    Judge sets fall trial date in death penalty case


    A tentative trial date has been set for a Micah Crofford Brown of Greenville charged in the shooting death of his ex-wife.

    Brown has pleaded not guilty to allegedly murdering Stella Michelle Ray, despite admitting to the crime, according to authorities. If convicted, he could face the death penalty.

    Ray, a teacher at Caddo Mills ISD, was shot and killed last summer in a believed custody dispute.

    Trial for Brown will begin November 1. He remains jailed on $1.5 million bond.

    Jury pool ordered for Micah Brown capital murder trial

    The trial of a Greenville man, charged with capital murder in connection with the shooting death of his ex-wife, will formally begin one month from today.

    A state district judge Tuesday ordered the assembly of a jury pool on March 27 in the case of Micah Crofford Brown. During a pretrial hearing in the 354th District Court, Judge Richard A. Beacom called for 400 potential jurors to be summoned to appear on that date.

    The questioning of individual jurors is scheduled to begin on April 1.

    Prosecutors have announced they intend to seek death by lethal injection as a punishment for Brown, should he be convicted of capital murder involving the death of Stella Michelle “Doc” Ray. Brown has pleaded not guilty.

    Ray, a Caddo Mills school teacher, was shot and killed in Greenville.

    Brown, 33, remains in custody at the Hunt County Jail in lieu of $1.5 million bond. Authorities say Brown has confessed to shooting Ray, 36, of Greenville on the night of July 20, 2011 as the two argued over a custody dispute.

    The capital murder indictment alleges Brown committed the murder while also committing family violence and “in the course of committing or attempting to commit terroristic threat.”

    A start of testimony has not yet been set, but prosecutors have begun issuing subpoenas for witnesses to appear in the pending trial of a Greenville man, charged with capital murder involving a 2011 shooting death.

    Hunt County District Attorney Noble D. Walker Jr. Thursday issued 79 subpoenas for witnesses to testify in the trial of Micah Crofford Brown, charged in connection with the death of Stella Michelle “Doc” Ray. Brown has pleaded not guilty.

    Jury selection in the case began March 27. It was unknown if a jury had been chosen, and a date for the start of testimony had not been scheduled as of Friday.

    GREENVILLE — The start of the capital murder trial of a Greenville man, charged with the 2011 shooting death of his ex-wife, a Caddo Mills school teacher, has been set.

    Opening arguments and the start of testimony in the trial of Micah Crofford Brown are scheduled May 20 in the 354th District Court. Brown has been indicted on one count of capital murder in connection with the death of Stella Michelle “Doc” Ray. Brown has pleaded not guilty.

    Hunt County District Attorney Noble D. Walker Jr. has issued 79 subpoenas for witnesses to testify for the prosecution during the trial.

    Jury selection in the case began March 27 and concluded Thursday. A third pool of potential jurors had been called for Monday, May 13, although that panel has been cancelled. The jury pool which had been summoned for the 354th District Court for May 20 has also been cancelled.

    Testimony begins in Brown capital murder trial

    Stella Michelle “Doc” Ray was already a teacher for the Caddo Mills Independent School District two years ago, but had just earned her doctorate degree and was planning on taking a professorship at a college in Marshall.

    Her mother, Donna Ray, recalled that Stella was planning to stop by her Greenville residence on the night of July 20, 2011, the day before she was to move to Marshall. Donna Ray said she fell asleep and was awakened by a phone call from Stella’s ex-husband, Micah Crofford Brown.

    “He said, ‘I shot her in the head and she’s dead,’” Donna Ray said, as one of the first witnesses in Brown’s trial on a charge of capital murder.

    Donna Ray said she was in the emergency room at Hunt Regional Medical Center when she received another call.

    “It was Micah and he said, ‘See, I told you,’” Donna recalled.

    Opening arguments and the start of testimony were conducted Monday during the first day of trial in the 354th District Court.

    Testimony is scheduled to resume today. Judge Richard A. Beacom told jurors the trial is expected to take through next week.

    Brown was indicted on one count of capital murder in connection with the shooting death of Stella Ray and has pleaded not guilty.

    However, Brown’s defense counsel, Toby Wilkinson, said there was no doubt as to whether Brown shot and killed Ray.

    “This is not a who done it case,” Wilkinson said during his side of opening arguments. “This young man did it. This is a why did it case. Why did he do it?”

    Wilkinson placed the blame for the killing on Ray, claiming there were two sides to the victim.

    “To some people I’m sure she was wonderful,” Wilkinson said. “To others she was not.”

