    Staci Barbosa Sentenced in 2010 Murder of 6 mo. old Son

    Vandergriff, Barbosa to be tried separately

    A Superior Court judge granted a motion Thursday to sever the murder cases of two co-defendants who are charged with murdering their infant son.

    Jonathan Edward Vandergriff, 23, and Staci Lynn Barbosa, 19, are charged with first-degree murder, child abuse by domestic violence, sexual assault of a minor under the age of 15 and sexual conduct with a minor under the age of 15. The couple is charged with the death of their 6-week-old son.

    Superior Court Commissioner Derek Carlisle granted a defense motion to sever the cases, meaning both defendants will be tried separately.

    Vandergriff’s attorney, Carlene Lacy, said she will file two more motions to get the autopsy records from the Las Vegas medical examiner and to get records from the Arizona Child Protective Services. The judge set the next hearing for Sept. 22 to argue those motions.

    Deputy Mohave County Attorney Greg McPhillips also said he will decide by Monday whether to seek the death penalty against the either or both of couple. If he does not seek the death penalty, the each could face life in prison with or without the chance of parole after 35 years if convicted. Vandergriff is being held on $500,000 bond and Barbosa is being held on a $250,000 bond.

    Judge Steven Conn denied a motion Tuesday filed by Barbosa’s attorney for a new judge. Carlisle was the prosecutor in a criminal case where Vandergriff was the victim in an assault. The woman who assaulted Vandergriff could be a witness in Barbosa’s upcoming trial.

    Vandergriff pleaded guilty in 2006 to child abuse after he abused another girl when she was 10 months old. Vandergriff was sentenced to probation and jail time.

    Barbosa was arrested June 15 after she took her badly injured son, Matthew, to the Western Arizona Regional Medical Center. Vandergriff turned himself in to police officers later that day.

    Matthew suffered from bruises, broken ribs, broken femur and swollen eyes. According to medical officials, he was also malnourished and dehydrated. The infant reportedly also showed signs of sexual abuse and shaken baby syndrome.

    Matthew was later taken to a Las Vegas hospital where he died the next morning.

    Judge steps down from case

    A Superior Court judge excused himself Thursday from the case of one of the two murder suspects who are charged with killing their 1-month-old son.

    Staci Lynn Barbosa, 19, along with Jonathan Edward Vandergriff, 23, are charged with first-degree murder, child abuse by domestic violence, sexual assault of a minor under the age of 15 and sexual conduct with a minor under the age of 15.

    Barbosa’s attorney, Sandra Carr, asked Superior Court Commissioner Derek Carlisle to excuse himself from the case without cause. She previously said that Carlisle had been the prosecutor in a criminal case where Vandergriff was the victim in an assault. The woman who assaulted Vandergriff could be a witness in Barbosa’s upcoming trial.

    Attorneys are allowed only once to file a motion for a change of judge without reason. Attorneys can file a motion for a new judge with cause, or for a specific reason, as many times as they want. Carr previously filed a motion with cause to remove Carlisle from being the judge on the case. Judge Steven Conn denied that motion ruling there was no evidence that Carlisle could not be fair and impartial.

    Carlisle also said that the motion had to be filed within 10 days of a defendant’s arraignment and the motion for a new judge in Barbosa’s case was not filed in time. The judge, however, ruled that it was a clerical error and not Barbosa’s fault.

    Barbosa’s murder case will now be sent to Conn, the presiding criminal judge to be reassigned to another judge. Vandergriff’s case will remain in Carlisle’s court. Carlisle previously granted a defense motion to sever the cases, meaning both defendants will be tried separately.

    A 20-year-old Bullhead City, Ariz., mother pleaded guilty Wednesday to second-degree murder in the death of her infant son. Staci Barbosa faces a 13-to-20-year prison term when sentenced in January for the June 2010 death of 5-week-old Matthew Vandergriff.

    The boy died at Sunrise Hospital and Medical Center in Las Vegas. The Clark County coroner's office said the baby's death was the result of blunt force trauma to the head.

    Prosecutor Greg McPhillips said doctors also determined that the victim was dehydrated and malnourished and suffered a broken leg and bruises all over his body that were in various stages of healing.

    McPhillips said Barbosa's conviction relates to her failure to protect Matthew and seek medical attention for his various injuries. McPhillips contended it was Jonathan Vandergriff, the boy's father, who actually brutalized and sodomized the baby .

    KINGMAN — A Bullhead City woman was sentenced to 15 years in prison Friday afternoon for her role in the murder of her infant son in June 2010.

    Staci Lynn Barbosa, 20, pleaded guilty in October to second-degree murder. Her remaining charges, including first-degree murder, were dropped. Under the plea agreement, she could have been sentenced up to 20 years in prison.

    Barbosa’s attorney, Sandra Carr, read a letter from Barbosa, who was too emotional to read it. The letter described her life of fear and abuse living with her co-defendant, Jonathan Edward Vandergriff, who she met when she was just 15. She told of Vandergriff’s anger issues and his control of her and that he threatened to take her children if she left.

    Carr also painted a troubled picture of Vandergriff, who she said abused his younger sister when he was about 10 years old and was always in trouble as a teenager. The defense attorney also said Vandergriff assaulted his former girlfriend even breaking her ankle when he threw her down.

    Carr also said that Vandergriff did not want Barbosa’s son Matthew and once taped his mouth shut when he cried. He also allegedly abused the child physically and sexually. He refused when she wanted to take Matthew to the hospital.

    The defense attorney also pointed out other criminal cases where in one case the mother of an abused child was not prosecuted and in another, the father who left his child in a hot car received less prison time than her client.

    Deputy Mohave County Attorney Greg McPhillips argued as an aggravated factor of the cruel and heinous injuries to Matthew and that some of his injuries were not recent, since the broken bones had calcified.

    Judge Steven Conn took into account Barbosa’s age, her lack of criminal history and her minor involvement in Matthew’s death saying, there was no evidence she caused the child’s injuries. But the issue was her obligation in protecting her child over any obligation to Vandergriff. The judge also said it was difficult to compare criminal cases to each other since each case had different variables. In the end, Conn sentenced her to 15 years in prison.

    Vandergriff, 25, is still charged with first-degree murder, child abuse by domestic violence, sexual assault of a minor under the age of 15 and sexual conduct with a minor under the age of 15 for the death of their infant son. He faces life in prison with or without the chance of parole after 35 years if convicted of murder. Vandergriff’s murder case remains in limbo after recently being assigned a new attorney from Phoenix.
