    Gag order denied in Holly Bobo case

    DECATURVILLE, Tenn — Judge Charles Creed McGinley denied a request from state prosecutors to keep the men accused of kidnapping and murdering Holly Bobo from speaking about the case during a hearing on Wednesday.

    McGinley announced his decision during a status update hearing for defendant Jason Autry, who faces the murder and kidnapping charges along with Holladay resident Zachary Rye Adams.

    Assistant District Attorney General Beth Hall argued that Jason Autry's interview with WTVF News Channel 5 and his effort to pass a note to news reporters standing outside the courtroom before today's hearing were examples of how Autry's efforts to contact the media could unfairly influence the outcome of a trial.

    The motion filed by prosecutors Tuesday requested the court to order "all trial participants, including lawyers, parties, and witnesses, to refrain from commenting about this trial as those comments, whether intentionally or unintentionally, pose a substantial likelihood of prejudicing a fair trial because of the publicity of the proceedings."

    McGinley said that he would not grant the gag order, but that it "behooves everyone involved to try the case in court and not in the media."

    McGinley repeated again in court today that he intended to keep the proceedings involving Autry and Adams moving as quickly as possible while maintaining fairness to both sides.

    "I am fully cognizant that there is voluminous discovery that is out of the ordinary for a criminal case," he said. "So I have made a scheduling order that is a bit more liberal than I would normally use."

    McGinley said he wanted the prosecution to furnish both defendants in the case with discovery — the prosecution's evidence against them — in 90 days. After which, he said, the defense would have 60 days to make pretrial motions, to which the state would then have 30 more days to respond.

    He said there would then be 30 days for judicial review.

    If a plea agreement is not reached by Jan. 14, then a trial date will be set.

    McGinley said he expects to issue an identical scheduling order for Adams during Adams' status update hearing on June 4, although the defendants will currently be tried separately.

    The judge said he would have to issue a decision if a request were made to join the two trials together.

    McGinley said that after a three-year investigation it appears the prosecution has "mountains of materials."

    The prosecution said the defense is providing the state with several external hard drives on which to place much of the discovery materials that have been recorded in a digital format.

    Toward the end of the hearing, Autry's attorney, Mike Flanagan, requested that at some point in the near future the prosecution give some notice of what punishment they would request for Autry. Hall said the state had talked with an attorney, and mentioned the death penalty.

    When this was mentioned, Autry pursed his lips, turned his head, looked back at his mother Shirley King and winked.

    Accused Holly Bobo killer makes demands in court

    DECATURVILLE, Tenn. — One of two men charged with killing Decatur County nursing student Holly Bobo came to court Wednesday with a list of demands.

    Zachary Adams’ lawyer, Jennifer Lynn Thompson, filed a range of motion that his status hearing.

    Judge Creed McGinnley said to Thompson, “You have filed the motions yesterday and today. They’re fairly standard motions.”

    Thompson filed four motions in all.

    One asked that any evidence that would help the defense be turned over. Another asked that evidence be given in enough time to request information be suppressed. The judge approved both.

    The other motions dealt with Adams’ treatments in the Chester County Jail.

    Adams wants and a pencil, paper, envelopes, and stamps in his cell.

    The state says a pending coercion charge should play into that decision, but Judge McGinnley said Adams should be treated like any other inmate.

    “What I don’t want is, simply for the nature of this charge, for him to be treated differently than any other person at that holding facility,” McGinnley said.

    Thompson also asked the judge to allow Adams’ family to visit him without her being present. He agreed to look into it.

    The prosecution did not have any evidence ready for the defense yet.

    The judge wants the trials for both Adams and Jason Autry, who is also charged with kidnapping and murdering Holly Bobo, to move quickly.

    However, neither will be back in court until December 17.

    Friends of the Bobos, like Tammy Ramey, are frustrated.

    “This family’s been put through hell, and it needs to come to a conclusion,” Ramey said.

    Zachary Adams’ cousin Leigh Ann Griggs contacted WREG reporter Katie Rufener on Twitter Wednesday.

    She said of Adams, “He didn’t do it. He has no rights at all. You want justice for Holly? Find the real killer!”

