I posted 6 various mug shots of Driskill...I'm not surprised he showed no remorse. My heart goes out to your wife for what she had to endure on jury duty. The media reports very little of the details that come to light at trial.

Driskill Sentenced to Death for the Murder of Johnnie and Colleen Wilson

The man accused of killing an elderly couple in Laclede County has been sentenced to death for the murders and seven consecutive sentences of life in prison for other charges.

Jesse Dean Driskill, 33, has been convicted in the July 2010 murders of Johnnie and Colleen Wilson in Lebanon, Mo.

According to a statement from Attorney General Chris Koster on Nov. 5, a judge sentenced Driskill to death for each murder conviction and seven consecutive sentences of life in prison for forcible rape, forcible sodomy and each of the five armed criminal action counts, plus fifteen years for burglary in the first degree.

In the early house of July 26, 2010, the day after the Wilson’s 59th wedding anniversary, the couple encountered Driskill as he attempted to burglarize their home on Marigold Dr., just north of Bennett Springs State Park.

Driskill forced the couple inside their home at gunpoint, where he shot and suffocated 82-year-old Johnnie Wilson. After that, he raped and fatally shot 76-year-old Coleen Wilson.

Evidence in the case also suggests that Driskill tried to burn the couple’s bodies in an unsuccessful effort to hide evidence of the crimes.

    Too troubled to stand trial?

A man who was convicted last year of brutally murdering an elderly Laclede County couple in 2010 should not have stood trial because of his mental problems, his attorney is saying.

Jesse D. Driskill, 33, was found guilty of brutalizing and murdering Johnnie Wilson, 82, and Coleen Wilson, 76, on July 26, 2010. They were found shot to death and partially burned by their son and granddaughter later that day.

In August 2013, a Franklin County jury found Driskill guilty of two counts of first-degree murder, one count of forcible rape, one count of forcible sodomy, one count of first-degree burglary and five counts of armed criminal action. Twenty-Sixth Judicial Circuit Presiding Judge Kenneth Hayden followed the jury’s recommendation and sentenced Driskill to death in November 2013.

Death sentences are automatically appealed to the Missouri Supreme Court. In Driskill’s case, his public defender, Rosemary E. Percival, filed an appellant’s brief last week, claiming that the trial court erred in multiple ways.

“The trial court erred in trying, accepting the guilty verdicts, and sentencing Driskill, a man who was not mentally competent to stand trial, and in denying defense counsel’s repeated motions for a competency evaluation, hearing, or a continuance,” Percival wrote in the brief.

Surpreme Court to Hear Appeal of Condemned Inmate Jesse Driskill

The state Supreme Court will hear Wednesday the appeal of a man sentenced to death for the murders of a Laclede County couple in July 2010.

Jesse Driskill, 34, was sentenced to death last year for the murders of 82-year-old Johnnie Wilson and his wife, 76-year-old Coleen Wilson. He was also convicted of rape and sodomy for attacking Coleen Wilson after killing her husband, as well as burglary and five counts of armed criminal action

Driskill claims that because he was denied medication for panic attacks, he was unable to testify during his trial out of fear of having an attack on the stand and was unable to be in the courtroom while his sentence was being considered. He says that prevented him from participating in his own defense. His challenge also stems from what evidence the jury was and was not allowed to review while considering his punishment, and from the court denying his request for a competency hearing.

The Attorney General’s Office argues that Driskill waived the right to be present during portions of his trial and that previous competency hearings found that he was able to stand trial without medication. It argues that he understood how the trial would proceed and was able to assist in his defense. It also says that the court made proper decisions regarding the evidence the jury saw and that Driskill had plenty of opportunity to present arguments regarding that evidence.

The Laclede County Prosecuting Attorney and Attorney General Chris Koster argued in last year’s trial that the Wilsons encountered Driskill as he attempted to burglarize their home north of Bennett Spring State Park where they had gone to celebrate their 59th wedding anniversary. He shot and suffocated Johnnie before raping, sodomizing and shooting Coleen. He then tried unsuccessfully to burn their bodies to hide the evidence of his crimes.

Missouri Supreme Court hears appeal of death penalty case from Laclede County

JEFFERSON CITY, Mo. (AP) - Missouri Supreme Court judges are weighing an argument that a man sentenced to die for killing an elderly couple didn't receive a fair trial because of his problems with anxiety.

A lawyer for Jesse Driskill, of Lebanon, said during a Wednesday hearing that Driskill was incompetent to stand trial and didn't receive anxiety medication, which sometimes prevented him from being present in court.

Driskill is seeking a new trial and a new sentencing hearing.

A state attorney says the trial court accommodated Driskill's anxiety by giving him breaks and allowing him to text or call his attorney while he watched from another room.

Driskill was convicted of murdering 82-year-old Johnnie Wilson and 76-year-old Coleen Wilson at their home near Lebanon in July 2010. He was sentenced to death.

    State v. Driskill

    Opinion Date: March 31, 2015

    Court: Missouri Supreme Court

After a jury trial, Defendant was found guilty of two counts of first-degree murder, one count of forcible rape, one count of forcible sodomy, and five counts of armed criminal action. Defendant received two death sentences for the murder convictions. The Supreme Court affirmed, holding that the trial court did not err in (1) failing to stop the trial and order a competency evaluation, as Defendant did not meet his burden of demonstrating that he was not competent to stand trial; (2) granting Defendant’s requests to not remain in the courtroom during certain phases of his trial; (3) finding Defendant voluntarily waived his right to testify during both the guilt and penalty phases of his trial; (4) overruling Defendant’s motion for a continuance to be medicated; (5) denying the jury’s request to view all of the exhibits admitted into evidence during the penalty phase; and (6) admitting victim impact testimony and evidence. Finally, the Court held that the imposition of the death penalty met the statutory requirements.
