    Death penalty for heroin trio

    Gardener Kwok Weng Fatt, 62, labourer Abdul Rahman Lee Abdullah, 54, and housewife Nurul Jannah Seng Abdullah, 47, were arrested at the Penang International Airport en route to Australia in January 2005.

    The three, who did not know each other, told the High Court they had met three different people who asked them to swallow rubbery tubes to be taken to Australia, media reports say.

    They said they believed the tubes contained just medicine.

    Kwok was paid RM180 ($A58) for each of 84 tubes he swallowed, Abdul Rahman was paid RM160 for each of the 68 tubes he swallowed, while Nurul Jannah was paid RM150 for each of the 81 tubes she swallowed.

    Judge Datuk Zamani Abdul Rahim rejected their defence and sentenced them to hang, the newstraitstimes online reports.

    The ABC says they plan to appeal.

    Swede gets death penalty in Malaysia for drugs

    A Swedish bar operator was sentenced to death by the High Court here yesterday for trafficking in drugs two years ago.

    Judge Noor Azian Shaari sentenced Ferry Linbark, 44, a Swedish of Iranian origin, after finding him guilty of trafficking in 4.3kg of methamphetamine at the Kuala Lumpur International Airport arrival hall at 10am on Dec 6, 2011.

    The drugs were found at the bottom of Linbark's bag.

    In her decision, Noor Azian said the defence had failed to raise reasonable doubt on the prosecution's case.

    She said Linbark, who owns a bar in Pattaya, Thailand, had relied on mere denial in his defence against the charge.

    "We, therefore, find the accused guilty.

    "With no other alternatives available, the court has to impose a sentence of death as provided under the law," she said.

    Deputy public prosecutor Naziah Mokhtar from the Customs Department prosecuted while Linbark was represented by Manjit Singh and L. Ramesh.

    A total of nine witnesses testified in the trial.

    He is an Iranian who received Swedish nationality by marriage. He disposed of the female.
    The bar in Pattaya is a fail.
    He is an idiot as if he went across the land border he would never get caught. Going through an airport with their electronic sniffers and dogs means you have a concentrated choke point. Also if you are carrying its hard to deny. If you are driving a rental car you can claim its the previous renter.

    Businessman sentenced to death for drug deal

    A Malaysian court on Friday sentenced a German businessman to death for drug trafficking, his lawyer said.

    A high court outside the capital Kuala Lumpur found Bebou Akpo Bouraima guilty of trafficking, which carries the mandatory death penalty by hanging, his lawyer Karpal Singh said.

    The German, who is of Togolese descent and is reportedly 40 years old, was found guilty of smuggling 1.5 kilogrammes (3.3 pounds) of methamphetamine at the Kuala Lumpur International Airport in 2011, he said.

    "She (the judge) didn't believe his story... that his bag was intended for his girlfriend," Karpal told AFP, adding the defence would appeal the ruling.

    Anyone with at least 50 grammes of the drug is considered a trafficker in the Muslim-majority Southeast Asian country.

    Two other Germans of Afghan descent were acquitted earlier this year for drug smuggling in a separate case.

    They were arrested for smuggling more than 10 kilogrammes of methamphetamine into Malaysia in 2012. They remain in jail pending appeal, said Karpal, who also defended them.

    On Monday, Malaysian authorities re-arrested an Australian man, who was acquitted of drug trafficking last week.

    His lawyers, seeking his release, have argued detaining him pending appeal is unconstitutional. A court is to rule on the case next Tuesday.

    Hundreds of people are on death row in Malaysia, many for drug-related offences, though few have been put to death in recent years.

    Appeals Court allows Vietnamese woman on death row to produce new evidence

    PUTRAJAYA: In a rare decision, the Court of Appeal here today allowed an application brought by a Vietnamese woman, who was sentenced to death for drug trafficking, to bring in new evidence in her bid to prove her innocence.

    A three-member panel chaired by Justice Datuk Balia Yusof Wahi granted Nguyen Thanh Ngoc Tuyet's application (rpt Nguyen Thanh Ngoc Tuyet) to produce new evidence in the form of two police statements and oral evidence of three Vietnamese witnesses to support the contents of those documents.

    The statements were allegedly made by her friend Tran Tranh Tam to two Vietnamese police officers who had recorded her statements in Vietnam.

    Nguyen Thanh, 25, a university dropout, had claimed in her defence that she had picked up a bag (in which drugs were found) belonging to Tran Tranh at the Penang International Airport
    and that she had no knowlege of the contents of the bag.

