    Love guilty of capital murder, faces death penalty

    The jury found Albert Leslie Love Jr., 26, of Waco, guilty of capital murder in the shooting deaths of Tyus Sneed and Keenan Hubert.

    The judge has recessed the jury until 8:30 a.m. Wednesday when punishment phase will begin.

    Love Trial Update: Gang expert testifies about Love’s tattoos

    William Sustaita, a gang investigator at the McLennan County Jail, testified that he has not interviewed Love, but he said by looking at Love’s tattoos, he likely is a member of a set belonging to the Bloods street gang.

    Defense attorneys objected to Sustaita’s testimony outside the jury’s presence, however, Judge Ralph Strother ruled Sustaita can testify as a gang expert.

    The numbers five and nine, a five-point crown and a five-point star are significant to the Bloods, Sustaita said.

    The jury was shown photos of Love’s numerous tattoos, many of which Sustaita says are affiliated with the Bloods gang or a set of it.

    Defense attorney Jon Evans said Love also has tattoos with the names of his wife, mother and sister, ones with nothing to do with gangs.

    Jurors heard from a Waco PD undercover officer about a 2007 traffic stop in which Love was found seated with a loaded SKS assault rifle on his lap and a black ski mask, pistol and AK-47 rifle elsewhere in the car. Four other men were in the car too. Love pleaded guilty to unlawfully carrying a weapon in as a result of the traffic stop.

    Love later pleaded guilty to evading police in a vehicle during a 2008 traffic stop in which he briefly tried to flee with his wife and her two kids in the car. Officers found pain killers and marijuana residue in car. Love was placed on probation for four years.

    McLennan County probation officer Monica Harper said Love always wore a piece of red clothing or red shoes and she documented that as a possible sign of being in a gang.

    As part of Love’s probation he was required to write a life history. Prosecutor Hilary LaBorde read Love’s history to the jury. He said he was a good boy until the 5th grade, when he joined the Bloods street gang, she read.

    Love attended Prairie View A&M University where he said he was “partying, fighting, smoking weed and robbing people.”

    In 2007 Love had brain surgery to remove abscesses. He was told he couldn’t risk getting hurt in fights, so he started carrying a gun at all times, he wrote.

    His friends told him if he couldn’t fight, then shoot somebody. He carried a gun everywhere, even in church, he wrote.

    No Love family members have been in the courtroom during the trial, likely because many of them are under subpoena as potential witnesses and are therefore prohibited from being in court.

    GEORGETOWN — Prosecutors will try to link Albert Leslie Love Jr. to gangs, drugs, shootings and robberies Wednesday morning as Love’s capital murder trial moves into the punishment phase.

    A Williamson County jury took just an hour Tuesday morning to convict Love in the March 2011 shooting deaths of Tyus Sneed, 17, and Keenan Hubert, 20, at the Lakewood Villas apartment complex on Spring Street in Waco.

    Love’s trial was moved to Georgetown because of publicity generated in Waco by the trial of his co-defendant, Rickey Cummings, who was sent to death row in 2012.

    Love, 26, has a previous felony conviction for evading arrest. Prosecutors say they will show Love admitted to his probation officer through a diary that he was involved in robberies and shootings while a student at Prairie View A&M University.

    Prosecutors also plan to show the jury photos of tattoos they say will link Love to the Bloods street gang.

    Defense attorneys plan to present evidence to show Love underwent two brain surgeries for abscesses while he was at college in possible mitigation testimony.

    Second Man Sentenced To Death For 2011 Shooting Rampage

    A jury Friday in Georgetown decided on the death penalty for Albert Love, the second of two men convicted in a shooting in 2011 at the Lakewood Villa apartments in Waco that left two dead and two injured.

    Love was convicted of capital murder Tuesday in the March 28, 2011 shooting deaths of Tyus Sneed, 17, and Keenan Hubert, 20, both of whom died in a hail of bullets as they sat inside a car parked at the apartment complex on Spring Street.

