    Death Penalty Phase Resumes In Albert Johnson Murder Trial

    OKLAHOMA CITY - Albert Johnson's defense and attorneys are calling their own set of witnesses in the death penalty phase of his capital murder trial.

    On Monday there is a forensic psychologist on the stand, saying he diagnosed Johnson with a psychotic disorder while in jail. The psychologist says Johnson has an anti-social personality disorder and an IQ of 77. On cross examination, psychiatrist admitted he did not perform any tests on Johnson himself.

    The same jury that found Johnson guilty on all counts last week must now decide if he should face the death penalty for the crimes he committed, which included murder, rape, kidnapping, and assault and battery.

    OKLAHOMA CITY - Closing arguments are underway in the death penalty phase of the Albert Johnson capital murder trial.

    Johnson was found guilty on all counts connected to the brutal attack on June 13, 2014 that left one woman dead and another beaten and raped. The woman who survived was Johnson's girlfriend at the time. She testified against him in this trial.

    The prosecution told the jury that Johnson is a sexual deviant that derives pleasure from his crime. And also said he was a sexual predator in prison. Then, the prosecution wrapped by asking the jury for the ultimate punishment for Johnson – death.

    Jury Reaches Verdict In Death Penalty Phase Of Albert Johnson Trial

    OKLAHOMA CITY - A jury of nine men and three women reached a verdict in the death penalty phase of a man they convicted and sentenced to 10 life terms.

    The jury recommended the death penalty against Albert Johnson who was convicted of assaulting two women which resulted in the death of one of them.

    Wednesday morning, the jury heard from Johnson's biological father, who did not even recognize his own son that he abandoned when he was 7, and who now faces either the death penalty or life without parole.

    Despite coming face to face with his only living parent, Johnson continued to show no emotion during this last day of testimony in the sentencing portion of his trial.

    Both the prosecution and defense gave impassioned closing arguments, asking the jury to take into consideration all of the evidence and aggravators and mitigating factors in this trial.

    The state is asking for the ultimate punishment which is death, saying Johnson is a sexual deviant and sociopath who poses a continued threat to society.

    They brought up that when he killed 24-year-old Rachel Rogers, it was especially heinous, atrocious and cruel.

    Johnson's defense team said Johnson was also raped and abused as a child and grew angry as a result.

    They told the jury that three of their experts diagnosed him with a mental illness called intermittent explosive disorder and that since they already sentenced him to 10 life sentences, the 49-year-old will never get out and will most likely die in prison.

    OKLAHOMA CITY - A judge sentenced Albert Johnson to death for his 11 felony crimes including murder, rape, and assault and battery on Wednesday.

    The execution is set for September 16, 2016, but Johnson's appeal is mandatory, which means it could take years for him to be executed.

    Mike, they does the same in Ohio on occasion. For example, Ashford Lamar Thompson when he was sentenced to death in 2010, Thompson was given an execution date 1 year from his formal sentencing.

    Oklahoma murderer, rapist gets death penalty; DA calls it the 'only just punishment'

    An Oklahoma City man convicted last month of raping his girlfriend and her friend and then murdering the friend was sentenced to death by a judge Wednesday.

    On June 22, an Oklahoma County jury chose the death penalty as punishment for Albert Ray Johnson. District Judge Donald Deason followed the jury's verdict and ordered Johnson be put to death.

    "Mr. Johnson ... I suggest you take a deep breath because it will be the last free air that you ever breathe," the judge told Johnson before deputies escorted him from the courtroom.

    Johnson, 49, remained expressionless during the sentencing.

    The judge ordered Johnson be put to death on Sept. 16. The judge, though, noted that an appeal is mandatory so it will likely be several years before Johnson is put to death.

    Jurors found Johnson guilty of one count of first-degree murder, one count of assault and battery with intent to kill, two counts of forcible oral sodomy, two counts of first-degree rape, two counts of forcible anal sodomy, two counts of kidnapping, and one count of assault and battery with a dangerous weapon.

    Prosecutors said the offenses occurred June 13, 2014, at a house in The Village. Rachel Rogers, 24, was killed.

    District Attorney David Prater said the death penalty was the only just punishment for Johnson. Prater called Johnson "a cold-blooded killer who hurts everyone he comes in contact with."

    Johnson has other felony convictions, including second-degree rape, kidnapping and robbery. Prosecutors also told the jurors during the trial about multiple physical and sexual assaults allegedly committed by Johnson while in prison.

    Prater told reporters after the sentencing that Johnson has already been caught with a shank, or knife, in jail since being convicted last month.

    About the attacks

    Prosecutors said Johnson forced his girlfriend to invite over a friend so he could "rape and kill" her.

    Johnson was accused of threatening to kill his girlfriend and her 8-year-old daughter if she didn't comply with his request.

    The now ex-girlfriend told the jury she was forced to call Rogers to her home early June 13, 2014. When Rogers arrived, Johnson pulled Rogers inside and put a knife to Rogers' throat, she testified.

    The ex-girlfriend testified Johnson then raped both of them at knifepoint.

    After the rapes, Johnson tied up the women and beat them with metal objects, prosecutors said. Johnson fatally beat Rogers with a dumbbell weight, prosecutors said.

    Oklahoma court stays execution for man in woman's death

    OKLAHOMA CITY (AP) — An Oklahoma appeals court has stayed the execution of a man convicted of killing a 24-year-old woman while a mandatory appeal of his conviction and sentence are pending.

    The court on Tuesday issued the appeal for 49-year-old Albert Johnson.

    District Judge Donald Deason set a Sept. 19 execution, but noted it will likely be years before Johnson is put to death.

    A death penalty moratorium was issued while a grand jury investigated the delivery of the wrong drug for two lethal injections, the last of which was stopped by Gov. Mary Fallin after the wrong drug was discovered.

    Attorney General Scott Pruitt said he will not ask for any executions for about five months following the grand jury's May report criticizing Fallin's then general counsel for encouraging the use of the wrong drug.

    DOC: Officials investigating after death row inmate found dead in cell

    Officials are investigating after a death row inmate was found dead inside his cell at the Oklahoma State Penitentiary, according to the Oklahoma Department of Corrections.

    A correctional officer found 52-year-old Albert Johnson lying in his bed unresponsive Monday evening, officials said. Johnson was pronounced dead shortly afterwards.

    Officials say a medical examiner will conduct an autopsy to determine the cause of death.

    Johnson was convicted of first-degree murder and life sentences for shooting with intent to kill, forcible sodomy, first-degree rape, kidnapping, and assault and battery with a dangerous weapon, officials said.

    Matt Elliott, the public information manager with the the Oklahoma Department of Corrections, released a statement:

    At around 4:30 p.m. Nov. 25 (Monday), a correctional officer found inmate Albert Johnson lying on his bunk bed unresponsive in his single-cell at A-Unit of Oklahoma State Penitentiary. He was pronounced dead shortly after the discovery.

    We are investigating Mr. Johnson's death. The medical examiner will conduct an autopsy and determine the cause of death.

    Johnson, 52, was serving a death sentence on a first-degree murder conviction out of Oklahoma County, as well as life sentences for shooting with intent to kill, forcible sodomy, first-degree rape, kidnapping, and assault and battery with a dangerous weapon.
