    Prospective jurors summoned for Love capital murder trial

    Williamson County officials have summoned 1,200 potential jurors in hopes of getting at least 400 to show up Wednesday to fill out questionnaires as the capital murder trial of Albert Leslie Love Jr. enters its initial stage.

    Love’s trial was moved to Georgetown after his co-defendant, Rickey Cummings, received the death penalty in November following his conviction in Waco.

    Love, 26, also faces the death penalty if convicted in the March 2011 ambush-style slayings of Tyus Sneed, 17, and Keenan Hubert, 20, at the Lakewood Villas apartment complex in Waco.

    Judge Ralph Strother of Waco’s 19th State District Court, who will preside over Love’s trial in Georgetown, said testimony is set to begin July 8.

    The prospective jurors who report Wednesday will be asked to fill out a 21-page questionnaire with 119 questions that prosecutors Michael Jarrett and Greg Davis and defense attorneys John Donahue and Jon Evans will use to help determine if potential 
jurors are suited to the case.

    Strother said Williamson County officials summon so many 
jurors because the county has a poor track record getting jurors to honor court notices.

    “Their response is not as good as ours here in McLennan County, and we are trying to make sure we don’t have to go back and summon a supplemental panel like we had to do in Rickey Cummings’ case,” the judge said.

    In Cummings’ case, attorneys questioned about 180 potential jurors before selecting 12 jurors and two alternate jurors.

    Prospective jurors are questioned individually instead of together in a large panel in capital murder cases in which the prosecution is seeking the death 
penalty.

    Individual questioning of jurors will begin June 3 and is expected to take about three weeks, Strother said.

    The judge said testimony should last from two to three weeks.

    Strother placed the attorneys in the case under a gag order, preventing them from talking to the media.

    The questionnaire for potential jurors covers a variety of issues, from their views on capital punishment to their favorite TV shows.

    It includes personal information about their families, their religious and political affiliations, their knowledge of the criminal justice system and if they or family members have had dealings with law enforcement.

    The questionnaire also asks which is the greater wrong: for a jury to find a guilty person not guilty or for a jury to find an innocent person guilty.

    It also lists the names of about 100 prospective witnesses and asks potential jurors if they know any of them.

    Alleged shootings

    Sneed and Hubert were sitting in the back seat of a car at the apartment complex at 1601 Spring St. when multiple suspects opened fire on the car. Deontrae Majors and Marion Bible, who were in the front seat, were wounded but managed to escape.

    Waco police arrested Cummings, Love, Darvis Tyrell Cummings, Kennedy Wayne Hardway and Tyrece Edwards Richards and charged them all with capital murder in the shootings.

    District Attorney Abel Reyna since has dismissed the capital murder charges against Hardway and Richards.

    Jury Selection for Albert Love Trial

    Jury selection began yesterday in the capital murder trial for Albert Love.

    His trial was moved to Georgetown after Ricky Cummings was sentenced to death in the same case last November.

    Love could also face the death penalty if convicted in the shooting deaths of 17-year-old Tyus Sneed and 20-year-old Keenan Hubert.

    That attack happened in March of 2011 at the Lakewood Villas Apartment Complex.

    Despite moving the trial away from McLennan County, 19th District Judge Ralph Strother will still oversee the case.

    The jury will be made up of people living in Williamson County.

    Morton case affecting Love jury selection in Georgetown

    The wrongful conviction of an innocent man is casting a specter over jury selection in the Albert Leslie Love Jr. capital murder trial in Williamson County, where the Michael Morton case played out before a national audience.

    Judge Ralph Strother of Waco’s 19th State District Court said the notorious Morton case, in which the former grocery store manager spent
25 years in prison for a murder he did not 
commit, is playing a prominent role in individual questioning of potential jurors in Love’s trial.

    About 10 prospective jurors out of 55 questioned so far either were disqualified or excused by agreement because of their feelings of distrust for the criminal justice system spawned by Morton’s 
exoneration, the judge said.

    “The Morton case certainly has been a factor,” Strother said. “It has had an effect because so many people in Williamson County are aware of it.”