    The Bobo family would not speak to reporters after the status hearing.

    Authorities Not Commenting On Possible New Holly Bobo Evidence

    LEXINGTON, Tenn. - Officials with the Tennessee Bureau of Investigation are not commenting on the possible existence of a video that could possible be connected to the kidnapping of nursing student Holly Bobo.

    Court documents obtained by NewsChannel 5 from Henderson County showed that on May 29, Jeffrey Kurt Pearcy was arrested and charged with Tampering with Evidence and Accessory After the Fact.

    The affidavit said that Jeffrey Pearcy has a video on an electronic device, "that will prove to be beneficial in the prosecution of a current on-going investigation being conducted by the Tennessee Bureau of Investigation."

    On Monday, Officials would not say to which case that video was connected.

    NewsChannel 5 also obtained court documents from Decatur County, which suggested another man, Mark Lynn Pearcy, may have also appeared in that video.

    Suspect Charged In Connection With Bobo Case Scheduled To Appear In Court

    NASHVILLE, Tenn. - A suspect charged in connection with the disappearance of nursing student Holly Bobo is scheduled to appear in a Decatur County courtroom Monday morning.

    Mark Lynn Pearcy is scheduled to go before a judge at 9 a.m.. Pearcy was arrested on May 29 and charged with Accessory After the Fact and Tampering with evidence.

    Pearcy’s brother , Jeffrey, was also arrested in May and faces similar charges. He appeared in court for the first time last week. A not guilty plea was entered and Jeffrey was released on $25,000 bond. He was required to wear a GPS tracker on his ankle at all times.

    Attorney Olin Baker said the charges against the brothers were related to the possible existence of a video which shows Holly after she was taken from her home in Decatur County three years ago.

    Court documents obtained by NewsChannel 5 said Jeffrey Pearcy has a video on an electronic device "that will prove to be beneficial in the prosecution of a current on-going investigation being conducted by the Tennessee Bureau of Investigation."

    Those documents showed that, according to a witness, Mark Pearcy was identified as being in that video when it was recorded. Officials would not comment on the content of the video.

    Suspect in Bobo case faces gun, sex-offender registry charges

    DECATURVILLE — A man charged with tampering with evidence in the Holly Bobo investigation also faces charges of possession of a firearm by a convicted felon and violation of sex-offender registration requirements, according to court documents.

    The gun and sex-offender registration charges against Mark Pearcy are unrelated to the Bobo case but were filed around the same time as his arrest in that case.

    According to an affidavit, investigators found a .22-caliber handgun hidden inside an RV where Pearcy had been living on Middleburg Road in Decaturville. Pearcy, 38, was convicted of aggravated statutory rape, a felony, in Decatur County in 2000.

    Pearcy also is charged with a violation of registry and reporting requirements for sex offenders. According to court documents, he is accused of failing to notify the Decatur County Sheriff’s Office of his primary and secondary addresses.

    The state sex offender registry lists two addresses for him on Campground Road in Decaturville but does not include the RV address or an address in Lexington that’s on his arrest warrant.

    Mark Pearcy and his brother Jeffrey Pearcy are both charged with tampering with evidence and accessory after the fact in the Holly Bobo kidnapping and murder investigation. Both men have pleaded not guilty.

    Mark Pearcy was in Decatur County General Sessions Court on Monday for a scheduled preliminary hearing, which was postponed until 1 p.m. next Monday.

    Attorney Mike Cash, of Jackson, will represent Mark Pearcy. Cash declined to comment on the case after court Monday.

    The Pearcy brothers were arrested May 29. According to the Tennessee Bureau of Investigation, authorities believe the two men have possession of a video that is important to the Bobo case or know where the video is. Court documents do not describe the content of the video.

    According to affidavits filed in Henderson and Decatur counties, a witness saw a video connected to the Bobo case and told the TBI about it. The witness who watched the video believes a voice on the recording is Mark Pearcy’s, according to court documents.

    The witness who spoke to TBI investigators has known Mark Pearcy for about 17 years, according to an affidavit.