    Justice Balia fixed Dec 11 for the Court of Appeal to hear the testimonies of Tran Tranh and two Vietnamese police officers.

    Their (Tran Tranh and the two Vietnamese police officers') evidence would then be included in the records of appeal and would be considered by a three-member panel of the Court of Appeal which would hear Nguyen Thanh's appeal against her conviction and death sentence.

    Justice Balia who presided on the panel with Justices Datuk Rohana Yusuf and Datuk Seri Zakaria Sam ordered that the three witnesses be produced before the Court of Appeal at the defence's expense.

    He also made an order that the testimonies of the three witnesses were to be heard by a Court of Appeal panel and not before the High Court because judicial commissioner Mohd Amin Firdaus Abdullah who heard Nguyen Thanh's trial had retired this year.

    "Our paramount consideration is the interest of justice. Every opportunity must be given to the appellant (Nguyen Thanh) because she is facing the death penalty. There is a special circumstances to grant her application," said Balia.

    In today's proceedings, Nguyen Thanh's counsel K.Simon Murali said the statements that were recorded revealed vital facts that were capable of fortifying his client's defence that she had no knowledge of the presence of the alleged drug substance in the bag she was carrying at the time of her arrest.

    Simon said the new evidence only surfaced in December last year and July this year and were not available to Nguyen Thanh during trial in the High Court.

    He said the High Court's grounds of judgment had held that Tran Tranh was not a fictitious character but a real individual who had actually arranged Nguyen Thanh's travel and accommodation in Malaysia.

    Simon said the defence had the cooperation of the Vietnamese Embassy on this matter.

    The mother of a child (Nguyen Thanh) was sentenced to death by the High Court in George Town on July 18, 2012 after she was found guilty of trafficking in 2,030.5gm of methamphetamine at the arrival hall of the Penang International Airport in Bayan Lepas at 10.10am on June 26 2011.

    She lodged an appeal to the Court of Appeal against the High Court's decision.

    Romanian sentenced to death in Malaysia for drug trafficking

    A 21-year-old Romanian was recently sentenced to death by the High Court in Malaysia for drug trafficking, but his lawyers will appeal the decision.

    The Romanian was suspected of trafficking almost 1.5 kg of methamphetamine in June 2012, which was discovered during baggage checking at the Kuala Lumpur International Airport.

    A statement from the Romanian Ministry of Foreign Affairs states that “according to the information provided by the diplomatic mission, the conviction decision is not final and the sentence will be appealed under the local law.”

    The Romanian was born in Telega village in Prahova county, Romania.

    Malaysia rebuffs Iran call to spare condemned drug mules

    Malaysia insisted Wednesday two Iranian women sentenced to death for drug trafficking must face "due process" despite a warning from Tehran that their executions would harm bilateral relations.

    Shahrzad Mansour, 31, and Neda Mostafaei, 26, were sentenced to death in September for smuggling methamphetamine into Malaysia in December 2010. Defence lawyers are appealing the case.

    The two Muslim nations both use the death penalty against drug traffickers.

    But Iran's foreign ministry warned last week that executing the women would have a "negative effect" on bilateral ties, and called for them to be spared.

    In a statement sent to AFP, Malaysia's Foreign Ministry said that while it valued relations with Iran it could not tolerate "illegal activities, which are detrimental to Malaysia's image and security".

    "Any infringement of the laws, whether committed by foreigners or Malaysian citizens, will be dealt with in accordance with Malaysian laws," it said.

    "Malaysia assures Iran of the independence of the judiciary system... It is in this context that we hope for Iran to understand that any decision of our courts is carried out in accordance to the due processes of law," it added.

    More than 200 Iranians are jailed in Malaysia, mostly for drug-related offenses, the statement said.

    About half of the 200 have been convicted, with 70 either serving a life sentence or on death row, it added.

    The two women were arrested on arrival at Kuala Lumpur International Airport.

    The court was told that drug traffickers had promised them a free trip to Malaysia in exchange for transporting "food items" that were filled with methamphetamine without their knowledge.

    The Malaysian judge in the case dismissed that defense as a "fairy tale".

    Though hundreds of people are on death row in Malaysia, the country has carried out few executions in recent years.

    Iran has one of the world's highest execution rates, with more than 500 cases last year and almost the same number so far this year, according to human rights watchdogs.

    Malaysia is a predominantly Sunni Muslim country while Iran is predominantly Shia.

