    Fabion Brown To Represent Himself In Murder Trial

    The estranged husband charged in his wife's murder-for-hire ploy will defend himself during his upcoming trial.

    Judge Ray Elliott granted Fabion Brown's request to act as his own attorney. The state is seeking the death penalty in his case, and with that in mind, Elliott warned it is a life-threatening undertaking.

    Before the hearing News 9 asked Brown why he does not think he can get a fair trial with representation from the public defenders.

    "Because the officer did a lot of dirty stuff in his affidavits and I'm going to try to prove that next week," said Brown.

    Earlier this week, Brown sent a handwritten letter to Judge Elliott explaining his desire to defend himself in court.

    "I really don't know what I am doing ... but I feel a lot of evidence will not come out," said Brown.

    He also expressed concern over his public defender pushing to reach a plea agreement with the state. Before entering the courtroom, Brown was confident he could defend himself. Still, his competence to serve as his own lawyer was the first topic of discussion in the hearing.

    Elliott advised him of the potential pitfalls of self-representation when the ultimate punishment, execution, is a possibility.

    Brown maintained the same confidence as the day he was arrested, in Feb. 2012, for his alleged role in the murder plot of his estranged wife Jessica McPherson. Brown claimed then he was framed and insisted, today, he get the opportunity to present those facts to a jury.

    With reservation, Elliott granted Brown's request, but warned he will not be granted any special privileges due to his lack of experience. Brown referred to a state statute book and said he feels he has a good understanding of the law.

    When News 9 asked him what he planned to do next, Brown said, "Stay tuned and see it's going to be a very interesting day on the 20th."

    March 20 will be his court date where the judge will consider several motions filed by Brown, including insufficient evidence. Brown also admitted to News 9 that he has never practiced law before, but assured us he has a plan.

    News 9 asked his mom if she plans to buy more books before trial. She said it's a possibility.

    Fabion Brown Challenges State's Evidence Against Him

    OKLAHOMA CITY - A murder defendant who's representing himself in court challenges the state's evidence against him and fails.
    Fabion Brown is charged with first degree murder in the 2012 death of his estranged wife, Jessica McPherson Brown. Prosecutors argue Brown orchestrated a murder-for-hire plot, while Brown insists he has been framed.

    Brown, 26, is acting as his own attorney and plans to represent himself at trial.

    At the Oklahoma County Jail, where Brown is being held, policy prohibits media interviews with inmates. As a result, the only opportunity for reporters to inquire about the case and about his efforts at self-representation is as he's being escorted to and from the courtroom.

    Just prior to the start of today's hearing, we asked Mr. Brown how he felt his lawyering was going.

    "I think [it's] going pretty well, but we will find out about how everything really is today," Brown replied.

    Brown had a handful of motions to present to the court.

    In the first, Brown asked Judge Ray Elliott to repeal the case due to insufficient evidence. He claimed the probable cause affidavit contained false information and untruthful statements from his co- defendants.

    Next, Brown called his mother to testify, hoping to convince the judge to suppress evidence from an arrest related to the violation of a victim's protection order before his estranged wife was murdered.

    He also asked the judge to throw out evidence collected at the victim's home. He claims police did not have his consent, as next of kin, to search the home.

    Prosecutors argued Brown gave up those rights when he moved out of the home months before the murder.

    Brown also filed a motion for an evidentiary hearing, but First Assistant District Attorney Scott Rowland argued, "This is an exercise in futility that I ask the court not to engage in."

    Lastly, Brown called on the court to order psychological examinations, at the state's expense, for his co-defendants, Emily Matheson and hired hit man, Broderic Glover. Matheson and Glover both pleaded guilty in the murder plot and received lesser sentences in exchange for their testify against Brown.

    Brown also reminded the court that he doesn't have a law degree, by pointing out that he has access to only a minimal law library and said that although he does have a computer, he has no internet access.
    Judge Elliott denied all five motions.

    As Brown left the courtroom, we asked if there was a point at which he would give up.

    Murder Defendant Speaks Out About Case Before Trial

    OKLAHOMA CITY - A defendant, acting as his own attorney in a murder-for-hire case, is telling his side of the story.

    Did you have a hand in the murder for hire plot?

    "No, I did not," Brown said.

    Fabion Brown's murder trial is just days away, and tonight, he claims the state has a weak case against him.

