    Tulare County Superior Court judge Wednesday upheld a jury's death sentence for Samuel "Sammy" Rivera, who in 2004 shot at a van full of farm laborers and killed a man.

    Rivera, 22, of Traver was ordered transferred to San Quentin State Prison's death row by Judge Joseph Kalashian.

    In December, a jury found Rivera guilty of first-degree premeditated murder with the special circumstances that the murder was done during a gang drive-by and shooting at an occupied vehicle. The victim, Gustavo Barrera, 24, of Reedley was one of 14 people in a van struck by a 12-gauge-shotgun blast.

    Barrera, the only occupant hit, later died.

    The jury took about 4 1/2 hours to reach its death-penalty verdict. The victim's mother, who said Barrera, her only son, was her sole means of support, was among several family members to testify that their lives have been devastated by the killing, the Tulare County District Attorney's Office said in a release.

    Here's how the crime happened, according to prosecutors:

    On Nov. 16, 2004, the van full of field workers stopped at a Traver market. After leaving the market, an occupant noticed a "suspicious" brown car on Road 44.

    The car's front passenger leaned out of the window with a shotgun and fired one round into the back window on the van's driver's side. A second shot, fired from in front of the van, missed.

    Several van occupants identified Rivera as the shooter.

    A bus driver said he saw Rivera in the brown car's passenger's seat shortly after the shooting.

    Prosecutors said that two years earlier, Rivera had broken the window of the same van at the same Traver market during a gang-related encounter with the same driver. Another encounter took place a few months later, officials said, and a witness reported overhearing Rivera threaten the driver's life.
