    Ryan Petersen capital murder trial may not end before Christmas

    District Attorney Doug Valeska sparred with an expert witness Tuesday concerning capital murder defendant Ryan Petersen’s mental state at the time of a shooting at Teasers nightclub that left three people dead.

    Valeska bombarded Mark Cunningham, a forensic and clinical psychologist, with questions concerning inconsistencies by Petersen during an interrogation by police following the August 2012 shooting. In the statement, Petersen at times appeared to be aware of his actions and other times does not.

    “If you remember something that didn’t happen, it’s not a memory, it’s a false construction of your own mind,” Cunningham said.

    Cunningham has testified that Petersen had drug and alcohol problems, as well as mental illness and that these issues severely affected his capacity to understand his actions at the time of the shootings.

    Under questioning from Valeska, Cunningham said Petersen did not appear to be impaired in a video that shows Petersen re-entering the club after being ejected. Cunningham also read from an interview with a witness who said Petersen “locked on” to his targets after re-entering the club.

    Cunningham said that most observers questioned by police said that Petersen appeared to be incoherent and intoxicated when he interacted with them prior to the shooting.

    “They described his conversation as being incoherent, he reintroduced himself several times and that he appeared to be a ‘whack job,’” Cunningham said.

    Cunningham began testifying around 8:45 a.m. Tuesday and his testimony continued into the evening. It is doubtful that Petersen’s trial, now in its third week, will conclude by Christmas.

    Petersen is charged with capital murder in the shooting deaths of Tiffani Paige Grissett, 31, Cameron Eubanks, 20, and Thomas Robins Jr., 59. According to police, Petersen was kicked out of the nightclub after a dispute with an employee, went to his truck, shot Eubanks, the son of the owner, outside the club and then re-entered and shot Grissett and Robins to death. Petersen shot another man, who survived.

    Investigator to attorney: "That's a bald-face lie." Jury prepares to deliberate Teasers case

    Dothan, AL - Closing arguments are expected Thursday morning in the Teasers nightclub shooting trial. The case should be in the hands of jurors by early afternoon.

    A club employee testified Wednesday that Ryan Petersen acted irrationally on August 9, 2012 when he killed three people.

    Krista Sellers, a defense witness, said Petersen was putting his hands on customers and dancers and appeared “very” drunk. However, under cross examination, Sellers testified Petersen appeared steady on his feet when the fatal shots were fired.

    Defense attorney Christopher Capps brought into question a gun found at the scene that was never collected as evidence. The .38-caliber pistol, according to Capps, was in the possession Cameron Eubanks, among the fatal victims. He alleged it was removed by his father, Paul, after the shooting but before officers arrived. Paul Eubanks is the club’s owner.

    “You know that Cameron had a gun didn’t you and you hid the gun?” Capps accused. Houston County Sheriff’s Office Captain Bill Rafferty responded, “That is a bald face lie.”

    Rafferty testified the pistol had not been discharged and was not considered evidence. A pistol fired by Paul Eubanks in an effort to stop Petersen from fleeing was retained by investigators, Rafferty said.

    During closing arguments, District Attorney Doug Valeska will summarize the prosecution’s case for jurors. Capps, or Co-counsel Ben Freeman, will do the same for the defense.

    Circuit Judge Brad Mendheim will then charge the jury giving them multiple verdict options.

    If Petersen is found guilty of capital murder jurors will return January 3 to consider a punishment recommendation---life in prison without parole or the death penalty.

    Houston Co. jury finds Teasers shooter guilty on all counts for 2012 triple murder

    Dothan, AL (WTVY) - Teasers nightclub shooter Ryan Petersen was found guilty on all counts Thursday afternoon. He faces the death penalty. The sentencing phase of the trial begins January 3rd.

    A prosecutor told jurors Thursday Ryan Petersen’s capital murder case centers around only one issue: if he had intent to kill.

    Houston County Assistant District Attorney Seth Brooks claims Petersen did have the intent to kill 3 people August 9, 2012 at Teasers nightclub in Newton.

    Brooks told jurors Petersen arrived at Teasers, a strip club, between eight and nine o’clock. Petersen was ejected about three hours later for violating club rules. He went to his car, retrieved a gun and fired nine shots. Three people died and another was wounded.

    Jury deliberations lasted about 2 hours Thursday afternoon. Jurors will return January 3 to hear more testimony in the sentencing phase of the case. Their options are the death penalty or life in prison without parole. Circuit Judge Brad Mendheim is not bound by the recommendation.

