    Bean sentencing hearing rescheduled to Nov. 17

    While the jury that found Jeremiah Diaz Bean guilty of 12 charges sentenced him in early August to the death penalty on the murder charges, a judge will now decide the sentence on the rest of the seven charges, set for Nov. 17.

    The initial sentencing hearing earlier this month was postponed, reportedly to allow more time for the report from the state’s Parole and Probation Division, and now it has been set for 9:30 a.m. Nov. 17, before Judge John Paul Schlegelmilch in Third Judicial District Court in Yerington.

    Bean, 27, was found guilty after a two-plus week guilt phase portion of his trial in July in the murders of Bob and Dorothy Pape, 84, inside their Fernley home on May 10, 2013, and of Eliazar Graham, 52, of Sparks, in Mustang, and of Angie Duff, 67, and Lester Lieber, 69, inside Pape’s Fernley home, on May 13. He also burned the Pape home in the early-morning of May 13, 2013.

    The other charges Bean will be sentenced to include burglary with use of a firearm; grand larceny (between $650 and $3,500 value); grand larceny of a stolen vehicle; first degree arson; robbery with use of a deadly weapon; and burglary to obtain a firearm.

    In addition, the judge will also decide if the sentences are to be run concurrently or consecutively and decide on the sentencing enhancements apply on the murder charges, such as use of a deadly weapon and that the victims were elderly (over age 60).

    Two counts of convicted felon in possession of a firearm were dismissed during the trial.

    Nevada ex-con sentenced to death in 2013 killing-arson spree

    YERINGTON, Nev. (AP) — A 27-year-old ex-convict was sentenced to death Tuesday for killing five people in northern Nevada during a Mother's Day weekend murder spree in 2013.

    Jeremiah Diaz Bean's fate had been decided in August by a state court in Yerington.

    It was made official by Lyon County District Court Judge John Paul Schlegelmilch, who also imposed maximum consecutive penalties totaling 78 to 195 years for Bean's other convictions including arson, robbery, burglary, auto theft and theft using a firearm, the Reno Gazette-Journal reported (http://on.rgj.com/1PN7uAI).

    Bean was found guilty in July of fatally shooting Robert Pape and Dorothy Pape, both 84, in May 2013 in one Fernley home, and Angie Duff, 67, and Lester Leiber, 69, at a house around the corner.

    The jury found him guilty of fatally shooting newspaper deliveryman Eliazar Graham, 52, of Sparks, at an I-80 exit near the Mustang Ranch brothel east of Reno.

    Bean had been convicted of an unrelated burglary in January 2011 in Lyon County. His probation was revoked six months later. He was jailed for about a year and his parole expired in December 2012.

    Bean initially agreed to plead guilty in the 2013 slayings in a plea deal that would have spared him the death penalty. He changed his mind in November 2013 and stood trial this year.

    A prosecutor told the jury that Bean robbed and killed his victims to get cash to party on a Friday night, and he set the Pape home afire to try to destroy the evidence.

    Bean's defense attorney argued that Bean wasn't the only person to blame for the killings.

    Bean becomes the 81st inmate on death row at Ely State Prison.

    The last execution in Nevada was Daryl Linnie Mack in 2006.

    Death sentence in Fernley murder spree upheld by Nevada Supreme Court

    The Nevada Supreme Court has unanimously upheld the conviction and death sentence for Jeremiah Bean, who shot and killed five people during a crime spree in May 2013.

    Bean was convicted of entering the home of Robert and Dorothy Pape in Fernley, shooting both of them in the head then fleeing with some of their property and their truck.

    When that truck got stranded on Interstate 80, Bean flagged down Elliezear Graham and shot him to death before driving Graham’s truck back to the Pape residence and setting it on fire.

    Then he entered the home of Andie Duff and Lester Leiber, shot Leiber to death and then stabbed Duff to death.

    He was convicted of all five murders, use of a deadly weapon, burglary with a firearm, grand larceny, larceny of a motor vehicle, arson, robbery and grand larceny of a firearm.

    In November 2015, he was sentenced to death for each of the five murders and consecutive terms of imprisonment for a number of the other offenses.

    In his appeal, he argued the district court erred in denying a defense motion that he was mentally impaired but several tests showed he was not significantly impaired because his IQ was consistently between 78 and 83.

    He argued the court abused discretion by limiting defense questioning of potential jurors but the justices agreed with the district court in Lyon County that the questions the defense wanted to ask went beyond what was needed to determine if the jurors could apply the law.

    They said his motion for a change of venue had to be based on inflammatory pretrial publicity and actual bias on the part of jurors.

    “Bean showed neither,” the order states.

    They ruled the district court had the right to allow evidence of Bean’s drug use since he stole property, pawned it and used the money to buy drugs.

    Finally, the high court rejected his argument that the death penalty violates the 8th Amendment to the Constitution.
