    Ayman al-Zawahri issues warning over fate of Dzhokhar Tsarnaev, sentenced to death by lethal injection last June, or any other Muslim prisoner in US.

    Al-Qaida leader Ayman al-Zawahiri has warned the US of the “gravest consequences” if Boston marathon bomber Dzhokhar Tsarnaev or any other Muslim prisoner is executed.

    Tsarnaev, named in Zawahiri’s online video message, was sentenced to death by lethal injection last year for the 2013 bomb attack that killed three people and injured more than 260 others. Tsarnaev committed the bombing with his older brother, Tamerlan, who was killed in a shootout with police in the manhunt that followed it.

    “If the US administration kills our brother the hero Dzhokhar Tsarnaev or any Muslim,” Zawahri said in an online video, “[it] will bring America’s nationals the gravest consequences.”

    The younger sibling spoke publicly only once since his capture, telling the Boston court that sentenced him: “I am sorry for the lives I have taken, for the suffering that I have caused you for the damage I have done – irreparable damage.”

    Zawahri urged Muslims to take captive as many westerners as possible, especially those whose countries had joined the “Crusaders’ Campaign led by the United States”.

    The Egyptian-born militant, sitting in front of green drapes, urged sympathizers to hold “crusaders” hostage in order to bargain for Muslim prisoners’ release. He said that western nations “only understand the language of force”.

    Zawahiri took command of al-Qaida after Osama bin Laden was killed in 2011, by a US raid in Pakistan. The 64-year-old successor has eluded American strikes in the five years since, but the group’s influence has waned while rivals have gained power around the Middle East. Al-Qaida remains an active presence in Yemen, Pakistan and Libya, but its affiliate in Iraq grew into the terror group Isis as the civil war in neighboring Syria spiraled out of control.

    Al-Qaida’s propaganda arm periodically threatens nations with recorded messages and long statements. In January Zawahiri condemned the execution of a Shiite cleric, Nimr al-Nimr, and 46 others by Saudi Arabia. Later that month two men attacked a Shia mosque in the majority Sunni country, though no group claimed credit. The attack resembled those inspired by Isis, whose leader Zawahiri has called a false “caliph of surprises”.

    Zawahiri remains wanted by the US and has appeared in dozens of al-Qaida propaganda messages since 2003. In a September message he urged militants to move “the war to the heart of the homes and cities of the crusader west and specifically America”, and again called Isis’s territorial claims illegitimate.

    Tsarnaev is being held at a high-security prison in Florence, Colorado, while his attorneys appeal the death sentence. The legal struggle over his ultimate fate could last decades: since 1998, US authorities have executed only three of the 74 people sentenced to death for federal crimes.

    Marathon Bomber Dzhokhar Tsarnaev's Death Penalty Appeal Comes Due

    BOSTON, MA — An argument to spare the life of surviving Boston Marathon Bomber Dzhokhar Tsarnaev is due to a federal appeals court within two months, according to multiple reports Monday.

    Tsarnaev was sentenced to the death penalty in summer of 2015 for his role in the 2013 bombings that killed three people and injured 250 more. He also killed a police officer in the ensuing manhunt. The jury's unanimous decision followed 14 hours of deliberation.

    His legal team now hopes to appeal that decision.

    A federal appeals court wants to receive the initial write-up from Tsarnaev's team by Oct. 3, multiple outlets reported Monday afternoon.

    Tsarnaev’s lawyers during the 2015 trial admitted he took part in the bombings but argued he should be spared the death penalty because he was under the spell of his older brother, Tamerlan, who was killed in a shootout with police.

    A judge in January rejected his legal team's request for a new trial, leaving them mired in what will likely be a lengthy appeals process.

    Tsarnaev, now 23, is being held at a maximum security federal prison in Colorado.

    Boston Marathon bomber gets top public defender from New York in death penalty appeal

    Boston Marathon bomber Dzhokhar Tsarnaev has added New York’s top federal public defender to his legal team as he appeals his death sentence, filings show.

    A judge approved David Patton, the head of New York’s influential federal public defenders office, to represent Tsarnaev, 23, on Friday.