    Marion Bible, then 22, and Deontrae Majors, then 20, were wounded in the shooting, which prosecutors say was in retaliation for the April 2010 murder of Emuel Bowers III, 21, who was shot as he sat in his car at the intersection of Rose and McKeen Streets.

    Love's trial was moved to Georgetown because of heavy media coverage of the trial of the first defendant, Rickey Cummings, last fall.

    Cummings was found guilty of capital murder and then was sentenced to death on Nov. 7, 2012.

    Darvis Cummings, Ricky Cummings’ brother, has yet to go to court but also is charged with capital murder in the shooting.

    "This verdict reiterates the position of the McLennan County District Attorney's Office," District Attorney Abel Reyna said in a statement Friday afternoon.

    "Violence in our community will not be tolerated and will be met with the severest of consequences," he said.

    Before the jury went out just before 10 a.m., prosecutor Michael Jarrett called Love a cold-blooded assassin who kills without mercy or remorse.

    “Your evil is over,” Jarrett said. “It’s time to be held accountable, Gangsta. You’re done.”

    There are eight people sitting on the victims’ side of the audience and no one sitting on the side designated for Love’s family.

    His family members were on the witness list. They weren't allowed to be in the court room. His mother testified yesterday as one of the last witnesses in the punishment phase.

    Final Suspect in Spring Street Murders Sentenced

    MCLENNAN COUNTY - In a surprise move that had been kept secret for awhile, D'Arvis Cummings, charged with Capital Murder in the shooting deaths of Keenan Hubert and Ty Sneed entered a plea deal in a Waco courtroom Monday.

    Cummings was sentenced to 20 years in state prison.

    He had agreed to plead guilty to the murder charge in exchange for a lighter prison sentence.

    His brother Ricky Cummings, and Albert Love, had already been sentenced in jury trials to the death penalty in connection with the slayings that occurred in the spring of 2011.

    Judge Ralph Strother of 19th District court presided over the agreement and sentencing in the courthouse annex courtroom.

    McLennan County District Attorney Abel Reyna said in a statement, "We are very satisfied with the results of this matter. This plea brings to a close over three years of tireless investigation and prosecution of a brutal, senseless crime. We are very pleased to be able to achieve justice for the victims and their families. They can put this matter to rest knowing that all the individuals responsible for this cowardly act have been held accountable."

    In agreeing to the McLennan County D.A.'s plea deal, D'Arvis Cummings waived all rights to appeal and future hearings.

    Jury selection begins in 2010 murder case

    Jury selection is set to begin Monday afternoon in a murder case that may have been the impetus for the March 2011 ambush-style double killing at the Lakewood Villas apartments.

    Steven Jay Peace Jr., 24, is on trial in Waco’s 19th State District Court for the April 2010 shooting death of Emuel “Man Man” Bowers III, 21, at Hood Street Park.

    Testimony is expected to begin Tuesday morning, court officials said.

    Melanie Walker and Edward Vallejo were appointed special prosecutors in the case after McLennan County District Attorney Abel Reyna recused his office following a dispute with Bowers’ mother, Shelia Hilliard-Bowers.

    Hilliard-Bowers filed a grievance against Reyna with the State Bar of Texas and was openly critical about the manner in which the DA’s office and Waco police handled the investigation of her son’s death. Sources have said the State Bar summarily dismissed the grievance against Reyna. State Bar grievances are confidential and are not made public unless the agency takes official action against an attorney.

    Prosecutors and police detectives have said Bowers’ shooting death in his car at the park was the motivation behind the slayings of Keenan Hubert, 20, and Tyus Sneed, 17, at the former Lakewood Villas, 1601 Spring St., a year later.

    Witnesses placed Hubert at the scene when Bowers was shot. Rickey Donnell Cummings and Albert Leslie Love Jr., who were later convicted of the Lakewood killings, possibly believed Hubert played a role in Bowers’ death, according to testimony at their trials.

