    US pair charged with Bali murder could face death

    An American couple arrested on the Indonesian resort island of Bali in connection with the slaying of the woman's mother could be charged with premeditated murder, which carries a maximum penalty of death, police said Saturday.

    Heather Mack, 19, and her boyfriend, Tommy Schaefer, 21, both from Chicago, were arrested in Bali's Kuta area Wednesday, a day after the body of Sheila von Wiese-Mack was found stuffed inside a suitcase in the trunk of a taxi parked in front of the upscale St. Regis Bali Resort in the island's exclusive Nusa Dua section.

    An autopsy Saturday found that von Wiese-Mack, 62, died of asphyxiation from a broken nose bone resulting from a blunt blow, said Ida Bagus Putu Alit, head of forensics at Sanglah Hospital in Bali's provincial capital of Denpasar. She also suffered from a broken neck, Alit said.

    Mack and Schaefer were charged with murder on Friday. Col. Djoko Hari Utomo, chief of police for Denpasar, said Saturday that police had enough evidence to charge them with premeditated murder.

    He reiterated that the couple was still refusing to talk to investigators without the presence of American lawyers.

    "But that does not hamper our investigation. We have enough evidence, including CCTV and fingerprints," Utomo said. "And I am inclined to charge them with premeditated murder."

    An FBI agent arrived Friday to help with the investigation, including on the couple's possible involvement in criminal activity in the United States, Utomo said.

    The autopsy found that breaks in von Wiese-Mack's neck and nose extended to her upper right and left jaws, causing respiratory disorders, Alit said. It also showed hand wounds suggesting she was trying to fend off an attack.

    "We also found blood aspiration, which meant the victim was standing when assaulted," Alit said. "The conclusion is that the victim suffocated from lack of oxygen because of influx of blood from the broken nose bone."

    Alit said von Wiese-Mack was believed to have died Tuesday morning.

    "The victim was last spotted on CCTV at 3:45 a.m. (Tuesday), and three hours later she called receptionists asking to wake her up at 10 a.m.," Alit said. "However, she did not respond when awakened."

    Meanwhile, Bali's deputy police chief, Brig. Gen. Gusti Ngurah Raharja Subyakta, said psychological tests showed that there were no psychiatric disorders with the couple.

    Von Wiese-Mack, also from Chicago, and her daughter arrived at the St. Regis on Aug. 9, while Schaefer checked in on Monday, two days later, according to police. Security camera video showed that the victim had an argument with Schaefer on Monday in the hotel's lobby.

    Police say Mack and Schaefer placed the suitcase inside the trunk of the taxi, and asked the driver to wait while they checked out of the hotel. However, they didn't return, and hotel security guards who had found blood spots on the suitcase suggested that the driver take the taxi to a police station, where officers opened the suitcase and discovered the body.

    The couple told investigators that von Wiese-Mack was killed by robbers while they managed to escape, Utomo said.

    Authorities in an upscale Chicago suburb, Oak Park, have examined records of 86 incidents in which police were called to the house where von Wiese-Mack lived with her daughter. Friends have alleged that the mother-daughter relationship was sometimes contentious.

    Von Wiese-Mack was the widow of highly regarded jazz and classical composer James L. Mack, who died in 2006 at age 76.

    U.S. teen held after mother's body found in Bali tested for pregnancy

    Indonesian police said on Tuesday they have tested a U.S. teen, detained after the discovery of her mother's battered body in a suitcase in Bali, to see if she is pregnant and are awaiting the result.

    No charges have been brought in connection with the murder of Sheila von Wiese-Mack, 62, whose body was found in the bloodied case outside the luxury St. Regis hotel in Nusa Dua, Bali, last week.

    Her daughter, Heather Mack, 19, and boyfriend, Tommy Schaefer, 21, were arrested on Wednesday and detained as suspects.

    Bali police spokesman Hery Wiyanto told Reuters Mack had told them she was pregnant, but police were not able to confirm this.

    "We have done some tests but we have not received the result," he said. "It could be just something she says so she will be sent home."

    But extradition to have the case heard in the United States was highly unlikely, the couple's Indonesian lawyer, Haposan Sihombing, said on Monday.

    The couple have refused to speak to Sihombing, the lawyer said. They had hired a U.S. lawyer who Wiyanto said was due to arrive on Wednesday.

    Only an Indonesian lawyer is permitted to present a case to a domestic court. Suspects are not formally charged with a crime until after an investigation is completed and a trial begins. Police said the investigation, in which the FBI is assisting, could take weeks.

