    A sheriff's deputy has been killed in a shootout with a man at a West Texas convenience store, authorities said.

    The Upton County Sheriff's Office says Billy "Bubba" Kennedy died late Wednesday at the store in McCamey, some 50 miles south of Odessa.

    The sheriff's office says the 38-year-old Kennedy encountered 50-year-old Gary David Green and several shots were fired. Green was arrested and is being treated for multiple gunshot wounds. Texas Rangers are investigating the shooting.

    Green has been charged with capital murder and is hospitalized in critical condition in Odessa with multiple gunshot wounds received in the shootout. The Odessa American (http://bit.ly/16mnzr3) reports bond is set at $1 million.

    Kennedy leaves behind a wife and two sons, ages 15 and 11. He had been a peace officer for the last 14 years.

    Brown County sheriff Bobby Grubbs described Kennedy, who served with the department between 2006 and 2009, as a "good officer."

    A second officer that was involved in the shooting was not injured.

    Kennedy is the second Upton County deputy to be killed in approximately a year. Deputy Mike Smith died in June 2012 when his patrol car was struck by a tractor-trailer while en route to an emergency call.

    Deputy Sheriff Billy Kennedy was shot and killed after responding to a call at a convenience store on South Burleson Avenue, in McCamey, at approximately 11:15 pm.

    After he arrived at the scene he encountered a male subject. During the encounter the two exchanged gunfire. Despite being mortally wounded, Deputy Kennedy was able to return fire and wounded the suspect.

    Deputy Kennedy had served in law enforcement for 14 years. He is survived by his wife and two sons.

    I am going to give this a 99% chance of Green receiving the DP. Very rural county (population ~3500) and a well like deputy, a scumbag repeat offender.

    The suspect, who is identified Gary David Green, is recovering from gunshot wounds at the hospital.

    We're told that Green has a long wrap sheet for drugs and fighting and he's no stranger to prison. In fact, he was out on parole when the shooting happened.

    According to court records, he's known as the "Pink Panther" Green.

    He's been arrested several times in the past for aggravated assault, possession of marijuana and DWI.

    In 2001, Green was behind bars in the Huntsville Prison in Southeast Texas.

    Green was on parole until March of 2016.

    Bond Set At $1 Million For Suspect In Texas Deputy’s Death

    Gary David Green, 50, who’s charged with capital murder in the shooting death of an Upton County sheriff’s deputy, remained hospitalized in critical condition Friday with gunshot wounds he received in the shootout in which the deputy was killed.

    Lockdown Lifted in McCamey, Upton County After Shooter's Son Was Caught

    NewsWest 9 has just confirmed that Gary David Green's son, Kyler Green, has been caught in Johnson County.

    We're told he is not under arrest but is being monitored by authorities.

    We're told the lockdown has been lifted. An official with McCamey ISD has confirmed that there is no longer a threat.

    McCamey ISD has confirmed that the County Judge, Bill Eyler, has sent out an alert requesting that all schools in McCamey ISD go on lockdown.

    This after receiving threats from the son of the shooter, Gary David Green, involved in Wednesday's fatal shooting of Deputy Billy Kennedy.

    A courthouse employee informed NewsWest 9 of the situation that began around 9 a.m. Friday morning.

    The exact reason for the lockdown has not yet been confirmed by officials.

    NewsWest 9 has a crew on the way to McCamey.

    Upton County deputy remembered

    Upton County Deputy Billy “Bubba” Kennedy, a licensed peace officer for 14 years with stops in Pecos County, Brown County and Upton County, was remembered by his friends and family today after Kennedy, 38, was shot and killed during an incident at 11:15 p.m. Wednesday at the Stripes Convenience Store in McCamey, 50 miles south of Odessa on Highway 385.

    The Upton County Sheriff's Office reports Kennedy, 38, was killed in the line of duty. The incident took place at 11:15 p.m. Wednesday at the Stripes Convenience Store in McCamey.

    Kennedy encountered a male subject and multiple shots were fired, a news release stated.

    Gary David Green, 50, has been charged with capital murder in the death of Kennedy, according to Sgt. Santos Carrasco Jr. with the Texas Department of Public Safety. Green suffered gunshot wounds and is in critical condition at Medical Center Hospital.

    There continues to be a heavy police presence at the Stripes on Highway 385 in McCamey. The Texas Rangers are on the scene and investigating the the incident.

    Kennedy died on the scene of the shooting last night. Between eight and 11 shots were heard during the shooting. Texas Ranger Dewayne Goll was on the scene this morning and refused comment.

    Kennedy worked for the Brown County Sheriff’s Office from March 6, 2006 to Dec. 31, 2009. Brown County Sheriff Bobby Grubbs said Kennedy was “a good officer.” He said Kennedy was a K-9 officer under his command.

    Grubbs was at a firing range training with other officers when he heard of the fatal shooting.

    “We are staggered from this,” said Grubbs the retired Texas Ranger for the Midland region. “Any time it is a fellow officer it hits too close to home. We are saddened by this.”

    Jessica Rodriguez, 27, described Kennedy as a family man, saying he enjoyed hunting and roping with his 15-year-old son.

    A third-cousin of Kennedy, Rodriguez recalled one time when she was 17 years old and was arrested by Kennedy for a minor in possession. In a rage, Rodriguez said she threatened to have Kennedy removed from the family.

