    Dallas County death penalty trial underway for man accused of killing girlfriend and her teenage daughter

    Dallas County First Assistant District Attorney Heath Harris told jurors in opening arguments that they should have no difficulty convicting Tyrone Cade of capital murder.

    “This case is not a complex mystery,” he said.

    Harris told jurors that Cade killed Mischell Fuller, 37, and her 18-year-old daughter, Desaree Hoskins because Cade was jealous. He had recorded Fuller having an intimate conversation on Skype with her exhusband, Carlton Hoskins, and was angry.

    Cade, Harris said, was a “wannabee ladies man.”

    Cade could “turn on the charm in the blink of an eye, turn on the tears in the blink of eye,” Harris said. “But he could also turn on the aggression in the blink of an eye.”

    Harris told jurors that the defense planned to prove Cade was not guilty by reason of insanity, meaning the defense believes Cade had a mental disease or defect at the time of the slayings that cause him not to know the difference between right and wrong.

    Defense attorneys Lalon “Clipper” Peale, John Tatum and Richard Franklin delayed making an opening statement, so no further details were provided to jurors before a lunch break.

    Irving Police Officer Aaron Shook testified that Cade turned himself in at the police station, saying that “he had killed a couple of people.”

    Shook told jurors that he grabbed a knife to question Fuller but then she screamed for her daughter and started kicking. He then stabbed them both to death.

    Shook said that Cade handed over three cell phones and one of them appeared to have blood on it.

    On a recording of 911 call made from the lobby of the police station before talking to officers, Cade appears to be crying as he says, “I killed two people … Yeah, I killed them … I stabbed them to death.”

    Cade says on the 911 call: “I just snapped.”

    He said that he wishes he could get the death penalty. He said he also tried to kill himself but he was “too punkish” to go through with it.

    Fuller’s mother, Elena Belcher, tearfully testified about her daughter and granddaughter, struggling to maintain her composure on the witness stand. She began sobbing when prosecutors showed her photos of her daughter and granddaughter.

    Belcher told jurors that her daughter was afraid of Cade because he threatened to burn the house down with her in it after Fuller asked Cade to move out. Fuller had wanted Cade to leave for some time after finding out he was a registered sex offender, according to testimony.

    About a week before their deaths, Fuller and her daughter went to Florida where they went to Disney World and saw Fuller’s ex-husband, who also the father of her children, according to testimony.

    Original post, 6:22 a.m.: This morning, a Dallas County jury will begin hearing testimony in the capital murder case of Tyrone Cade, who is accused of killing his girlfriend and her teenage daughter. Prosecutors are seeking the death penalty.

    Cade, a registered sex offender, turned himself in to police at the Irving police department after the March 2011 stabbing deaths of Mischell Fuller, 37, and her 18-year-old daughter, Desaree Hoskins.

    “I killed some people,” he told officers.

    Fuller and Hoskins, were found dead about in the one-story home the three shared in the 1400 block of Ronne Drive, near Shady Grove Road and MacArthur Boulevard, police said.

    Irving police have said that Cade confronted Fuller about their relationship earlier in the day Sunday and that the argument escalated. Cade then took out a knife and attacked Fuller and Hoskins, police said.

    Cade was convicted of sexual assault in Collin County in 2002.

    Tyrone Cade looked away today in court as prosecutors showed autopsy photos in court of the women he had admitted killing.

    Cade covered his eyes with his left hand and hung his head as photos depicting the stab wounds to his girlfriend Mischell Fuller, 37, and her 18-year-old daughter, Desaree Hoskins were shown to a Dallas County jury.

    Cade, 39, has admitted stabbing the women to death to Irving police. He faces a possible death sentence if jurors convict him of capital murder. Defense attorneys intend to present a defense of not guilty by reason of insanity, meaning they believe Cade had a mental disease or defect that caused him not to know right from wrong at the time of the slayings.

    Prosecutors say Cade killed Fuller and Hoskins because Cade was jealous. He had recorded Fuller having an provocative conversation on Skype with her ex-husband, Carlton Hoskins, and was angry.

    Forensic pathologist Jill Urban testified that Hoskins had 39 wounds and Fuller had 28.

    One of the wounds to Hoskins’ neck went into her spinal cord.

    Both women had knife injuries that penetrated their lungs.

    Cade was convicted of sexual assault in Collin County in 2002 and is a registered sex offender.

    Police suspect that Fuller was also sexually assaulted, according to testimony.

