    Holly Bobo: Judge sets January plea deal deadline

    SAVANNAH — Judge C. Creed McGinley has again extended the deadline he set for the prosecution and defense to come to a plea agreement for John Dylan Adams, one of three men charged in the kidnapping, rape and killing of 20-year-old nursing student Holly Bobo.

    The prosecution and defense had not come to an agreement when the Hardin County Court re-convened at 11 a.m. Monday morning. McGinley has now given opposing counsel until Jan. 22 to reach an agreement.

    McGinley said Monday morning if the prosecution and defense didn't have a negotiated plea by Jan. 22, the negotiated plea would come off the table and he would set deadlines for motions in the trial.

    Other possible options in this case are Adams pleading to the indictments after the Jan. 22 deadline or nolle prosequi (Latin for "we shall no longer prosecute," which is a declaration made to the judge by a prosecutor in a criminal case, meaning the case against the defendant would be dropped).

    At Adams' previous status hearing Thursday, McGinley said both sides had made substantial progress toward a negotiated plea agreement and extended the deadline until Monday morning. McGinley said Monday no progress had been made over the weekend between the parties.

    Don Franks, the Bobo family pastor and spokesman, said he will not comment on the case until it is resolved.

    Dylan Adams' defense attorney Matt Maddox said, "they are looking forward to proceeding on with the case" and did not comment when asked about the possiblity of taking a plea deal.

    Adams appeared for a status hearing Monday morning at the Hardin County Courthouse. The state previously filed a motion to no longer seek the death penalty or life without parole against Adams.

    Adams' trial is scheduled to begin in May.

    SAVANNAH, Tenn. (AP) — The brother of a man serving life in prison for kidnapping, raping and killing Tennessee nursing student Holly Bobo pleaded guilty Monday in exchange for a 35-year sentence.

    John Dylan Adams entered an Alford plea, which means that he maintains his innocence, but acknowledges that prosecutors have enough evidence to convict him of especially aggravated kidnapping and facilitating first-degree murder. Judge C. Creed McGinley accepted the agreement, sparing the victim's family from having to "listen to the horrible details" at another trial.

    Bobo's mother, Karen, said she was prepared to endure it again, but is satisfied with Adams' guilty plea in the most exhaustive and expensive case in the history of the Tennessee Bureau of Investigation.

    "For the sake of our family and just letting one more chapter be behind us, we decided we would go with this," she said.

    Bobo was 20 when she vanished from their home in rural Parsons, Tennessee, in April 2011, prompting a massive search of woods, fields and farms in west Tennessee. Her remains weren't found until more than three years later, in September 2014, by two ginseng hunters in woods not far from their home, about 100 miles (160 kilometers) southwest of Nashville.

    John Dylan Adams is the younger brother of Zachary Adams, who is seeking a new trial after being convicted and sentenced to life without parole plus 50 years in a last-minute deal in September that avoided the possibility of a death sentence.

    A TBI agent testified at Zachary Adams' trial that the agency made a mistake when it did not pursue leads only days after Bobo went missing that pointed to four men who lived in a dark underworld of crime and drug use: the Adams brothers and their friends Jason Autry and Shayne Austin.

    Investigators were unable to recover any DNA pointing to the four suspects, who ultimately would be accused based on witness statements.

    Autry, also charged with Bobo's kidnapping, rape and murder, testified in expectations of getting a lenient sentence and is on a list of witnesses who have been offered immunity. He said the elder Adams told him in graphic detail how he, his brother John and Austin raped Bobo. Autry also testified that he served as a lookout while Zachary Adams shot Bobo under a bridge spanning the Tennessee River. Austin committed suicide in Florida in February 2015.

    A fellow jail inmate, Shawn Cooper, testified that Zachary Adams told him he was involved in the "Holly Bobo murder case" and wanted him to deliver a message to his younger brother: Stay quiet, or he would "put him in a hole beside her." At the time, Cooper was about to be transferred to the same jail where John Dylan Adams was being held.

    Autry, meanwhile, testified that Zachary Adams asked him to kill his younger brother to silence him.

    Prosecutors have not publicly revealed the details of John Dylan Adams' involvement, but Shelby County Assistant District Attorney Paul Hagerman did say Monday that he had less involvement than his older brother.

    No hearing has been set to resolve Autry's charges, but his lawyer has told the judge that a trial does not need to be set, indicating that he has reached a deal with prosecutors.

    Tennessee convict pleads guilty in Holly Bobo murder case

    SAVANNAH, Tenn. (AP) — A convicted felon pleaded guilty Monday to taking part in the killing of Tennessee nursing student Holly Bobo more than nine years ago, but he is expected to be released soon as part of a deal with prosecutors

    Hardin County Judge C. Creed McGinley sentenced Jason Autry to eight years in prison after Autry pleaded guilty to solicitation to commit murder and facilitation of especially aggravated kidnapping. Autry gets credit for time served in the case and he could be released in the next few days, said his attorney, Michael Scholl.

    Autry provided key testimony in the 2017 trial of Zachary Adams, who was found guilty of murder, especially aggravated kidnapping and aggravated rape. Adams was sentenced to life in prison plus 50 years.