    The bomber’s legal team indicated in papers they were still reviewing trial documents in preparation for arguments before the First Circuit Court of Appeals.

    Federal defenders in New York have represented many high-profile defendants in Brooklyn and Manhattan, including Times Square bomber Faisal Shahzad, Russian spy Anna Chapman and so-called cannibal cop Gilberto Valle. The office is also representing accused Chelsea bomber Ahmad Rahami.

    The acclaimed anti-death penalty defender who opened her argument for sparing the life of Boston Marathon bomber Dzhokhar Tsarnaev with the shocking declaration, “It was him,” now wants off his case, telling a federal court his appeal “would benefit from a fresh look.”

    Attorney Judy Clarke’s legal acumen kept the likes of Olympic Park bomber Eric Rudolph and Unabomber Ted Kaczynski from facing execution before a jury sentenced Tsarnaev, 23, to die. She has asked the U.S. Court of Appeals for the First Circuit in Boston to replace her with fellow California legal eagle Clifford Gardner. Gardner’s infamous clients include Scott Peterson, who is appealing his death sentence for the 2002 murder of his pregnant wife, Laci.

    “This substitution would provide Mr. Tsarnaev with high-quality and cost-effective appellate representation,” the motion to remove Clarke reads. “Mr. Gardner ... is one of the most experienced capital appellate and federal appellate lawyers in the United States. He has particular expertise representing high-profile defendants whose trial court proceedings resulted in voluminous, complicated records.”

    Tsarnaev has been held in the federal Supermax prison in Colorado since his trial wrapped in 2015. He signed off on the substitution of Gardner for Clarke Jan. 18 in a consent document filed with the court Friday.

    His defense team, led by Clarke, filed their notice of appeal one year ago yesterday, but still have not submitted a brief stating on what grounds they believe Tsarnaev’s conviction and capital punishment should be overturned.

    Feds refuse to share secret files with Tsarnaev lawyers

    Federal prosecutors are refusing to turn over to convicted marathon bomber Dzhokhar Tsarnaev’s appellate lawyers 13 “classified” documents that are still sealed nearly two years after he was condemned to death.

    The secret government filings were part of Tsarnaev’s case in U.S. District Court for the 2013 Boston Marathon bombings that killed three spectators, wounded hundreds more, and were followed by the murder of an MIT police officer and wounding of a transit cop.

    Without knowing what they are, the 23-year-old death-row killer’s lawyers insist to the U.S. Court of Appeals for the First Circuit they “will not be able to meaningfully represent Mr. Tsarnaev on appeal ... There is no precedent for allowing secret information in a case under the Federal Death Penalty Act.”

    But in their opposition filed late last week, prosecutors for acting U.S. Attorney William D. Weinreb and the U.S. Department of Justice contend, “The fact that this is a death penalty case changes nothing. Although defense counsel in capital cases have a duty to advocate vigorously for their client, they do not have an unqualified right to access classified and otherwise confidential information.”

    The documents, which prosecutors have shared only with Tsarnaev trial Judge George A. O’Toole Jr., are described along with “the reasons for their continued non-disclosure to the defense” in a filing with the appellate court. It, too, is sealed; however, prosecutors did disclose that none of the disputed information was used against Tsarnaev at trial and none of it is “helpful to the defense.”

    O’Toole issued an order last month denying Tsarnaev’s public defenders access to the paperwork.

    Although Tsarnaev’s lawyers are appealing his 30-count conviction and death sentence, no brief has been filed and no date has been set for when one is due.

    Juror transportation during the high-profile trial of Boston Marathon bomber Dzhokhar Tsarnaev, who was sentenced to death in 2015, could be one of the many factors under review in his pending appeal, records show.

    The issue of how jurors were escorted to and from the Moakley Courthouse surfaced in a brief order that US District Court Judge George A. O’Toole Jr. entered on Friday.

    “I understand from the Clerk’s Office that counsel are requesting copies of the Jury Management and Transportation Order, which was sealed during the proceedings in order to protect the confidential juror transportation arrangements made by the United States Marshal Service and to minimize the risk of juror contamination [by outside factors],” O’Toole wrote.