    The court documents state that Jeffrey Pearcy told the witness about the video, and that Jeffrey Pearcy then left the witness’s home and went to see Mark Pearcy. Jeffrey Pearcy returned to the witness’s home with the video and used an electronic device to show the video to the witness, the affidavit says.

    Jeffrey Pearcy, 42, is charged in Henderson County and was released on bond.

    Mark Pearcy is charged in Decatur County, but is being held in the Carroll County Jail. His bond was set at $65,000.

    Two other men, Zachary Adams, 29, and Jason Autry, 39, were charged by the TBI earlier this year with especially aggravated kidnapping and felony first-degree murder of Bobo and are awaiting trial.

    All four men charged in connection with the Holly Bobo case were being held in separate jails. Adams is being held in Chester County without bond. Autry is in Riverbend Maximum Security Institution in Nashville, where he is serving a sentence on an unrelated charge. Jeffery Pearcy was held in Henderson County, and Mark Pearcy is being held in Carroll County.

    Josh Devine, spokesman for the TBI, said that there is not a specific effort to keep the men separated.

    Bobo, a 20-year-old nursing student, was abducted from her home in Darden in April 2011. Her body has not been found, but investigators have said they believe Adams and Autry were responsible for killing her shortly after she was kidnapped. Investigators have said witnesses saw Bobo alive with Adams and Autry after she was abducted.

    Holly Bobo suspect Jeff Pearcy says he's innocent

    CAMDEN, Tenn. -One of two brothers recently arrested in connection to the kidnapping and murder of nursing student Holly Bobo is speaking publicly about the charges he faces for the first time.

    Jeff Pearcy, 42, is charged with accessory after the fact and tampering with evidence but claims he is not guilty of the crimes.

    Investigators with the Tennessee Bureau of Investigation believe he and his half-brother, Mark Pearcy, know about an alleged video that could help solve Bobo's murder case.

    According to court documents, Jeff allegedly told an unidentified witness about the recording and showed it to that person. The witness said she recognized Mark's voice on the video.

    During an interview with News 2 Wednesday, Jeff Pearcy said he knows nothing about any video.

    "The first I heard about a video was when investigators were questioning me and the more that I told them I didn't know what they were talking about the more mad they got,” he said.

    Pearcy says he did not know why he was being arrested last month until a few days after he'd been in solitary confinement in the Henderson County jail and was served warrants.

    "I thought it was more or less like a dream but after being in that place realization started to sink in and I was like, ‘Hey they really think this?’" Pearcy continued.

    The Benton County father of six says he never met Bobo but has seen her picture posted throughout the community many times since her disappearance.

    The then-20-year-old was last seen on April 13, 2011 being led away from her family's Decatur County home by an unknown man.

    Despite massive searches no one was arrested until this year when the TBI charged Zachary Adams and Jason Autry with her kidnapping and murder.

    "My heart goes out to Holly's family," Pearcy told News 2.

    Pearcy says he knows of Adams and Autry but has never been friends with them.

    As for the person who turned him into the TBI, Pearcy believes it was someone he knows.

    "I'm sure there are motives why somebody would do it. They may be gaining something or promised something in return," he said.

    Pearcy has spent the past 15 years working as a jeweler in Middle Tennessee. He was fired after his arrest.

    Pearcy pleaded not guilty to the charges against him and is free on $25,000 bond. He must wear an ankle monitoring device as a condition of his bond.

    Pearcy will be back in court in July 1.

    Mark Pearcy No Show in Court, Hearing Rescheduled

    DECATUR COUNTY, Tenn. - Holly Bobo suspect Mark Pearcy was a no-show Monday in court but his attorney was.

    Pearcy was picked up by federal agents on charges including having a gun as a convicted felon.

    He and his brother are charged with tampering with evidence and accessory after the fact in the death of Holly Bobo.

    The judge rescheduled his hearing for August 18.

    Holly Bobo suspect Zachary Adams faces assault charge after jail incident

    Deputies say man charged with Holly Bobo's murder suicidal, assaulted officer

    Zachary Adams, the man charged with the aggravated kidnapping and first-degree murder of Decatur County woman Holly Bobo, will now face charges for assaulting an officer, according to a report from the Chester County Sheriff's Department.

