    Miller faults judge for giving jurors impression his defense was 'outlandish and stupid'

    OLATHE (AP) — The Missouri man convicted of killing three people outside Jewish sites in Kansas is seeking a new trial.

    Frazier Glenn Miller Jr. was convicted in August of capital murder for the three shooting deaths in April 2014. He said he wanted to kill Jewish people, although his victims were Christians. The Johnson County jury recommended Miller receive a death sentence.

    The Kansas City Star reports (http://bit.ly/1NWPpAB) Miller’s motion for a new trial cites the denial of his request for a change of venue, his inability to consult with “standby” lawyers during court hearings and not being allowed to present all of his evidence.

    Miller also contends the judge gave jurors the impression that he thought Miller’s defense was “outlandish and stupid.”

    The motion will be considered before sentencing Nov. 10.

    Judge denies F. Glenn Miller Jr.’s request for new trial

    About a dozen family members of the victims are expected to speak at the sentencing hearing in Johnson County District Court.

    District Judge Kelly Ryan has the option of following the jury’s death sentence recommendation or sentencing Miller to life in prison without parole.

    On Tuesday morning, Ryan denied Miller’s request for a new trial.

    Kansas City JCC shooter sentenced to death

    The white supremacist who killed three people at two suburban Kansas City Jewish institutions has been sentenced to death.

    F. Glenn Miller Jr., 74, was sentenced Tuesday by Johnson County District Judge Kelly Ryan, the Kansas City Star reported. Miller, who is also known as F. Glenn Cross, is only the second person sentenced to the death penalty since Kansas reinstated it in 1994, according to the Star.

    In September, a jury found Miller guilty of capital murder and recommended the death penalty.

    Miller was convicted of three counts of first-degree murder in the April 2014 deaths of Reat Underwood, 14, and his grandfather, William Corporon, 69, outside the Jewish Community Center of Kansas City in Overland Park, as well as Terri LaManno, 53, outside the Village Shalom assisted-living facility. None of the victims was Jewish, but Miller assumed they were when he shot them.

    He also was found guilty of aggravated assault for pointing a shotgun at a woman and asking if she was Jewish, and of firing into the JCC.

    A former Ku Klux Klan grand dragon, Miller has been unapologetic about the shooting, in which he said he was trying to kill as many Jews as possible. During his trial, he waived the right to an attorney and argued the jury should find him not guilty because his shooting spree was a “patriotic attempt” to “defend my people against genocide.”

    Miller told the Kansas City Star in an interview last November that he began planning the attacks when he became so sick with emphysema that he thought he would die soon and that he conducted reconnaissance missions of the JCC and Village Shalom in the days before the shootings.

    “I wanted to make damned sure I killed some Jews or attacked the Jews before I died,” he told the newspaper.

    Soon after his arrest, Miller told officers that he was an anti-Semite and asked them, “How many did I get?”

    Even though District Judge Kelly Ryan sentenced him to death by lethal injection, the likelihood of the sentence being carried out because of his age looks unlikely.

    Family Settles Lawsuit Against Walmart Over Shootings At Overland Park Jewish Community Center

    The family of a woman killed in 2014 outside the Village Shalom retirement community in Overland Park has settled a lawsuit against Walmart, which sold one of the guns used in the shooting.

    Terri LaManno, a 53-year-old occupational therapist, was shot outside the facility by Frazier Glenn Cross Jr., the man who killed three people in an attack that began at a nearby Jewish Community Center.

    LaManno’s family filed the wrongful death lawsuit in 2016 after a Missouri man who purchased the gun admitted he bought it for Cross in what is known as a straw purchase.

    The lawsuit alleged Walmart employees should have known that John Reidle was buying the Remington shotgun for Cross. Reidle and Cross went to a Walmart near Springfield, Missouri, to purchase the weapon, according to court records.

    Reidle later pleaded guilty to a federal weapons charge and was sentenced to probation. Cross, who is sometimes referred to as Frazier Glenn Miller Jr., currently sits on death row.