    Strother moved Love’s trial to Williamson County because of publicity in McLennan County in the trial of Love’s co-defendant, Rickey Donnell Cummings.

    Cummings was sentenced to death in November in the March 2011 ambush-style slayings of Tyus Sneed, 17, and Keenan Hubert, 20, at the Lakewood Villas apartments in Waco.

    Strother said that while the Morton case is being discussed with many potential jurors in Love’s case, it has not been distracting enough to give him second thoughts about his choice for the new venue.

    The judge said the Morton case had not been resolved when he selected Georgetown for Love’s trial and no one knew then how it would turn out.

    But Strother acknowledged the Morton case likely would not be mentioned as frequently if Love’s trial had been moved to a location farther away from Georgetown.

    “It occurred in Georgetown, so because of the proximity, it is fresh on everybody’s minds,” Strother said. “I certainly question if it would have come up in another county, especially to the degree of frequency that it has here.”

    Gag order

    Strother has placed prosecutors Michael Jarrett and Greg Davis and defense attorneys John Donahue and Jon Evans under a gag order, preventing them from discussing Love’s case in the media.

    Jury selection in Love’s trial began June 3 and is expected to take three weeks or more. Four jurors have been selected so far. Testimony is set to begin July 8.

    Morton was sentenced to life in prison for the murder of his first wife, Christine, in their Williamson County home.

    He was freed and declared innocent in October 2011 after DNA testing of a blue bandanna pointed to another man as the killer.

    State District Judge Ken Anderson, a former Williamson County district attorney who prosecuted Morton, was arrested April 20 after a specially convened court found he intentionally hid evidence to secure Morton’s conviction in 1987.

    State District Judge Louis Sturns, who presided over the special review, said Anderson defrauded the trial court and Morton’s trial attorneys, resulting in an innocent man serving almost 25 years in prison.

    Sturns said evidence showed Anderson improperly concealed two pieces of evidence that could have proved useful to Morton’s defense: a transcript of a police interview with Morton’s 3-year-old son, who witnessed the murder and said Morton was not at home at the time; and a police report about a suspicious man parked in a green van near the Morton home who walked behind the home on several occasions.

    Authorities arrested drifter Mark Norwood after his DNA was found on the blue bandanna mixed with Christine Morton’s blood.

    Trial movement


    Norwood’s trial was moved from Georgetown to San Angelo, where only 10 people out of 140 on the jury panel had even heard of the Morton case, said Norwood’s attorney, Russ Hunt Jr., who has an office in Georgetown.

    “The Morton case was the whole reason the state agreed to transfer venue for the Norwood trial,” Hunt said. “They knew there were so many people skeptical about the state and its actions in the Morton case, and I think it’s the reason we have a new DA here in Williamson County.

    “The blue bandanna became a campaign symbol in that race and prosecutors here tell me that they are asked by jurors in every case, even misdemeanor cases, about the Morton case. People here are very familiar with the case, and it has made an impact on how people feel about the criminal justice system.”

    Waco attorney Walter M. Reaves Jr., who helped defend Rickey Cummings and has worked with attorneys for the Innocence Project in a number of cases, said he is not surprised that jurors are asking about the Morton case in Love’s trial.

    “It definitely will help the defense lawyers because I think people who are aware of that case are just more suspicious of the prosecution now and they are going to be more cautious about the decisions they make,” Reaves said.

    During the past legislative session, Texas lawmakers passed the Michael Morton Act, which requires prosecutors to have a uniform open-file policy and to hand over all evidence favorable to defendants.

    A jury of seven women and five men, plus two female alternates, will hear testimony beginning July 8 in the death penalty trial Albert Leslie Love Jr., who is 
charged with two others in the March 2011 ambush-style slayings of two men at a Waco apartment 
complex.

    Jury selection finished Wednesday in Georgetown after court officials picked the two alternate 
jurors to round out the panel.

    Testimony to begin in Albert Love capital murder trial

    The capital murder trial of Albert Leslie Love Jr. has the potential to be the costliest McLennan County trial in decades because of a venue change to Georgetown.

