    Family of former Evarts mayor wants death penalty for Shell

    Family members of former Evarts mayor Ronnie King want murder suspect Shelby Shell to pay with his life.

    Jerri Mulkey says her brother was murdered in cold blood.

    Police say King was found dead inside his burning home last month, his hands and ankles tied, with duct tape covering his nose and mouth.

    "You don't go out and buy duct tape and gasoline and zip ties and all this, if you're just snapping," Mulkey said.

    29-year-old murder suspect Shelby Shell's family has claimed he killed King because of a mental illness, but Mulkey rejects that claim. Sister Diana Perkins says King's murder is the hardest thing the family has ever endured.

    "It's destroyed us. It's killed us. I mean just like killing... him being dead, it's like it's killed us," Perkins said.

    Shelby Shell has maintained this whole time that he is innocent and that police have the wrong man, but Ronnie King's family says he is guilty and they want justice.

    "We do want lethal injection. We're pushing for that, and we do not have any sympathy for Shelby Shell or his family," Mulkey said.

    Family members say it was not King's time to go, and they can not move on until his killer pays for what he has done.

    Prosecutors are waiting for the charges against Shelby Shell to be presented to the Harlan County grand jury.

    Suspect in former mayor's death faces eight count indictment

    A man accused of killing a former mayor now faces an eight count indictment.

    Police say in February, 29-year-old Shelby Shell shot and killed Ronny King at his home in Evarts and then set it on fire.

    Shell told us from jail he is innocent, but members of King's family say they are convinced Shell is the killer.

    The charges against Shell include murder, robbery, kidnapping, and arson.

    He's expected to be arraigned May 16th.

    Shell pleads not guilty to murder

    A man accused of murder was arraigned in Harlan Circuit Court on Thursday. Shelby Shell, 29, of Berea, was arraigned in front of Judge Robert Costanza from Bell County.

    Shell, who will be represented by Laura Karem of the Public Defenders Office, entered a plea of not guilty on charges of murder, first-degree robbery, tampering with physical evidence, first-degree burglary, kidnapping, possession of a handgun by a convicted felon, persistent felony offender and second-degree arson.

    Shell is accused of the murder of Ronnie King, a former Evarts mayor.

    According to previous reports, King was found dead in his home on Feb. 18 when his brother, Jerome King, entered his brother’s house after seeing smoke. He found his brother dead inside the residence.

    An autopsy determined King’s cause of death was a gunshot wound.

    Previous reports show Shell was indicted on the charges last week and served at the Harlan County Detention Center where he is incarcerated, according to Kentucky State Police Det. Mike Cornett.

    Shell’s next court appearance is scheduled for Aug. 15.

    Shell appears in court for murder case

    Shelby Shell made a brief appearance in Harlan Circuit Court on Thursday for a scheduled pre-trial conference in front of Judge Henry Johnson.

    Shell is accused of murdering Ronnie King at King’s home in Evarts. King was the manager of Eastbrook Apartments and previously served as mayor of Evarts as well as an Evarts city councilman.

    Shell’s attorneys, Daniel Schulman, Laura Karem and Roger Gibbs, all of the public defender’s office, used the appearance to discuss a trio of motions filed by the defense team. The motions are requesting a visit to the crime scene, some additional discovery (evidence) as well as a motion to preserve evidence.

    Assistant Commonwealth’s Attorney Karen Davenport told Johnson she had not yet seen any of the motions.

    “They look pretty normal to me,” remarked Johnson.

    Johnson set a court date of Sept. 5 in order to give Davenport time to receive a copy of the motions and review them.

    Shell also requested through his attorneys that he be moved from the Harlan County Detention Center to another detention facility due to safety concerns. Johnson did not make a decision on the request at this time.

    According to Gibbs, a facility willing to take Shell would have to be located before a decision could be made regarding where he would be held.

    Shell was arrested for the murder by the Kentucky State Police Special Response Team on Feb. 25 at his residence at 100 Melody Lane in Berea.

    Previous reports state King was found dead in his home on Feb. 18 when his brother, Jerome King, went into his brother’s house after seeing smoke and found his brother dead inside the residence. Evarts Fire Department and Kentucky State Police were then called to the scene.

    Harlan County Coroner Phillip Bianchi sent the body to the state medical examiner’s office for an autopsy. The autopsy determined the cause of death was a gunshot wound.

    After his arrest, Shell was transported back to Harlan County and lodged in the Harlan County Detention Center on a $500,000 bond.

    In addition to the murder charge, Shell faces charges of first-degree robbery, first-degree arson, kidnapping of an adult, tampering with physical evidence and first-degree burglary. He was additionally charged with possession of a firearm by a convicted felon.

    Shell has an extensive arrest history in Harlan County which includes previous arrests for burglary, robbery, assault and fleeing or evading police.

    Accused murderer’s motion against jail denied

    22 incident reports filed against Shell while incarcerated

    The afternoon session of Harlan Circuit Court on Thursday saw a string of defendants accused of murder and other charges.

