    Brown described as model inmate

Employees of the Hunt County Jail Wednesday described Micah Crofford Brown as a model inmate who has caused no problems during his almost two-year stay inside the facility.

And a psychologist who examined Brown testified the defendant showed no violent tendencies prior to murdering his ex-wife, Stella Michelle “Doc” Ray, in July 2011.

“He had no history of violent behavior until the shooting,” said Dr. Paula K. Lundberg-Love, the final witness to testify Wednesday during the second day of a punishment hearing for Brown, who has been convicted of capital murder in connection with Ray’s death.

The jury in the 354th District Court which delivered the guilty verdict will decide whether Brown will be sentenced to life in prison without the possibility of parole or receive death by lethal injection.

The punishment hearing is scheduled to resume this morning, with testimony expected from at least one more defense witness addressing “mitigation” factors, or reasons why Brown should not receive the death penalty.

Following the conclusion of all witness testimony, and the presentation of any rebuttal witnesses, attorneys for both sides will present closing arguments before the jury receives the case to decide punishment.

Hunt County Sheriff Randy Meeks and two jail employees were among the witnesses testifying during the morning session Wednesday.

Love, a professor of psychology at the University of Texas at Tyler, testified during the entire afternoon session, noting she was asked to perform a “psychopharmacological assessment” on Brown.

“To look at the history of his drug use, abuse,” she said.

Brown had been using various substances — including cocaine, methamphetamine, marijuana and alcohol — off and on since the age of 18, including prior to the shooting.

Ray, 36, from Greenville, was shot and killed in Greenville on the night of July 20, 2011.

Ray had been working as a school teacher in Caddo Mills but at the time of her death had just completed a doctorate program at Texas A&M University-Commerce and was moving from Greenville the next day to take a job teaching at a college in Marshall.

Jury returns death sentence for Micah Crofford Brown

A jury in the 354th District Court Friday returned a sentence of death by lethal injection for Micah Crofford Brown, who was convicted on a charge of capital murder one week ago involving the July 20 2011 shooting death of Stella Michelle "Doc" Ray, his ex-wife.

Judge Richard A. Beacom has set formal sentencing for Brown for 11 a.m. Monday.

“The brutality of Stella’s murder, as well as several contributing aggravating factors, had to have contributed to the jury reaching it’s verdict," said District Attorney Noble D. Walker Jr. "I’m also very appreciative for Stella’s family and many friends who have remained very involved in this case since July 2011.”

Micah Crofford Brown formally sentenced to death by lethal injection

    By BRAD KELLAR
    The Herald-Banner

GREENVILLE — Micah Crofford Brown was formally sentenced Monday morning to death by lethal injection for the July 20, 2011 shooting death of Stella Michelle "Doc" Ray. An appeal is automatic in the case.

Cindy Ray Kemp, Ray's sister, released the following statement Friday afternoon, after a jury sentenced Brown to the death penalty:

“After hearing all sides of this case, Doc is my Hero. She protected her children, all three not just the two in her car. On behalf of the Ray family we would like to thank all that brought the light forward. We pray for the Brown family and we pray for Micah’s soul. The trial is over but the suffering is not. We’ve got three children who will never have their mother again. However, by the Grace of God, we know He will carry us through all these things.”

Hearing next month in death penalty capital murder case

A hearing is scheduled next month, concerning an appeal of a Hunt County death penalty capital murder case.

Micah Crofford Brown of Greenville was convicted and sentenced to death by lethal injection in connection with the murder of Stella Michelle “Doc” Ray.

In September of last year, the Texas Court of Criminal Appeals denied one appeal filed in the case.

But a separate post conviction writ was filed in January 2015 on Brown’s behalf with the 354th District Court by the Office of Capital Writs, a capital post-conviction state agency charged with representing death sentenced persons in state post-conviction habeas corpus and related proceedings.

The 124-page document listed multiple alleged issues with Brown’s conviction and sentence, including ineffective assistance by the trial and appeals defense attorneys, improper arguments by prosecutors during the punishment phase, and failure to present evidence during the punishment phase that Brown suffers from an Autism Spectrum Disorder, which may have mitigates the jury’s decision to issue the death penalty.

