    Holly Bobo Suspect Misses Court, Faces Witness Coercion Charge

    The man accused of murdering Tennessee nursing student Holly Bobo still has not retained an attorney, it was revealed Wednesday, even as he faces an additional charge related to threatening to kill his brother.

    Zachary Rye Adams, 29, wasn’t required to appear in Decatur County court, prompting Circuit Judge C. Creed McGinley to announce he would force the suspect to attend future status hearings. An attorney represented Adams in court Wednesday, but the convicted felon hasn’t officially retained her, reported The Jackson Sun.

    “Until Mr. Adams is present, I am limited in what I can do,” McGinley said.

    The state has refused to begin discovery in the case until Adams retains a lawyer, according to NBC affiliate WSMV.

    Adams pleaded not guilty last month for the kidnapping and first-degree murder of Bobo, who was 20 when she vanished from her home in western Tennessee on April 13, 2011.

    Authorities have not revealed why they believe Adams is a suspect, and have not said whether they have recovered Bobo’s body.

    Adams lived just 15 miles from the Bobo family home.

    The case, meanwhile, took another strange turn last week, when a court affidavit revealed Adams was also being charged with witness coercion.

    Adams had learned a fellow inmate at Chester County Jail was being transferred to a new jail where Adams’ younger brother is being held, the affidavit reportedly said. Adams then asked the inmate to pass a message to his brother: “He’s the one who started this [expletive] and if he don’t shut his mouth he will be in the hole beside her.”

    Adams’ younger brother, John Dylan Adams, is serving time for a stolen firearms charge.

    Zachary Adams must attend the next status hearing at 1 p.m. on April 30.

    New Details That Led To Arrest In Holly Bobo Case

    DECATUR COUNTY, Tenn. - New details uncovered by NewsChannel 5 shed light on what may have led to the arrest of Zach Adams for the murder of Holly Bobo.

    Bobo disappeared three years ago, and earlier this year the Tennessee Bureau of Investigation charged Adams with the crime. The key to the case could be his brother Dylan Adams.

    "The brother is now a witness and a key witness in this prosecution," said NewsChannel 5 legal analyst Nick Leonardo.

    The brothers lived with their grandfather, Dick Adams, in separate homes on a piece of property near Decaturville. The TBI searched the property in February, not long before Zach Adams was arrested. So what led authorities to Adams and the property?

    In an exclusive interview with NewsChannel 5, the grandfather dropped a bombshell: His grandson Dylan told the TBI he saw Holly Bobo inside his brother Zach's house after she disappeared.

    "I believe that Mr. Adams' brother stated that Holly Bobo was seen in the house alive," said Leonardo.

    If the grandfather is telling the truth, Leonardo said that tip would have helped the TBI obtain the warrant to search his property.

    It might also explain why Zach Adams later lashed out at his brother -- who is also jailed on separate federal gun charges.

    "This is but one piece of the puzzle we are getting but it's all coming together very quickly," said Leonardo.

    Not long after the TBI arrested Zach for Bobo's murder they said he threatened his brother sending a message through another inmate: "He's the one who started this s*** and if he don't shut his mouth he will be in the hole beside her."

    The "her" may be Holly Bobo.

    And NewsChannel 5 has learned the "hole" could refer to one of the water wells on Adams' property. The grandfather confirmed there are two: One is 15 feet down to a shallow spring. The other is much deeper. Both capable of hiding a body.

    "Absolutely, especially a well that goes down 80 feet. That's especially a place of interest," said Leonardo.

    In fact, the grandfather confirmed the TBI used backhoes to dig up and search both wells. There was no indication they found a body. But several sources close to the investigation said they recovered some type of physical evidence -- possibly bone fragments. If that's true the question is: Did the fragments come from Holly Bobo?

    "Obviously they are waiting to see if there's a forensic match with Holly's DNA that comes back from the lab," said Leonardo.

