courage and power that comes from the Holy Spirit.

    A special anti-terrorism court (ATC) has sentenced a ruthless suspect to death 4 times after he was found guilty of killing his wife and 3 children.

    The Karachi-based special ATC convicted Manan alias Bengali, accused of killing his wife and 3 children, and sentenced him to death 4 times.

    A fine of Rs100,000 has also been imposed on the accused. The court, however, acquitted 2 co-accused Asif and Yusuf by giving them the benefit of doubt. Public Prosecutor Ghulam Abbas had argued that accused Manan Bengali had killed his wife and 3 minor children in 2017.

    It was victim Rabia's 2nd marriage with the accused. A case was registered against the accused at Iqbal Market police station on the complaint of the victim's father.

    Remand extended


    Meanwhile, the South Judicial Magistrate has extended the remand by 5 days of the man accused in the murder case of a businessman - Veer Bhan - who was killed during a robbery.

    The Magistrate directed the investigation officer to submit a progress report. A case of murder of a Hindu businessman during a robbery was heard before the court of South Judicial Magistrate in Karachi City Court.

    Upon completion of physical remand, the police produced the main accused in court. The court further extended the physical remand of the accused for five days.

    The court sought a progress report from the IO at the next hearing. According to police, the accused had killed 35-year-old Veer Bhan while robbing him of Rs7.3 million.

    The arrested suspect remained inside the bank along with his accomplices while Veer Bhan was withdrawing money. Money snatched in the incident was also recovered from the possession of the accused. South police are conducting raids to nab other accomplices of the accused. The same group is also involved in committing a robbery outside a bank in Gizri area.

    Pakistan: 6 Death sentences over killing of Sri Lankan accused of blasphemy

    Six men have been sentenced to death over the mob killing of a Sri Lankan man accused of blasphemy in Pakistan.

    Priyantha Diyawadanage, 48, a factory manager in the city of Sialkot, was beaten to death and his body set alight last December.

    Of 88 people convicted, nine were given life sentences and the others jail terms of two to five years.

    The case shocked the country and was described as "a day of shame" by the then Prime Minister Imran Khan.

    Videos of the lynching on social media showed scenes of the incensed crowd dragging Mr Diyawadanage from his workplace and beating him to death.

    They then burnt his body, with several people seen in the crowd taking selfies with his corpse.

    The victim's wife, Nilushi Dissanayaka, described how she had seen him "being attacked on the internet... it was so inhumane".

    What led to the mob violence?

    The violence had begun after rumours spread that Mr Diyawadanage had allegedly committed a blasphemous action, in tearing down posters with the name of the Prophet Muhammad.

    But a colleague, who rushed to the site in a bid to save him, told local media at the time that Mr Diyawadanage had only removed the posters as the building was about to be cleaned.

    The scale of the vicious killing - involving hundreds of people - shocked the nation and sparked vigils.

    Blasphemy is defined as speaking insultingly about a particular religion or god. In Pakistan, it can carry a potential death sentence for anyone who insults Islam.

    The country's blasphemy law prohibits disturbing a religious assembly, trespassing on burial grounds, insulting religious beliefs or intentionally destroying or defiling a place or an object of worship.

    Making derogatory remarks against Islamic personages is an offence - and in 1982, a clause prescribing life imprisonment for "wilful" desecration of the Quran, the Muslim holy book, was added.

    In 1986, a separate clause was inserted to punish blasphemy against the Prophet Muhammad and the penalty recommended was "death, or imprisonment for life".

    In Pakistan, even unfounded accusations can incite protests and mob violence against alleged perpetrators. Human rights critics have long argued that minorities are often the target of accusations.