    Dallas County prosecutors have finished calling witnesses in the guilt/innocence phase of the capital murder trial of Tyrone Cade.

    Defense attorneys will soon begin calling witnesses as they attempt to prove Cade, 39, had a mental disease or defect that cause him not to know right from wrong when he stabbed Mischell Fuller, 37, and her 18-year-old daughter, Desaree Hoskins.

    Cade faces a possible death sentence if jurors convict him of capital murder.

    Prosecutors say Cade killed Fuller and Hoskins at their Irving home in March 2011 because Cade was jealous. He had recorded Fuller having a provocative conversation on Skype with her ex-husband and was angry. Fuller had been trying to force Cade to move out of her house.

    This morning jurors listened to an audio recording Cade made of that conversation. He secretly recorded Fuller while he was gone to keep track of what she was doing. Many parts of the recording were not audible.

    Cade was convicted of sexual assault in Collin County in 2002.

    Irving man who killed girlfriend, her daughter is guilty of murder

    A Dallas County jury on Friday found a man guilty of capital murder, rejecting his claims that he didn’t know right from wrong when he killed his girlfriend and her daughter.

    The punishment phase of Tyrone Cade’s trial will begin Monday as prosecutors ask jurors to send him to death row for the stabbing deaths of 37-year-old Mischell Fuller and 18-year-old Desaree Hoskins in March 2011 at their Irving home.

    Jurors deliberated nearly 90 minutes before reaching the guilty verdict.

    After the presiding juror read the verdict, Cade sat in his chair, slumped to the left with a hand over his face — a common position throughout the trial. When he stood as jurors filed out of the courtroom, he closed his eyes. The family of Fuller and Hoskins left without commenting.

    Defense attorneys Lalon “Clipper” Peale, Richard Franklin and John Tatum tried to convince jurors that Cade, 39, was not guilty by reason of insanity — meaning a mental disease or defect prevented him from knowing right from wrong.

    They said physical and sexual abuse as a child, chronic back pain, depression, unemployment, suspicions that Fuller cheated on him and Fuller’s trying to end their relationship culminated in a mental break that led to the murders.

    “He snapped. He went off the chain,” Peale told jurors in closing arguments. “They build up and build up.”
    But prosecutors Heath Harris, Jason Hermus and Rachael Jones told jurors that killing the women was an evil act and that Cade knew exactly what he was doing when he stabbed Fuller and then Hoskins.

    “The insanity defense — are you kidding me?” Harris said to jurors, telling them that the stabbings of the women and rape of Fuller was about “dominance,” “control,” “punishing” and “retribution.”

    A doctor who examined Cade for prosecutors found that he was not insane at the time of the murders, according to testimony. Defense experts who reviewed records and literature testified that it was possible Cade did not know right from wrong. But because they did not interview Cade, they could not offer a definitive opinion.

    Since Cade’s arrest, he has been treated for minor depression, according to testimony. But there was no prior indication of a history of mental illness, although his father suffers from schizophrenia and a bipolar disorder.

    Cade admitted to police that he stabbed the women after secretly recording Fuller having a provocative Skype conversation with her ex-husband.

    Cade told police that he tried to question Fuller at knife point at their Irving home about the conversation. But he said he stabbed her because she would not be silent. Cade said he stabbed Hoskins when she ran into the room after hearing her mother’s screams.

    Woman testifies that Dallas County man facing possible death sentence raped her 13 years ago

    Now, she is 33, pregnant and in jail on drug charges.

    But in 1999 — the night Tyrone Cade raped her — she was 21, going to college and working for a broadcasting company.

    She testified before jurors who will decide whether Cade should be sentenced to death for the murderers of 37-year-old Mischell Fuller and 18-year-old Desaree Hoskins at their Irving home in March 2011. Jurors convicted Cade of capital murder Friday.

    The woman is not being named because The Dallas Morning News does not typically name victims of sex crimes. She cried or choked back tears throughout her testimony and wore a green and gray striped jail uniform.

    Cade appeared to watch the woman intently as she testified and learned forward in his seat beside his attorneys. This is a marked difference from the guilt/innocence phase of the trial when Cade almost always slumped to the left in his seat and often had a hand over his face.

    She testified that she and Cade became friends after meeting at a laundromat. They did not date and nothing sexual had ever happened between them before, she said. In 1999, she invited Cade to go out for drinks when she was meeting friends from work. Afterward, she showed him her new apartment. But when she tried to leave to go to her boyfriends’ house, Cade sexually assaulted her, she testified.