    Cummings and Love, who have said they considered Bowers like a brother to them, both were sentenced to the death penalty in 2012 and 2013. Cummings’ younger brother, D’Arvis Tyrell Cummings, pleaded guilty to murder for his role in the Lakewood slayings and was sentenced to 20 years in prison in September 2014.

    Hilliard-Bowers testified during Cummings’ capital murder trial that she and her brother met frequently with police and started an investigation of their own in an effort to find who killed her son. She said Hubert’s name came up as a possible suspect as well as two others, including Peace.

    She said friends and family became frustrated with the progress of the police investigation and lodged complaints with a police supervisor, County Commissioner Lester Gibson and Reyna. Later, she filed the grievance against Reyna.

    It also was revealed during Cummings’ trial that Hilliard-Bowers had a two-minute phone conversation with Love, followed by a text message from Love, about 2 a.m. March 28, 2011. Her contact with Love came about three hours after Hubert and Sneed were killed at Lakewood Villas.

    Her return text message said, “Love y’all, too,” according to trial testimony.

    It was not revealed what Love texted her.

    State court reverses death penalty in Love murder case

    The Texas Court of Criminal Appeals reversed the capital murder conviction and death sentence of Albert Leslie Love Jr. Wednesday, ruling text messages were improperly used against him because they were obtained without a warrant.

    Love was convicted and sentenced to death after a trial in Williamson County in 2013 in the March 2011 shooting deaths of Keenan Hubert, 20, and Tyus Sneed, 17, at the Lakewood Villas apartment complex, 1601 Spring St.

    The court, in a 6-3 opinion with 3 dissents, awarded Love a new trial because his Fourth Amendment rights were violated when the content of his text messages were improperly admitted against him because they were obtained without a warrant.

    Love will be returned to McLennan County to await another trial. The reversal sent shock waves through the McLennan County Courthouse, where officials were unclear if Love's retrial can be held in McLennan County, if it will be returned to Williamson County or moved to another county.

    Love's trial was moved to Georgetown because the trial of his co-defendant, Rickey Donnell Cummings, was held first in Waco. Cummings' conviction has already been affirmed by the appeals court.

    McLennan County District Attorney Abel Reyna and his first assistant, Michael Jarrett, did not return phone messages Wednesday.

    Cummings, like Love, is a Bloods gang member who was sentenced to death in 2012 for his role in the double slaying.

    Cummings' younger brother, Darvis Cummings, was sentenced to 20 years in prison in September 2014 after he pleaded guilty to murder as a party to the ambush slayings.

    Deontrae Majors and Marion Bible, who were in the front seat of the car, were wounded in the attack but managed to flee to safety.

    Prosecutors told the jury at Love's trial that Cummings and Love wanted to kill Hubert because they believed he killed their best friend, Emuel "Man Man" Bowers III, at Hood Street Park the year before.

    It mattered little to Love, the prosecutors said, that 3 other men were with Hubert in the car when he opened fire with his AK-47, spraying at least 19 shots with the high-powered assault rifle.

    Prosecutors introduced Love's cellphone records, which included 37 pages showing the contents of about 1,600 text messages.

    Among the most damaging was one sent to Bowers' mother shortly after the ambush attack that said, "mission accomplished."

    Trial testimony showed that Bowers' mother, Shelia Bowers, whom Love and Cummings called "Mama Shelia," was upset that Waco police investigators had not arrested anyone in her son's murder.

    Prosecutors showed photos of Love's numerous tattoos that tie him to the Bloods gang. On his right arm are the words "R.I.P. Man Man" next to a tattoo of an AK-47.

    The Court of Criminal Appeals ruling says that after a review of the record as a whole, the court finds that the "probable impact of the improperly-admitted text messages was great. As we cannot determine beyond a reasonable doubt that the text messages did not contribute to the jury's verdict at the guilty phase, we hold that the error was not harmless."