    Wilkinson said the shooting came as the result of a dispute between Brown and Ray concerning the couple’s two small children, who were inside the PT Cruiser Ray was driving on the night she was killed.

    “She pushed his buttons and unfortunately it turned out bad for her,” Wilkinson said. “She didn’t let him know where the kids are.”

    Prosecutors have announced they intend to seek death by lethal injection as a punishment for Brown, should he be convicted of capital murder.

    The prosecution rested its case Wednesday afternoon in the capital murder trial of a Greenville man, charged in the 2011 shooting death of his ex-wife, a Caddo Mills school teacher.

    The defense in the trial of Micah Crofford Brown will begin presenting its case when the trial resumes this morning in the 354th District Court.

    Brown has been indicted on one count of capital murder in connection with the death of Stella Michelle “Doc” Ray. Brown has pleaded not guilty.

    However, Brown’s defense counsel, Toby Wilkinson, said during opening arguments Monday there was no doubt Brown shot and killed Ray in Greenville on the night of July 20, 2011.

    Prosecutors have announced they intend to seek death by lethal injection as a punishment for Brown, should he be convicted of capital murder.

    Brown, 33, remains in custody at the Hunt County Jail in lieu of $1.5 million bond and has allegedly confessed to the shooting to investigators.

    Ray, 36, from Greenville, was shot and killed as a result of a domestic dispute between her and Brown concerning custody of their two small children. The toddlers were reported to have been riding in Ray’s car at the time Brown allegedly killed their mother.

    Hearing set in death penalty capital murder case

    A hearing is scheduled next week concerning an appeal of the capital murder conviction and death penalty sentence of Micah Crofford Brown.

    A bench warrant has been issued to return Brown from state prison to the custody of the Hunt County Detention Center. Brown had not been placed in local custody as of Tuesday afternoon.

    A status hearing concerning the appeal which had been scheduled July 1 but was not conducted, due to an elevator fire which forced the evacuation of the Hunt County Courthouse.

    A hearing is now set in the 196th District court on Jan. 5.

    Brown of Greenville, was convicted in May 2013 and sentenced to death by lethal injection in connection with the 2011 murder of Stella Michelle “Doc” Ray. He does not yet have an execution date scheduled.

    The Texas Court of Criminal Appeals has upheld the conviction and sentence, but a separate post conviction writ was filed by the Office of Capital Writs, listing multiple alleged issues with Brown’s conviction and sentence, including ineffective assistance by the trial and appeals defense attorneys, improper arguments by prosecutors during the punishment phase, and failure to present evidence during the punishment phase that Brown suffers from an Autism Spectrum Disorder, which may have mitigated the jury’s decision to issue the death penalty.

    The First Administrative Judicial Region has appointed 196th District Court Judge J. Andrew Bench to oversee the proceedings.

    Hearing next month in death penalty capital murder case

    A hearing is scheduled next month, concerning an appeal of a Hunt County death penalty capital murder case.

    Micah Crofford Brown of Greenville was convicted and sentenced to death by lethal injection in connection with the murder of Stella Michelle “Doc” Ray.

    In September of last year, the Texas Court of Criminal Appeals denied one appeal filed in the case.

    But a separate post conviction writ was filed in January 2015 on Brown’s behalf with the 354th District Court by the Office of Capital Writs, a capital post-conviction state agency charged with representing death sentenced persons in state post-conviction habeas corpus and related proceedings.

    The 124-page document listed multiple alleged issues with Brown’s conviction and sentence, including ineffective assistance by the trial and appeals defense attorneys, improper arguments by prosecutors during the punishment phase, and failure to present evidence during the punishment phase that Brown suffers from an Autism Spectrum Disorder, which may have mitigates the jury’s decision to issue the death penalty.

    After Judge Richard A. Beacom recused himself from the case, Judge Mary Murphy with the First Administrative Judicial Region appointed 196th District Court Judge J. Andrew Bench to oversee the proceedings, with a hearing concerning the evidence scheduled for April 28.

    Brown was convicted of capital murder and received the death penalty in May 2013. He does not yet have an execution date scheduled.

    An appeal is automatic in capital murder cases.

    Ray was shot and killed in Greenville on the night of July 20, 2011 as the result of a domestic dispute between her and Brown.

    Prior to the murder Ray, 36, from Greenville, had been working as a school teacher in Caddo Mills but at the time of her death had just completed a doctorate program at Texas A&M University-Commerce, and was moving from Greenville the next day to take a job teaching at a college in Marshall.