    Brown is claiming he's been framed. He's been locked up at the Oklahoma County Jail since 2012, and because interviews with inmates are not allowed, we had to wait for him to call.

    Brown used one of his phone calls from the Oklahoma County Jail, claiming he wanted to set the record straight before trial.

    "Before they make any decision about me, wait until all of the evidence is in," said Brown. "That's all I ask."

    Brown denies all claims he orchestrated the murder- for-hire plot that left his estranged wife, Jessica McPherson Brown, dead in her Midwest City home in 2012.

    So to be clear, you are saying all of the state's witnesses are lying?

    "They are lying or mistaking facts," Brown said.

    Midwest City Police Chief Brandon Clabes said in part, he is "very confident in the two-month investigation that led to formal charges against Brown" and said they are acting as the "voice of the victim murdered in front of her children."

    "It's based on a lot of circumstantial evidence," Brown said.

    Brown says, contrary to the charges against him, he did not conspire with his girlfriend, Emily Matheson, to pay Broderic Glover $250 to kill Jessica. Instead, he believes his alleged co-conspirators lied to implicate him and help themselves.

    Matheson admitted to the crime and is a key witness for the state.

    She is set to testify against you. How are you going to handle that?

    "I have a little something up my sleeve for her, but the main thing is she made a lot of statements prior to her arrest," Brown said.

    After reviewing witness statements, police reports and other evidence, Brown said he's found several inconsistencies and plans to use it to prove his innocence.

    "If I get a jury that is not biased, and I get a fair jury, I am pretty sure I can get a good trial," Brown said.

    Brown told News 9 he knows his life is on the line, because prosecutors are seeking the death penalty but said he had no choice but to represent himself.

    First Assistant District Attorney Scott Rowland said he will respond to all of Fabion's remarks during trial.

    Testimony Underway In Midwest City Murder Trial

    OKLAHOMA CITY - An accused killer stands in his own defense in an Oklahoma County courtroom Friday. Not to testify though, but to serve as his own attorney.

    Fabion Brown, 26, is defending himself against two counts of first-degree murder and conspiracy to commit murder in Oklahoma County District Court.

    Brown is accused of orchestrating the murder-for-hire plot that led to the death of his estranged wife, Jessica McPherson Brown, 23, and her unborn baby on January 11, 2012.

    From the beginning, Brown has been very outspoken about the case and about the courtroom strategy he plans to use in an effort to prove his innocence. Now, with the trial underway, he's taking a different stance and saved all of his remarks for the courtroom.

    Brown stood before the Oklahoma County Jury of five men and seven women to defend himself. In opening statements, Brown said, this is a very touching matter for me because this is a matter of life or death."

    Prosecutors do not dispute that fact, they are seeking the death penalty in this case.

    They warned jurors that Brown masterminded a gruesome crime, and for that reason, the evidence would be nothing short of gruesome.

    A statement that proved true on Friday afternoon, when the state introduced autopsy photos of gun wounds to the dead pregnant mother's face, as well as, pictures of her unborn baby's body.

    The victim's mother, Judy Richardson of Yakima, Washington, provided tearful testimony. She testified to the day she swaddled and held the body of her dead grand-baby at the funeral home. Richardson also revealed the contents of text messages she exchanged with her daughter in the months leading up to the murder. The evidence indicated Jessica McPherson Brown was scared of Brown and feared for her life.

    Brown's questions to the states witnesses were few, but he told the jury when all the evidence comes out it will be crystal clear he's innocent.

    The state is expected to call more than 40 witnesses in presenting the case. Prosecutors plan to introduce wiretap evidence, as well as phone calls Brown made as an inmate at the Oklahoma County Jail, including his exclusive interview with News 9.

    Fabion Brown Found Guilty Of First-Degree Murder

    OKLAHOMA CITY - Jurors have found Fabion Brown guilty on two counts of first degree murder and one count of conspiracy, after less than an hour of deliberation, Thursday evening.

    The jury was handed the case just before 6 p.m.

    Oklahoma County Prosecutors and murder defendant, 26-year-old Fabion Brown spent two hours in closing arguments. Brown opted to defend himself against two counts of first-degree murder and one count of conspiracy.

    The state rested its case late Wednesday and brown began presenting his case to the jury, Thursday morning. He called a number of witnesses to the stand including several past girlfriends and his mother, Gladys Brown.