    Hotel rooms, meals and mileage reimbursement for 19th State District Judge Ralph Strother, five court officials, two or three prosecutors, two defense attorneys, daily costs to keep Love in the Williamson County Jail and more all will be funded from McLennan County coffers as the state seeks the death penalty for Love.

    Testimony is set to begin Monday in the Williamson County Courthouse. The trial was moved there after Strother determined that the publicity surrounding the Waco trial of co-
defendant Rickey Cummings last year would prevent a fair trial here for Love.

    Jury selection began June 3 and took more than three weeks to complete. Each of the 160 potential jurors questioned in the arduous process was paid $30 and the 12 jurors and two alternate jurors will be paid $30 a day during the trial, which is expected to last at least two weeks.

    Before that, 450 potential jurors were called to fill out questionnaires in May. Each was paid $6 for showing up that day, also a tab that McLennan County will pay.

    During the jury selection process, the judge, a court administrator, a court reporter, two deputies and District Clerk Karen Matkin or her chief deputy, 
Suzanne Bounds, stayed in hotels at $89 a night and were given $10 a day for meals.

    Also, prosecutors Michael Jarrett and Greg Davis and defense attorneys John Donahue and Jon Evans stayed in a motel and will be reimbursed for meals.

    Love, 26, is on trial in the March 2011 shooting deaths of Tyus Sneed, 17, and Keenan Hubert, 20, at the Lakewood Villas apartment complex, 1601 Spring St. in Waco.

    Sneed and Hubert were sitting in the back seat of a car, while Deontrae Majors and Marion Bible were in the front seat. Majors and Bible were wounded but managed to escape. They testified at Cummings’ trial, which ended in November.

    Prosecutors intend to prove that Love was wielding an AK-47 when he, Cummings and perhaps others ambushed the four men sitting in the car.

    Also, records show Love reportedly violated federal firearms statutes by encouraging his girlfriend to try to buy an AK-47 assault rifle for him at Praco Pawn in Waco in March 2011; and that he committed the offense of unlawful possession of a firearm by a felon by possessing a revolver and an AK-47 in March 2011.

    Love’s school and medical records filed by his attorneys perhaps give a clue about some issues that might come up at trial.

    Love was accepted to Prairie View A&M University in the fall of 2006 and made a B, four Cs and a D his first semester. In the spring of 2007, records show he made five Fs and was given an incomplete.

    In the fall of 2007, he made 5 Fs and an A in reading, his transcripts show.

    But his medical records show that Love became ill while at school, complaining of headaches, nausea and vomiting.

    In May 2007, Love underwent a craniectomy in 
Waco to drain and remove a brain abscess, a swelling caused by a bacterial infection.

    He spent three weeks in the hospital, but returned again on May 28, 2007, for another operation on a second abscess, according to his medical records on file with the court.

    Defense attorneys could use the brain surgeries as mitigation evidence should the jury convict Love of capital murder.

    Judge bans live-tweeting in Waco death penalty case

    UPDATED — 9:47 a.m.

    Judge Ralph Strother has said he will ban live-tweeting by news reporters during trial testimony. Tribune-Herald representatives are objecting in person to the judge.

    The announcement came after a bench conference with the lawyers. The judge also ordered no cell phones to be brought into the courtroom. During the trial of Love’s co-defendant Rickey Cummings in Waco, some family members accused of taking pictures of jurors and witnesses in the case.

    Trial has recessed until 1 p.m.

    GEORGETOWN — The capital murder trial of Albert Leslie Love Jr. got off to a sluggish start Monday morning after a prosecution witness who threatened not to show up for court made good on her promise, delaying the start of testimony.

    Judge Ralph Strother of Waco’s 19th State District Court issued an order directing deputies to find and bring the witness to the Williamson County Courthouse to testify in Love’s trial.

    Strother, who was made aware that more than one witness was threatening not to show up last week, had already instructed the jury to report to court at 1 p.m. Monday instead of 8:30 a.m. when the judge wanted to begin.

    It was not immediately clear why the missing witness is reluctant to testify. Prosecutors Michael Jarrett and Greg Davis are under a court-imposed gag order and cannot speak to the media about the case.