    Adams is appealing his conviction. His brother, John Dylan Adams, also reached a deal with prosecutors. He is serving 35 years in prison.


    Bobo was 20 when she vanished from their home in rural Parsons, Tennessee, in April 2011, prompting a massive search of woods, fields and farms in west Tennessee.     The case shook Parsons and the surrounding rural counties, as residents feared that Bobo’s killer or killers lived among them.


    Ahead of Zachary Adams’ trial, Autry’s name showed up on a list of witnesses who could get immunity, and he said during questioning that he was testifying because he wanted leniency.


    Autry said Adams provided some graphic details when he told Autry that he — along with his brother, John Dylan Adams, and Autry’s cousin, Shayne Austin — had raped Bobo. Austin was found dead in an apparent suicide in Florida in February 2015.


    Autry told jurors he had been locked up for theft and drug convictions three times before he was jailed in the Bobo case. He acknowledged an addiction to methamphetamine and morphine.


    Autry said he’d known Zachary Adams for years. He said he called Adams on the day of Bobo’s disappearance to ask Adams for a morphine pill. When Adams called him back, he told Autry that he needed his help.


    Autry then went to Austin’s trailer, where Adams had driven with Bobo wrapped in a blanket in the back of his pickup truck, Autry said.


    Adams and Autry drove to a river and retrieved Bobo’s body from the truck, he said. Instead of burying her, they decided to throw her into the river, at a spot under a bridge.


    But Bobo made a sound and moved, indicating she was still alive. Adams retrieved a pistol from his truck, Autry said.


    Autry then walked around the area to make sure no one was around, he said.


    Autry told Adams the area was clear. He then heard a gunshot coming from the location where Adams and Bobo were.


    “It sounded like, boom, boom, boom, underneath that bridge. It was just one shot but it echoed,” Autry said. “Birds went everywhere, all up under that bridge. Then just dead silence for just a second.”


    Fearing capture, he and Adams loaded Bobo’s body back into the truck and drove away, Autry said.


    McGinley, the judge, praised Autry's testimony.


    “His testimony was some of the most credible, persuasive testimony I've ever heard given in a courtroom,” the judge said Monday.


    Bobo’s parents were in the courtroom Monday and prosecutor Paul Hagerman said they supported plea deal.


    Autry’s testimony helped answer important factual questions in the case, the prosecutor said.


    “It was a very important piece in getting justice for Holly,” Hagerman said.

    Tennessee Appellate Court Affirms Convictions and Life Sentence in Holly Bobo Murder Case

    A Tennessee appellate court has affirmed the convictions of the man sentenced to life imprisonment plus 50 years for kidnapping, raping and murdering Holly Bobo.

    The three-judge panel rejected Zachary Adams’s claims that there was insufficient evidence for a jury to convict him and that his constitutional rights were violated.

    Bobo, a 20-year-old nursing student at the Tennessee Technology Center, went missing on the morning of April 13, 2011, and it would take three years of what had been called the most intense investigation in the state’s history for anyone to discover her remains.

    In 2014, a ginseng hunter saw an upside down bucket in the woods — and discovered a human skull beneath it, later traced to the victim. Investigators also found a few rib bones. Forensic examination of the skull showed a single gunshot wound to the back of the head, consistent with a close range of fire. Adams and his brother John Dylan Adams were later charged with Bobo’s kidnapping, rape and murder.

    As Law&Crime previously reported, their friend Jason Autry, Shayne Austin, and Jeff and Mark Pearcy were also charged, but Austin later died by suicide. Autry would later become the state’s star witness, and authorities dropped the cases against the Pearcy defendants. John Dylan Adams entered into a so-called Alford plea, in which he did not admit the criminal conduct but accepted the sufficiency of proof of his conviction.

    Zachary Adams maintained his innocence, fought the claims at trial, and following his convictions, entered into a deal with the government averting the death penalty.

    In an 81-page ruling issued on Friday, lead author Judge Robert Montgomery reprised much of the evidence linking Adams to the crime, including the killer’s statements to his ex-girlfriend Rebecca Earp following Bobo’s disappearance.

    “Additionally, the defendant’s inculpatory statements in the aftermath of the offenses were significant,” the ruling states. “Mere days after the victim’s disappearance, Ms. Earp saw Mr. Austin smirk and laugh about a news report related to the victim, and she heard the Defendant say that law enforcement would ‘never be able to find her.’ Further, when Ms. Earp ended her relationship with the Defendant in July 2011, the Defendant threatened to ‘tie [her] up just like he did [the victim]’ and said ‘nobody would never see [Ms. Earp] again.’ Afterward, she and the defendant continued to socialize, although their romantic relationship had ended.”

    The ruling also says that Zachary Adams asked a fellow inmate to pass on a threatening message to his brother.

    “The defendant wanted his brother to know that if his brother ‘don’t keep his mouth shut,’ the defendant would ‘put him in a hole beside her,'” according to the ruling.

    Judges Timothy L. Easter and Jill Bartee Ayers joined the ruling.

    Adams’s attorney Jennifer Lynn Thompson declined to comment.

    Did authorities ever recover, or substantiate the existence of, the alleged video that was filmed of the rape/murder?
