    Bean Pleads Not Guilty to One Count of First Degree Murder

    Bean pleaded not guilty Thursday morning to one count of first degree murder. Pleas to the rest of the charges will be heard at another hearing in Yerington October 21 and no trial date has been scheduled. The death penalty is on the table as possible punishment if Bean is found guilty.

    YERINGTON, NV - An arraignment has been continued until Thursday, October 3, in the murder case of Jeremiah Bean, accused of killing five people in Fernley and Mustang over Mothers' Day weekend in May 2013.

    In District Court in Yerington Tuesday morning, October 1, Bean had worked out an agreement with his defense and the prosecution to plead guilty in exchange for the death penalty being taken off the table. That would have led to a sentence of life in prison.

    But when the judge asked him for his plea in court to enter into the record, Bean replied, "not guilty," leading the judge to continue the hearing to allow Bean time to consider the ramifications of the death penalty. If he pleads "not guilty" again, a trial date will be set; if he pleads "guilty," a date for sentencing will be set.

    Bean is accused of killing two couples in Fernley and a newspaper delivery man off the Mustang exit from Interstate 80 over a four-day period. Investigators haven't released information about a possible motive.

    At a hearing in December, Bean was declared competent after doubts were raised about his mental state of mind.

    Suspected Timeline in Bean Murders

    Shocking new details in the murders that have rocked the small town of Fernley. Five people, all allegedly killed by one man, 25-year-old Jeremiah Bean. When we first broke the story it appeared as if the crime spree all happened in the span of a few hours. But a criminal complaint shows the crimes were conducted over a series of four days. The complaint says Bean shot and killed the Pape couple on May 10th.

    The home on Jessica Lane in Fernley is where the Pape couple, Dorothy and Robert, both 84, were shot to death on Friday May 10th.

    The criminal complaint states Bean used an NEF Co. Model R92 .22-caliber handgun to kill the couple and then stole jewelry and $3500 dollars in cash.

    Three days later in the early morning of May 13, Bean allegedly broke through the back sliding door at 610 Tamsen and there stabbed and shot 67-year-old Angie Duff and her friend Lester Leiber.

    The criminal complaint says Bean took Duff's gun, a Smith & Wesson, went back to the Pape home and stole the couple's white pickup.

    Investigators say Bean drove the truck west and took the Mustang exit, where the vehicle got stuck in a ditch.

    Sometime after, the complaint says Bean came into contact with Eliazar Graham, who was on his way to work at the Chevron Station.

    The complaint says Bean shot Graham, took his truck, drove it back to the Pape's garage and set it on fire.

    Bean was found hiding later in a neighbor's house, just two doors down from where he was living on Tamsen, right next to Duff's home.

    Investigators say Bean had items from one of his victims in his possession.

    What Bean was doing for the time between the Papes' murders and the other three murders is what Lyon County Investigators are trying to piece together.

    Bean gets new attorney, arraignment is postponed

    After a not guilty plea earlier this month that surprised his attorney — and now with a new death penalty-certified attorney appointed — the arraignment Jeremiah Diaz Bean in Third Judicial District Court was rescheduled from Monday to Nov. 4 at 3:30 p.m.

    District Court Judge Bill Rogers earlier this month issued an order granting the withdrawal request of Bean’s former attorney, John Arrascada and, in another order, appointed Richard Davies to serve as Bean’s attorney.

    Since the Lyon County District Attorney’s Office had stated an intention to seek the death penalty — although it had not filed the notice of intent to do so with the court as of last Friday — a death-penalty certified attorney needed to be appointed.

    None of the Lyon County public defenders are certified, according to Supreme Court rules, to serve as first chair in a death penalty case. Davies will fill that role while public defender Paul Yohey will sit as the second chair on the case.

    Earlier this month, Bean agreed to a plea negotiation wherein the DA’s office would not seek the death penalty and drop several charges, leaving only the five first-degree murder charges for the deaths of five people in May, four in Fernley and another in Mustang that was being prosecuted in Lyon County, in exchange for his guilty pleas.

    However, during two arraignment hearings earlier this month, Bean instead pleaded not guilty when the first count was read in court, with both instances resulting in delays for Arrascada to talk with him.

    When he again pleaded not guilty the second day, Judge Rogers delayed the hearing and rescheduled it to Oct. 28, but when a new attorney was appointed, sit was delayed until Nov. 4.

    Assistant District Attorney Steve Rye previously indicated when Bean didn’t follow through with the guilty plea as part of the plea agreement, the DA’s office would file a new information with the initial 19 charges against Bean.

    Bean was arrested on May 13 and charged with open murder with a deadly weapon in the shooting deaths of 84-year-olds Bob and Dorothy Pape, which law enforcement officials said occurred on May 10 in Fernley; Angie Duff, 67; and Lester Lieber, 69, at a Fernley home, and Eliazar Graham, 52, of Sparks at Mustang, with the latter three on May 13.     DA seeks death penalty against Bean

    The Lyon County District Attorney’s office is seeking the death penalty in the murder case against Jeremiah Bean of Fernley, accused in five murders this past May.

