    Facts of the Crime:

    Richard Nathan Simon was sentenced to death in Riverside County on November 2, 2001 for the murders of Michael Sterling, 34, Vincent Anes, 18, and Sherry Magali, 18. Anes and Magpali were confronted as they necked in Vincent's parked car on December 3, 1995 at Pedroreno Park in Moreno Valley. Simon and a one-time friend, Curtis John Williams, stripped Anes of his clothes and robbed and killed him. Magpali was raped and taken to the side of Interstate 215 north of Sun City, where she was shot in the head. The unrelated shooting death of Sterling occurred during an argument with Simon in May 1996.

    Simon's case has been fully briefed on direct appeal before the California Supreme Court since July 17, 2012.

    On May 26, 2016, oral argument will be heard in Simon's direct appeal before the California Supreme Court.

    PEOPLE v SIMON

    Opinion Date: July 18, 2016

    Court: California Supreme Court

    After a jury trial, Defendant was found guilty of two counts of first degree murder and one count of second degree murder with the personal use of a firearm, among other crimes. A mistrial was declared after the first penalty trial. After a second penalty trial, the jury fixed the penalty as death. The trial court sentenced Defendant to death. The Supreme Court affirmed the judgment in its entirety, holding that there was no prejudicial error during the guilt phase of trial or the penalty phase of trial, and Defendant’s challenges to California’s death penalty scheme were unavailing.

    On September 1, 2016, Simon filed a habeas petition before the California Supreme Court.
