    Prosecutors seek delay in Tulsa shooting case

    Prosecutors are asking a judge to delay next week's scheduled arraignment for two men charged in the April killings that terrified residents of a Tulsa neighborhood.

    Assistant District Attorney Doug Drummond filed a request Tuesday to delay next Monday's arraignment for Jake England and Alvin Watts. The request says prosecutors want more time to decide whether to seek the death penalty.

    A judge has not yet ruled on the request. The motion says defense attorneys do not object to a delay.

    England and Watts face murder and hate crime charges in a shooting spree that killed three people and wounded two others. All five victims were black, and authorities say England may have targeted black people because he wanted to avenge his father's shooting death by a black man.

    Shooting suspect's assault case postponed

    A man facing murder charges in a Tulsa shooting rampage that left three people dead earlier this year is due in court Dec. 27 on a separate charge of allegedly assaulting a jail guard.

    Jake England was charged after he allegedly elbowed and cursed a guard as he was being taken to his cell at the Tulsa jail from the recreation yard Nov. 1. His hearing Wednesday was rescheduled to Dec. 27.

    England and Alvin Watts face murder and hate crime charges in the April rampage that killed three and wounded two others. They're to be arraigned Jan. 9.

    All five shooting victims were black, and authorities say England may have targeted black people because he wanted to avenge his father's shooting death by a black man two years earlier.

    DA to seek death penalty in Tulsa shooting rampage

    Tulsa prosecutors say they'll seek the death penalty against two men charged in an April 2012 shooting rampage that killed three black people and left two more wounded.

    Tulsa County District Attorney Tim Harris made the announcement Friday in the case against Jake England and Alvin Watts. The two also face hate crimes charges stemming from the shootings of William Allen, Bobby Clark and Dannaer Fields.

    Two others who were shot survived. The shootings happened in a predominantly black section of Tulsa, and all five victims were black.

    Authorities have said England may have targeted black people because he wanted to avenge his father's shooting death by a black man two years ago.

    However, England, who describes himself as Cherokee Indian, has said he has no ill-will toward black people.

    Attorneys file challenges to death penalty request for Good Friday shooting*suspect

    Lawyers for one of two defendants charged with murdering three people in Tulsa on Good Friday filed court challenges Wednesday to a death penalty request and also to the sufficiency of the evidence presented at a preliminary hearing.

    Jacob Carl England’s position is that a motion to suppress his statements to Tulsa police should have been sustained, and therefore evidence from the custodial interrogation should not have been considered in determining whether England should have been bound over for trial, according to a document filed by the defense.

    “Even if the statement could be considered admissible, the evidence was insufficient as to establish probable cause,” says a brief filed by defense attorney Rob Nigh.

    Tulsa County prosecutors will have an opportunity to file a response before this motion and others are argued at a Feb. 25 hearing.

    No trial date is yet set.

    England, 20, and Alvin Lee Watts, 33, are each charged with three counts of first-degree murder, two counts of shooting with intent to kill, and five counts of malicious intimidation or harassment.

    When arraigned Wednesday, England and Watts declined to enter a plea.

    District Judge James Caputo entered a plea of not guilty on behalf of both defendants.

    England and Watts are accused of shooting five black people at random at four north Tulsa locations on April 6, 2012.

    At the 2012 preliminary hearing, defense attorney Clark Brewster asserted that a Tulsa police detective, in assuring England that a recorded statement was confidential, contradicted a previous Miranda warning that anything England said “can and will be used against you in a court of law.”

    At the preliminary hearing, Special Judge David Youll denied the motion to suppress England’s statements, but the issue can be raised again before the trial judge, Caputo.

    Prosecutors allege that both England and Watts deserve the death penalty.

    In court Wednesday, Assistant District Attorney Steve Kunzweiler read aloud the charges and the alleged “aggravating circumstances” that support the death penalty requests.

    Another defense filing asserts that the bill of particulars filed in support of the death penalty request is deficient and should be stricken as “it does not satisfy the demands of due process.”

    The defendants face murder counts linked to the fatal shootings of Dannaer Fields, 49, Bobby Clark, 54, and William Allen, 31.

    Counts of shooting with intent to kill pertain to two victims, David Hall and Deon Tucker, who survived.

    Shena Burgess, one of Watts’ public defenders, said she will soon file a motion seeking to have Watts and England tried separately.

    Two men charged with fatally shooting three people in Tulsa last year are scheduled to be in court.

    Court records show Alvin Watts and Jake England are due to appear Monday afternoon ahead of their separate jury trials, which have been set for early next year.

    Pair plead guilty in Tulsa shooting rampage



    Two men charged with first-degree murder and hate crimes in the shooting deaths of three people in Tulsa last year pleaded guilty Monday and were sentenced to life in prison without parole.

    Alvin Watts and Jake England changed their previous pleas of not guilty in Tulsa County District Court as part of a deal in which prosecutors agreed to spare the men the death penalty. Members of the victims' families also agreed to the punishment, prosecutors told the court.

    England, his voice cracking slightly as he read a prepared statement to the court, admitted going on the rampage with Watts with the aim of killing black people. England also apologized to the city's black community.

    "There are no words to express the sorrow and guilt of what I have done," England said. "There is no excuse for my actions. I must live with this in my heart until the end of my days."

    Watts said nothing when offered a chance to speak in court, only admitting to helping England carry out the rampage.

    As England read his statement, family members of the victims sobbed quietly in the first row. They were later ushered out of the courtroom after the men were sentenced and did not speak to reporters.

    Watts, 34, and England, 21, were charged with first-degree murder, shooting with intent to kill and five hate crimes in the 2012 shootings of William Allen, Bobby Clark and Dannaer Fields, who were killed as they walked near their Tulsa homes on Easter weekend. Two others were shot and wounded.

    All five victims were black. Watts is white and England has said he is Cherokee Indian. Watts and England had faced separate trials that were scheduled for early next year.

    District Court Judge James Caputo sentenced both men to three terms of life in prison without parole for the murder convictions. The two were each given two more life terms for shooting with intent to kill and five, one-year prison terms for the hate crimes.

    "Justice is served by this result," said Tulsa County First Assistant District Attorney Doug Drummond. "These killers will spend the rest of their life behind bars for their actions.

    "This was a senseless and tragic violent crime that alarmed everyone in our city as well as nationwide," he added.

    Rob Nigh, an attorney for England, said a deal from prosecutors had only recently been offered to his client. He said England decided to plead guilty because he wanted to take responsibility for what he had done.

    "He has tremendous remorse for what has happened," Nigh said. "He was telling the truth when he said he will live with this for the rest of his life."

    Some of the brutal details on how the pair carried out their rampage last year came out in a preliminary hearing.

    England's uncle testified last year that England and Watts treated the mass shootings as a contest and said England used racial slurs to describe the victims the day after the crimes.