    Special Judge David Williams presided over the session.

    Shelby Shell, accused of murdering Ronnie King in his home and setting it on fire in Evarts, appeared with attorneys Roger Gibbs and Laura Karem for a pretrial conference.

    According to the Circuit Court Clerk’s Office, Shell’s attorneys filed a motion to prohibit the Harlan County Detention Center from violating his rights.

    Assistant Commonwealth’s Attorney Karen Davenport called Harlan County Detention Center Sgt. Derrick Moore to the stand to shed some light on the accusation.

    Moore testified that Shell was being kept in a cell by himself due to actions Shell had taken while incarcerated.

    Moore said Shell has had 22 incident reports filed on him including multiple sexual assault reports from other inmates and escape attempts.

    Shell, sitting next to his attorney, interrupted Moore’s testimony by loudly stating “That’s bull…!”

    Williams told Shell if he did not settle down the hearing would end immediately. Shell fell silent.

    Moore continued his testimony, stating Shell is being treated as a security risk for the safety of everybody involved.

    Shell was called to the stand to testify by Karem.

    Shell testified that he was not allowed to have a spoon and had to eat with his fingers. He also stated he was only allowed 18 inches of toilet paper at a time and when issued a Bible he had to return it after a few hours.

    After some consideration Williams ruled against the motion, stating the Harlan County Detention Center had not taken punitive action against Shell.

    Shell is charged with murder, tampering with physical evidence, first-degree robbery, kidnapping, first-degree burglary, second-degree arson and convicted felon in possession of a handgun.

    Murder cases headed for resolution

    A murder case involving the death of Evarts resident Ronnie King is also still ongoing.

    Shelby Shell, 31, of Berea, was charged with King’s murder.

    According to a previous report, the criminal complaint sworn out by Kentucky State Police Lt. Jason Adams states Shelby Shell unlawfully entered Ronnie King’s residence and shot him in the head. Shell then allegedly bound Ronnie King’s hands and feet with duct tape. Shell then set fire to the residence in an attempt to destroy or remove evidence from the scene. The complaint also states Shell entered the home in possession of a firearm.

    Shell faces multiple charges including murder, first-degree robbery, first-degree arson, kidnapping of an adult, tampering with physical evidence and first-degree burglary. He was additionally charged with possession of a firearm by a convicted felon and parole violation.

    Shell’s next scheduled court appearance is a pre-trial conference on Jan. 15.

    Update: Judge declares mistrial in Harlan County murder case

    A judge has declared a mistrial in the Shelby Shell murder case.

    Thursday morning at 9 a.m. the defense continued calling witnesses to the stand including Evarts Fire Chief Cledo Powers, a woman who once worked with Ernie Shell, and Jessica Wells, an investigator for the defense.

    More evidence was brought forth for the jury, including phone records and payroll of Shelby Shell.

    The defense closed around 11 a.m. and closing arguments began.

    In closing arguments, Laura Karem with the defense claimed former detective Michael Cornett stopped his investigation after interviewing Ernie Shell and James "Jimbo" Collins.

    After closing arguments the jury began deliberating shortly after 6:30 p.m.

    Two hours later, the jury came back into the courtroom and said they could not reach a verdict.

    Harlan County Circuit Court Judge Kent Hendrickson sent the jury back to deliberate, to try to go over the evidence again and reach a verdict.

    At around 10:50 p.m.the jury came back in to say they still could not reach a verdict, and Judge Hendrickson declared a mistrial.

    The jury count was 6-6.

    Shell accepts 20-year plea deal for King murder

    An Evarts man accepted a 20-year plea deal on Tuesday during a Harlan Circuit Court final sentencing for the murder of former Evarts mayor Ronnie King in 2013 and separate hostage situation at the Harlan County Detention Center in 2014.

    Shelby Shell, 36, of Berea, took the 20-year plea for the 2013 murder charges, while the kidnapping charges of two deputies at the detention center were amended as misdemeanors.

    Harlan Circuit Court Judge Kent Hendrickson first declared the King murder case a mistrial after a hearing on March 14, 2019, with the jury count at 6-6. After hours of reviewing more evidence and listening to the arguments, the jury came back to say they still could not reach a verdict.

    Shell was arrested by Kentucky State Police officers on Feb. 25, 2013, for the murder of the former Evarts mayor and council member.

    According to a criminal complaint from former KSP Lt. Jason Adams, Shell unlawfully entered King’s home in possession of a firearm. Shell allegedly shot King in the head. He then bound King’s hands and feet before setting fire to the home, destroying the evidence.

    Shell is charged with murder, first-degree robbery, first- and second-degree arson, kidnapping of an adult, tampering with physical evidence, first-degree burglary, possession of handgun by convicted felon and for being a persistent felony offender.

    Shell currently has two full-cash bonds worth $1,000,000 and $10,000, respectively.
