    Hot car death: Georgia dad charged with murder

    ATLANTA (AP) -- A Georgia man whose son died after he was left in a hot car for seven hours was charged Thursday with murder in the toddler's death.

    A Cobb County grand jury indicted Justin Ross Harris on multiple charges including malice murder, felony murder and cruelty to children. Harris has been in jail since his arrest the day his son died.

    Harris has told police he was supposed to drive his son to day care the morning of June 18 but drove to work without realizing that the child was strapped into a car seat in the back.

    Police have said the toddler was left in a vehicle for about seven hours on a day when temperatures in the Atlanta area reached at least into the high 80s. The medical examiner's office has said the boy died of hyperthermia -- essentially overheating -- and has called his death a homicide.

    During a three-hour hearing in July, prosecutor Chuck Boring questioned a police detective at length, outlining evidence he said proved that Harris intentionally left his young boy in the hot SUV. But defense attorney Maddox Kilgore argued that the evidence was insufficient and that the boy's death was a tragic accident.

    Cobb County Police Detective Phil Stoddard testified at the hearing that Harris was sitting in his office exchanging nude photos with several women, including a teenager, the day his son died. Stoddard said Harris also had looked at websites advocating a child-free lifestyle and had researched how long it takes to die in a hot car.

    Harris is a native of Tuscaloosa, Alabama, and moved to Georgia in 2012 to work for Home Depot.

    No death penalty for Ga. dad charged in hot car death

    ATLANTA - A prosecutor says he won't seek the death penalty for a Georgia man whose toddler son died after he was left in a hot vehicle.

    Justin Ross Harris faces multiple charges, including malice murder, felony murder and cruelty to children. The malice murder charge indicates prosecutors intend to prove Harris intentionally left his 22-month-old son Cooper to die in the hot car.

    The eight-count indictment also includes charges related to exually explicit exchanges prosecutors say Harris had with an underage girl.

    Harris has told police he was supposed to drive his son to day care the morning of June 18 but forgot the child was in the SUV and drove to work.

    Georgia man accused of leaving son in hot car to die enters not guilty plea to murder charge

    MARIETTA, Ga. – A Georgia man accused of intentionally leaving his toddler in a hot vehicle to die has pleaded not guilty to murder and other charges against him.

    Staci Brinson, the staff attorney for Cobb County Superior Court Judge Mary Staley, said a lawyer for Justin Ross Harris on Friday waived formal arraignment for his client and entered a plea of not guilty.

    Harris, who was 33 when arrested, has been in custody since June. He was indicted last month on multiple charges, including malice murder, felony murder and cruelty to children.

    Police have said Harris left 22-month-old Cooper in an SUV for about seven hours on June 18, when temperatures reached at least into the high 80s in the Atlanta area.

    Attorneys for Harris have said the child's death was a tragic accident.

    MARIETTA, GEORGIA -- An attorney for the Georgia man accused of murdering his 22-month old son in a hot car death has asked that a large chunk of the evidence against his client be thrown out.

    Justin Ross Harris, originally from Tuscaloosa, was arrested in June after his toddler son, Cooper, was found in Harris' SUV. Harris' attorney, Maddox Kilgore, argued in 15 motions that police mishandled the investigation that led to a seven-count indictment against Harris.

    Kilgore argued that Harris' statements to police should be thrown out because police did not properly inform Harris of his Miranda rights according to the Marietta Daily Journal, Kilgore also said police did not properly obtain evidence from Harris' home and workplace.

    The defense is also hoping that Cobb County Superior Court Judge Mary Staley will separate the charges against Harris into two separate trials: one regarding Cooper Harris's death, and another relating to charges that Harris "sexted" with a teenage minor.

    Maddox argued that the case should be severed into two trials because they have different victims, the Marietta Daily Journal reports.

    Harris, 33, has pleaded not guilty to the charges in the case. Prosecutors will not seek the death penalty for Harris.

