    Death row convict is found guilty of killing two inmates

    A death row convict at Kamiti Maximum Security Prison has been found guilty of killing two inmates who refused to sing a hymn.

    Lady Justice Hedwig Ong’udi ruled that Christopher Njoroge Mumbo was guilty of bludgeoning to death Ibrahim Aden and Julius Kimani at the prison’s hospital ward after the two refused to sing a ‘Hallelujah’ song in 2012.

    The judge, however, spared him the death penalty on grounds that he was mentally unstable when he committed the offence and left his fate at the mercy of the President.

    “There is high probability that he was not of sound mind when he committed the offence. I therefore make a special finding that he is guilty of murder but was insane at the time and will be detained at the pleasure of the President,” ruled Justice Ong’udi.

    Njoroge was on death row at Kamiti Prison after he was sentenced to death for robbing a shopkeeper in 2007. He had gone to the shop to buy cigarettes but returned later, armed with a panga, and ordered the shopkeeper to surrender everything.

    On the night of January 10, 2012, he complained that he was feeling unwell and the prison wardens on duty took him to the sick bay ward, where he found other inmates waiting to be treated.

    According to the prosecution, Njoroge picked up a piece of wood that had nails and ordered all the inmates to start singing the ‘Hallelujah’ song.

    Out of fear, some of the inmates started singing.

    Aden and Kimani, however, refused to sing and Njoroge attacked them with the piece of wood.

    The other prisoners ran out of the room while others hid under beds.

    The wardens, who delayed in responding to the cries from the sick bay, found two inmates unconscious and others injured. The two died while being taken to hospital.

    Njoroge, in his defence, told the court that he was suffering from cerebral malaria at the time and did not know that he had killed two inmates.

    He stated that he was admitted to hospital for many days after the attack and only became aware of his actions six months later when fellow inmates and warders informed him that he was to be charged with murder.

    Justice Ong’udi ruled that she was satisfied the prosecution had established the offence of murder but failed to provide evidence that he was mentally stable at the time.

    “His action of beating inmates and forcing them to shout ‘Halleluiah’ could not be from a normal person. He was violent on the night and the trend continued a week later, when he had to be tied to a stretcher to be taken to hospital,” said the judge.

    She added that Njoroge might have been affected by the many years he spent abusing hard drugs and that no one knew what he was ailing, leaving the court to believe his statement that he had cerebral malaria.

    A 'manipulative' Kenyan beauty queen has been given a death sentence for murdering her boyfriend by stabbing him 25 times.

    Ruth Kamande, 24, who won a prison beauty pageant whilst awaiting trial for the attack on her boyfriend in 2015, has been given the death penalty.

    She killed Farid Mohammed, also 24, and showed 'no remorse' for the violent attack which left "blood all over" the crime scene.

    Last August, Kamande had been crowned 'Miss Lang'ata Prison' in Nairobi.

    Judge Jessie Lesiit who passed the sentence, said: "I want young people to know that it is not cool to kill your boyfriend or girlfriend even where you feel disappointed or frustrated - don't do it.

    "Instead, it is cool to walk away and thereafter to forgive."

    Human rights group, Amnesty International called the sentence as "cruel, inhumane and outdated". A speaker for the group said:" "This sentence is a blow to Kenya's progressive record in commuting death sentences to terms of imprisonment."

    Mr Mohammed's aunt, Emmah Wanjiku said: "We're glad that this day came and his grandparents, his sister were actually in court today when this verdict was given.

    "He had just started his job when his life was cut short."

    Kamande's lawyer, Joyner Okonjo, said that she would appeal the sentence.

    Prisoner hacks fellow inmate to death

    Police are holding an inmate after he reportedly killed a convict at Kodiaga Prison yesterday. Regional Prisons Commander Amos Misik said the man is suspected to have killed Ronald Gekonge using a hoe.

    He said the two were cultivating the prison’s vegetable farm while under the supervision of prison warders when the incident happened.

    “The incident took place at around 9.45am. Police have already launched investigations into the case,” said Mr Misik.