    The TBI calls the Bobo investigation open and ongoing and they can't reveal any specifics about the case. And many details -- like those in the search warrant -- remain sealed for now.

    Leonardo said one reason to keep such documents sealed is not to tip off other suspects. He believes there is a very good chance there will be other arrests in the case.

    'Significant developments' expected in case of missing woman Holly Bobo

    Authorities are expected to announce "new and significant developments" in the case of a missing Tennessee nursing student abducted from her family's home three years ago, the Tennessee Bureau of Investigation confirmed to FoxNews.com.

    Holly Bobo, a nursing student at the University of Tennessee at Martin, was last seen at her home in Parsons on April 13, 2011, by her older brother, who reported seeing her being taken into the woods by an unidentified man dressed in camouflage.

    A small amount of blood was found in the family's carport, where Holly was believed taken from while on her way to school, police sources told FoxNews.com at the time of her disappearance. Despite extensive searches that included bloodhounds and high-resolution underwater imaging, authorities found no trace of the 20-year-old woman, who is presumed dead.

    In late February, Zachary Rye Adams, 29, was charged with murder and aggravated kidnapping in the death of Bobo. He was arrested last week after police searched his home in an unrelated assault case.

    "We believe we can prove that she was taken forcefully from her home without her consent," District Attorney General Hansel McAdams said at the time. He said he will consider pursing the death penalty if Adams is convicted. He has also been charged with coercion of a witness in the Bobo case.

    Investigators would not get into details about why Adams was charged. His home, however, is about 15 miles from where Bobo lived in Parsons, a small town about 100 miles northeast of Memphis in Decatur County.

    Adams has pleaded not guilty and remains in jail without bond.

    A source close to the case told FoxNews.com on Tuesday that additional charges will be filed in the case.

    Bobo's brother, Clint, reported to police that he saw a man in camouflage clothes leading his sister into the woods behind the family's home. He said he initially thought she was being taken into the woods by her boyfriend, but grew concerned when he saw the man's arm holding onto his sister. He called his mother, who then contacted 911.

    A news conference is planned for 4 p.m. local time.

    Second suspect charged with murder in Holly Bobo case

    DECATURVILLE, TN (WSMV) - Charges have been filed against a second individual in the 2011 disappearance of nursing student Holly Bobo.

    A special grand jury met Tuesday in Decatur County and returned indictments of especially aggravated kidnapping and first-degree murder against Jason Autry, 39, in Bobo's disappearance.

    Bobo was 20 years old when she disappeared outside her Darden, TN, home on April 13, 2011, as her brother saw her being led away from the home between 7:30 and 8 a.m.

    The investigation picked up steam in February 2014 when agents from the TBI and FBI searched several locations in Decatur and surrounding counties, including the home and property of Zachary Adams in Holladay, TN, about 15 miles from the Bobo residence.

    Adams, the only person who has been arrested in the case, is charged with kidnapping and murder. He is also facing a coercion of witness charge.

    Adams appeared in court on Tuesday for the coercion charge.

    It was learned in court on Tuesday that Adams' brother told investigators he saw Bobo alive in Adams' home after she disappeared. Adams' brother plans on testifying against him during trial.

    Adams is scheduled to be in court again on Wednesday.

    Third man targeted in Bobo investigation

    Prosecutors plan to indict at least one more person in the Holly Bobo case, according to documents obtained Tuesday by The Jackson Sun.

    According to the documents, prosecutors plan to indict Shayne Kyle Austin, who previously had been granted immunity in exchange for his cooperation in the investigation.

    The state voided the immunity agreement because Austin was not completely truthful and forthcoming, according to an email from Assistant District Attorney General Beth Boswell to Austin’s lawyer, Luke Evans. The email was sent on March 27.

    “When we indict your client, I will give you a courtesy call informing you,” Boswell told Evans in the email.

    The Jackson Sun went to an address listed for Austin on whitepages.com, but the property was surrounded by a fence, and the driveway was blocked by a locked gate. The listing did not include a telephone number.