    The DA’s office filed a notice of intent to seek the death penalty in Bean’s case last Friday in Third Judicial District Court. In addition, earlier last week the DA’s office filed an amended information with the court that included the original 19 counts in the case, including 10 total open or first degree murder counts.

    Bean, whose lead defense counsel is Richard Davies of Reno, a death-penalty certified lawyer, is scheduled for an arraignment on those charges at 3:30 p.m. Monday in Third Judicial District Court in Yerington.

    In September, Bean signed a plea agreement wherein the DA’s office would not seek the death penalty and it would file an information with only the five murder counts.

    However, in two scheduled arraignments earlier this month, Bean pleaded not guilty when the first count was read by the judge, instead of the guilty plea expected by his now-former attorney and the DA’s office.

    The 17-page notice of intent to seek the death penalty cites 23 aggravating circumstances, which includes several that are listed five times for each of the five victims.

    They include that his actions “knowingly created a great risk of death to more than one person;” that the murder was committed in commission of or flight after committing any robbery, arson, burglary or home invasion; murder committed to avoid or prevent a lawful arrest or to effect escape from custody; murder committed to receive money or any other thing of monetary value; and that the defendant has been convicted of more than one offense of murder in the first or second degree, using convictions in this case for the penalty phase.

    Bean, who was 25 at the time, was arrested on May 13 and charged with open murder with a deadly weapon in the shooting deaths of 84-year-olds Bob and Dorothy Pape, which law enforcement officials said occurred on May 10 in Fernley; Angie Duff, 67, and Lester Lieber, 69, at a Fernley home; and Eliazar Graham, 52, of Sparks at Mustang, with the latter three on May 13.

    The man accused of killing four senior citizens in Fernley - and another man in Mustang - has pleaded not guilty to all charges.

    Jeremiah Bean also asked for a speedy trial (within 60 days) during his arraignment late Monday afternoon in Yerington.

    The judge has set a December 16th trial date, but Bean's defense attorney may file a motion to start proceedings on January 4th.

    Bean's original attorney recused himself from the case at a hearing last month.

    He says Bean was expected to accept a plea deal to avoid the death penalty, but did not. Prosecutors say they will seek the death penalty.

    Bean is accused of killing the Bob and Dotty Pape at their Jessica Lane home, in Fernley, and later lighting their house on fire in May.

    Investigators say he stole their truck and drove to Mustang and killed Eliazar Graham.

    They say he returned to Fernley and murdered Lester Leiber and Angie Duff at her home on Tamsen Lane.

    Attorney's request to continue Bean trial granted

    Although defendant Jeremiah Diaz Bean previously had invoked his right to a speedy trial (within 60 days of arraignment), the murder trial for the Fernley man has been continued from December to June.

    During a Third Judicial District Court arraignment in Yerington on Nov. 4, Bean pleaded not guilty to 19 total counts. At that hearing, he indicated he didn’t wish to waive his right to a speedy trial and, his trial was scheduled for Dec. 16-Jan. 3.

    But Bean’s defense attorneys, including Richard Davies of Reno, who was appointed because he is certified to sit as lead chair in a death penalty case, and public defender Paul Yohey, on Nov. 18 filed a motion to continue the trial, saying they couldn’t adequately prepare a proper defense for Bean in that time. They requested a delay until October 2014.

    Bean was arrested and formally charged with murder and other charges (including burglary, robbery, grant theft and arson), a total of 19. He is charged with the deaths of 84-year-olds Bob and Dorothy Pape, which law enforcement officials said occurred May 10 in Fernley, of Angie Duff, 67, and Lester Lieber, 69, at a Fernley home, and Eliazar Graham, 52, of Sparks, at Mustang, with the latter three on May 13 and all by gunshot.

    In an order from Third Judicial District Court Judge Bill Rogers dated Nov. 20 and filed Friday, the judge granted the request to continue the trial.

    In a subsequent trial setting and scheduling order also filed Nov. 22, Rogers set the jury selection for the trial from June 4-6. It continued that the evidentiary phase of the trial should start on June 9. If necessary, a penalty phase was set for June 23-27, with all proceedings starting at 9 a.m.

    This order also set status hearing/motion dates on Dec. 6, Jan. 17, Feb. 14, March 7 and April 4 (all on Fridays), all at 10 a.m. It also stipulated all motions should be filed by 5 p.m. on April 24, and a hearing on pending motions was set for May 15-16.

    In the order granting the defense counsel’s instant motion to continue the trial date, Rogers indicated the defense “demonstrated good cause for the need for a continuance,” noting case law shows the speedy trial right can only be waived for good cause, as stipulated in existing case law.

    New co-counsel assigned in Fernley murder case

    Trial likely to be delayed

    With a change in the public defender setup in Lyon County, Third Judicial District Court Judge Leon Aberasturi last week approved the replacement of Paul Yohey as co-counsel in the Jeremiah Bean murder case defense, replaced by public defender Ken Ward.