    Attorneys representing the LaManno family and Walmart formalized the settlement Tuesday during a hearing in Jackson County Circuit Court. The lawsuit had been scheduled for a jury trial later this month. The settlement's monetary terms remain confidential.

    Jim LaManno, Terri's husband, said after the hearing that he hopes the lawsuit and others like it across the country will force retailers to do more to thwart straw purchases and other illegal firearm transactions.

    "I realize that we'll never replace the 2nd Amendment, but I think more safeguards need to be added to our country to keep people safe," he said. "Over the last five years we've had an increase in the way guns are used against Americans. And I just don't think it's right."

    An attorney representing Walmart declined to comment after the hearing.

    The family of the other two victims, William Corporon and his grandson, Reat Underwood, settled a similar lawsuit against Walmart last year. The terms of that settlement also were not disclosed.

    LIBERTY, Mo. — An avowed anti-Semite who shot three people to death at two suburban Kansas City Jewish sites in 2014 is asking the Kansas Supreme Court to overturn his death sentence, saying he should not have been allowed him to represent himself at trial.

    The appeal from Frazier Glenn Miller Jr. is scheduled to go before the state Supreme Court on Monday. He was convicted of one count of capital murder, three counts of attempted murder, and assault and weapons charges in August 2015.

    Miller’s attorneys argue that the Johnson County Court judge who oversaw his trial should not have allowed him to represent himself. They say the judge did not consider whether Miller had mental health issues that would make him incompetent to represent himself in a complex capital case.

    Miller, from Aurora, Missouri, also argues that the judge should have allowed him to present mitigating evidence during the penalty phase, and that the death penalty itself is unconstitutional.

    Miller, who is also known as Frazier Glenn Close, testified during trial that he drove to the Kansas City area in April 2014 to kill Jews before he died. He said at the time that he didn’t expect to live long because he had chronic emphysema.

    He ambushed and killed William Corporon, 69, and Corporon’s 14-year-old grandson, Reat Griffin Underwood, at the Jewish Community Center in Overland Park, Kansas. He then shot 53-year-old Terri LaManno at the nearby Village Shalom retirement centre.

    All of his victims were Christians.

    During the trial, Miller frequently interrupted proceedings with outbursts aimed at the judge, jury and prosecutor. After he was convicted, he said he didn’t care if he was sentenced to death.

    In his closing arguments during the penalty phase, Miller spent nearly an hour complaining that Jewish people were running the government, media and Federal Reserve. He yelled “Heil Hitler” when he was sentenced to death.

    Miller is a Vietnam War veteran who founded the Carolina Knights of the Ku Klux Klan in his native North Carolina and later the White Patriot Party. He also ran on a white-power platform during campaigns for the U.S. House in 2006 and the U.S. Senate in 2010 in Missouri.

    OVERLAND PARK, Kan. — The self-avowed anti-Semite convicted of murdering three people on the Jewish Community Center campus in Overland Park, Kansas, in 2014 has died in prison.

    A notice from the Kansas Department of Corrections said Frazier Glenn Cross, Jr., died Monday at the El Dorado Correctional facility.

    Cross was on death row after being convicted of capital murder in the deaths of William Corporon, his grandson Reat Underwood and Terri LaManno at the Jewish Community Center and Village Shalom.

    In recent weeks, Cross's attorneys had been working to have his death sentenced overturned, stating that he should not have been allowed to represent himself at trial or during the penalty phase and that the death penalty is unconstitutional.

    The jury deliberated for less than two hours before rendering a guilty verdict at trial.

    Cross, also known as Frazier Glenn Miller, said he shot the victims because he wanted to kill Jews. All three of his victims were Christian. He admitted to the shootings multiple times, including in court in front of the jurors. His defense was about whether his anti-Semitic beliefs drove him to do it.

    Officials with KDOC said it is believed that Cross died of natural causes, however, an autopsy is set to be performed in this case. Cross had been imprisoned within the Kansas Department of Corrections since November 2015.

    The Corporon family shared their thoughts on Cross' death in a Facebook post.