    Love, 26, is on trial for the March 2011 shooting deaths of Tyus Sneed, 17, and Keenan Hubert, 20, at the Lakewood Villas apartments, 1601 Spring St. in Waco. If convicted, he faces the death penalty.

    Two people, including Cummings’ uncle, were arrested on retaliation charges.

    Where dozens of people flooded the McLennan County Courthouse to watch Cummings’ proceedings, there are only a few spectators in the Georgetown courtroom. Four appear to be supporting love, three are seating on the prosecution’s side.

    Love was brought to court wearing gold, wire-rimmed glasses, a navy blue blazer, tie and black pants

    Court officials expect the trial to last at least two weeks.

    LOVE TRIAL UPDATE: “It was like a battlefield, except I didn’t have anything to defend myself with”

    Prosecutors called Joye Hudson, a friend and Waco High classmate of Love’s, to the stand to kick off day 3 testimony in the death penalty trial.

    Hudson testified that the night Tyus Sneed and Keenan Hubert were gunned down in March 2011, she got a call from Love’s girlfriend who said Love was not at home with her and she didn’t know where he was. Both women tried to call him, she testified.

    Deontrae Majors, who was sitting in the front seat of the car and was shot in the ambush, then took the witness chair.

    Majors testified he and fellow witness Marion Bible were sitting in his car listening to music when Hubert joined them. The three smoked marijuana. It was then that they saw Rickey Cummings at the complex. Cummings “mean mugged” or glared at the group. Hubert got out of the car and spoke some rap lyrics to Cummings and then got back in the car, Majors testified.

    A few minutes later Tyus Sneed joined the group. As all four men sat unarmed in the car, without warning, shots rang out and windows were blown out. Majors said he heard screaming and ran for protection to a nearby apartment. He was shot six times fleeing to safety.

    “I don’t know how I got up, but some how I got up and ran. I had heard gunfire before but never before in my life like that,” Majors told the jury.

    “It was like a battlefield, except I didn’t have anything to defend myself with.”

    Prosecutors intend to call Deontrae Majors to describe how he scrambled from the front seat of a car parked at the Spring Street apartment complex and hid inside a nearby apartment until police and paramedics arrived.

    Love, 26, is on trial for the shooting deaths of Tyus Sneed, 17, and Keenan Hubert, 20. The men were in the back seat of a car and were shot eight times each. Love faces the death penalty if convicted.

    Love’s trial was moved to Georgetown because of publicity generated by the 2012 trial of one of his co-defendants, Rickey Cummings.

    Cummings was sentenced to death in November.

    His younger brother, Darvis Cummings, also is charged with capital murder in the assaults.

    Prosecution testimony in the second week of Albert Leslie Love Jr.’s capital murder trial bogged down Monday morning when three witnesses failed to show up for court.

    Judge Ralph Strother issued orders for deputies to find the witnesses and bring them to court, postponing the start of testimony until 12:45 p.m.

    Court officials reported about 10:45 a.m. Monday that the witnesses had been located and were being brought to court in Georgetown. The trial was moved to Georgetown from Waco because of publicity generated by the 2012 trial of one of Love’s co-defendants.

    Prosecutors Michael Jarrett and Greg Davis are expected to rest their case against Love today, court officials said. They are seeking the death penalty.

    Closing Arguments Begin in the Albert Love Trial

    Jurors in the capital murder trial of Albert Leslie Love Jr. watched videos Monday of Love and his wife trying to buy an AK-47 assault rifle at a Waco gun shop two weeks before the Lakewood Villas shootings.

    A store clerk testified Monday he refused to sell the rifle to Love’s wife, Takeila Patterson Love, because he was concerned the sale would be a “straw purchase,” meaning she was unlawfully buying it for someone else.

    Prosecutors Michael Jarrett and Greg Davis and defense attorneys John Donahue and Jon Evans rested their respective cases Monday afternoon.

    Love, 26, did not testify and his attorneys called no witnesses.

    Jury summations are set to begin at 8:30 a.m. Tuesday.

    If the jury answers the first two questions yes and the third no, Strother would assess the death penalty. If answered in any other combination, Love would be sentenced to life in prison without parole.