    Prosecutors in Justin Ross Harris case want judge to block release of hot car death information

    A judge is considering a request by prosecutors that would prevent agencies from releasing information about the death of a toddler who died after being left in a hot vehicle in suburban Atlanta.

    Justin Ross Harris has pleaded not guilty to murder and other charges in the death of his 22-month-old son, Cooper Harris, on June 18. Harris told police he was supposed to drive his son to day care but forgot the child was in the SUV and drove to work.

    WSB-TV reports that the Cobb County District Attorney's Office has asked Judge Mary Staley to sign an order preventing any county agency from releasing information in the case.

    Harris is a native of Tuscaloosa, Alabama, and moved to Georgia in 2012 to work for Home Depot.

    Judge denies defense motion to bar media from Ross Harris hearings

    Cobb County Superior Court Judge Mary Staley on Monday denied a motion by Justin Ross Harris’ attorneys to bar the media from pre-trial hearings in a case that has drawn national attention

    Attorney Maddox Kilgore argued his client would not be able to receive a fair trial if the press is allowed to cover motions hearings where evidence will be discussed.

    Harris, now sporting a buzz cut, is accused of intentionally leaving his 22-month-old son inside a hot SUV to die. He was indicted last September on charges including malice murder, felony murder and cruelty to children. Prosecutors have portrayed him as a porn-obsessed, would-be playboy seeking a “child-free lifestyle.”

    Harris pleaded not guilty and has been held without bond ever since. Kilgore said he’s already been “condemned” by sensationalized media coverage of the case.

    “All contested evidence is going to become public domain and will be available to any potential juror,” said Maddox Kilgore, Harris’ lawyer. Even if the judge were to dismiss any evidence, “it would be out there, affixed to commentary or analysis.”

    “It does have an effect on potential jurors” he said. “Negative reporting has shifted the burden of proof (to the defense).”

    Staley disagreed, saying, “Much of what is complained of here is information that’s already in public purview.”

    Atlanta Journal-Constitution attorney Tom Clyde argued against Kilgore’s motion, saying, “You’re not entitled to a jury knowing nothing about your case.”

    Clyde said the defense hasn’t proved the media coverage of the Harris case has been prejudicial to the defendant.

    Detectives describe Ross Harris after hot car death of son

    ATLANTA -- New details emerged Tuesday morning in regards to what Ross Harris said to authorities moments after discovering his 22-month-old child dead in his car.

    Detective Jacquelyn Piper, who was a patrol officer the day Cooper died, was the first of two detectives to take the stand. There, she discussed three statements Harris made when he was arrested.

    According to Det. Piper, Harris initially told her to "Shut the (expletive deleted) up" when she tried to get him off the phone. The detective said Harris asked her to call his wife, saying she would be at the daycare and she'd realize Cooper wasn't there. He also mentioned, "I was supposed to drop (Cooper) off this morning. I didn't do a second look in my car," according to Det. Piper.

    While on stand, Piper said Harris was put in handcuffs to help secure the scene, not because he was under arrest.

    Detective Phil Stoddard, who was the first to talk to Harris at the police station, followed Det. Piper on the stand.

    Raw footage of a police interview with Ross Harris was shown in court on Sept. 15, 2015.

    Det. Stoddard interviewed Harris for about 20 minutes, taking his handcuffs off and offering him water and snacks. When the accused father was told he would be charged with murder, Harris told the detective: "there was no malicious intent" and invoked his right to remain silent.

    Trial date set for Justin Ross Harris in hot-car death of toddler son

    A Georgia father jailed for the past 16 months in the hot-car death of his toddler son will go to trial in February 2016.

    Cobb County Superior court Judge Mary Stanley today set the trial for Justin "Ross" Harris to begin the week of February 22, according to the Associated Press. Authorities contend Harris intentionally left his son in the car in June 2014. Harris' attorneys, however, argue it was an accident.

    The Tuscaloosa native has been held without bond since the June 18 death of his 22-month-old son, Cooper. An eight-count indictment against Harris includes: malice murder, felony murder, felony murder, first-degree cruelty to children, second-degree cruelty to children, sexual exploitation of children, and two counts of dissemination of harmful material to minors.

