SUPREME COURT: Death sentence for 1997 cop killer upheld
The California Supreme Court today upheld the death penalty sentence for a Whitewater man convicted in the ambush slaying of two Riverside County sheriff's deputies in 1997.
The state high court found unanimously against the arguments of attorneys for Timothy Russell, now 50, who was sentenced in 1999.
The deputies, James Lehmann Jr., 41, of Apple Valley, and Michael Haugen, 33, of San Jacinto, were murdered outside Russell's residence in a remote desert area east of Cabazon on Jan. 5, 1997.
The deputies responded to a domestic violence call placed by Russell's estranged wife, who ran to a neighbor's house after he struck and kicked her.
Using an M-1 carbine, Russell fired a dozen shots at the deputies, killing them both before they could draw their weapons or even see their attacker.
Russell claimed his death sentence should be overturned because the amount of time he lied in wait for the deputies was not a long enough duration to indicate he was trying to ambush them.
Justices disagreed, noting that any time period of lying in wait was sufficient to warrant a possible death sentence, under the state's requirement for special circumstances in capital cases.

In today's United States Supreme Court orders, Russell's petition for a writ of certiorari and motion for leave to proceed in forma pauperis was DENIED.
Convicted Cop Killer Timothy Russell has committed suicide. in the early morning hours on Saturday, October 5, 2013, the cowardly cop killer took his own life. Unfortunately he did not do this prior to executing Deputies Haugen and Lehman. Sadly he has denied the the Haugen and Lehman family members the opportunity to see him put to death.
Condemned inmate at San Quentin dies in apparent suicide

A condemned inmate at San Quentin State Prison was pronounced dead in an apparent suicide, the prison said.
Timothy Russell, 53, was found unconscious in his cell late Friday night. He had been on death row since 1999 for the murders of two Riverside County sheriff's deputies, James Lehmann Jr. and Michael Haugen.
Twenty-two condemned inmates have committed suicide since California reinstated the death penalty in 1978. Sixty have died of natural causes, and 13 were executed.
More than 700 inmates remain on death row in California.
California has not executed a condemned inmate since 2006, when a federal judge ruled that the state's lethal injection procedure violated the Eighth Amendment's prohibition of cruel and unusual punishment.