    Brown tried to create doubt in the state's case against him by using by using witness testimony to point the finger at his alleged co- conspirator, Emily Matheson.

    Brown alleged Matheson, who was his girlfriend at the time of the murder, is the person who orchestrated the murder-for- hire plot to kill his estranged wife Jessica McPherson Brown and her unborn baby in 2012.

    First Assistant District Attorney Scott Rowland and Assistant District Attorney Daniel Gridley of Oklahoma County were able to undercut much of the testimony from the defense witnesses by revealing their character flaws - specifically showing a pattern they lied to protect Brown.

    "You know usually the saying is the person who represents themselves has a fool for a client, said Irven Box, News9 legal analyst, "he looked like he was doing a good job actually."

    Box is a prominent defense attorney sat in on some of the trial and said although it's rare for a murder defendant to represent himself in a case where the state is seeking the death penalty he said it could work to his advantage, "He presents himself well. I don't know what the jury is going to think about it but I don't think they are going to be offended by him and how he is representing himself."

    "It's devastating, it hurts," Brown said. "I've got to wait on an appeal and hopefully I can go home with that," he added.

    News 9 asked Brown about his choice to defend himself in the death penalty case.

    Jessica Brown's family had a private moment at the courthouse following the verdict, but said they did not want to speak on camera.

    The jury recommends $5,000 fine and 10 years in prison for the conspiracy count. So far no details on what they have suggested on the two murder counts. The punishment phase of the case will take place on Friday.

    Fabion Brown Sentenced To Death For Murder

    OKLAHOMA CITY - An Oklahoma County jury has sentenced a convicted murderer to death.

    Fabion Brown was found guilty for the 2012 murders of his wife, Jessica Brown, and her unborn child.

    The jury decided on the death penalty due to two aggravating circumstances: Brown knowingly created a great risk of death to more than one person and Brown hired someone to commit the murders for money.

    Brown said he was hoping for anything besides death after representing himself in his death penalty case.

    "I just hope they find something that gives them a reason to give something less than death," Brown told News 9 before the sentencing verdict.

    During the sentencing phase, Oklahoma County prosecutors said Brown hired a gunman so he could get the $400,000 life insurance policy.

    Brown told the jury he had PTSD from his military service in Iraq and deserved to live. Prosecutors said real soldiers don't execute women and babies. The jury took 90 minutes to unanimously decide on the death penalty.

    Twenty four hours earlier, jurors took just 30 minutes to return the guilty verdicts for two counts of murder and one count of conspiracy to commit murder.

    "These verdicts are among the quickest that I've ever seen in a death penalty case and particular, a death penalty case of this complexity," said Scott Rowland, Oklahoma County Assistant District Attorney.

    The case had everything from wiretaps to long term surveillance and testimony from his co-conspirator and girlfriend, Emily Matheson.

    "This was a jury who rolled up their sleeves, went to work and worked hard and I think achieved a very just result," said Rowland.

    Brown said he plans to appeal. Jessica's mother told News 9, "Hopefully, no other family will have to go through this at his hand."

    Brown's formal sentencing is August 11th.

    MIDWEST CITY, Okla. — An Oklahoma judge sentenced Fabion Brown today for killing his pregnant wife and unborn child.

    Earlier this year, a jury convicted Brown of orchestrating a plot to murder his pregnant wife, Jessica Brown, and her unborn child.

    Jessica Brown was found shot to death inside her Midwest City home in 2012.

    The accused trigger man and two others all pleaded guilty to taking part in the crime.

    Brown represented himself at trial and does plan to appeal the verdict.

    Isn't there an automatic appeal?

    Oklahoma court stays execution of man in wife's death

    OKLAHOMA CITY — The Oklahoma Court of Criminal Appeals has stayed the execution of a 26-year-old man convicted of hiring another person to kill his estranged, pregnant wife.

    Fabion Brown was formally given two death sentences in Oklahoma County District Court earlier this month for the January 2012 deaths of 23-year-old Jessica Brown and her unborn child in her Midwest City home.

    Brown's execution was set for Oct. 31, but it was stayed to give the court time to review his first-degree murder conviction and death sentences.

    Brown had pleaded not guilty and represented himself at trial. Prosecutors acknowledged that Fabion Brown did not pull the trigger, but instead paid someone $250 to do it.

    Three co-defendants in the case previously pleaded guilty as part of plea agreements and already have been sentenced.
