    Trial date set for capital murder suspect in 2011 Decatur Krystal shootings


    A trial date has been set for one of the three suspects charged with capital murder in the fatal shooting of two employees at a Krystal restaurant in Decatur.

    Court records show Jordan Creque's jury trial will begin at 9 a.m. Sept. 30. No start dates have been established for the other two suspects, Cassandra Eldred and Ezekiel Gholston.

    Jeffrey Graff and Jessie Aguilar were gunned down at the Krystal on 6th Avenue on Aug. 24, 2011. Police say the shootings were connected to a robbery.

    Police say Creque and Eldred were employees at the Krystal, which allowed them access.

    Krystal Shootings: Creque Trying To Get Trial Moved

    One of three people charged in the murder of two Krystal employees is still trying to get his trial moved.

    Later today, attorneys for Jordaan Creque will have a hearing for a change of venue for Creque’s trial, which is scheduled to start soon. The motion hearing is at 1:30 p.m.

    The Morgan County District Attorney wants the trial to stay in Decatur, where the crime happened.

    Creque is charged with capital murder, robbery and attempted robbery in connection with the August 2011 deaths of two Krystal employees. Investigators say Creque and two others went into the Krystal on 6th Avenue in Decatur and shot and killed Jesse Aguilar and Jeffrey Graff.

    Cassandra Eldred and Ezekiel Gholston are also charged in this case

    Capital murder trial begins Thursday for man accused of killing two Krystal employees

    A Morgan County judge has seated the jury in a capital murder trial.

    Jordaan Creque faces capital murder charges for the shootings that killed two employees of a Decatur Krystal restaurant in 2011.

    The jury pool initially had 90 potential jurors. The jury is made up of one man and 15 women.

    Testimony will begin Thursday morning.

    Medical examiner: Krystal murder victims didn't die instantly

    A retired medical examiner testified Monday that one of the men shot during a 2011 robbery at Krystal would not have died instantly from his wounds.

    Dr. Emily Ward testified during Jordan Creque's capital murder trial about the injuries to Krystal manager Jeffrey Graff and employee Jessie Aguilar in August 2011. Creque, 23, is accused of killing them during a robbery.

    Ward testified that Aguilar was shot four times -- once in the neck, once in the chest, once in the abdomen and once in the arm. Under questioning by prosecutors, Ward said she believed he lived for more than a minute.

    Ward testified that Graff had a gun pressed directly to his neck when it was fired, sending a bullet through his spine and out his back. She said he could have lived for several minutes after being shot.

    Earlier in the day, Decatur police detective Todd Pinion testified about evidence collected from Creque's apartment and from a trash bin. Pinion said blood was collected from Creque's bedroom floor, along with pajama pants and 9mm ammunition. Clothes, latex gloves and Regions Bank money bags were recovered from the trash bin.

    Creque, Ezekiel Gholston and Cassandra Eldred are all charged with capital murder. Gholston and Eldred have not had trial dates scheduled.

    First defendant to be tried for slayings at Krystal in Decatur found guilty on 3 murder counts

    One of three people accused in the 2011 slayings of two employees at Krystal in Decatur was found guilty this morning on three counts of capital murder, according to the District Attorney's Office.

    Jordaan Stanley Creque, 23, was found guilty by a Morgan County jury for the shooting deaths of night manager Jeffrey Mark Graff, 49, of Huntsville, and Jesse Jose Aguilar, 23, of Decatur. Their bodies were discovered in the restaurant's walk-in cooler.

    Creque and two other defendants - Ezekiel Marquez Gholston, 22, and Cassandra Rayann Eldred, 24 - were each charged with three counts of capital murder, with the third stemming from the fact that they were accused of killing the men during commission of a robbery. Creque and Eldred worked at Krystal at the time.

    Eldred and Gholston will be tried separately.

    Sentencing will be set for Creque, who faces the death penalty or life in prison. District Attorney Scott Anderson has said he will seek the death penalty.

    The jury began deliberating Thursday after six days of testimony, according to a report in The Decatur Daily. They resumed deliberations at 8:30 a.m. today and rendered a verdict before lunch.

    Creque testified Wednesday he did not intend to kill Graff and that Gholston was the one who shot Aguilar, the Daily reported.

