    Demond Bluntson remains on death row

    LAREDO, TX (KGNS) - It’s been two years since a Laredo jury found Demond Bluntson guilty of murdering his two kids and their mother.

    It was a historic case since it was the first time in nearly 25 years that a jury had sentenced someone to death row.

    During Wednesday’s child abuse conference, District Attorney Isidro Alaniz spoke about the trial and the decision to seek the death penalty.

    Many similarities have been made between the Bluntson case and the recent case of Ronald Anthony Burgos Aviles who is charged with murdering a one-year-old and his mother.

    Alaniz says that Bluntson remains incarcerated in a facility in Livingston, Texas on death row.

    His conviction is currently under appeal and is awaiting a hearing before the Texas Court of Criminal Appeals.

    Alaniz says, “Eventually, the Court of Criminal Appeals will make the decision that if the jury's verdict in this case was in fact properly rendered or given and then he will receive the death penalty, so I'm not sure if it will be in a year or five years but we're very optimistic and confident that the decision will be affirmed.”

    The district attorney says that despite the similarities between the two cases, he says he was not made a final decision on whether he will seek the death penalty or life in prison for Burgos.

    Alaniz says that while the alleged crime does qualify for the death penalty, he still needs time to review the evidence.

    Appeal hearing postponed for Laredo man on death row for murder of two children

    The motions hearing set Friday for a man on death row was postponed with a date yet to be determined, and it is unclear why and if it will be rescheduled.

    The hearing was set to be heard in Webb County’s 49th District Court of Judge Joe Lopez at 1:30 p.m., according to the court docket. Demond-Depree Bluntson, 43, was sentenced to death in 2016 for allegedly murdering his son and girlfriend’s son.

    LMT reached out to the District Attorney’s Office for clarification of exactly why the hearing had been pushed back but no specific reason was provided before press time.

    The case has been on appeal since then in the Texas Court of Criminal Appeals, as the appellant is entitled to an automatic appeal in death row cases.

    A person who receives the death penalty does not choose whether or not their case is appealed.

    Bluntson was also sentenced to 50 years each for the two counts of aggravated assault against a public servant.

    The Texas Court of Criminal Appeals found he is entitled to the opportunity to file an out-of-time appeal for these two sentences.

    There are about 217 inmates currently on death row in Texas, according to the Texas Tribune. Texas has been the No. 1 state for years for its number of death penalty executions.

    Demond Bluntson trial: Day Two

    Mental health specialists took the stand in the trial of a convicted murder.

    On Wednesday, day 2 of the trial of Demond Bluntson, witnesses continue to speak on their interactions with him and his state of mind.

    Bluntson’s case is back in court for a retrospective competency trial.

    The trial will discuss Bluntson’s mental health and whether he understood what was happening during his initial trial.

    On Wednesday one of the witnesses called was Dr. Diane Mosnik, PHD, Neuropsychologist.

    Mosnik was retained to do a retrospective competency evaluation on Bluntson if he could stand trial.

    Opening statements and cross examination began on Tuesday morning.

    However, on Tuesday afternoon, mental health specialist Jose Luis Macias, took the stand as the 3rd witness.

    District attorney Isidro Alaniz asked Macias if Bluntson was alert, orientated, calm, neutral, thought process coherent during his interaction with Bluntson to which Macias said yes.

    Bluntson is represented by a new legal team, Therese Huntnizer and Hilary Sheard, in this trial.

    Huntnizer questioned Macias reports and whether Bluntson’s mental state changed during their interactions.

    Macias had evaluated Bluntson for 4 years while incinerated.

    The fourth witness was Dr. Homero Sanchez, psychiatrist, described his interaction with Bluntson.

    “He was a little bit anxious, talking a little bit rapidly, there was no evidence of abnormal behavior” Sanchez said.

    Sanchez told jurors he didn’t see any psychotic symptoms on Bluntson during his evaluation.

    Bluntson was given medicine to help him sleep, however over time, Sanchez said he had symptoms of delusions and “didn’t trust anyone”.

    Sanchez says Bluntson’s changes to his physical appearance over time and the lack of taking care of himself could attribute to his change of mental state.

    In 2016, Bluntson was sentenced to death for the shooting and killing two children at a Laredo hotel that was once a Holiday Inn.

    The trial continues in the 49t district court.

    Bluntson found competent in trial

    A jury has determined that a man convicted of capital murder in 2016 and facing the death penalty was competent to stand trial, according to the Webb County District Attorney’s Office.

    On May 2, a jury in the 49the District Court was selected for the retrospective competency trial of Demond Bluntson, the man who fatally shot his son and girlfriend’s son, and fired shots at Laredo police officers at the then Holiday Inn by Interstate 35 in 2012.

    Attorneys for Bluntson, 47, alleged that he was incompetent to stand trial at his 2016 capital murder case. Psychological, expert and other evidence was presented to the jury throughout a five-day trial. The case was given to the jury on Friday.

    The jury returned a unanimous verdict on Monday finding that Bluntson was competent at the time of the trial in 2016. He was the county’s first person sentenced to death row in nearly 25 years.

    The case was prosecuted by District Attorney Isidro R. Alaniz, Chief Assistant District Attorney Marisela Jacaman, and Assistant District Attorneys Amber Holmes and David Reuthinger.

    Bluntson was arrested in 2012 in connection with the attack that left his 21-month-old son, Devian, and 6-year-old Jayden Thompson dead. The boys' mother, Brandy Cerny, 28, was later found shot to death in El Campo.

    Bluntson was found barricaded in a following the incident with a mattress, box spring and two tables pushed against the door, according to a police report.

    Officers busted in and detained Bluntson, and “In the process, officers located two unresponsive male children on the floor covered in blood, with visible gunshot wounds to the head,” the report states. They also recovered a semiautomatic handgun.

    Court records show Bluntson’s criminal history begins at age 18, with arrests and convictions spanning more than a decade.

    In May 1994, he was arrested on state felony cocaine possession. He pleaded guilty in February 1995 and was sentenced to 10 years’ probation. Two months later, he was arrested on a Class A misdemeanor assault charge.

    He was arrested again in late 1997 on charges of cocaine possession. He was given two years’ probation in 1999.

    A police investigation in early 2000 pinned Bluntson to drug dealings outside an El Campo park between January and February of that year. He was charged with four counts of delivery of a controlled substance in a drug-free zone.

    He was convicted on two of the counts. Also, his probation for the 1994 and 1997 charges was revoked, and he was sentenced to four years in prison.

    In November 2007, months after enrolling in the community college, he was arrested again on another drug-related charge. Documents state that he attempted to hide a bag containing marijuana. He pleaded guilty in June 2009 to tampering with evidence.

    A relative said Cerny and Bluntson had been dating for the past few years.

    Bluntson graduated from El Campo High School in 1994, according to his Facebook page.

    He attended Wharton County Junior College from 2007 to 2011. Cerny was a student there, too, from 2001 to 2005.