After Judge Richard A. Beacom recused himself from the case, Judge Mary Murphy with the First Administrative Judicial Region appointed 196th District Court Judge J. Andrew Bench to oversee the proceedings, with a hearing concerning the evidence scheduled for April 28.

Brown was convicted of capital murder and received the death penalty in May 2013. He does not yet have an execution date scheduled.

An appeal is automatic in capital murder cases.

Ray was shot and killed in Greenville on the night of July 20, 2011 as the result of a domestic dispute between her and Brown.

Prior to the murder Ray, 36, from Greenville, had been working as a school teacher in Caddo Mills but at the time of her death had just completed a doctorate program at Texas A&M University-Commerce, and was moving from Greenville the next day to take a job teaching at a college in Marshall.

    By Brad Kellar
    The Herald-Banner

Another hearing is set this week concerning an appeal of the capital murder conviction of Micah Crofford Brown.

Brown remains in custody at the Hunt County Detention Center after being transferred from state prison in April.

A status hearing concerning the appeal is scheduled Friday in the 196th District Court.

Brown, 37, of Greenville, was convicted in May 2013 and sentenced to death by lethal injection in connection with the 2011 murder of Stella Michelle “Doc” Ray. He does not yet have an execution date scheduled.

The Texas Court of Criminal Appeals has upheld the conviction and sentence, but a separate post conviction writ was filed by the Office of Capital Writs, listing multiple alleged issues with Brown’s conviction and sentence, including ineffective assistance by the trial and appeals defense attorneys, improper arguments by prosecutors during the punishment phase, and failure to present evidence during the punishment phase that Brown suffers from an Autism Spectrum Disorder, which may have mitigated the jury’s decision to issue the death penalty.

Testimony ends in death penalty appeal

    By Brad Kella
    Herald-Banner

Testimony has concluded in the latest appeal in the case of Micah Crofford Brown, convicted of capital murder and sentenced to death by lethal injection in connection with the 2011 shooting death of his ex-wife Stella Michelle “Doc” Ray, a Caddo Mills Independent School District teacher.

A final decision in the case is not expected for a few more months, according to 196th District Court Judge Andrew Bench.

Both sides rested their cases Friday in the hearing after all evidence was presented related to Brown’s latest appeal.

Bench said the attorneys will now await delivery of an official transcript of the hearing, then they can review the transcript before presenting their “facts and conclusions of law.”

Bench said once those documents are presented to his court, he will schedule a hearing for both sides to present their final live arguments before he makes a ruling in the appeal.

Brown was transferred from state prison to the custody of the Hunt County Detention Center for this latest hearing, and he remained in the jail Monday.

Brown, of Greenville, was convicted in May 2013 and sentenced to death by lethal injection. He does not yet have an execution date scheduled.

Testimony during the trial indicated Ray was shot and killed in Greenville on the night of July 20, 2011, as the result of a dispute with Brown concerning the couple’s two children.

After the conviction and death sentence were upheld by the Texas Court of Criminal Appeals, a post-conviction writ was filed on Brown’s behalf in 2015 by the Office of Capital Writs, a state agency charged with representing death-sentenced persons in state post-conviction habeas corpus and related proceedings.

The 124-page document listed multiple alleged issues with Brown’s conviction and sentence, including ineffective assistance by the trial and appeals defense attorneys, improper arguments by prosecutors during the punishment phase, and failure to present evidence during the punishment phase that Brown suffers from an autism spectrum disorder, a developmental disorder that affects communication and behavior, which may have mitigated the jury’s decision to issue the death penalty.

During Brown’s capital murder trial, Ray’s mother testified her daughter had worked as a teacher for the Caddo Mills ISD for two years, and she had just earned her doctorate degree and was planning on taking a professorship at a college in Marshall.

Donna Ray said her daughter was planning to stop by her residence on the night of the murder, the day before she was to move to Marshall.

During the trial, defense attorney Toby Wilkinson stated that the shooting was the result of a dispute between Brown and Ray concerning the couple’s two small children, who were inside the PT Cruiser that Ray was driving on the night she was killed.