    The report also said that Adams was overheard expressing the desire to kill himself in the Chester County jail where he is currently being held.

    On Friday June 13, Chester County Sheriff Deputy Mark Griffin received an incident statement from corrections officer Mark Morris which stated that Morris had overheard Adams make suicidal comments, "specifically to throw himself from the highest point to which he could climb inside his cell," a report sent out from the sheriff's department today said.

    "I advised second shift supervisor, Sgt Brown, to have (sic) Inmate Adams moved to a specialized cell so that he could be monitored and observed (sic) twenty-four hours per day to prevent him from injuring himself," Griffin wrote in the report.

    Correctional officers Jordan Phelps, Keith Crowe and Cody Riley later made statements that the three of them entered Adams' cell in order to move him and that Adams refused and resisted.

    The officers said Adams jerked away from Riley and struck Riley with his hand. The officers reported that Crowe sprayed Adams with a chemical agent in order to restrain him and that Adams continued to resist and struck Phelps "on or about the nose."

    The officers stated that Adams was restrained, but continued to resist and "attempted to trip Crowe at least three times and had to be physically carried to the cell."

    The report said Adams will be charged with assault.

    Court Hearing Set For Suspect Charged In Bobo’s Disappearance

    HENDERSON COUNTY, Tenn. - One of two new suspects charged in connection with the disappearance of nursing student Holly Bobo is expected in court on Tuesday afternoon.

    Jeffrey Kurt Pearcy was charged with tampering with evidence and accessory after the fact. He was set to go before a judge in Henderson County General Session Court at 1 p.m.

    Pearcy appeared in court last month, where the judge entered a plea of not guilty on his behalf. Bond was set at $25,000, with a requirement that Pearcy wear a GPS tracker on his ankle at all times.

    He was released from jail shortly after that.

    In an interview with NewsChannel 5, Pearcy claimed his innocence. He said the arrest ruined his reputation and said he has lost his job.

    He feels the Tennessee Bureau of Investigation made a mistake when they arrested him for allegedly knowing about, or at one time possessing, a recording of Bobo that was made after she disappeared in 2011.

    "The TBI told me they don't care about nothing but the Holly Bobo case. That was the first words out of their mouth. And I said, ‘Okay, what's that got to do with me,’ and then they commenced," said Pearcy in the interview last month.

    Court documents obtained by NewsChannel 5 from Henderson County showed that Pearcy was arrested on May 29.

    The affidavit said he has a video on an electronic device, "that will prove to be beneficial in the prosecution of a current on-going investigation being conducted by the Tennessee Bureau of Investigation."

    Pearcy was told not to have any contact with a witness who reported he had seen video evidence.

    Also charged was Pearcy’s half-brother, Mark Lynn Pearcy.

This is a warrant based largely on hearsay it looks to me like a police tactic to try to make an arrest and they are trying to rattle some evidence loose... the TBI is on a fishing expedition," he added.

    LEXINGTON — A hearing was postponed today for a man charged with tampering with evidence and accessory after the fact in the Holly Bobo case.

    But the suspect, Jeffrey Pearcy, spoke to reporters outside the courthouse, and he said that the allegations against him are false.

    Today a judge ordered that Pearcy, who has been released on bond, no longer needs to wear an ankle monitor bracelet because he has not been convicted of a crime.

    According to affidavits filed in Henderson and Decatur counties, a witness claims to have seen a video connected to the Bobo case and told the TBI about it. The witness who watched the video believes a voice on the recording is Mark Pearcy's, according to court documents.

    The witness who spoke to TBI investigators has known Mark Pearcy for about 17 years, according to an affidavit.

    The court documents state that Jeffrey Pearcy told the witness about the video, and that Jeffrey Pearcy then left the witness's home and went to see Mark Pearcy. Jeffrey Pearcy returned to the witness's home with the video and used an electronic device to show the video to the witness, the affidavit says.

    Jeffrey Pearcy, 42, is charged in Henderson County and was released on bond.

    Mark Pearcy, 38, is charged in Decatur County, but is being held in the Carroll County Jail. His bond was set at $65,000.