    Murder carries the death penalty in Indonesia.

    Police last week provided CCTV footage showing the couple speaking to a taxi driver after dropping the bloodied suitcase along with other luggage outside the hotel.

    Police said the two left, apparently to check out of the hotel, and never returned.

    They were later arrested at a nearby budget hotel.

    An official at the hospital that conducted the autopsy said von Wiese-Mack had been repeatedly hit on the face and head with a blunt object.

    Body of American woman slain on Bali to be flown to US

    The body of an American woman will be flown to the United States after her daughter and the daughter’s boyfriend were accused of killing her on the Indonesian resort island of Bali.

    The body of Sheila von Wiese-Mack was found inside a suitcase in the trunk of a taxi in front of an upscale hotel last week.

    Sanglah Hospital’s head of forensics, Ida Bagus Putu Alit, said Tuesday the body would be flown home early Wednesday on a Korean Air plane. The official didn’t identify which American city, but von Wiese-Mack is from Chicago.

    Nineteen-year-old Heather Mack and 21-year-old Tommy Schaefer have been arrested, and Indonesian police said they might be charged with premeditated murder which could carry the death penalty.

    DENPASAR, Bali - An American teenager suspected of killing her mother in Bali has been sexually assaulted multiple times in her prison cell, her lawyer claimed.

    But the 19-year-old is not sure whether it was fellow inmates or guards who assaulted her, her Chicago attorney Michael Elkin told MailOnline.

    "It is very disconcerting," he was quoted as saying. "She initially thought it was fellow inmates, but now she has discovered that not all the guards are wearing official uniform."

    Heather and her boyfriend Tommy Schaefer, 21, were arrested on Aug 13 over the murder of Sheila von Wiese-Mack in the luxury St. Regis hotel in Bali where they were three days into a 10-day vacation.

    Mrs Mack's body was found stuffed into a suitcase that police claimed the young couple had placed in the boot of a taxi. They told the driver they would be back but instead fled to another hotel.

    It is believed that the 62-year-old widow was bludgeoned to death with a heavy glass ashtray and vase, with such violence that both objects shattered, according to MailOnline.

    The news website quoted the lawyer as saying his client was distraught when he spoke to her by phone several times.

    "'She was tearful, she is being mistreated," he said, adding that the information she could give him was limited as he was worried their phone calls were being monitored.

    "'I have told her she can only give me yes or no answers,'' the report quoted him as saying.

    "I asked her if she was being mistreated and she said yes. I started going through questions and asked her if she had been touched inappropriately and she said yes. I asked her if it was in the female area and she said yes. I asked her if it was on more than one occasion and she said yes.

    "I asked her if it was consensual and she said no. I could not go into the specifics of whether there was an actual rape or whether it was sexual assault, molesting, call it what you will. I cannot say for sure it was intercourse,'' he said.

    NBC Chicago also quoted the lawyer as saying his client is two months pregnant and he has serious concerns about her health. She sounded dazed, confused and incoherent during their conversation, the lawyer said.

    When asked why she sounded incoherent, the teen reportedly said she was not given enough water and had been given strange vitamin pills by authorities, according to the report.

    Meantime, news website - news.com.au - reported that the young couple had both complained that they had been given a meal from Kentucky Fried Chicken. They were reportedly upset that authorities had presumed they would want fried chicken because they are black.

    Police were taken aback at this allegation, claiming that in Bali, KFC is expensive for the average income earner and is not for the lower wage earners, reported the website.

    It quoted Bali chief Djoko Hari Utomo as saying: "We have already given treatment that is more than normal.. We give the same food for all suspects. We also give special attention to her as she is still young."

    He said if her lawyer wanted to allege that the police had used violence towards Mack, he was welcome to provide evidence of this, according to the report.

    The couple could be sentenced to death if they are charged and then found guilty of murdering Mack's mother.

    But her pregnancy could complicate police calls for her to face the firing squad over a crime which they believe was premeditated and should carry the death penalty, said the news portal.

    It also reported that the victim's body is expected to be returned to the United States on Wednesday after an autopsy on the weekend found she had suffered a broken neck, broken nose and asphyxiation.

    Dr Ida Bagus Putu Alit, from the forensic team, said the autopsy found signs of violence from blunt objects and many defensive wounds, indicating that the victim had fought hard for her life.