    Austin would be the third person indicted in the case related to the abduction and killing of Bobo. Jason Wayne Autry was indicted Tuesday on charges of first-degree murder and especially aggravated kidnapping. Zachary Adams was indicted on the same charges in March.

    Bobo was abducted from her home in Darden in April 2011.

    Boswell’s email indicating the intent to indict Austin was included with documents filed by Austin’s lawyer in Decatur County Chancery Court on April 1. The documents seek a restraining order and temporary injunction to keep prosecutors from violating the immunity agreement and indicting Austin.

    According to the documents, Austin received immunity in the Bobo investigation in an agreement signed on March 6. The agreement gave Austin immunity from any criminal charges arising from the Bobo case.

    More specifically, the agreement said, “In exchange for the total cooperation of Shayne Kyle Austin, the State agrees to grant him immunity for all charges arising out of the disposal, destruction, burial and/or concealment of Holly Bobo’s deceased body, conditioned upon him assisting us in recovering the body of Holly Bobo.”

    The immunity agreement said the state also would not charge Austin with tampering with evidence or accessory after the fact “if he was present for, if he participated in, of (sic) if he has information concerning the disposal, destruction, burial and or concealment” of Bobo’s body or other items of evidence connected to or belonging to her.

    The agreement also said the state would give Austin immunity for information concerning the “possession of any controlled substances, the sale of any controlled substances, the possession of drug paraphernalia, and/or any other drug related criminal activity (not to include any drugs administered to Holly Lynn Bobo.)”

    The agreement was contingent upon Austin being “completely truthful, forthcoming and cooperative” in the investigation. The agreement was also void if investigators independently developed evidence or witnesses — other than any co-conspirators — that implicated Austin in a crime related to the Bobo case.

    The immunity agreement had been signed by Boswell, Evans, Austin and Russ Winkler, assistant special agent in charge of the Tennessee Bureau of Investigation.

    Boswell did not respond to a telephone message left at her office seeking comment.

    Evans, who is from Murfreesboro, said his court filings on behalf of Austin speak for themselves.

    “My client takes issue with the state’s position that he has somehow breached his immunity agreement,” he said in a telephone interview Tuesday night. “My client’s position is that he has been truthful and forthcoming and is greatly disturbed at the state’s accusation.”

    Evans said, “A great bit of conjecture went along with the investigation and with the community’s search for an answer.”

    Man Suing State To Keep Immunity Deal In Bobo Case

    NASHVILLE, Tenn. – Another man named in connection with the Holly Bobo case has sued the State of Tennessee in order to protect his immunity.

    So far, Zach Adams and Jason Autry have been charged with kidnapping and killing Bobo.

    Court records have indicated that Shayne Austin may also be indicted in connection with the case. Prosecutors granted Austin immunity if he could help with the TBI investigation, which apparently included finding Bobos' body.

    Newschannel 5 learned that a tip from Austin helped lead to a massive search of Adams' property back in February.

    No body was found, and Newschannel 5 Legal Analyst Nick Leonardo said if prosecutors have to rely on circumstantial evidence they may have a big problem with Austin.

    "I believe that the state of Tennessee is going to try to use him with the jury to say believe Mister Austin the statements he's making about these co-defendants' involvement -- it's true, but in this particular case the state is going to be a little disingenuous because they themselves don't believe the voracity of Mister Austin's statements,” Leonardo said.

    Through e-mails prosecutor told Austin's attorney he'd broken the immunity agreement by not being truthful, and they'll make a courtesy call when they indict Austin.

    Now, Austin has sued the state in chancery court to keep them from breaking the agreement. Apparently, he felt he had been truthful.

    Adams and Autry were scheduled to appear in court again in two weeks.

    Zach Adams' grandfather told Newschannel 5 the TBI used backhoes to dig up and searched two wells on the Adams property.

    Several sources close to the investigation told Newschannel 5 they did recover some physical evidence -- possibly bone fragments.