    Nigerian students gets death for drug trafficking

    A Nigerian student of a private college in Kuala Lumpur was sentenced to death by the High Court here today for trafficking 6.59 cannabis last year.

    Judicial Commissioner Datuk Mohd Zaki Abdul Wahab ruled that the prosecution had proved its case beyond reasonable doubt against Pius Emmanuel David, 33.

    The accused, clad in blue and white striped t-shirt and brown pants, appeared calm and nod his head when the verdict was read out to him by the court interpreter.

    Pius was found guilty of committing the offence at an express bus station in Sungai Petani on Jan 25 at about 9.15pm.

    In the defence, the accused claimed that he was unaware of the drugs being in his possession and blamed his friend who allegedly took his luggage when the latter sent him to a hotel in Changlun.

    According to the accused, he did not check the content of the bag when his friend returned it to him before both of them headed to Sungai Petani in a car.

    He also claimed that he only learnt about the seven packets of drugs which were found inside his black luggage when he was inspected by police before boarding an express bus to Kuala Lumpur at a bus station in Sungai Petani.

    However, Zaki in his judgment said that the court found the defence as illogical as it was hard to believe that the accused did not bother to check the content of the bag after it was returned to him.

    The prosecution was conducted by deputy public prosecutor Siti Aishah Abdul Rashid while the accused was represented by counsel B Murthy.

    Frenchwoman charged with planting cannabis in Malaysia

    A Frenchwoman was charged on Thursday in Malaysia with growing cannabis, escaping a harsher drug trafficking charge which could have seen her sentenced to death.

    Melissa Marie Commins, 31, was charged together with a Malaysian, Jon Stephen Mosundu, 24, with planting cannabis at an upmarket condominium unit in Kota Kinabalu on Borneo island, news agency Bernama reported.

    The penalty for the offence is life in prison upon conviction. A government official with knowledge of the case confirmed the charge.

    The pair were arrested last week, together with two other Malaysians and an Indonesian maid at another unit in the same condominium.

    Police seized 36 cannabis plants and half a kilogram (1.1 pounds) of processed cannabis from the units.

    One of the others arrested, named by Bernama as Ashley Ng Han, 26, was charged Thursday in a separate court with planting cannabis and drug trafficking, which carries a mandatory death penalty upon conviction.

    Malaysia is known for its strict anti-drug laws with hundreds of people currently on death row, mainly for drug-related offences.

    Court upholds death sentence of man who set wife, daughter ablaze

    PUTRAJAYA: The Federal Court here Wednesday upheld the conviction and death sentence of an ice seller for killing his wife and daughter, about 10 years ago, by splashing kerosene and setting them ablaze.

    A five-member panel chaired by Federal Court judge Tan Sri Suriyadi Halim Omar also upheld the High Court decision to sentence P. Balan Subramaniam to 12 years jail for attempted murder of another daughter.

    Suriyadi, who presided on the panel with justices Tan Sri Ahmad Maarop, Tan Sri Jeffrey Tan Kok Wha, Tan Sri Mohamed Apandi Ali and Datuk Seri Abu Samah Nordin, dismissed Balan's final appeal on his conviction, death sentence and jail sentence.

    Balan, 62, was found guilty and sentenced to death by the Ipoh High Court for the murder of his 48-year-old wife, R. Angeladevi.

    The High Court had originally acquitted and discharged Balan on the charge of killing his daughter, Anuradha, 20, a college student, and attempted murder of his then-23-year-old daughter Malini (now 34 years old), a hospital assistant, without his defence being called.

    However, on appeal to the Court of Appeal by the prosecution, the matter was subsequently remitted back to the High Court for Balan to enter his defence on the two charges.

    At the end of the defence case, Balan was found guilty and sentenced to death for killing Anuradha and he was also found guilty and given a 12-year jail sentence for the attempted murder on Malini.

    He lost his appeal to set aside his conviction and sentences at the Court of Appeal.

    Balan was accused of committing the offence at his house in Jalan Anggerik, Desa Changkat, Batu Gajah in the Kinta District of Perak between 10pm and 11pm on Oct 11, 2004.

    According to the facts of the case, a quarrel broke out on the day of the incident which led to the arson. Angeladevi and Anuradha had made declarations implicating Balan before their death.

    Balan was represented by lawyers Datuk K. Kumaraendran and Dev Kumaraendran while deputy public prosecutor Hamdan Hamzah appeared for the prosecution. - Bernama