    An officer said the suspect would be arraigned today.

    Kisumu West OCPD Meshack Kiptum said: "As we speak, I have dispatched officers, led by the OCS, to the institution to find out more information about the incident".

    It was not clear what sentences the two inmates were serving. In 2015, a convicted serial killer Harrison Okumu was killed by fellow inmates after a fight broke out at the prison. Okumu had been facing charges of killing five people and burying them in his compound.

    He had allegedly attempted suicide twice while in prison.

    And last May, the High Court found another inmate at Kamiti Maximum Prison guilty of murdering two inmates for refusing to sing a hymn.

    The suspect, Christopher Njoroge, had been on death row for robbing a shopkeeper. In the suit, Njoroge had been accused of taking a piece of wood and using it to bludgeon the fellow inmates to death, as other prisoners ran and hid under beds.

    City cops handed death sentence for killing colleague in pub

    Two police officers have been sentenced to death for murdering an Administration Police Constable in cold blood.

    Lady Justice Stellah Mutuku on Wednesday imposed the mandatory death penalty on Benjamim Kahindi Changawa and Stanley Okoti after finding them guilty of killing Joseph Obongo Onchuri on October 7, 2014 at M-Club in Kangemi, Nairobi.

    The two officers also shot dead the victim’s two relatives Goeffrey Nyabuto Mogoi and Amos Okenye Makori.

    The judge put in abeyance the sentences for the murders of Mr Mogoi and Mr Makori. She however said the first death sentence of the AP will be meted.

    Acted Irresponsibly

    Justice Mutuku said the two officers acted irresponsibly when they shot dead the three who had already surrendered.

    The two police officers were called into the club by a watchman who informed them that there were armed robbers in the club.

    The two, who were patrol, went to the club and opened fire on the three, killing them on the spot.

    In their defence the police officers said they had been informed that the suspected robbers were armed.

    The judge said Onchuri, who although was armed, did not use his gun on anybody.

    The court observed that the two relatives surrendered by lying on the floor of the club but were not spared. Onchuri lifted his hands up but was shot at.

    “Justice served better is optimum penalty given under the law,” Justice Mutuku.

    Mr Changawa had served the force for 39 years, while Mr Okoti had served for 20 years.

    Bomet man who defiled and killed baby sentenced to death

    A man who defiled a three year-old girl before strangling her to death has been handed the death sentence by the High Court in Bomet.

    Justice Roselyne Korir sentenced Benard Busieney alias Chagicha to death for the offence of murder, which occurred three years ago.

    According to the prosecution, Busieney murdered the baby in Bomet on January 27, 2017.

    In its submission before the court, the prosecution led by George Murithi gave a chilling account of how Busieney defiled the baby and strangled her.

    The court heard that even though there was no witness to the commission of the offence, the case was proved through circumstantial and forensic evidence.

    “Externally, there was blood secretion in the nostril, strangulation marks around the neck…there was fresh blood on the thighs, genitalia and rectal regions. The perineum had bruises and tears. Cause of death was strangulation,” read the postmortem report by Ronald Kibet.

    Richard Kimutai, a government analyst who conducted DNA tests, found that the blood stains on the accused’s trouser and shirt matched those extracted from the vaginal and rectal swab of the deceased.

    In her ruling, Justice Korir said that while death sentence for the offence of murder was unconstitutional and that the trial court should exercise discretion after taking into consideration the circumstances of the case as well as any aggravating or mitigating cause before meting an appropriate sentence, the Supreme Court saved the validity of the death sentence.

    “In this case, I have considered all the factors and circumstances as aforestated. The circumstances in this case as borne by the evidence and the judgment were so aggravating as to attract the maximum sentence…The court in my view has the constitutional duty to apply the law to mete out proportionate punishment and to protect the community,” she said.

    Korir added, “It behooves the court to protect vulnerable children from fatal defilement and cold-blooded murder. It would offend the society’s sense of justice if the accused were to get any sentence other than the maximum sentence provided by the law…I sentence the accused to suffer death and I so pronounce.”