    “Upon review of the order, I see no reason for a continuation of the seal. Therefore, the Clerks Office is directed to unseal the document and docket entry text as to Dzhokhar A. Tsarnaev.”

    The document remained unavailable for review on the federal Public Access to Court Electronic Records, or PACER, website as of 10 p.m. Friday.

    Tsarnaev, 23, was sentenced to death for his role in the April 15, 2013 bombings, which killed three people and wounded more than 260. His appeal is pending before the US Court of Appeals for the First Circuit in Boston.

    His older brother and co-conspirator, Tamerlan, was killed in a clash with police days after the attacks. Tsarnaev is being held at a supermax prison in Colorado.

    Boston Marathon bomber Dzhokhar Tsarnaev are fighting to get their hands on sealed interviews with Ibragim Todashev, a Chechen national who was fatally shot by an FBI agent after allegedly confessing that he and Tsarnaev's late brother Tamerlan were behind an unsolved triple murder in Waltham.

    The attorneys, whose argument for sparing Tsarnaev's life is due next month before the U.S. Court of Appeals for the First Circuit in Boston, filed a motion with the court late Tuesday asking that the reasons for their request be sealed, as well.

    Todashev knew Tamerlan Tsarnaev, 26, from a mixed-martial arts gym in Boston where both had trained. Todashev was fatally shot in Orlando, Fla., on May 22, 2013, one month after the brothers' terrorist attack on Copley Square, while being interviewed by the FBI.

    Tsarnaev's legal team seek "reports and recordings of interviews of Ibragim Todashev" that are part of "still-sealed proceedings in the district court" where their client was tried and sentenced to death in 2015, their initial motion states.

    They note, however, that the request could be a moot point if a district court judge agrees to unseal the Todashev material.

    Tsarnaev's original defense team was forbidden by U.S. District Court Judge George A. O'Toole Jr. to introduce the 2011 Waltham killings as a way to suggest to jurors that Tsarnaev was a manipulated puppet of his older brother.

    After personally reviewing the FBI's transcripts, audio and video of its interviews with Todashev, O'Toole remarked he might have ruled in the defense's favor, "if Todashev were available as a potential witness.”

    Tsarnaev, 24, of Cambridge, has been on death row for three years at the federal Supermax prison in Florence, Colo., for the terrorist bombings at the marathon finish line in Copley Square on April 15, 2013, that killed spectators Martin Richard, Krystle Marie Campbell and Lingzi Lu, and severely maimed or injured hundreds others.

    The former University of Massachusetts Dartmouth student was also convicted of murdering Massachusetts Institute of Technology police officer Sean Collier while attempting to evade capture with his brother three days later.

    Tamerlan Tsarnaev died that night from injuries he suffered in a firefight with police in Watertown.

    Federal prosecutors told Dzhokhar Tsarnaev's attorneys they had “no evidence” of his brother's involvement in the gruesome deaths of Raphael Teken, 37, and Erik Weissman, 31, both of Cambridge, and Brendan Mess, 25, of Waltham. The men's bodies were found in Mess's apartment Sept. 12, 2011.

    The Boston Marathon bomber’s lawyers are fighting to save his life, by demanding to see the FBI’s interview with his friend in a bid to spare him the death penalty.

    Appeals lawyers for convicted bomber Dzhokhar Tsarnaev are asking for the recordings of interviews with Ibragim Todashev, a suspect in a triple-homicide in Massachusetts. He was shot in 2013 during a confrontation with police.

    Their legal battle comes three years after a US jury of seven women and five men unanimously voted to punish Dzhokhar Tsarnaev with death for his part in detonating two bombs at the 2013 Boston Marathon, killing three people and injuring more than 260 others.

    Tsarnaev was convicted in April 2015 of all 30 federal charges against him, 17 of which carried the possibility of the death penalty.

    In May 2015, the jury found that he deserved the death penalty for some but not all of the charges – which means he will be executed by lethal injection.

    But the death-row inmate's attorneys have filed a motion for the sealed video and audio recordings of Ibragim Todashev, without spelling out their reasons for asking.
