A sheriff's deputy has been killed in a shootout with a man at a West Texas convenience store, authorities said.
The Upton County Sheriff's Office says Billy "Bubba" Kennedy died late Wednesday at the store in McCamey, some 50 miles south of Odessa.
The sheriff's office says the 38-year-old Kennedy encountered 50-year-old Gary David Green and several shots were fired. Green was arrested and is being treated for multiple gunshot wounds. Texas Rangers are investigating the shooting.
Green has been charged with capital murder and is hospitalized in critical condition in Odessa with multiple gunshot wounds received in the shootout. The Odessa American (http://bit.ly/16mnzr3) reports bond is set at $1 million.
Kennedy leaves behind a wife and two sons, ages 15 and 11. He had been a peace officer for the last 14 years.
Brown County sheriff Bobby Grubbs described Kennedy, who served with the department between 2006 and 2009, as a "good officer."
A second officer that was involved in the shooting was not injured.
Kennedy is the second Upton County deputy to be killed in approximately a year. Deputy Mike Smith died in June 2012 when his patrol car was struck by a tractor-trailer while en route to an emergency call.