    NASHVILLE, Tenn. - Jason Autry is one of the two men at the center of one of the mid-state's most high profile criminal cases. He and Zach Adams have been charged with kidnapping and murdering Holly Bobo. In an exclusive interview, Autry spoke with Nick Beres about the case against him.

    The Tennessee Bureau of Investigation arrested Autry three years after Bobo disappeared from her Decatur County home.

    We asked him if he killed her.

    "No sir. Right hand before God. The Father, Son and Holy Ghost. I didn't bother that girl in no form or no fashion and I don't know who did," said Autry from his cell at Riverbend Maximum Security Prison.

    Autry said he never personally knew Bobo, though he did know of her.

    "I didn't now nothing about her other than her dad and my dad and some of our kin knew each other. I went to school with her mother as my school teacher growing up," said Autry.

    But, he said he doesn't even know the location of Bobo's home where she was abducted.

    "I never went to the house. I never hung out with her on the town. I never, none of that," said Autry.

    Autry said he does know his co-defendant Adams as a friend.

    But he denied rumors that Autry, Adams and another friend, Shayne Austin, formed a gang known as the A-Train that terrorized the locals in Decatur County for years.

    "Some people portray us as big dope dealers and gang members and that's not the case. This is a community that's real small. It was just a few dopeheaded boys just hanging out," said Autry. "Our relationship is what you might call drug-based. The only time we hung out was when we was getting high."

    Autry denies that he was involved in some type of drug-induced, crazy plot to kidnap and kill Bobo.

    "It never dawned on me that someday I was going to be falsely accused of this," said Autry.

    "Jason Autry has been in trouble with the law before," said his attorney Fletcher Long.

    But he said there is nothing to link Autry to Bobo's disappearance, much less murder. The TBI has looked, but has yet to find a body.

    "You can prosecute without a body, but you better have some pretty convincing circumstantial evidence on death and I don't think they have that here," said Long.

    Even if the TBI does have some physical evidence -- perhaps bone fragments or clothing -- it may not matter for Autry.

    Long dropped this bombshell: "We may have a strong alibi defense."

    Long has indicated that Autry will be able to prove he was far away -- in another county -- when the TBI issued the alert for Holly Bobo.

    The TBI has declined to comment on what Autry has said about the investigation.

    Media Whore Attorney Fletcher Long Complains About Access To Holly Bobo Murder Suspect Even After Long Set Up Unapproved Media Interview With Jason Autry in Prison

    NASHVILLE, Tenn. – The war of words has escalated, and it could jeopardize the case against one of the Holly Bobo murder suspects.

    The attorney for suspect (career criminal) Jason Autry said he may ask the judge to dismiss the indictment, claiming Riverbend Maximum Security Prison is hindering Autry’s right to a legal defense.

    Jason Autry has been charged with the kidnapping and murder of Holly Bobo. He talked to NewsChannel 5 by closed circuit TV from Riverbend Maximum Security Prison. But Autry’s attorney Fletcher Long wants better access.

    The state response read: “Mr. Long was granted a video conference with his client, but, unfortunately, Mr. Long chose to squander his time when he circumvented TDOC policy by allowing a member of the media to conduct an unapproved interview with an inmate.” This referred to him allowing NewsChannel 5 to interview Autry.

    This ‘attorney’ for Jason Autry, Fletcher Long, is nothing more than an a headline grabbing media whore who is trying to shed some sympathetic light on his client, violent meth dealer Jason Autry.

    Jason Autry is a thug who described his former self in a newspaper story as a serious drug addict, “using needles, stealing, running drugs.”

    Jason Autry’s statewide criminal record includes more than 20 arrests, with 22 felony charges in Decatur County alone.

    A Tennessee Bureau of Investigation summary of his criminal records showed that Jason Autry has been arrested on charges of Aggravated Burglary, Theft, Criminal Trespassing, Possession of a Weapon with Altered Serial Number, Possession of Schedule II Drug Meth with Intent to Manufacture/Sale, Domestic Assault, Possession of Anhydrous Ammonia used to make meth, among other charges.