    As soon as she put her hand on the door knob, she said, he grabbed her arm and threw her to the floor.

    She struggled and Cade, she testified, repeatedly told her: “Don’t make me kill you like the last girl.”

    The woman said the more she struggled, the rougher he got.

    “The more I fought, the worse it got,” she said. “He was just too strong for me to get away from.”

    To save her life, she said, she pretended to consent and “tried to make him think it was OK.” Although at one point, she was able to grab a small knife and stab him. But the wound was superficial.

    He raped her in the new apartment she was once so proud to show off. He left a belt, shirt and picture of him and his girlfriend behind.

    The following day, Cade left her a voicemail, she said. “He said he was ‘sorry.’”

    The woman said she didn’t tell her parents about the rape because “I was so ashamed.”

    The case went to court in Collin County and a jury gave Cade three years probation in 2002.

    “He took everything from me … and he didn’t get anything for it,” she testified.

    The following year, Cade violated probation and a judge ordered him to prison for three years.

    Many details about what happened before and sometimes during the rape were fuzzy, she said. They may have smoked marijuana before. She can’t remember.

    Prosecutor Rachael Jones asked the woman if she tried to forget it.

    “Everyday,” she replied.

    But she can’t.

    No matter what a jury decides, Tyrone Cade will die in prison.

    Jurors are deliberating whether the state will be the one to kill Cade, 39, or if he’ll just live out his life in prison. They have to decide between a death sentence or life without parole.

    The jury last week rejected an insanity defense and convicted Cade of capital murder in the brutal stabbing deaths of his girlfriend, 37-year-old Mischell Fuller, and her daughter, 18-year-old Desaree Hoskins.`

    Cade admitted to police that he stabbed the women dozens of times after secretly recording Fuller having a provocative Skype conversation with her ex-husband.He then sexually assaulted Fuller.

    To determine Cade’s punishment, jurors must decide if Cade would commit future act of violence. If the answer is yes, they then consider if there is anything in Cade’s background that would warrant a life sentence instead of death.

    In closing arguments, prosecutors Heath Harris, Rachael Jones and Jason Hermus told jurors that Cade deserved to die for his crimes and there are no mitigating factors that call for the lesser sentence.

    Harris urged jurors to send a message to other batterers and impose a death sentence on Cade.

    If you “act like the worst of the worst, then we will punish you like the worst of the worst,” Harris said during closing arguments.

    Prosecutor Rachael Jones told jurors that Cade was a manipulator. He manipulated Fuller and he turned on the tears when confessing to the murders to police to try to do the same. He told officers that he tried to kill himself and he wanted the death penalty.

    “If Tyrone Cade wanted to be dead, he could be dead today. He wants to still live,” Jones said. She called Cade ”an evil capital murderer who will be a threat everyday for the rest of his life.”

    Defense attorneys Lalon “Clipper” Peale, John Tatum and Richard Franklin urged jurors to show mercy and said that Cade’s background — a broken home, emotional abandonment, an allegation of sexual abuse by his mother, a low IQ, depression, constant back pain from a football injury — were enough for jurors to decide of life without parole. Cade’s father also suffers from a bipolar disorder and schizophrenia but there is no evidence Cade has more than mild depression.

    Peale said that Cade’s background is ”not an excuse, it’s an explanation.”

    Peale told jurors that there are other murderers in prison who aren’t on death row. He said that prison security is enough to ensure Cade complies with the rules.

    “You know that the prison can control these people,” Peale said.

    Tatum urged jurors to “stop the killing” and spare Cade’s life.

    Irving man condemned for killing girlfriend, her daughter loses appeal

    The Texas Court of Criminal Appeals has upheld the death sentence of an Irving man convicted of killing his girlfriend and her daughter during a jealous rage four years ago.

    Attorneys for 42-year-old Tyrone Cade argued that his trial in 2012 was marked by 44 errors, including problems with jury instructions, admission of evidence, improper testimony and insufficient evidence to support a death penalty verdict.

    The state’s highest criminal court Wednesday rejected each claim.

    Cade’s lawyers at his trial said he was insane when he fatally stabbed 37-year-old Mischell Fuller and her 17-year-old daughter Desaree Hoskins at their home. Evidence showed Cade’s relationship with Fuller was deteriorating.

    Evidence also showed Cade confessed to the slayings in a 911 call from a pay phone in a police station.