    While pleading for leniency, Busieney stated that he was the first born and breadwinner of his family and that it was alcoholism that made him to commit the crime.

    A probation report submitted to court stated that the accused was a class seven dropout and heavily abused alcohol and smoked bhang.

    The report further stated that the incident caused public outrage leading to the torching of several houses in the home of the accused and eviction of his family members.

    “Both the deceased’s and accused’s families craved for a deterrent custodial sentence as they are fearful of his release back to the community…it is untrue the accused is the breadwinner.”

    The court observed that Busieney paints a picture of a person whom the community should be protected from.

    Busieney was given 14 days to appeal both the conviction and sentence.

    Kenya 'starvation cult' death toll rises to at least 89 after more bodies dug up

    The number of victims of a suspected starvation cult has risen to at least 89 after more bodies were dug up in a Kenyan forest.

    Most of the dead were found in shallow single and mass graves, while a few were found emaciated but later died.

    There are fears the death toll could rise further as the local Red Cross said more than 200 people had been reported missing.

    Forensic teams have been scouring an 800-acre site where the Good News International Church was based, with body bags being carried away from the Shakahola forest, in eastern Kenya.

    Pictures show mud huts with palm-thatched roofs scattered among the trees and foliage.

    The church's alleged leader, pastor Paul Mackenzie, is in custody and is accused of telling people to starve themselves to go to heaven.

    He has denied any wrongdoing and Kenyan media reported he was refusing food and water.

    Mackenzie was arrested on 14 April when the site in Kilifi county was raided after a tip-off. Fourteen other cult members are also being held.

    Interior minister Kithure Kindiki said another 16 bodies were exhumed on Tuesday, taking the number of dead to 89.

    Three more people were rescued alive - bringing that total to 34 - but some cult members fled when authorities arrived.

    Most of those rescued were unable to walk or talk.

    "We pray that God will help them to go through the trauma, to help them recover and tell the story of how one time a fellow Kenyan, a fellow human, decided to hurt so many people, heartlessly, hiding under the Holy Scriptures," said the interior minister.

    Post-mortem examinations on the bodies are due to start on Thursday.

    Kenya's public prosecutions office said it was looking at possible charges including murder, radicalisation and threatening public safety.

    Kenya cult death toll hits 200, with more than 600 reported missing

    The death toll linked to a doomsday cult in Kenya hit 201 on Saturday after police exhumed 22 more bodies, most of them bearing signs of starvation, according to the coast regional commissioner.

    he bodies are believed to be those of followers of a pastor based in coastal Kenya, Paul Mackenzie. He's alleged to have ordered congregants to starve to death in order to meet Jesus.

    More than 600 people are still missing.

    Mr Mackenzie, who was arrested last month, remains in custody. Police plan to charge him with terrorism-related offences.

    Hundreds of bodies have been dug up from dozens of mass graves spread across his 800-acre property, located in the coastal county of Kilifi.

    Mr Mackenzie insists that he closed his church in 2019 and moved to his property in a forested area to farm.

    Autopsies conducted on more than 100 bodies last week showed the victims died of starvation, strangulation, suffocation and injuries sustained from blunt objects.

    Local media outlets have been reporting cases of missing internal body organs, quoting investigators in the case.

    Mr Mackenzie, his wife and 16 other suspects will appear in court at the end of the month.

    Coast regional commissioner Rhoda Onyancha on Saturday said the total number of those arrested stood at 26, with 610 people reported as missing by their families.

    It is unclear how many survivors have been rescued so far from the search and rescue operations on Mackenzie's vast property. Some of them were too weak to walk when they were found.

    Cults are common in Kenya, which has a religious society.

    Police across the country have been questioning other religious leaders whose teachings are believed to be misleading and contrary to basic human rights.

    President William Ruto last week formed a commission of inquiry to investigate how hundreds of people were lured to their deaths at the coast and recommend action on institutions that failed to act.

    Mr Mackenzie had in the past been charged with the deaths of children in his church in a case that is ongoing in court. Residents nearby had raised the alarm after his followers moved to the forested area.