    Richard Davies of Laub & Laub law firm in Reno remains the defense’s lead counsel for Bean, who is accused of murdering five people last May, four in Fernley, as Davies is death penalty certified, as required by Supreme Court rules in death penalty cases. The Lyon County District Attorney’s Office is seeking the death penalty.

    The main purpose of the Jan. 22 status hearing in Third Judicial District Court in Yerington was to discuss and make changes to the proposed jury questionnaire for the trial currently scheduled for June, with some changes in wording and regarding questions such as whether prospective jurors are opposed to the death penalty and if they have a history of substance abuse.

    The trial date for Bean remains in early June but Davies, a former Washoe County public defender, said he anticipates filing a motion to request a delay in the trial, possibly until next October. He said he has three investigators working on the case, and they’ve done a lot of investigation but doesn’t feel they would be prepared for a trial in June.

    Bean is accused in the murder of four Fernley senior citizens and with the death of a Sparks newspaper delivery person in the Mustang area. First, he is accused of murdering Robert and Dorothy Pape on May 10 and stealing their pickup, before later setting their Jessica Lane home in Fernley on fire. He is then accused of killing Angie Duff and Lester Lieber at a Tamsen Lane home on May 13 and with killing Eliazar Graham in Mustang and taking his pickup.

    Bean last year pleaded not guilty to 19 counts, including 10 first-degree felony murder counts.

    The next status hearing for Bean in district court is scheduled for 1:30 p.m. Feb. 6.

    A motion from the attorney representing murder suspect Jeremiah Bean was rejected by Third Judicial District Court Judge Bill Rogers, meaning the June trial date remains in effect.

    Bean’s lead attorney Richard Davies had filed a motion seeking to have the trial continued from the planned June 4 trial start date, once saying he thought October would be a good date.

    However, with Bean himself opposing that motion, Rogers denied the continuance motion.

    Bean, 25 at the time of his arrest last May, after rejecting a plea agreement in court that would have eliminated all but the murder charges and the potential of the death penalty, faces 19 felonies, including those in the deaths of five people from May 10 and May 13, 2013, including 10 felony or first-degree murder counts.

    He is accused of murdering Fernley residents Bob and Dorothy Pape, both 84, at their home on May 10, Angie Duff, 67, and Lester Lieber, 69, at a nearby home on May 13, and Eliazar Graham, 52, of Sparks, in Mustang, also on May 13.

    He also faces charges in relation to the theft of vehicles from the Papes and Graham, setting fire to the Pape home and other theft-related charges.

    Davies was a second death-penalty certified attorney appointed to represent Bean, after the first attorney requested removal after he didn’t follow through with a plea agreement, instead pleading not guilty.

    He is also represented by Lyon County Public Defender Ken Ward.

    Bean trial suffers another delay

    The trial for a man accused of killing five people in and around Fernley has been delayed.

    According to the Lyon County District Attorney's Office, Jeremiah Bean will be evaluated to determine if, intellectually, he is eliegible for the death penalty. The evaluation should take place anytime between now and August 21.

    In October, Bean pleaded not guilty to 19 counts, including murder. His trial was scheduled to begin on Monday.

    Bean murder trial continued, no new date set yet

    After prior motions by defense counsel to continue the trial date were denied, a last-ditch motion did result in Third Judicial District Court Judge Bill Rogers calling off the June 4 trial for murder defendant Jeremiah Diaz Bean.

    Bean's court-appointed legal counsel Richard P. Davies and Kenneth Ward had filed a motion seeking the June 5 trial to be continued to next spring, but when Bean opposed it, Rogers denied it and a subsequent reconsideration request, citing the right to a speedy trial. Then, the defense counsel filed a petition for writ of mandamus, including an emergency motion for stay, to the Nevada Supreme Court to delay the trial, but it was denied.

    The attorneys sought the writ of mandamus seeking to continue the trial date so they could "prepare adequately for his defense." The motion said not granting a continuance would "result in [Davies and Ward] being unable to provide Mr. Bean with effective representation in violation of Mr. Bean's Fifth, Sixth and Fourteenth Amendment rights to due process and counsel."

    However, two weeks ago the defense counsel filed a motion seeking an evaluation of mental retardation and the trial date of this week was postponed, with a hearing now scheduled for Aug. 21. An evaluation will be scheduled to determine if his mental capacity is high enough to make him eligible for the death penalty, which is being pursued by the Lyon County District Attorney's Office

    Bean was charged with killing Robert and Dorothy Pape, both 84, on May 10, 2013, at their Jessica Lane home in Fernley and then killing newspaper deliveryman Eliazar Graham, 52, of Sparks, on May 13, 2013, in Mustang (being tried in Lyon County) and charged with killing Angie Duff, 67, and her friend Lester Leiber, 69, in a home on Tamsen Road, around the corner from the Papes.

    Bean also was charged with stealing two pickups and other items from the residences, resulting in additional charges (including arson) beyond the 10 first degree murder counts.

    A plea agreement reportedly had been reached last fall with Bean, with the death penalty to be removed, but he changed his mind and pleaded not guilty to 19 felony counts when he came before the judge for pleading. This resulted in a change of attorney to Davies to serve as the death-penalty qualified defense attorney.
