    Akron man Dawud El Spaulding sentenced to death in fatal shootings

    A 30-year-old Akron man has been sentenced to death for the fatal shootings of two people and a related shooting that left a man paralyzed.

    Summit County Common Pleas Judge Paul Gallagher imposed the death penalty Friday morning for Dawud El Spaulding in an hourlong court hearing.

    Gallagher set the execution date for March 3, 2014, but under Ohio law such sentences carry automatic appeals.

    Spaulding previously was convicted of two counts of aggravated murder, one count of felonious assault and other crimes in the December 2011 slayings of Ernest “Ernie” Thomas and Erica Singleton, the mother of Spaulding’s 7-year-old son and 2-year-old daughter.

    Patrick Griffin was the first victim. He was shot hours earlier that same day at a Grant Street home. The 2 a.m. shooting left him paralyzed.

    Some six hours later, after Spaulding fled, he returned to the home and fatally shot Singleton and Thomas just moments after they left the steps of Thomas’ front porch.

    In court Friday, Spaulding, who was clad in red-striped jail clothes and guarded by nine sheriff’s deputies and courthouse security commanders, showed no emotion as he sat between his two attorneys at the defense table.

    He made no statements or comments to the many family members and friends of the victims, who were seated in the public gallery.

    “I just want to get this over with,” he told the judge.

    When Gallagher asked him again if he wished to address the court, Spaulding shook his head back and forth, saying nothing.

    Gallagher followed a previous recommendation by the jury in imposing the capital sentence.

    Gregory Lott's execution date is on March 19th and Spaulding's was on March 3rd. So, procedural dates can definitely be set within less than a month of a real date. So, the question still remains why does the Ohio Supreme Court insist on setting real execution dates at least two months apart?

    Supreme Court to consider Summit, Medina counties death-penalty appeals

    The Ohio Supreme Court will hear two separate appeals from death-row inmates in cases from Summit and Medina counties during July oral arguments.

    Dawud Spaulding was convicted and sentenced to death for the 2011 Akron murders of his children’s mother and her boyfriend, as well as the attempted murder of another man. A court imposed the death penalty on Steven Cepec following his conviction for the 2010 murder of a Chatham Township man.

    Akron Double Homicide

    In the Akron case, Spaulding’s ex-girlfriend Erica Singleton reported to police on Nov. 28, 2011, that Spaulding had broken into her house and threatened her. He had been convicted of domestic violence against Singleton earlier in the year and in 2010. Singleton obtained a civil protection order against him on Dec. 1, 2011. However, on Dec. 15, Spaulding shot Patrick Griffin outside the residence where Ernest Thomas, Singleton’s boyfriend, lived. Griffin was left paralyzed by his injuries. A few hours later, in the same location, Spaulding shot and killed Singleton and Thomas.

    A jury convicted Spaulding for aggravated murder, attempted murder, violation of a protection order, and other offenses.

    Spaulding raises concerns about Griffin’s identification of him as the shooter, noting Griffin first selected no one from the police photo array he was shown. Spaulding also argues that the jury’s trip to the crime scene shouldn’t have taken place without the judge, a court reporter, and him. He also claims his attorneys were ineffective in their representation because they weren’t both present during critical points in his case.

    Medina County Murder

    Cepec occasionally borrowed money and got rides from Frank Munz. On June 3, 2010, Cepec, who had left his halfway house without authorization, visited Munz at his home. Munz’s nephew called 911 when he heard two loud thumps, the sound of choking, and someone going through rooms of the house. Police found Munz lying on the kitchen floor. He had been hit repeatedly with a hammer and choked with a lamp cord, and died from his injuries. Cepec was found nearby hiding in a bush.

    A jury found Cepec guilty of aggravated murder, murder, aggravated robbery, and aggravated burglary.

    Cepec contests statements made during the trial by his parole officer, who mentioned Cepec’s prior burglary convictions. Although the jury was instructed to disregard these statements, Cepec asserts that he deserves a new trial because of the comments. He also argues the trial court should’ve held a hearing to evaluate the competency of Munz’s nephew after the judge asked whether the witness was developmentally challenged. In addition, Cepec contends his constitutional rights were violated when police continued to question him after he asked whether he could have a lawyer before officers administered a chemical test that would check for traces of blood on his hands.

    Oral Arguments

    Stave v. Spaulding will be heard on Tuesday, July 12, and State v. Cepec will be considered on Wednesday, July 13. Four other cases will also be argued during this session. Arguments on both days will begin at 9 a.m. at the Thomas J. Moyer Ohio Judicial Center in Columbus and will be streamed live online at sc.ohio.gov and broadcast live on The Ohio Channel.

    Condemned Akron inmate's execution put on hold during appeals

    COLUMBUS, Ohio -- The Ohio Supreme Court placed the execution of an Akron man convicted of killing the mother of his children and her boyfriend on hold until all of his appeals have been settled.

    Dawud Spaulding was set to be executed in 2021 for the aggravated murders of Erica Singleton and Ernest Thomas, and a shooting that left Thomas' nephew, Patrick Griffin, paralyzed from the waist down.

    But the Court, which upheld Spaulding's death sentence in December, agreed on Thursday to delay Spaulding's execution. Such decisions are routine in death-penalty cases.

    Spaulding, a serial abuser of Singleton, shot the the nephew in the neck outside Thomas' apartment on Grant Street in 2012, police said. The shooting left the nephew paralyzed from the neck down.

    Police cleared the scene from the roommate's shooting about 5 a.m. Three hours later, they were called back to the apartment after a neighbors heard gunshots and found the bodies of Singleton and Thomas lying next to their cars, both with gunshot wounds to the back of their heads.

    Singleton left her children with her mother the day before and had a piece of luggage with her when she was shot. Officers found more luggage in her car, police said.

    Spaulding was convicted in 2012 of aggravated murder, felonious assault, domestic violence and a host of other charges. He was sentenced to death in January 2013.

    Griffin is currently serving one year of federal house arrest after he pleaded guilty in 2015 to Hobbs Act extortion. He was charged along with childhood friend Franklin Conley of trying to force former Ohio State University running back Chris "Beanie" Wells to pay them tens of thousands of dollars after Wells' brother set up a drug deal in which both men lost money.