    Petersen trial enters penalty phase

    The penalty phase of Ryan Petersen's capital murder trial is expected to begin today as Petersen's defense attorneys begin their attempt to spare him from the death penalty.

    Petersen was convicted of capital murder and attempted murder last month related to a 2012 shooting at Teasers that killed 3 people and injured 1. According to police, Petersen was ejected from the club after getting into an argument with a Teasers employee. Police reports say Petersen then went to his vehicle, got a handgun and returned to the establishment, shooting Cameron Paul Eubanks, 20, the son of the club's owner, outside the club. Prosecutors said Petersen shot Eubanks several times in the pelvis and chest before shooting him in the head.

    Police said Petersen then re-entered the club and next shot Scotty Russell, a patron of the nightclub, wounding him. After shooting Russell, Petersen shot Tiffany Grissett, a dancer at the club, once and then chased her into the bathroom and shot her again. He then shot Thomas Robins Jr. to death and fled the club, police said.

    During Petersen's trial, his defense presented testimony that Petersen had a history of psychological issues resulting in involuntary commitments. Petersen's defense also presented evidence of long-term substance abuse issues and argued that he was intoxicated at the time of the shootings.

    Prosecutors have argued that Petersen was sufficiently competent to be responsible for his actions. During Petersen's trial prosecutors presented testimony from witnesses that Petersen appeared to be focused and determined during the shootings.

    Jury recommends death penalty in Wicksburg nightclub murders

    Houston County jury has recommended Ryan Clark Petersen, 26, of Enterprise, be put to death for killing three people at a Wicksburg nightclub in 2012.

    The jury returned their recommendation, which came on a 10-2 vote, right around 4 p.m. on Thursday. A judge will now decide whether to follow the jury's recommendation or he can choose to sentence Petersen to life in prison without the possibility of parole.

    Death sentence given in Wicksburg nightclub triple killing

    A Houston County judge followed the jury's recommendation and sentenced Ryan Clark Petersen to death on Tuesday afternoon for the murders of three people at a Wicksburg nightclub in 2012.

    The jury had voted earlier, by a 10-2 vote, to recommend the death penalty after about two hours of deliberation.

    Circuit Judge Brad Mendheim presided over the trial and followed the jury's recommendation during Tuesday's sentencing.

    Petersen killed Tiffani Grissett, Cameron Paul Eubanks, and Thomas Robins Jr., and also wounded Scotty Russell.

    Petersen spent most of an August evening in 2012 at Teasers, drinking alone and acting strangely, according to some who were at the club the night of the incident. According to court testimony, club security removed Petersen from the establishment after a dispute with an employee. He returned moments later armed with a handgun and opened fire. He was found by police a few hours later in the woods near the club.

    Defense attorneys for Petersen argued during the guilt phase of the trial that Petersen was not responsible for his actions due to mental impairment and large consumption of alcohol. They argued during the sentencing phase that Petersen’s life should be spared due to several mitigating factors including his mental condition.

    Teasers nightclub killer seeking a new trial

    The man convicted and sentenced to death last month for killing three people inside a Wicksburg nightclub in 2012 was back in court Wednesday morning, seeking a new trial.

    A motion was presented to Circuit Judge Brad Mendheim, requesting a new trial for Ryan Clark Petersen. He was sentenced to death in March after being convicted of capital murder for killing three people at Teasers nightclub.

    On the night of the killings, Petersen, 24, spent most of the August evening at Teasers, drinking alone and acting strangely, according to witnesses who were at the club the night of the incident. According to court testimony, club security removed

    Petersen from the establishment after a dispute with an employee. Petersen returned moments later armed with a handgun and opened fire, killing Cameron Paul Eubanks, 20, Tiffani Paige Grissett, 31, and Thomas Robins Jr., who was 59. He also shot Scotty Russell, 33, of Opp, who survived his injuries.

    Petersen’s attorney, Benjamin Freeman, requested Mendheim approve the motion for a new trial on a lesser charge of manslaughter based on two factors.

    “We are asking for this motion, sir, because during my client’s trial, an officer was asked did he have any evidence that my client was intoxicated,. He replied he did not have any evidence,” Freeman said. “That is in court records. Also, your honor, we believe due to the fact the defendant got into a monetary dispute and was forcibly removed from the building, along with aggressive language being used towards Peterson, there was no cooling-off period. We believe this all occurred in the heat of passion.”

    According to Freemen, he believes if Petersen would have had time to cool down the situation would have turned out differently.

    Mendheim stated he anticipates denying the motion for a new trial. His order will be entered at a later date.

    The motion for a new trial is part of the appeal process. The case will now go to the Alabama Court of Criminal Appeals.