    CLARKSVILLE, TN (WSMV) - A Channel 4 I-Team investigation has obtained official audio recordings of former employees of the law firm claiming lead attorney Fletcher Long sexually harassed them and used racial slurs.

    The Channel 4 I-Team obtained the recording after attorney Fletcher Long was arrested in December 2013 on a harassment charge from his former office manager Christie Hill. Hill also obtained an order of protection saying Fletcher Long sent her threatening text messages that included racial slurs.

    In the hearing, the first employee said, “He [Long] referred to the employees as his n—-s.”

    Fletcher Long has represented some of the biggest accused criminals in recent Middle Tennessee memory – from the so-called “Wooded Rapist” Robert Burdick, to Vanderbilt rape suspect Brandon Vandenburg.

    Hill says she worked for Long up until last month, when she was told her contract had ended with the firm. When she says her last four paychecks bounced from Fletcher Long, Hill went for help. “I went to the DA. The Channel 4 I-Team has confirmed Long and his former law partners are under investigation by the Tennessee Bureau of Investigation.

    Holly Bobo Murder: Suspect Shayne Austin Lied, Should Lose Immunity, Prosecutors Say

    The Holly Bobo murder case took another twist this week as prosecutors tried to strip one of three suspects in the 2011 kidnapping and murder of the 20-year-old Tennessee nursing student of the immunity they granted him for cooperating. And the suspect, Shayne Austin, is suing the prosecutors for breach of contract.

    Holly Bobo vanished from her home in Parson, Tennessee on April 13, 2011. Police and prosecutors are treating the case as a murder, though no trace of Holly Bobo has ever been found.

    Two men have been arrested and indicted for the abduction and murder of Holly Bobo. Zachary Adams and Jason Autry, two friends who were allegedly part of a local drug gang, are now in jail awaiting trial. Austin may now also be indicted if prosecutors are successful in revoking his immunity.

    Austin told law enforcement authorities that he could lead them to where Holly Bobo’s body was disposed of. But when police searched the location, they found no trace of the missing nursing student.

    But when Austin appeared in court Tuesday, a judge in Decatur County Chancery Court said that she had no jurisdiction to rule on whether 29-year-old Austin should have his immunity revoked or not. Decatur County Chancellor Carma D. McGee said that only a criminal court could make that call.

    Autry recently gave an interview to a Tennessee TV station in which he denied taking part in the kidnap and murder of Holly Bobo.

    Autry’s attorney, Fletcher Long, said that he plans to defend the accused killer based on what he says is a strong alibi. Long says he can prove that Autry was miles away, not even in the same county, when Holly Bobo went missing.

    Prosecutor Seeks Gag Order In Holly Bobo Case

    DECATUR COUNTY, Tenn. – Prosecutors have asked for a gag order in the case against one of the Holly Bobo kidnapping and murder suspects.

    This request seemed to be the direct result of a NewsChannel 5 exclusive interview last week with Jason Autry, one of two people accused of kidnapping and murdering Holly Bobo.

    The state objected to the broad content of that interview and claimed the comments made by Autry and his attorney, Fletcher Long, could intentionally or unintentionally pose a substantial likelihood of prejudicing a fair trial because of the publicity.

    Attorney General Beth Boswell claimed Long inappropriately allowed NewChannel 5 to interview his client while he was being held in segregation at Riverbend Maximum Security Prison.

    Inmates in segregation are not allowed to do interviews in the prison. Our interview was conducted by way of video conferencing.

    The NewsChannel 5 crew was not at the prison.

    Fletcher Long said he did nothing wrong. He said it's his decision how best to defend his client, and if an interview with him in the prison was prohibited he sought other options – either by telephone or, in this case, by video conferencing.

    A judge has not yet heard the motion for the gag order.