    Will of Chicago mother slain in Bali filed in court

    A will of a Chicago woman whose body was found stuffed in a suitcase two weeks ago on the resort island of Bali has surfaced in Cook County.

    Sheila von Wiese-Mack’s will was filed late last week by Lance Taylor, an Oak Park attorney, more than a week after Indonesian authorities took von Wiese-Mack’s 18-year-old daughter and her boyfriend into custody in connection with the woman’s death.

    Heather Mack and Tommy Schaefer, 21, could be charged with premeditated murder and if convicted, face the death penalty.

    But it’s still not clear from von Wiese-Mack’s will who stands to inherit her property. Taylor said only that he did estate planning in 2006 for von Wiese-Mack and her husband, the late James L. Mack.

    “Having the will, I have an obligation to file it,” Taylor said.

    Von Wiese-Mack signed her will Aug. 1, 2006 — the same day her husband signed his. She left her property to a trust but did not name its beneficiary. Neither did her husband in his will, signed five days before his death on Aug. 6, 2006. Taylor declined to discuss those details.

    James Mack wrote in his will that the document was intended “only to provide for Heather Mack, my child and for no other children.” Heather Mack was 10 when he signed it, and her mother was named her guardian.

    But other court records identified von Wiese-Mack as the “sole beneficiary” of James Mack’s trust after the couple in 2011 won a $1.5 million settlement from a cruise line. The lawsuit was filed before James Mack’s death but settled afterward. Initially, half the money went to his estate, but a judge authorized von Wiese-Mack, as its executor, to pay the money to herself.

    Von Wiese-Mack named her brother, William Wiese, the executor of her estate. He did not immediately return messages for comment Monday.

    An American man has confessed to killing his girlfriend's mother at a luxury resort on the Indonesian island of Bali, while the girlfriend has admitted helping stuff the body into a suitcase, police said Friday.

    The battered body of Sheila von Wiese Mack, 62, was found in the case in the boot of a taxi in front of an exclusive hotel in the upscale Nusa Dua resort area on August 12.

    Her teenage daughter, Heather Mack, and daughter's boyfriend, Tommy Schaefer, had been staying with her at the St Regis hotel but fled to another part of the island after the killing. They were caught the following day.

    They are in custody in Bali while police investigate and could face the death penalty if found guilty of premeditated murder.

    Indonesian authorities previously claimed they have strong evidence against the pair and on Friday Djoko Heru Utomo, police chief in the Balinese capital Denpasar, said they had admitted their involvement in the case during questioning in recent days.

    "Both suspects have confessed," he said, adding that Schaefer, 21, had admitted to carrying out the killing after an argument with the victim.

    The daughter, 19, claimed she watched Schaefer kill her mother and then helped to stuff the body into the suitcase, said Utomo.

    "The interrogation is continuing in order to get the full account," he added.

    Heather Mack, who is pregnant, had previously refused to talk to Indonesian police without American legal representation present, and this week her lawyer from the United States arrived in Bali to assist her locally-hired lawyers.

    The pair are yet to be charged with any crime, as under the Indonesian legal system suspects are not formally charged until they appear in court at the start of a trial.

    A trial will only begin once police have completed their investigations and passed the evidence to prosecutors. The victim and the suspects are all from the Chicago area.

    Five Death-Row Inmates Exhaust Appeals

    The Attorney General’s Office said five inmates who are currently on death row will be executed by the end of the year.

    Basuni Masyarif, deputy attorney general for general crimes, said the five condemned prisoners have all exhausted their chances for appeal as well as failing to secure a pardon from President Joko Widodo.

    “Their rights have all been exhausted. So it now comes to the technical aspect [of when and where],” he said.

    Basuni declined to provide any further details about the inmates’ identities, saying only that two of the prisoners scheduled for execution this year are Nigerians. The five inmates are imprisoned in Banten, Riau and Jakarta.

    Indonesia resumed the execution of death-row inmates in 2013 after a four-year moratorium, killing five people by firing squad. Basuni said the five were supposed to be executed last year.

    Capital punishment is an option for Indonesian judges as a sentencing option for several convictions, including drug trafficking, murder, sedition and terrorism.

    The law says inmates must be informed of their execution 72 hours before it is carried out by firing squad.

    Basuni said the government will execute at least 10 prisoners each year, in a bid to reduce the backlog of people handed the death penalty.

    As of 2013, campaigners against the death penalty recorded that there are 113 prisoners awaiting execution but since then, more than 16 have been sentenced to death by Indonesian judges.