    Jury recommends death penalty for man convicted of 2011 Decatur Krystal murders

    DECATUR, Alabama -- A Morgan County jury has convicted Jordaan Stanley Creque in the slayings of two Krystal employees and is now recommending a sentence of death, reports AL.com's news partner, WHNT News 19.

    Creque, 23, was charged in the shooting deaths of Jeffrey Mark Graff and Jesse Jose Aguilar. Both were working at a Krystal restaurant in Decatur when they were shot to death during a robbery. Creque, along with Ezekiel Marquez Gholston, 22, and Cassandra Rayann Eldred, 24, were charged in the crime.

    The jury convicted Creque of three counts of capital murder on Friday. The third count stems from the fact the murders occurred during a robbery, according to an earlier AL.com report.

    The jury voted 11-1 in favor of the death penalty on Monday. Circuit Court Judge Glen Thompson scheduled the formal sentencing for January 15, 2014, WHNT reports.

    The news station reports Creque did not appear to react at the jury's recommendation but did apologize to the families in court earlier on Monday.

    "I just wanted to have the opportunity to say I'm sorry for my actions and participation in such an event," he said. "I know there's nothing I can say or do to bring any kind of relief that would comfort you. I just wanted to say I'm sorry for the lives that have been taken from you."

    Gholston and Eldred are also charged with capital murder and will be tried separately. Their trial dates have not been set, WHNT reports.

    A man found guilty of the murder of two Krystal employees in Decatur has been sentenced to death.

    Jordaan Creque was found guilty in October for the 2011 murders of Jesse Aguilar and Jeffrey Mark Graff at a Krystal restaurant in Decatur.

    The death sentence was handed down by the judge Wednesday afternoon. The jury had previously recommended the death penalty following their conviction of Creque.

    Members of the victims' families had their chance to address the man who killed their loved ones before the judge handed down the death penalty. Marie Aguilar, mother of Jessie Aguilar, held a picture of her son with his first-born child, then a picture of him with his second-born.

    She told Creque she would have shown him a picture of Jessie with his third child, but that picture never happened because her son was killed before the child's birth. She told Creque she asked the judge for the death penalty becuase that is what he is worthy of, and that he would never be worthy of forgiveness.

    Lois Graf, wife of Jeffrey Mark Graf, said although she is personally against the death penalty, she would trust and support the judge's decision.

    Cassandra Eldred and Ezekiel Gholston are also charged for the murders of Aguilar and Graf. Their trial dates are still pending.

    DECATUR, Alabama - A 23-year-old man sentenced to death in January after being convicted in the slayings of two Krystal workers in Decatur is seeking a new trial.

    Jordaan Stanley Creque of Decatur will have a hearing on his motion at 9 a.m. Monday, April 16 in Morgan County Circuit Judge Glenn Thompson's courtroom, according to the Circuit Clerk's office.

    A jury found Creque guilty in October 2013 in the 2011 shooting deaths of Krystal employee Jessie Jose Aguilar, 23, and night manager Jeffrey Mark Graff, 49.

    Creque and two other defendants - Ezekiel Marquez Gholston, 22, and Cassandra Rayann Eldred, 24 - were each charged with three counts of capital murder. The third charge stems from the fact that the murders occurred during the commission of a robbery.

    Creque and Eldred worked at Krystal at the time. Eldred's and Gholston's cases have not come to trial but Gholston's trial is set for Oct. 15.

    DECATUR, Alabama -- A Decatur man convicted in the August 2011 shooting deaths of two Krystal employees will not be getting the new trial he wanted.

    A Morgan County jury convicted Jordaan Stanley Creque, 24, was convicted of three counts of capital murder in October 2013. Police say he shot and killed Jessie Jose Aguilar, 23, and night manager Jeffrey Mark Graff, 49, while robbing the restaurant where he also worked. Circuit Judge Glenn Thompson sentenced Creque to death in January 2014.

    Thompson denied Creque's motion for a new trial Thursday. One of the prosecutors, Assistant District Attorney Paul Matthews, said Creque's lawyers will likely move forward with appeals. The listed defense attorneys could not be immediately reached.

    Court documents state the three counts refer to the murder of two or more people during the action plus one count of murder during a robbery for each victim.

    The other two defendants in the case are Ezekiel Marquez Gholston, 23, and Cassandra Rayann Eldred, 25. They also face three counts of capital murder each. Court records show Gholston's trial is scheduled for Oct. 15. No trial date is shown for Eldred.