    Pretrial motions in the case began last month. During the Sept. 15 and 16 hearings, Harris' lawyers tried to bar the media and public from the pretrial hearings but the judge said that wouldn't happen.

    In today's hearing, defense attorneys tried to convince the judge to separately try charges that Harris had inappropriate online exchanges with an underage girl separately, but the judge declined to separate the cases, the AP reported.

    Detective Phil Stoddard of the Cobb County police department read several conversations from a social media app called KIK in open court today, where Ross Harris allegedly asked a 17-year-old girl to send him a picture of her lower private part, according to Fox 5 in Atlanta.

    The detective said Harris met the girl online when she was 16-years-old and knew exactly how old she was, but deceived the teen of his age. Prosecutors also introduced evidence that Harris requested and successfully received a picture of another minor's lower body part. They say Harris engaged in affairs and wanted to escape his married life and saw his son, Cooper, as in the way of enjoying his life, the television station reported.

    The defense told the judge prosecutors were orchestrating a smear campaign against Harris. Harris is expected to be back in court Tuesday.

    Justin Ross Harris: Defense accuses police of lying, wants evidence thrown out

    The Georgia dad accused of murder in the "hot car death" of his toddler son will return to court next week.

    22-month-old Cooper Harris died after being left in his car seat for seven hours on June 18, 2014.

    Court Chatter has obtained a 35-page motion the defense filed ahead of next week's hearing. The motion addresses several issues surrounding the seizure of Harris' property.

    In the motion, attorneys for Harris claim his cell phone was illegally seized.

    "....without consent, without obtaining a search warrant, and without exigency...searching of Defendant's cell phone without securing a search warrant is a clear violation of Defendant's Fourth Amendment rights..."

    They are asking the court to suppress any evidence obtained from that phone as "fruit of the poisonous tree".

    The motion goes on to say the search warrants that were issued in this case - there were thirty three in total - were done so without probable cause or "probable cause was based upon material misrepresentations/omissions to the magistrate". In other words, the defense is accusing the police of purposely misrepresenting facts to obtain the warrants.

    Harris will be back in court Monday morning.

    Jury selection is set to begin today in Georgia for the trial of Ross Harris, charged in the 2014 hot-car death of his toddler son.

    Harris, formerly of Tuscaloosa, has remained jailed for the past 22 months. Authorities contend Harris intentionally left his son, 22-month-old Cooper, in the car for hours. An eight-count indictment against Harris includes: malice murder, felony murder, felony murder, first-degree cruelty to children, second-degree cruelty to children, sexual exploitation of children, and two counts of dissemination of harmful material to minors.

    Prosecutors have said Harris lived an "alternative lifestyle,'' was sexting six different women while young Cooper was dying in Harris' sweltering SUV, including sending and receiving nude pictures, and had carried out various "concerning" internet searches, including "how to survive prison."

    A second indictment, issued in March of this year, charged Harris with two additional counts of sexual exploitation of children and six counts of dissemination of harmful material to minors. The newest charges deal with three different girls under the age of 18. Authorities have said Harris used the social media app KIK. Included in those newer charges, records show, Harris gave a teen girl a "photograph of a male in a state of undress so as to expose the male's genitals, and of a depiction of uncovered male's genitals in a discernibly turgid state" and "printed matter containing explicit and detailed verbal descriptions and narrative accounts of sexual excitement and sexual conduct."

    Harris' attorneys say Cooper's death was a tragic accident.

    Harris' wife, Leanna Harris, filed for divorce just two months ago. The couple was married on May 27, 2006 and have been separated since June 18, 2014, which is when Ross Harris was jailed. Leanna Harris, who was never charged with any crime, said their marriage was "irretrievably broken." The divorce has since been finalized.

    Pretrial motions in the case have been ongoing since September. Atlanta television station Fox 5 reports that Cobb County court officials expect to call 300 prospective jurors.
