Death penalty still on table for stabbing
A man accused of stabbing a fellow inmate to death in the Marion County jail still is waiting to see whether he will face the death penalty.
The Marion County Sheriff's Office said David Ray Bartol, 42, stabbed Gavin Siscel, 33, through the eye with a homemade knife in the jail's day room June 4. Siscel died 2 days later.
Since then, Deputy District Attorney Matt Kemmy said his office is deciding whether it should ask for the death penalty.
Jurors in an Oregon death penalty case have to unanimously answer yes to 4 questions about a person's intent and history before he or she can receive a death sentence.
"That's 48 yeses. If it's 47 yeses and 1 no, he does not get death," Kemmy said. "We want to ensure the 4 questions are answered to our satisfaction before we charge him ... That's continuing as we speak."
Kemmy didn't know when his office would finish its background work on Bartol. He said the DA could also ask for life without parole or life with the option of parole in 30 years.
Bartol currently is serving 18 years in the Oregon State Penitentiary for a January home invasion shooting in South Salem.