    Separately, new attorney general H.M. Prasetyo said Joko was not planning to abolish capital punishment any time soon and that the president would provide no clemency for people trafficking drugs into the country.

    Joko “said he will be firm,” the attorney general said as quoted by Viva News. “We want to send a warning [to international drug syndicates] that Indonesia doesn’t want to be a stopping place, market or even producer [of narcotics].”

    Human rights activists have condemned the resumption of capital punishment and demanded Joko end capital punishment.

    Indonesian police have completed their probe into an American man and his girlfriend accused of killing the woman's mother in Bali and stuffing her body in a suitcase, a prosecutor said Monday, adding the pair was expected to go on trial next month.

    He also said 19-year-old Heather Mack, who is pregnant, and her boyfriend Tommy Schaefer were being transferred from police cells to the resort island's notorious Kerobokan jail, where prisoners live in cramped, filthy conditions and drug abuse is widespread.

    The battered body of Sheila von Wiese Mack, 62, was found in a suitcase in the boot of a taxi in front of an exclusive hotel in the upscale Nusa Dua resort area in August.

    Mack and Schaefer, 21, had been staying with her but fled to another part of the island after the killing. They were caught the following day and police have said they could face the death penalty if found guilty of premeditated murder.

    Prosecutor Eddy Artha Wijaya told reporters in the Balinese capital Denpasar that police had finished their investigation and handed responsibility to the prosecution service.

    "We have received the case file from the police," he said. Prosecutors have an initial 20 days to draw up charges and Wijaya said he hoped the pair would face trial in January.

    If the case does proceed to court, Mack and Schaefer will be formally charged at their first appearance, which is the usual procedure in the Indonesian legal system.

    They had been in police holding cells during the police investigation. But now that probe had wrapped up they would be moved later Monday to Kerobokan, Wijaya said.

    Mack's lawyer, Raja Nasution, insisted that "she will be more comfortable there as it's bigger". He added that she would go to hospital every month to check on the progress of her pregnancy.

    The victim and the suspects are all from the Chicago area.

    Indonesia Rejects Clemency for Brazilian Citizen, Who Is To Be the First Westerner To Be Executed in the Country

    The Indonesian government has rejected clemency for Brazilian citizen Marco Archer Cardoso Moreira, 53, sentenced to death over drug trafficking.

    Officials say he will be executed "very soon".

    The pledge was denied on December 31st by President Joko Widodo. This was the second time that Moreira asked for the presidential pardon - the first rejection came in 2006.

    According to Indonesian rule, those sentenced may only make two clemency requests, after all opportunities for court appeal have been used.

    From the legal point of view, there is not any other action that can be taken to prevent his execution.

    "We have met every legal criteria to execute him", said Tony Spontana on Thursday, January 8th, to Folha.

    He is the spokesperson for Indonesia's Public Prosecutor's Office, the department responsible for carrying out executions in the country.

    "He is one of the next in the list to be executed - and I can guarantee that the plan is to execute him very soon."

    The date has not yet been defined, Spontana says, but it can happen as soon as the end of January.

    In addition to Moreira, the government intends to execute other five people all at once.

    At least until Thursday, January 8th, the Brazilian, who says he is repentant, did not know about the rejection.

    In December, Widodo announced that he intended to execute those who were sentenced to death for drug trafficking, which let him nervous - he is allowed to read newspapers in prison.

    Brazil's Ministry of External Relations says that it has not received an "official" notice about this matter.

    In December, before the rejection was announced, President Dilma Rousseff sent a letter to Widodo requesting the execution to be annulled.

    According to what Folha has gathered, Ms Rousseff's cabinet is assessing if there are any additional actions that can be taken to intercede on the behalf of the Brazilian.

    The circle closest to the president is said to be working with urgency to find a new option.

    The only way to avoid execution is to take the political way. Indonesia's population, the largest Islamic country in the world, is majorly in favor of capital punishment.

    Widodo took over office in October with an intimidating speech aimed at drug dealers.

    If the capital punishment is fulfilled, Moreira will be the first westerner to be executed in Indonesia.

    Between 2000 and 2014, 27 people were executed, most of the Indonesian citizens.

    The Brazilian was imprisoned in 2003, after attempting to enter Jakarta airport with 13.4kg of cocaine hidden in tubes used for hang gliding.

    The other Brazilian is Rodrigo Gularte, who was also caught with cocaine in Indonesia and is in the same prison as Moreira, in the countryside.

    His second request for clemency has not yet been issued.
