    Isle Wight County Sheriff Mark Marshall said Commonwealth Attorney Wayne Farmer may seek the death penalty against Joseph Jay Joyner Jr. for allegedly murdering his father and stepmother.

    Marshall referred the matter to Farmer, who did not return repeated phone calls to The Tidewater News.

    Marshall made the statement after Joyner, 37, on Monday waived his right to a preliminary hearing in Juvenile and Domestic Relations Court for allegedly shooting Joe Joyner, 62, in the back of his head with a shotgun and beating Sandra Joyner, 58, to death on April 26.

    Their bodies were found the next day at their Walters Highway home.

    While investigators have not given a motive for the killings, friends of the victims have indicated it was over money.

    By waiving the hearing, Joyner agreed there is enough evidence for the case to continue in circuit court.

    A grand jury will hear the case on Friday, Nov. 9.

    He said hes not involved, said Virginia Beach attorney Sonny Stallings, who represents Joyner.

    Stallings also said the death penalty could be an option, assuming charges are upgraded to capital murder. Joyner currently faces two counts of first-degree murder and life in prison.

    During a July bond hearing, Stallings argued the case against Joyner was quite weak. Commonwealths Attorney Wayne Farmer disagreed, saying Joyner could flee to Louisiana, where his wife and children live.

    Joyner is being held at Western Tidewater Regional Jail in Suffolk.

    An Isle of Wight Circuit Court grand jury on Friday indicted a man accused of killing his father and stepmother on April 26 with three counts of capital murder.

    Joseph Charles "Jay" Joyner Jr. was indicted on capital charges in connection with the deaths of Joe Joyner Sr. and Sandra Joyner, said Isle of Wight Commonwealth's Attorney Wayne Farmer. Legally, Joyner could be charged with three capital offenses because the murders were committed during a robbery and more than one person was killed within three years, Farmer said.

    If convicted on any of the capital charges, Joyner could receive the death penalty, Farmer said

    "The decision to seek the death penalty was not made lightly but given the nature of the crime and evidence, I believe it is appropriate," Farmer said, adding that he doesn't recall the last time a capital murder case was tried in Isle of Wight. "It's been a long, long time."

    The grand jury also issued indictments charging Joyner with one count each of robbery and using a firearm in the commission of a felony, Farmer said.

    Authorities discovered the body of Sandra Joyner inside the couple's home in the 3000 block of Walters Highway on April 26, said Isle of Wight Sheriff Mark Marshall. An autopsy revealed that she died from blunt force trauma to the head, according to police reports.

    Police found the body of Joe Joyner Sr. in the woods on the couple's 100-acre Carrsville farm on April 27. The senior Joyner, who made an unsuccessful bid for a seat on the Isle of Wight Board of Supervisors in 2011, was shot in the head.

    What do you think, Heidi? I'd be somewhat surprised if this case actually ended up in a death sentence. Murdering only two adult family members without torture or sexual assault doesn't usually seem to result in many death sentences.

    A man accused in the brutal slayings of his father and stepmother in Carrsville has been sentenced to four consecutive life terms in prison.

    Joseph Joyner, Jr. entered an Alford plea Wednesday afternoon.

    An Alford plea means the criminal defendant does not admit guilt, but admits the prosecution could likely prove the charges against him.

    In this case, those charges include robbery and capital murder of multiple persons. According to Joyners attorney, Sonny Stallings, his client was expected to plead guilty to the murders during the hearing. As this is a capital murder case, Stallings said the guilty plea would have spared his life.

    On a sunny April afternoon, the body of Sandy Joyner was discovered inside her home along Walters Highway in Isle of Wight County. Hours later, with the help of a helicopter from the Virginia State Police, her husband Joes body was located in the wooded area behind the home.

    Sandy died from severe blunt force trauma while Joe died of a close-range gunshot wound to the head.

    The Isle of Wight County Sheriffs Office later arrested and charged Joes son Jay Joyner on two counts of first degree murder in connection to the deaths. Deputies said they found evidence linking Jay to the murders and witnesses claimed to have seen him near the Blackwater River where the murder weapon was found.

    In December, Joyner was ordered to undergo a psychological evaluation to determine if he was capable of standing trial. As the case involved capital murder, the death penalty was on the table.

    Some folks in Western Tidewater were surprised last week to learn that Joe Charles Jay Joyner had entered a plea for the murder of his father and stepmother, bringing to a quick conclusion the trial for the heinous crimes.

    Eight months after shooting Joe Joyner, 62, in the head and then beating to death Sandra Joyner, 58, at their Carrsville-area home, Jay Joyner on Wednesday entered an Alford plea in Isle of Wight County Circuit Court. This type of plea means he didnt admit to killing the couple on April 26, but agrees there was enough evidence for a conviction.

    In exchange, the 37-year-olds life will be spared. The prosecution agreed to drop the death penalty for the plea. Joyner got four life sentences.

    Especially when it comes to a capital murder case like this one, the wheels of justice usually grind slowly. But no time was wasted in this case, and the efficiency of the justice system owes much to the hard work and determination of the law enforcement officers and prosecutors who worked it. The Isle of Wight Sheriffs Office, especially, should be commended for uncovering enough evidence against Joyner to lead him to believe a jury would find him guilty.

    Paying for a long imprisonment and legal defense costs for Joyner while he exhausted the appeals available to a death-row inmate would have cost Isle of Wight and, subsequently, Virginia taxpayers far more money than was spent securing his conviction last week.

    The loss of Joe and Sandy Joyner was tragic. Justice, however, was served.