    “He said, ‘I’m just doing my job,’” Rodriguez said.

    Kennedy, who lived in Rankin, leaves behind a wife and his 15- and 10-year-old sons. A hard worker, Kennedy will leave a huge hole that can’t be filled, Rodriguez said.

    “Whether we have differences, when something like this happens, the stupidity goes out the door and we all come together,” she said.

    Town closes day after shooting death of deputy

    Threats made against the town of McCamey from an unknown person shut the small city down a day after residents mourned the death of a local deputy who was shot to death at a convenience store.

    Upton County officials took the threat so seriously, they closed down the McCamy City Hall, had the school district placed on lockdown, and several of the town’s restaurants closed their doors.

    Upton County Commissioner for Precinct 3 David “Rowdy” Mooney said he received a call from Upton County Judge Bill Eyler about an unspecified threat that was made against McCamey “sometime before lunchtime.”

    “He didn’t say where it came from or who it came from,” Mooney said in a phone interview.

    Attempts to reach Eyler at the Upton County Courthouse were unsuccessfully Friday. Officials with the Upton County Sheriff’s Department also declined to release any information regarding the threats.

    The identity of the person who made the treats was unknown, but officials said it was a person related to 50-year-old Gary David Green, accused of the shooting death of Upton County deputy Billy “Bubba” Kennedy.

    Television Station KOSA reported the suspect who made the threats is the son of Green and was arrested; however, a spokesperson with the Johnson County Jail said no one was in the jail by the reported name of Zane Green.

    Green, who was listed in critical condition at Medical Center Hospital on Friday, was charged Thursday with capital murder in Kennedy’s death and being held on a $1 million bond. The Texas Rangers are investigating Kennedy’s death.

    Details are still unknown about exactly what happened, but officials said Kennedy was shot around 11:35 p.m. Wednesday in the parking lot of the of the Stripes Convenience Store in McCamey.

    Kennedy, 38, was a sheriff’s deputy for 14 total years and graduated from high school in Iraan. Funeral services for Kennedy are scheduled for 11 a.m. Tuesday at the Park Building in Rankin.

    Along with city hall, several shops and restaurants were closed down after news of the threat spread. The McCamey Independent School District also went into lockdown, lifting the status around noon.

    McCamey Superintendent Janet Hunt said she decided to lift the lockdown after law enforcement officials told her the suspect who made threats against the town was no longer a threat.

    Hunt said originally the school was going to cancel their afternoon pep rally, but decided to have it after the lockdown was lifted to keep a sense of normalcy.

    “I think everyone’s emotions are on edge,” Hunt said. “It’s just that, in a small community, everyone is like family. Everyone comes together and they’re helping each other get through the tragedy Wednesday night.”

    Man Accused of Killing Deputy Billy Kennedy Listed in Fair Condition

    ODESSA - Gary David Green, the man accused of killing Deputy Billy Kennedy, is in fair condition at Medical Center Hospital in Odessa.

    NewsWest 9 learned the information Saturday afternoon.

    A media representative for Medical Center Hospital told NewsWest 9, Green was in fair condition which means his vital organs are stable.

    Green is accused of killing Kennedy on Wednesday night. Green has been recovering from gunshot wounds after a firefight at a Stripes gas station in McCamey. He is currently in law enforcement custody and is being watched by a guard.

    Green will be arrested for capital murder after his release. Green's bond has been set at $1 million. This isn't the first time Green has been in trouble with the law but it might be last. In Texas, capital murder is punishable by death. The Texas Penal Code specifically defines capital murder as knowingly killing an officer in the line of duty.

    Honoring Upton County Sheriff's Deputy Bubba Kennedy

    Upton County Sheriff's Deputy Billy "Bubba" Kennedy will be laid to rest Tuesday in Rankin.

    Kennedy died after being shot in the line of duty October 2 in McCamey.

    A message outside the Rankin Volunteer Fire Department offers prayers for Deputy Kennedy's family.

    "It's a big loss. You know, it's someone you see not only on a professional level, you know them personally," said Kody Brown, a captain with the fire department.

    Captain Brown and the Rankin Fire Department will be part of a procession Tuesday to honor Deputy Kennedy.

    "Not only are you losing a member of the community, basically you're losing a friend or someone you know fairly well," Kody Brown said.

    Sheriff Dan Brown and his deputies now wear a black bank around their badges.

    "We're going to miss Bubba," Sheriff Dan Brown said. "Everybody loved Bubba here. He was just something else."

    Sheriff Brown reflected on Deputy Kennedy's unforgettable personality.

    "Always had a smile on his face," the sheriff said. "He was one of the most unique people that you ever met in your life. If you ever met him you didn't forget him. We're going to miss him."

    "It's going to be hard. We have to remember, what I always told people to remember about Bubba he's not just a lawman but he was a father, a husband, somebody's son and brother. He was a good man."

    In addition to the U.S. Honor Flag being brought to Rankin for the service, law enforcement agencies from across the state are expected to pay their respects to a fallen brother.

    "I think Bubba deserves it," Sheriff Brown said. "You know, it's not so much about our department it's about him and he deserves all the glory and everything we can give him."
