    Papers Outline Robbery Plot Against Elderly Milton Freewater Woman

    PENDLETON, Ore. (AP) - Affidavits from investigators show a plot for a home invasion robbery led to an attack in January on a 79-year-old Eastern Oregon woman who lived alone in an unincorporated community. Two young men have been charged.

    The affidavits describe a conversation recorded after a third young man agreed to wear a recording device.

    In the conversation, 21-year-old Caleb Scott says that the other suspect, 20-year-old Matthew Hermann, believed victim Joyce Key had seen his face.

    She was found the next morning, bound by duct tape in her kitchen near Milton-Freewater. She suffered severe head injuries and was initially hospitalized in a coma, but survived.

    Hermann is accused of attempted aggravated murder and other crimes. Scott is accused of robbery, kidnapping, burglary and conspiracy.

    Matthew Raymond Hermann has a trial date to face charges of aggravated murder and more for the death of Joyce Key of Umapine in 2013.

    Hermann, 21, had a hearing Tuesday morning before Circuit Court Judge Eva Temple in Hermiston. His defense attorneys and Umatilla County prosecutors agreed to go to trial July 7 through Aug. 15, 2015. District Attorney Dan Primus said after the minutes-long hearing that next summer was the time that fit into everyone's schedule.

    That also gives his office a bit of time to prepare, particularly in light of the upcoming slate of big cases.

    Joseph Quintana, 35, goes to trial Aug. 25 for the 2010 murder of Allen Spencer in Pendleton. On Sept. 16 the murder trial begins for George West Craigen, 52, who the state has accused of killing Cecil "Rob" Carter in Milton-Freewater at the end of 2011.

    And in December a murder trial is on the calender for 22-year-old Caleb Leon John Scott, who is Hermann's co-defendant, along with Jacob Lee White, 20.

    The state accuses Hermann, Scott and White of breaking into Key's rural home in late January 2013 to rob her. But they ended up tying her to a kitchen chair, blindfolding her and beating her bloody. She died months later from her injuries, according to the state.

    White, Scott and Hermann have pleaded not guilty to multiple counts of murder and other charges. Hermann alone faces charges of aggravated murder, which carries the threat of the death penalty in Oregon. The three are in the Umatilla County Jail, Pendleton.

    White has a settlement conference Tuesday in Pendleton, according to court records, and a hearing July 1. Scott has a pretrial conference June 27 and then a motions hearing Aug. 22 at state court in Hermiston.

    Hermann sentenced to life in prison

    Matthew Raymond Hermann, a member of the Umapine 3 accused of killing elderly Joyce Key in 2013, pleaded guilty to the crime Thursday and was sentenced to life in prison.

    Judge Charles Luukinen sentenced Hermann at the Umatilla County Courthouse. Because Hermann also pleaded guilty to one count of first degree assault, which carries 15 years, he won’t be eligible for parole until he has served 40 years.

    Also appearing Thursday was Caleb Leon John Scott, who pleaded guilty to robbery in the first degree, kidnapping in the second degree and burglary in the first degree. Scott will be sentenced at a later date, but Luukinen noted he could face 18 years behind bars.

    Jacob Lee White, the other member who admitted to the crime, pleaded guilty to first degree robbery and burglary in June 2014. He is yet to be sentenced.

    As a part of their deals, Hermann and Scott will each pay $13,821 in restitution to Key’s family.

    Luukinen thanked both Key and Hermann’s families in cooperating with the district attorney’s office. He advised Hermann to talk with his family in the future if he ever thought of doing “something stupid.”

    “Mr. Hermann, everyone agrees that this was a horrible thing that happened,” Luukinen said.

    White told police Hermann was the leader of a planned robbery of Key’s home, which resulted in the restraining and beating of the 79-year-old woman. She died six months later at the age of 80.

    In a trembling voice, Hermann apologized to Key’s family in a short statement.

    “Words cannot convey how sorry I am to your family,” he said.

    Key’s family declined to address either Hermann or Scott.

    Hermann’s assault charge was related to a separate incident last year at the Umatilla County Jail where he and fellow prisoner Daniel Lee Smith beat fellow inmate Justin Bedard.

    Thanks to the plea deals, the trio from the Walla Walla area avoided a number of other charges.

    In the Key case, Hermann, 22, originally faced five counts of aggravated murder, five counts of murder, three counts of first-degree robbery, one count of first-degree kidnapping, one count of first-degree kidnapping and one count of second-degree theft.

    For the Bedard beating, Hermann was also looking at four felony charges and one misdemeanor charge of tampering with evidence.

    Scott, 23, was initially charged with two counts of first-degree robbery, three counts of murder, one count of second degree robbery, one count of second degree kidnapping and one count of first degree burglary.

    White, 20, was charged at-first with three counts of murder, one count of first-degree robbery, one count of second-degree robbery, one count of second-degree kidnapping and one count of first-degree burglary.
